Three Silver Linings in the Bad Arizona Court Decision
by Ken KlukowskiWednesday’s federal court decision on Arizona’s immigration law is being rightly criticized for a number of reasons. But there are three silver linings to this situation, which may result in the rule of law prevailing in the end.

On July 28, Judge Susan Bolton of the U.S. District Court for the District of Arizona issued a preliminary injunction—meaning she stopped from going into effect—most of the key provisions in Arizona’s new law. As I’ve written previously, this law should be held constitutional because it’s not an immigration law; it doesn’t determine who can become a citizen or who can be on American soil. Instead it’s a police-power law, where Arizona says that if you’re not permitted to be in this country, then you’re trespassing if you enter Arizona, and if you have a run-in with the cops for some other reason, then those cops can ask if you’re in this country illegally.
This is not an immigration law. It’s also not racist. It’s not racial profiling. And it’s not usurping the role of the federal government (which has abysmally failed here).
Instead, it’s an employment law and property law. That authority arises from Arizona’s police power to make laws for public safety, health, and societal welfare—which the Constitution reserves to the states through the Tenth Amendment.
But as bad as the federal court’s decision is, there are three silver linings to it that could see the rule of law prevail in the end, to the benefit of everyone—including foreigners who want to work here.
First, with Elena Kagan’s nomination to the Supreme Court looming, this highlights the need for judges who faithfully interpret the Constitution and federal laws according to their original meaning, without any regard for politics or policy preferences. This Arizona case will go to the U.S. Court of Appeals for the Ninth Circuit. Goodwin Liu, who believes in constitutional rights to healthcare and housing, and who says any judicial nominee who believes judges are bound by the words of the Constitution should be filibustered because they’re unfit for the bench—is President Obama’s nominee for the Ninth Circuit. This case highlights Liu’s radicalism, and draws the public’s attention to the extremists that the president seeks to put on the courts to rubber-stamp his agenda.
That this law has been put on hold by a federal judge is unfortunate. While Congress has overriding power to make immigration laws, states retain police power under the Tenth Amendment to make laws like Arizona’s. This case will focus America’s judicial debate on faithfulness to the Constitution and the limits of federal power, with implications for everything from Obamacare, to free speech, to gun rights.
Second, this spotlights the need for enforcement in immigration policy. America desperately needs an effective immigration policy that will fulfill our labor needs while upholding the rule of law. (Labor needs that can be met without granting citizenship.) But as Senator Jon Kyl explained, President Obama is holding border enforcement hostage to force amnesty. That’s no way to make policy, and this case focuses the frustration of the American people to secure the border first, and then we can all have a calm and thoughtful debate on how to deal with the broad questions of labor needs, citizenship, and the millions of illegals currently here.
And third, there’s a good chance that this decision will be reversed on appeal. Although the Ninth Circuit is the most liberal federal appellate court in the country (more so if Liu is confirmed), there are a number of originalist judges on that court, so depending on the judges Arizona draws for its three-judge panel, things could go well. Either way the U.S. Supreme Court likely will take this case after the Ninth Circuit reviews it, where the odds are good that Arizona’s law will be upheld.
So Wednesday was a bad day for the rule of law, but those cheering this decision may not be celebrating in the end. It reminds millions of Americans about what we expect from our government—and our courts.

This ruling by an activist judge, legislating from the bench, will so enrage the public that there will be a backwash this November that drains the goddamned swamp in Washington, DC.
Why do people meekly lay down? It is as if they desire defeat. A court order doesn't really mean anything. There are checks and balances to the branches and the Executive can choose to enforce or not anything they wish. You people have a very distorted view of the courts – they are really the weakest branch yet you have been convinced they have some sort of ultimate control when they don't.

A recent raid in Arizona is sparking fears nationwide that illegal immigrants may have infiltrated the nation's largest military intelligence-training center.
Maricopa County Sheriff Joe Arpaio says he has “deep concerns” that people in the country illegally have “managed to gain access onto an active U.S. military installation."
"This cause for concern goes well beyond the argument that people are only committing the crime of wanting to work in this country," he said at a press conference Tuesday.
Arpaio's detectives raided Phoenix-based cleaning company Valley View Building Services Tuesday in search of 25 employees suspected of identity theft and fraud. At least one of the suspects had worked at Fort Huachuca, an Army post 15 miles north of the U.S.-Mexico border that serves as the largest military intelligence-training center in the country.
Five women were detained, four were suspected of being in the country illegally; the fifth is a U.S. citizen with an outstanding warrant. Authorities are still searching for other illegal immigrants said to be working for the company – particularly any others that may be working at the Army post.
We have an existing "Federal Immigration Law" Obama and our Fed Govt. need to Enforce it! If it were enforced, there would not be one Illegal Alien in the U.S. (Dems & Unions would hate that)

I disagree. Law is law, and the president and his cronies are subject to abide by law as any citizen. We are not a dictatorship yet. We can not cherry pick our laws. Either we enforce them or we are in violation and subject to prosecution. However our current administration with its cronies and trolls does seem to consider itself to be above the law. The courts are a CO-EQUAL branch of our govt. Not less than the Executive, not more. Our courts are empowered to determine the Constitutionality of any law enacted by the co-equal legislative branch and (eh-hem) enforced by the executive branch.

Federal and state agents have arrested nearly 100 people in a sweep of marijuana-growing operations that's netted more than $1.7 billion worth of pot in California's Sierra Nevada range.
Fresno County Sheriff Margaret Mims says several Mexican drug cartels are involved in the operations. She says most of the 97 people arrested are Mexican illegal aliens !
Gil Kerlikowske, who directs the White House's Office of National Drug Control Policy, says agents have destroyed more than 432,000 marijuana plants during the three-week operation, which ends Friday.
Kerlikowske was in Fresno on Thursday to express support for the sweep, which involves 450 agents covering the remote stretches of Fresno, Madera and Tulare counties.

Then why do we bother with having two other branches – one to write and pass laws and one to determine if those laws are compatible with the COTUS? My sense is the judge effectively punted while trying to appease her liberal masters. She likely knew the ruling was going to be appealed no matter which way she went with either AZ or the Admin pushing it right up the ladder to the Supremes. Notice that she didn't block cops from asking about a suspect's immigration status; she only blocked the requirement that they must check. A cop can still check immigration status if they feel it warranted (granted most will be intimidated by fear of lawsuit). She also left the part about Sanctuary Cities being illegal in AZ. The part that really ticks me off is the part where she blocked the crackdown on day laborers. AZ can target the employers, but they can't also target those seeking work illegally? Wtf.

The Founders didn't create one, but through the decades the court has gradually expanded its power. I do believe that the courts hold more power than they should. However, that doesn't excuse Executive power grabs either. Two wrongs do not make a right.
We were originally set up to be a nation of laws in which the laws affected all equally and were applied to all equally. That leaves no room for enforcing what one does or does not like. There either is a law that we all follow or their might as well not be one. And in this case, the Executive branch chose to ignore some laws forcing a state to take action in its own defense – something it should never have had to do because it is a clear COTUS mandate to provide for the common defense.

If the federal government won't enforce immigration laws, and if it won't let my state do it, then maybe it's time to separate ourselves from the country so we can protect ourselves "from all enemies, foreign and domestic."

Where is the Republican sponsored legislation to deny citizenship to anyone entering the U.S. illegally? It shouldn't preclude some other legal status from being obtainable, but must deny citizenship, and therefore the right to ever vote.
That leaves no room for enforcing what one does or does not like.
It is called prosecutorial discretion.

Great point. I do believe we were also set up to be a nation of as few laws as possible. How long was the Obamacare bill? How long is the tax code? Ever tried reading the tax code? The U.S. Senators who have been demanding answers from the Administration about a rumored administrative amnesty have now revealed shocking memos from top Obama officials.
They show Obama Administration officials offering a detailed plan that would offer actual or de facto amnesty to millions of illegal aliens without Congress ever taking a vote.
In this way, the Administration would be able to reap the thanks of all the cheap-labor, outlaw industries relying on illegal labor, as well as the entire pro-illegal voter base.
But no Member of Congress would have a vote for amnesty on his/her record while facing elections.

USCIS Memo Details Administration's Plan to Provide Mass Amnesty Through Administrative Actions

A newly revealed memo, obtained by Sen. Chuck Grassley (R-Iowa) who is leading the fight against amnesty, shows Obama Administration officials offering a detailed plan that would offer actual or de facto amnesty to millions of illegal aliens without Congress ever taking a vote.
The 11-page memo, drafted by Chief of Policy and Strategy for U.S. Citizenship and Immigration Services Denise Vanison, outlines the various ways to offer a mass amnesty to the nation's 11-18 million illegal aliens through the use of administrative actions. The stated purpose of the memo is to offer "administrative relief options to promote family unity, foster economic growth, achieve significant process improvements and reduce the threat of removal for certain individuals present in the United States without authorization."
"The memo proposes 18 different ways for the Obama Administration to essentially eliminate our borders through regulatory fiat and in clear violation of the letter and the spirit of U.S. immigration laws, which Obama swore an oath to faithfully execute," said NumbersUSA's Director of Government Relations Rosemary Jenks.
The memo is an alternative plan to amnesty "in the absence of Comprehensive Immigration Reform." In addition to using deferred action and parole, which were previously identified in two separate letters drafted by Sen. Grassely and signed by 11 other Senators (read the first and second letters), the memo outlines ways that USCIS can extend benefits and protections to individuals and groups of people by lessening the standards used in "extreme hardship" cases.
Item 4 in the memo outlines ways the Obama Administration can provide amnesty for millions of illegal aliens through the "extreme hardship" provision. It would "encourage many more spouses, sons, and daughters of U.S. citizens and lawful permanent residents to seek relief without fear of removal. It would also increase the likelihood that such relief would be granted." Section 4 reads:
Lessen the Standard for Demonstrating "Extreme Hardship"
The Act at 212(a)(9)(B)(i)(I) and (II) renders inadmissible for 3 or 10 years individuals who have been unlawfully present in the U.S. for 180 days or one year respectively, and then depart. By statute, DHS has discretion to waive these grounds of inadmissibility for spouses, sons and daughters of U.S. citizens or lawful permanent residents if the refusal to admit such individuals would result in extreme hardship to their qualifying relatives. Generally, the "extreme hardship" standard has been narrowly construed by USCIS.
To increase the number of individuals applying for waivers, and improve their chances of receiving them, CIS could issue guidance or a regulation specifying a lower evidentiary standard for "extreme hardship." This would promote family unity, and avoid the significant human and financial costs associated with waiver denial decisions born of an overly rigid standard. This revised standard would also complement expanded use of PIP as set forth in B.
In addition to lessening the standard for demonstrating "extreme hardship", the memo details many more options that "have the potential to result in meaningful immigration reform absent legislative action."
Other options include: allowing aliens in the United States under Temporary Protected Status to adjust their status to Legal Permanent Resident, extending "grace periods" to leave the country for aliens on temporary work visa, changing the distribution time line for temporary workers on the H-2B visa, and granting up to 240 additional days on applications for employment authorization when the application is filed before the work authorization expiration date.
Denise Vanison has been an immigration attorney for more than 18 years. She advised multi-national and domestic corporate clients on employment of foreign nationals in the United States, I-9 employment verification and procurement of passports, visas, green cards and U.S. citizenship.
The memo was drafted for Director of U.S. Citizenship and Immigration Services Director Alejandro Mayorkas. In addition to Denise Vanison, Roxana Bacon from the Chief Councel's office, Debra Rogers from Field Operations, and Donald Neufield from Service Center Operations were also listed as authors of the memo.

I have always questioned why judges that are hell bent with an agenda of Constitutional usurpation, are allowed to stay on the bench and cause legal havoc. IMO, the house and senate judiciary committees should be expunging the courts of this damaging legal trash.
If congress is relying on the brainwashed garbage by the courts, of their self manufactured shield of "judicial independence," well ladies and gentlemen, that term is not to be found anywhere in the Constitution. However, impeachment is mentioned for everyone, including the folks that wear those long, black, funny, and ugly dresses.

Sorry I have to disagree with your last sentence. I believe laws should be NO more than 75 pages, on one side, double spaced, in size 14 font on 8 1/2" x 11". After they write the bill, I also believe that they should be posted on the internet, where every one has access to read them, for
one day per 2 pages, before they can vote on them.
If someone has someting they want for margins, I am open for suggestions.

The Constitution is the document that frees us from tyranny. It is the document that has allowed the United States to become the world's foremost economic power, military power, breadbasket and the most generous nation on Earth. The United States has delivered more good and prosperity to the world than any nation on the planet, past or present. More advances in technology, agriculture and medicine have come from the United States than any other nation, and likely more than the rest of the world combined. Anyone who would say the Constitution of the United States is "just a piece of paper" is too ignorant to be anything but a vile pile of crap who doesn't know very much about history.

This ties into my libertarian leanings. I agree that we need to have fewer laws. For every law that is made, a choice (also known as a freedom) is removed from the people. There are some laws that are necessary like those that punish others for removing the basic rights of another person, but many laws have grown out of the gross expansion of both the ideas of what a right should be and the ever looser interpretation of the COTUS.
As to legislative length, well, AZ effectively mirrored Federal law in less than 20 pages. Why should anything need to be longer than that, and if it is, then it should be broken into short, easily understood chunks.

Maricopa County Sheriff Joe Arpaio says he's "not going to put up with any civil disobedience" when the state's new immigration law takes effect.
Arpaio says that if protesters want to block his jail, he'll put them in it.

I wouldn't necessarily count the 9th down yet. So far, they've upheld every anti-illegal measure AZ has had challenged. Several people have said today that it depends on which three judges they draw for the panel.
Sorry. Meant to type "50" pages. Although 150 pages would be reasonable compared to what they are insulting us with these days.
And really my point is more about the fact that these new bills are thousands of pages long. They are designed NOT to be read.
