Obamacare: The President’s Wooden-headed Interpretation of Our Constitution

In chapter 4 of our book, The Blueprint: Obama’s Plan to Subvert the Constitution and Build an Imperial Presidency, we make the point that Team Obama would try to pull a fast one when it comes to Obamacare’s individual mandate that everyone reading this blog post needs to buy health insurance, or be subject to a penalty payable to your good friends at the IRS.
We first made this argument in a column we coauthored with Senator Orrin Hatch in the Wall Street Journal back in January. Now this issue has suddenly exploded back into the news.
For months, Team Obama has been saying that the individual mandate is authorized by Congress’ power to regulate interstate commerce found in the Commerce Clause. We explain in the book why that argument is a loser in court, and that the White House would have to pull a bait-and-switch and suddenly argue that the mandate is a tax (violating Obama’s promise not to raise taxes on anyone making less than $250K per year).
Looks like we were right. In their first filing against the multi-state lawsuit challenging Obamacare, Team Obama is now arguing that the individual mandate is… a tax.
If you read chapter 4 of our book, though, after we explain how the mandate is not authorized by the Commerce Clause, we then go on to explain how it is also unconstitutional if it’s a tax.
Evidently worried about this, Team Obama then goes on to argue that if the court doesn’t buy the tax argument either (because the argument is bogus, perhaps?), then it’s still justified under the General Welfare Clause.
Anticipating that, our next section in chapter 4 explains why the mandate is also not authorized by the General Welfare Clause.
We close that section by noting that one thing you’re taught in law school is that the General Welfare Clause doesn’t authorize the federal government to do anything. It is a limitation on federal power, not a source of additional power.
When you cite the General Welfare Clause, you’re grasping at straws. That’s exactly what Team Obama is doing. Their legal argument is desperate, because the Obamacare mandate is unconstitutional.
With Elena Kagan’s confirmation vote for the Supreme Court right around the corner, this issue could not be more timely. We need federal courts that will uphold the Constitution’s limits on federal power. They can start by striking down Obamacare.

Well, you know, when he said all those things he didn't really mean them. He just wanted to win the election, not be president.
Who do you think pays for the uninsured? Think really hard. The Easter Bunny? No, try again. Santa Claus? No, try again. I know. The government and the persons with insurance because hospitals pass down the cost of their deadbeats to their paying customers. I thought conservatives were all about individual reliance and not forcing the government to pick up the tab, when you should do it yourself. I must be mistaken.
First thing the Republicans should do in January is retract the censure of Joe Wilson. They probably won't, but they should.
Obama has brought more inflamed racism back into this country, than anyone I have ever seen! He is running as fast as he can to be America's first dictator….if WE THE PEOPLE don't stand up and protect ourselves from this monster in the White House, we will not have a free country long! He has taken over the most important elements of what America stands for, and if the politicians can't shut up long enough to see that we are doomed!

The US voluntarily gave over $310 billion last year during a recession in voluntary contributions NOT paid for by taxes. We can help the poor if the gov would get out of our way.

Maybe if Obama read the Preamble to the Constitution, he would understand the Constitution itself. It mentions providing the common defence and promoting the general welfare, not the other way around. But then, if you aren't interested in the Constitution, why bother reading it? Or better yet, just misinterpret it and you can do anything!

The cause is well known and it is just. When the alleged leader of a democratic republic places his own wishes so above those of the complete body politic, he is no longer worthy of the title, leader, no matter what office he might occupy.

Just for argument sake (not that I'm endorsing ANY of this), isn't the insurance mandate technically a tax anyway? A tax is using force to make us pay for a good or service against our will, like streets, fire, police, fisting art for homosexuals… so technically the gov is not doing anything different here since they are technically forcing us against our will to purchase a good or service.
We are even forced to pay for goods and services against our will with private sector stuff like street building being contracted to private firms or garbage or private companies building statues.
I think the forced purchase is wrong to begin with but at least the money doesn't go into some horribly badly run gov agency then paid out at 10cents to the dollar for the service. It goes directly to the service. If the gov mandated we HAD TO buy school services but the schools were private and we could pick the schools and change them, that still would be better than handing the $$$ to the gov and have it eat over 75% in admin costs.

I think the first thing Republicans should do is GET ON THE SAME PAGE!!! Far too many, or I should say few enough, have juuuusst that little bit of progressive in them. I think, for example, the Tea Party Congressional Caucus will be a good thing because it will separate those Republicans who ARE conservative from those who ARE NOT Conservative. Republicans have to STOP looking out for their own well-being politically like so many Democrats. This Caucus is a good, and big, first step towards doing that. Obamacare MUST be repealed. Elena Kagan MUST NOT be confirmed, and we have to STOP this political jockey-ing that Democrats have gotten far used to using and abusing for their benefit. We NEED people who WILL stand up AT ALL TIMES, not only when it is politically positive for themselves, like Senator McCain. The worst of the worst is Lindsay Graham, Olympia Snow and Susan Collins. Since some angel wing earner made a law that MANDATED all hospital ERs MUST give medical service to someone regardless if they can pay, that cost is passed on through force.
They are MANDATED to pass the cost because they are MANDATED by law to service ANYONE who enters an ER regardless of the ability to pay.
Yes it would be like if a grocery store had to sell groceries to someone even IF they could not pay. So the grocery store would pass that onto the other customers who do. But the real problem is the LAW that forces the grocery store to give out food. Same with ER services. If the hospital was not forced to give out ER services they would not pass on the costs.

I would love to retake that class, but taught by one of you, Mark Levin, Scalia, or Thomas, depending on who was available.

I don't want to have to pay for anyone's healthcare costs. I would rather everyone pay their own way, but that just ain't gonna happen. So the next best thing is to limit the cost of those uninsured. They should be provided major medical coverage and left to pay for the small things on their own.

a. You have an IQ higher than 10 (which most of his voters didn't have).

As an employer who pays 100% of my employees' medical/dental premiums, I can tell you that we are about to be caught in a catch-22 on this healthcare thing. A ridiculous 26 days after electing a new program after Anthem cancelled our better program, it raised our premiums by over $150/mo. I have one employee who had cancer last year, was covered and got completely cured, but she cannot obtain any individual insurance at any cost without the guaranteed group coverage I set up. She has one of those pre-existing conditions now. Her monthly premium is now over $700/mo. I cannot take advantage of the 35% tax credit for small business employers because my average employee earns more than $50K a year (that's not much in S. Cal). If the govt mandated "no pre-existing condition" kicks in, her premiums will go way up, and then I will be taxed a surcharge for paying for her "cadillac plan" as these are defined solely by premium amount threshold of $10,200 and not insurability. cont.

So, if I don't pay her premiums, she gets kicked out of all insurance and will have to look to the state for one of those "state exchanges" that have yet to be formed. We are walking straight into a catch-22 and the only way to avoid it is to offer no insurance and pay the penalty or close up shop. Whoever tries the snow job on this healthcare law bringing costs down is absolutely nuts!

Article 2 section 4 of the Constitution states,The President, Vice President and all civil Officers of the United States, shall be removed from Office on Impeachment for, and Conviction of, Treason, Bribery, or other high Crimes and Misdemeanors.

It's good to know that in 3 1/2 years when the government forces me to give up my high deductible insurance, and since I make less than $96,000 a year, that HuskersLoveBo will be there to cover my insurance with his share of the $1,000,000,000,000 in tax hikes he'll be paying.
What stupid liberals refuse to accept is that conservatives are not against helping those less fortunate than ourselves, however, you could supply every single uninsured person in America who can't afford it a high deductible insurance plan like the one I have for about $10B a year or less than 1/10th of the overly optimistic amount of Obamacare. What conservatives know that Bolovers don't is that Obamacare is not about helping the poor but expanding the size and influence of the federal government.
There is a lack of market forces in the medical industry. If insurance companies could sell policies across state lines, the cost of a policy would drop. That is called competition. Say it with me, 'com-pet-ish-un. Good. If people would pay out of pocket for routine Dr. visits, and procedures, and tests, etc. etc., costs would again go down.
Notice how when flat screen TVs and DVRs and cell phone, etc. etc. first appeared on the market, how expensive they were, but now they are cheap? That's due to market forces. Say it with me, 'mar-ket–for-seys'. Goooood! The truly poor can take advantage of something called 'CHARITY', and maybe, just maybe if your real nice, we could have some form of government subsidy to help the poor buy major medical policies. In any case, more government involvement is just going to exacerbate the problems that we already have. You should know this.
And major medical is cheap if you buy it when you are young and healthy.

If you are only "taxed" if you don't buy insurance wouldn't that violate Article 1, Section 9, "No Capitation, or other direct, Tax shall be laid."
This fine/penalty/tax occurs because you failed to purchase a product or service. The Federal Government cannot compel you to purchase anything. That would make this a direct tax because it is on the person and not property. "A Capitation Tax is a tax that is levied directly upon the individual without reference to property."

If the ER does not have the ability to refuse care, then they should have the ability to hold the person receiving said "emergency" services accountable for payment in full. Further, the ER should be able to ask immigration status – illegals get treated and released to their home countries for "follow up" care. Indigent legals who are able to work can work their bill off with the hospital. The truly needy already have a legitimate safety net.

Few on Capitol Hill, or in the media, took note that the order provides a
free ticket replete with housing and food allowances to individuals who have
displayed their overwhelming support to the Islamic Resistance Movement
(Hamas) in the parliamentary election of January 2006.
