ACORN = RICO
by Ken Blackwell and Ken KlukowskiNow that a third ACORN video has surfaced, a pattern emerges of ACORN workers willing to help people engage in prostitution, tax fraud, housing fraud, and even human trafficking. Under federal law, a RICO investigation is now warranted. Three strikes and you’re out, ACORN.
Videos show ACORN employees offering to help two undercover reporters/filmmakers posing as a prostitute and pimp in falsifying tax returns and getting a federal loan to buy a house that they could use as a brothel for underage prostitutes smuggled in from El Salvador.
When the first video emerged from such a meeting in ACORN’s Baltimore office on Thursday, ACORN fired the two workers involved. When another video surfaced on Friday, this one from ACORN’s D.C. office, the two workers involved there were fired as well, and ACORN said that these two reporters had tried and failed to carry out this sting in other offices.
One such office where ACORN said these reporters tried and failed was New York City. Yet Monday, a third video surfaced from Brooklyn in New York City. Once again, the ACORN employees on the video advise the undercover duo on how to violate federal law by filing a false income tax return to qualify for a federal housing loan.
As one worker says on the video, “honesty is not going to get you the house.” Well, not if you’re engaged in a host of felonies.
ACORN has the audacity to say that the undercover reporters may have committed a crime in the videotaping process, alleging that they doctored the tapes and that the reality is not what every viewer can plainly see and hear on the tape. (Who are you going to believe, me or your lying eyes?)
Talk about the pot calling the kettle black.
The reality is, there are at least a half-dozen state and federal laws that could have been broken here. Even though the undercover girl is not a prostitute and there are no El Salvadoran girls either, this could still meet the legal standard for conspiracy to commit these various crimes. At a bare minimum, depending on the state, it likely fulfills the elements for the crime of attempted conspiracy, which usually carries the exact same penalty as the underlying crimes themselves (prostitution, tax fraud, etc.).
What’s important about prostitution and human trafficking is that they are specific triggers for the Racketeer Influenced and Corrupt Organizations Act, better known as RICO. The RICO law is designed to enable the Justice Department to go after criminal enterprises. It defines “racketeering activity” as including importing illegal aliens for immoral purposes, falsifying identification documents and immigration papers, mail and wire fraud, and the sexual exploitation of children, among others.
These are all implicated on the video tapes. The ACORN workers rattle off their how-to instructions on carrying out these crimes without needing to do more than skim a couple books that they have on hand. The clear implication is that these workers are seasoned pros on how to carry out these crimes, subsidized by federal taxpayer money.
Although everyone is presumed innocent until proven guilty, a RICO investigation is now warranted. There are already multiple state investigations of ACORN underway, and thirty ACORN workers have already pleaded guilty to committing crimes. Attorney General Eric Holder should immediately order a RICO investigation, while we all wait to see if more footage is forthcoming.

I think it's kinda funny that they are grappling for straws, but yet they are the ones that could be shut down. Even if O'Keefe and Giles broke the law, evidence should still be able to show that the tapes are legitimate. When I have watched the videos there were no breaks in the stream to suggest editing, no inconsistancy with the voice to suggest dubbing… so unless O'Keefe and Giles are damn good film editors (or the had a professional do it) I will have to believe that those videos are correct in their portrayal of the events.
You do realize that they are most likely at this moment moving there operations over to Organizing for America don't you? Keep your eyes open some of the same people in Acorn will be makeing the shift.
Holder will not go after the dear leader's pet organization. How else can dear leader and co garner the votes needed to stay in power, and who would hire people for the day to stuff town hall meetings to silence the voices of the taxpaying voters against their socialist agenda?

By the way, Rep. Darrell Issa has long mentioned the RICO violations of ACORN. Of course with The Messiah and the Chicago political machinery at play, pushes to investigate and prosecute ACORN will likely be a tall order…for now anyway

As I said in a post under the announcement of the senate vote – Gillibrand, being a Jr Senator after carpetbagger Hillary took off, may have been politically inept enough to read the people and Schumer didn't school her – he threw her under the bus by not telling her how to vote to make herself look squeaky clean. He, on the other hand, voted the way he did just to be able to point to it during the next election – he didn't want to be on the wrong side. He's slick. It doesn't match his general record.
To get the IRS in for an audit you would have to say that ACORN was a conservative group. Good luck!

I want an investigation into the housing ACORN has already assisted people in getting. They may have actually helped set up real "businesses" in the neighborhood. None of the three videos really acted all that surprised at their request, so I'm guessing this is not the first time. Just the first time they got caught.

I find the recent lack of loud cries of outrage from the senior staff at ACORN very telling. When the videos from Mr. O'Keefe and Ms. Giles first surfaced, ACORN leadership was quite verbal in attempting to downplay and discredit the reports. Now, that the new film from NYC has surfaced, after ACORN officials said that the same attempt had been tried, and failed there, is very telling. ACORN is clearly on the defensive, from pulling information down off their website, to their new found lack of outrage. Shine the light and watch them run for cover.
It will be on Glenn Beck at 5 EST. The problems with all THESE organizations, they wouldn't be caught dead watching Glenn Beck or Fox News!!!!

Let us be serious on the expectation that Mr. Holder will do what he's supposed to. This is the person who called Americans "cowards about race". This administration is going to try to protect ACORN. Make sure to go to the INSPECTOR GENERAL of HUD website and email or make a phone call to ask that ACORN is investigated.
It's amazing that the MSM is not reporting on this. The good news is, that the White House MUST watch FOX, and they know that the people of the US are too, considering the ratings. It will be hard to cover up for ACORN knowing that so many people know the truth.

City inspectors and even their supervisor were in on the scams, presumably getting kickbacks. Some of the contractors were relatives of city inspectors. Themayor's performance has raised some eyebrows since this all came out.
And now the investigation has spilled over to community non-profit organizations.
Sadly, they are all African American. THAT is the story. Like ACORN, these schemes are ripping off taxpayers all over the country….and victimizing poor black residents. As background, refer to the Boston Globe's long investigative article about how Obama and his sponsors funneled hundreds of millions of $$$ into South Chicago housing programs….with no improvements to show for it. By the way, I meant to add how sad it is that the vast majority of these scams involve African American neighborhoods and, in many cases, politicians and public workers. I want to start a petition to run these two kids for the Nobel prize. These two kids take on a nation without protection of huge money behind them. Whats most telling about the three videos that have been released so far is the ease and skill with which the ACORN employees provided advice on how to circumvent and break laws to defraud the government. And this was in three separate locations in different cities. A reasonable person would take this as strong evidence ACORN is adept at this and that these episodes are typical about how ACORN does business.
The media and Left wing is largely silent on this realizing how damaging engaging in this conversation is to their constituency in the black community. They will continue the coverage blackout on this to the bitter end and only more reporting and discussion of this is going to result in any action against ACORN. The fact after systemic voter registration fraud over the past decaded in tens of states ACORN still retains any credibility or public trust is testament to the destructive effect of rampant political correctness.
We have already seen it, the predictable response have been the Left's favorite epithets, "Fox News" and "racism." So desperate are they to cloud the issue that they will even attempt to claim this has anything to do with Fox which had no role in conceiving or executing these investigative reports.

Stop Calling network news and newspapers MAINSTREAM when they are not. Whoever has the best ratings… the most viewers/readers and presents BOTH SIDES with the most effect on the public sentiment is the MAINSTREAM MEDIA.. the others are the biased fringe. Because some media outlets have established themselves as mainstream over the years, does not mean they continue to be. Only a few goofballs are wearing bellbottom jeans these days.
It seems clear to me that there is more than enough "stuff" to prompt a thorough investigation. My fear is that Obama and Holder are too busy investigating their political enemy's to have the time to go after real criminals!
I calleed and thanked Sen Jack Reed of RI for voting yea on removing ACORN from HUD funds, but called Sen Sheldon Whitrhouse and left a phone message berating him for voting ney. We need to thank even our Dem representatives for doing the right thing, as well as making sure they here from us when they don't… especially when they don't. This is huge and the duo O'Keefe & Giles should be proud of their hard work. They will go down in history. Ethics and morality just don't exist with the liberal left.

One hopes beyond hope that one or more of the 'pimp' stings was undertaken in a state with a Republican government. The Holder DOJ will never, ever, ever touch ACORN- and we've seen how Maryland is responding. Don't hold your breath waiting for action in DC or New York, either.
But if they nailed the swine in, say, Houston or New Orleans or Miami, states with Republican governors and AGs, then we might see something happen. After all, it's state action, not the Feds, which has gone after these creeps for vote fraud across the country.

How about a recall of the last election and throw out every application submited by ACORN and that voter's vote?

Everyone should read the chapter on Obamacorn: A Community of Organized Racketeers Nationwide, in Michelle Malkin's book Culture of Corruption for an insight into Obama's ties to Acorn. It's hard to believe there has not been a federal investigation of Acorn already. 'The thought of my tax money going to that organization makes me sick. The thought that we have a president associated with them makes me even more ill.

I got an email from the Glenn Beck show — says they name some of the politicians they talk to regularly and what bills they are lobbying for — and one of the ACORN people talks about how she shot her husband.
As far as I can see, there are three possibilities. Either these people are so stupid that they haven’t caught on to this journalistic sting operation, or the corruption is so widespread that they can’t get a handle on the cover up fast enough, or they think the Obama Administration is going to run interference for them.
It really doesn’t sound too good any way you want to look at it. I’m infuriated that my tax dollars are going to finance things like this. It has got to stop!

IN NEVADA – DEM AG KEEPS PROSECUTION 'LOCAL' TO AVOID RICO.
The newly elected Democrat Attorney General (first one since 1994 in Nevada) probably got some help from Harry Reid to ensure that SHE got to 'prosecute' those ACORN grifters in Las Vegas who had the FBI raid their offices prior to the 2008 elections after ACORN turned in tens of thousands of bogus voter registration cards.
Now, how often does the FBI end up handing a case THEY started and executed DOWN to an state Attorney General and not over to it's logical place – the US Attorneys Office in Las Vegas (where RICO cases are filed – Federal Court). Well, it's isn't often. Even though the Las Vegas FBI office is very small (Vegas has lots of other LEO including a huge US Marshalls office), surely they would like to actually help prosecute the people they were the lead in arresting and investigating. But after some lengthy negogiations, the case was droppped down to the State level and a party loyalists (Democrat Party, of course) is 'leading' the prosecution.
No shock that nearly a year after the evidence was seized that there is no real progress. And being in State Court, there is absolutely no possible way that this case will connect with the Corruption, Fraud or Election Violation cases in Ohio, Missouri, Lousiana, California, Colorado, etc, etc, etc, etc. Keeping the 'prosecution' at a local level avoids bringing in the head of the snake while it seeks to carve off the smallest part of the tail (if even that is necessary).
I hadn't heard of Kristin until she went to Congress from here in upstate NY. Now I've heard of her, and from her. We have a long memory here. I think it has to do with the water. .. especially when you're in hot water like she is.
Any investigation needs to go right to the top of ACORN… That includes the Rathke (sp?) brothers and the SEIU, plus multiple other organizations involved in the whole racketeering business… If Holder does NOT investigate or keeps putting it on the back burner he should be brought up on charges of dereliction of duty or even RICO violations himself.

There will not be any federal investigation. And it will not be ACORN participating in the census or collecting federal funds, but it will still be the same people, business as usual under a new name.
We're not 8 months into this administration and it is already smelling worse than last week's garbage. Now Obama goes on his concert tour, putting his mug in front of unions and the state run media to try to divert attention from his beloved community organizers at ACORN back to the lies and deceipt of his health care program.
What is really interesting is watching those who flock to him versus those who are starting to cut bait. Unions, AARP, and state run media all have their noses up his butt. Even some of his fellow democrats are realizing the emporer has no clothes and the American people know it. At least those who work for a living and aren't deluded.

The RICO law, 18 USC §1962(c), prohibits “any person employed by or associated with any enterprise engaged in… activities… which affect[] interstate… commerce, to conduct… such enterprise’s affairs through a pattern of racketeering activity…”
§ 1961(1) defines a “racketeering activity” as
(A) any act or threat involving murder, kidnapping, gambling, arson, robbery, bribery, extortion, dealing in obscene matter, or dealing in a controlled substance… which is chargable under State law and punishable by imprisonment for more than one year [or] (B) any act which is indictable under any of the following provisions of title 18, United States Code: Section 201…

And § 1961(5) defines a “pattern of racketeering activity” as “at least two acts of [even the same] racketeering activity…”
This would seem to be a case of "at least two acts" of "dealing in obscene material" or perhaps one of the other federal crimes from 18 USC § 201. Probably is worth investigating either by the local US attorneys of the various ACORN branches or by Holder as other commenters have mentioned. Crazy.

If Eric Holder launched an investigation, it would probably be such a white wash, and make it look like ACORN were saints. I think an independant criminal investigation should be launched, one that has no ties to either political party, that way nobody could imply that they were bias. This rotten to the core group,along with SEIU have to be dismantled,prosecuted for fraud and thrown in the big house. WE THE PEOPLE have to rid OUR COUNTRY of the corruption that has been allowed to run amuck.
I'm not holding my breath on Holder ordering an investigation. ACORN and SEIU know where the bodies are buried.
No law was broken in taping these people. If they had been "officials" They would have had to get a warrant or the permission of those being taped. But, since these two individuals were private citizens they are legal (God bless them).
