DC Mayor Calls upon the National Park Service to Remove Occupy DC from McPherson Square
by Kevin L. MartinDC Mayor Vincent Gray has called upon the National Park Service to remove Occupy DC Protesters from McPherson Square.
Local media is reporting that Mayor Gray seen a letter to National Park Service Officials dated January 12, 2012. The Mayor in his letter cited an ongoing rat infestation and other health concerns.
The Mayor states in his letter than the park, which is owned and operated by the National Park Services in infested with rats, the Mayor also express concern with the overall health of the protestors and the risk of hypothermia.
The Mayor’s letter comes weeks after complaints from local merchants, workers and others in and around McPherson Square about the increase level of rats since the protestors set up their encampment back in September. Back on January 3rd D.C. Department of Health Officials inspected the McPherson Square encampment and conditions then lead to the protesters closing down their hot food tent voluntarily
The Mayor called upon the protesters to move to Freedom Plaza where another encampment of Occupy DC protesters is housed. Both encampments are located in National Park Service properties and the Mayor’s letter prompted the Chairman of the House Oversight and Government Reform Committee Chairman Darrell Issa R-Calif. to issue a statement echoing the Mayor’s concerns about McPherson Square encampment.
National Park Service Spokesmen Bill Line stated that, “The free speech rights of the protestors must be protected.”
Rep. Issa has accused the National Park Service of being more interested in making excuses than providing information and protecting the public. The House Oversight and Government Oversight Committee has given the Department of Interior, which oversees the National Park Service until January 24th to respond to the committee’s request for information concerning the McPherson Square encampment decisions and how the National Park Service has worked with local officials.

Ah, and there is the rub.
Incorporation.
Whatever is done in D.C. as it pertains to this issue, it being a First Amendment issue and all, will apply across the nation and become binding on all states as a matter of "incorporation" of the First Amendment.
Barry knows it and so do all the other rats in Washington. This is why they fear action, any action, altogether. ANything they do will reverberate acros the country and responsibility will be right there in Barry's lap. Nothing scares him more than that.

the park service had no trouble telling the TP they couldn't have rallies there anymore. Or any of the other groups like 9/12, or even veteran's groups.

Regarding an incorporated right, which the First mos certainly is (and is the standard bearer)….. what transpires and stands in D.C then applies to the rest of the nation.

The National Park Service, (NPS), operates Cape Hatteras National Seashore as well, and required myself and many others to apply for and be granted PERMITS to simply hand out informational flyers concerning Beach Access within that park. No permit and you were subject to arrest.
How they can deny MY free speech unless I get a permit, but allow these marxist scum to run about freely speaks volumes as to just how high up the collusion concernig OWS goes.

As one who was denied a "permit" to assemble in he very same place Barry assembled his crew to announce his candidacy for the Office of President, I can relate to your frustration.
Therein rests the problem with government issued permission slips regarding exercise inalienable rights. Enumeration of certain rights was an extra step, something of an exclamation point, telling government in no uncertain terms that it does not have the power or authority to command the requirement of a permission slip.
If you really seek an answer to your question. Research and learn about "Incorporation" as it relates to rights enumerated within the Constitution in the form of Amendments to it.
Think you have a right to a trial by jury of your peers? Better think again. No incorporation, no right. Simple as that. Constitution? Nah, the court once said it, the Constitution, doesn't apply to state and local governments…. so until "Incorporation" happens, you don't have the right as it is so simply written in our Constitution.
