De-Fund Holder’s Manhattan Transfer

Transfer Elián from Florida to Cuba. Bad idea. Attorney General Janet Reno thought she might have to prove her toughness by transferring dozens of women and children from a Waco cult headquarters to eternity. Really bad idea.
But Eric Holder’s plan to transfer Khalid Sheikh Mohammed from Guantánamo Bay to Manhattan for a civilian trial is perhaps liberals’ worst idea in years. KSM and his cohorts had agreed to plead guilty before a military tribunal, accept a sentence of death, and speedily rendezvous with their 72 ladies-in-waiting.

This offer of an efficient way out for the administration was not good enough for Attorney General Eric Holder. He insists on trying the terrorists before a civilian jury in federal court, just a few hundred yards from Ground Zero. Next to martyrdom and a free trip to paradise, this has to be the terrorists’ wildest dream.
No turbaned genie ever appeared out of Aladdin’s lamp to grant three greater wishes than these. KSM to Genie: One, I want to exploit my status as mass-murdering terrorist; Two, I want to inflict even greater pain and suffering on the families of those thousands whom I’ve murdered; Three, I want to make my trial a magnet for my brother jihadists throughout the world.
Of course, it’s always possible that this whole transfer could go without incident. But why in the world would anyone take such an utterly reckless risk, going from swift and sure justice on a military base in a foreign country, to an unpredictable gamble on our own shores, surrounded by civilians in our largest city?
Eric Holder’s decision to try the terrorists in Manhattan may not be simply the worst decision of this administration, it bids fair to stand with Dred Scott and Roe v. Wade as being among the worst decisions in American history.
Congress has the power to prevent this farce from going forward. Congress must spare us this travesty. Phyllis Schlafly has reminded us—serious student of the Constitution that that she is—that Congress has the power to restrict the appellate jurisdiction of the federal judiciary. Very true. But Congress has a power that would provide even more immediate relief: That power is the power of the purse.
We need to move quickly to deny Mr. Holder’s Justice Department any federal funds to transfer or try any of the Guantánamo detainees apart from military tribunals. President Obama is on record as approving those military tribunals. As a senator in 2006, he even voted for the measure that established those tribunals. Of course, he is now on record backing up his besieged attorney general.
We would actually be doing Mr. Obama a favor by having Congress override his hasty and reckless attorney general. I think the president would secretly heave a sigh of relief if Congress would prevent this gross error from going forward.
It’s vitally important that the people’s representatives speak on this point. It’s why we have checks and balances.
It’s ironic. The president—as commander-in-chief of the military—would have enormous discretion to handle this situation as he saw fit if the Defense Department retained custody of these terrorists. But by transferring them to the Justice Department, this becomes a domestic issue outside President Obama’s commander-in-chief power, giving Congress the upper hand in deciding how to proceed.
We should have a good chance of prevailing on a cutoff of federal funds for civilian trials of terrorists. How many members of Congress would relish the prospect of having to explain on the campaign trail next year why they voted to spend a minimum of $75 million a year on security for the New York show trials? Voters will especially object when they realize that Guantánamo Bay was built with taxpayer funds for precisely such trials. We’d have good prospects of winning on such a proposition. But even if we don’t carry this amendment, we would certainly have a vote that would be of intense interest to American voters as they approach the 2010 elections next fall
The ins and outs of the health care debate, cap-and-trade, and the stimulus require voters to pay the strictest attention as lawmakers wade through numerous 2,000+-page legislative behemoths. But an up-or-down vote on Holder’s Manhattan Transfer has a marvelous clarity. Let’s get clear.

Actually, Freddie, I read a version of the koran/quaran and couldn't find any reference to having virgins in heaven. In fact I heard that muslims cannot execute a virgin, so they rape them first.

It is time to look at the reality of the ramifications that Eric Holder’s decision made to try the terrorists in Manhattan. This is beyond being stupid it is a only a decision one would make if they had a hidden agenda that is supported by this President.

These people deserve to rot in hell, but either they're enemy soldiers (and tried according to the Geneva convention), or civilians (and tried in civilian courts).
I think the notion that the President was not involved in this decision is absurd on its face. Note, all he said on the matter was it wasn't "his decision." He did nothing to correct, didn't say anything about it one way or another except to be able to distance himself from it. He does this with all things, because it's impossible to nail jell-o to the wall, and he doesn't want to be tied to any policy or move by his (note: HIS) administration.
He is not a leader, but a follower.
Who he follows is the truly scary part.
Beyond not being able to get a fair trial because I am sure everyone that knows about this will claim being racist-the case will tossed out of court. This case will go NOWHERE in this country! Even if it does and the jury are all of this "pigs" nationality- it won't be a fair trial. By the way, I am NOT racist. De-fund the transfers? Then Barry will have to send little Timmy down to the basement to crank some more tens of millions of play money off the Magic Money Press. Although for such a tiny amount it might be found forgotten on the floor somewhere.
Of course there are always the spare stimulus funds, just think of the hundreds of saved or created jobs that could come from this. Why after all the fire and ambulance crews rush to NYC to help out again, that could count as many thousands of jobs! Things are really looking up for the US under Barry's leadership!

Technically correct, but the did notify the military that's exactly what they were planning to do when their tribunal started. The plea itself is not official until a court or tribunal accept it.
Even if they did, all they have to do is tell the civil court judge they were coerced, and out the window it would have gone anyway.

I agree with your assessment of Holder, and that's what puzzles me about this. When push comes to actual shove, they're usually more interested in self preservation than going down with the ship.
He's risking everything by agreeing to take the fall if necessary. Why? I find it hard to believe he thinks its the right, honorable thing to do.

Can anyone tell me how Holder has any jurisdiction on enemy combatants that are being held offshore. Gitmo is a military base and jurisdiction should be under the Judge Advocate General and not the Attorney General correct? He has stated it was His only decision to bring KSM to NYC. Since when does the Attorney General have powers over our Military? Obama is pulling the strings on this one. Jury of twelve 4 NYPD, 4 NYFD and 4PAPD! I know. I'm perplexed myself. Unless they stack the jury, it's hard to get a death penalty in NYC. Of course, since I also believe that Obama is a Muslim, they are not allowed to kill other Muslims, so maybe he's going after a life sentence. But I agree with those who feel that both he and Holder were trying to taint the jury pool by claiming that KSM would be convicted and put to death. I think they're gambling on this one, especially if KSM gets off on a technicality, and the script will be written that it's all Bush/Cheney's fault. At least, that's the outcome I think they envision.
Obama's not a Muslim. He may or may not consider himself a Christian, but he's not a traditional Christian. But he's not a Muslim. The only reason I think that rumor still has legs is because the biased MSM keeps a spot light on it so they can chuckle and say 'oh, those crazy Bible thumping red necks.' I don't know a whole lot about Islam, but it doesn't come across to me as a religion one would even think to consider hiding.
I don't think stacking a jury is even possible in the current judicial system, especially in a population the size of NYC. You might be able to pull it off in a tiny town, but in MY we use a lottery system, and it's been five years, so my name should be be coming back up soon. I've never been on a jury, I have been dismissed just before a trail started once. But I despise the idea that a Judge can tell me to be somewhere at a certain time, or I go to jail.
As for me, I don't see how this could ever make it to a jury. He was not read his rights, he was not given access to an attorney, he was not given a speedy trail, he can claim enhanced interrogation as cruel and unusual punishment, plus who knows what else the ACLU can come up with. They'll have a field day with this. If this were any other case, he'd walk on opening motions.
In order to allow this thing (notice I did not say trial, that's not an accident) to proceed to a jury, the Judge will have to rule that the all those civil rights do not apply to a defendant in the federal court system.
That's precedent. That means the federal government can do it to We The People too.

Barry has already "tainted" not only the jury pool, but the entire trial………………he long ago said that KSM is guilty and that he WILL ( ROTFLMSO ) get the death penalty. For any other "felon", that alone is caused for dismissal.
Holder does NOT have the power, nor the authority to remove KSM from military hands, nor to say where he and the others will be tried.
Gates does NOT have the authority, nor the power to hand over a military prisoner, captured during a war, to a civilian court.

That's the only explanation for this trial decision that even APPROACHES anything that could be confused with logic. From a military standpoint, it's dangerous, at best. From a legal standpoint, it's without precedent, and fails simple logic tests. From a domestic standpoint, it spits in the face of the survivors of that horror, and benefits only the accused [by giving them a soapbox to spew from].
