Article V: Repealing ObamaCare
by Josie WalesThere is much talk of repealing socialized medicine, though the rhetoric has waffled a bit since passage. The problem is that even if we gain majorities in Congress we still need 60 votes in the Senate to avoid a filibuster, not to mention the 2/3 majorities we need in both houses to override a presidential veto. Meet Article V of the Constitution:
The Congress, whenever two thirds of both Houses shall deem it necessary, shall propose Amendments to this Constitution, or, on the Application of the Legislatures of two thirds of the several States, SHALL call a convention for proposing Amendments, which, in either Case, shall be valid to all Intents and Purposes, as part of this Constitution, when ratified by the Legislatures of three fourths of the several States, or by Conventions in three fourths thereof, as one or the other Mode of Ratification may be proposed by the Congress; Provided that no Amendment which may be made prior to the Year One thousand eight hundred and eight shall in any Manner affect the first and fourth Clauses in the Ninth Section of the first Article; and that no State, without its Consent, shall be deprived of its equal Suffrage in the Senate. (emphasis added)

Dark thoughts are on American minds these days, despite the optimism in the American system. It is not the first time, nor will it be the last. Travel backwards to the Spring of 1786. The Articles of Confederation were the “Supreme Law of the Land,” but one Charles Pinckney of South Carolina proposed a revision. Congress represented the sole institution of our national government, and Congress was rather weak. The states retained much of their sovereignty, and Congress, with the few powers it actually wielded, could only operate with unanimous consent. Rebellion and credit issues abounded, not to mention the threat of foreign invasion, without effective centralized governance. And so, the Constitutional Convention eventually convened in May 1787 to revise our system of government, and prevent disaster.
The Articles of Confederation were completely replaced by the Constitution when New Hampshire ratified it as the ninth state on June 21, 1788. The United States of America under the Constitution came into existence without a bloody revolution or civil war. And the Constitution provided a means to revision in Article V.
Every amendment to our Constitution was proposed by 2/3 of both houses of Congress. When there have been possibilities that 2/3 of state legislatures would propose an amendment Congress has pre-empted. Perhaps Congress, and the national government as a whole, feared a convention would completely alter our system of government, as did the Constitutional Convention. This is the fear we need to engender. If a convention is called, we will radically restore the limits of power on the national government to prevent its hegemony over the rights of individuals and the powers reserved to the states. We will radically alter its cash flow, and its ability to subvert the meaning of words for political gain.
Many think Congress will not acquiesce to our demands, but we have a legitimate Constitutional argument to force its hand. “Shall” is unequivocal. And if the progressives think it is not then the vast majority of laws passed in this country, including their precious socialized medicine, are illegitimate. Hell, the 1st Amendment would be absolutely useless if “shall” is not absolute, let alone every other limit on government regarding our rights. The Supreme Court cannot ignore this fact, and 2/3 of states petitioning the courts will not be ignored. Furthermore, Alexander Hamilton wrote in Federalist Paper 85:
“By the fifth article of the plan, the Congress will be obliged ‘on the application of the legislatures of two thirds of the States…to call a convention for proposing amendments’…The words of this article are peremptory. The Congress ‘shall call a convention.’ Nothing in this particular is left to the discretion of that body.” (emphasis added)
We should be ready to call for an Article V convention, regardless. This requires a focus not only on national politics, but state politics. A majority in Congress will help us avoid a conflict over Congress’s obligation to call a convention, but it is the state legislatures that must call for the convention. We need 34 states to call a convention. We need 38 states to ratify whatever comes out of that convention. It must be our goal to take back the state legislatures in as many states as possible. And we cannot forget that goal in our drive to replace Congress.
We should not even begin to consider other means by which we can bring the national government in line with our national will (though preparation never hurts). In fact, we do not necessarily need to call an Article V convention. The mere threat may suffice, at least in the short term. Perhaps an election is all we need. I am an optimist, but I am not a naïve optimist.
Over 200 years ago we had a crisis over a weak national government. Our Founders strengthened the national government, but entirely in terms of limitation to prevent Tyranny. Over the course of time, those limitations have been slowly eroded by false promises and naked power grabs.
We are not beyond the brink, but I see Tyranny raising its ugly head on the not too distant horizon. “Don’t tread on me” means nothing unless we are willing to use every tool at our disposal to stop Tyranny in its tracks. Article V is a fairly potent tool, and the one most suited to our times.

This is our only real hope. Legal challenges will fail. We will likely control the house and the senate in 2010 and will be able to sculpt bad into less bad – but it will still be bad. It might even be worse than bad if citizens continue to lose faith in the legitimacy in our form of government.
This is why I don't think repeal is realistic. Or at least it probably wont be till 2012 when the next presidential election is held.

HC reform would be a good thing. However this HC reform bill is a terrible conglmeration of sociaIist work. At best it will provide health care to some people at a cost to all. It is a violation of the constitution on several fronts… this alone is why we must fight it. If you think the only freedom you lost is "the freedom to pass the costs of your health care down to the persons with insurance and society", then you do not have a firm grasp on what this bill is all about. As more Americans are finding out what's in this bill, more Americans are against it. States are against it form day one. Corporations (that provide jobs) are loosing money. It has been confirmed that this is all about wealth redistributiona nd control of the people. You may not see it, but you are loosing your freedom and you are being enslaved.
The freedom we lost is to not pay for health insurance, either for ourselves, or for someone else through a fine. This is where you progressives get it wrong, people aren't against health care reform, they're against the government takeover of the health care system. What completely escapes me is how anyone could believe that this multi-trillion dollar entitlement program will reduce the deficit.
So, why not just use reconciliation to repeal the bill. That seems to be where the dems are now and will be passing major legislation that way from now on.
If the economy does for improve (unlikely under this administration) and the midterm elections turn out poorly for the Democrats (likely) I can see a scenario where the Democrats turn come around on this issue. In 2012 26 out of the 33 Senate races are held by Democrats and to save their seats will turn their back on President Obama.
It's sad that the current administration must abuse the Constitution the way it has in order to pass such bad legislation. Bill what Bill? Admendments, Lawsuits, lack of funding would make this Bogus Deal fade. Many sections of this Bill is Unconstitutional, i.e. the mandate for enrollment, which could be challenged in court or rejected by the individual states itself. This is not a Bill to insure everyone however, it's a Bill to redistribute the wealth which Hussein is all about!

While the federalist papers are not binding, they represent an expanded version of the thinking and reasoning behind the constitution. As such, they are the most important tool for interpretation of the constitution. The words of the constitution, as we have seen in history, can be misinterpreted as the meaning of words evolve. However, the federalist papers allow average voters to better understand the intended meaning of words and phrases in the constitution. In fact, the federalist papers were directed to the people residing in the 13 original colonies to build support for ratification of the constitution.
I've heard this proposal before, but before you think it's a good idea, consider this: There is no such thing as a "limited" Constitutional convention. If a Constitutional convention is called, ALL of the Constitution, the entire body, is up for revision. Do you really want Schumer, Feinstein, and the likes of them rewriting the Constitution? Just imagine what would happen. Guns? Gone. Homosexual rights? Present and accounted for. Granted, the states ratification would be dubious at best, but that's not a gamble I want to take.
I'll add we can't even count on the courts. Westboro verdict by the 4th district court as a prime example. A father, whose son gave his life for this country, is utterly insulted and fined. Has he not suffered enough? The courts to let us suffer.
Really. According to CNN, in 2009, 900,000 Americans filed bankruptcy as a result of health care expenses. I would say a visit to the ER was not responsible for most of these bankruptcies. Once again, the AMA endorsed the bill which contained significant cuts in the Medicare reimbursement rate because they realize they will not be writing off as much of their fees as they have in the past. Also, most of the doctors in the AMA are not ER docs.
Let me make this crystal clear. If the federal government can require a citizen to buy anything they can tell us to do anything they want in perpetuity. If the Supremem Court does not over turn this facet of this bill we are doomed.

In my opinion, a call by the States for a limited constitutional convention to propose an amendment for a national direct legislation would be a valuable approach to change the dictatorship of the political elites in our country. Article V does not restrict the option of calling for a constitutional convention for specific amendments. Once Congress were somehow forced to call it, then the thorny questions would "how would they be forced to call it? and Who would the delegates be?" In fact the Philadelphia convention was called for a specific purpose.

This is the rule in federal court. The loser pays the prevailing party's costs, not including attorneys' fees. See Federal Rule 54(d)(1). Sometimes this is inequitable, but it is the rule. Don't blame the court. By the way, it was the Fourth Circuit Court of Appeals, not the 4th district court.

You need to learn to sift the wheat from the chaff. When the Dems pulled those stats, they used all bankruptcies in the country with ANY medical bill in them at all. So, they could say that these bankruptcies were "related" to unpaid medical expenses. Sure, they were also related to unpaid credit cards, unpaid personal loans, unpaid mortgages, etc. A Fact check audit shows that 90% of those bankruptcies had nothing at all to do with medical expenses as their prime cause. Most of the medical bills were small unpaid clinic bills that had been sent months after treatment, for lab tests, x-rays, etc, and just ignored by the person, and had been on their accounts for years, the vast majority of them being well under $1,000 per bankruptcy claim.
Be careful what you wish for…. by demanding Congress hold a Constitutional Convention, you give Pelosi and Reid the power to radically alter our Constitution into something that will look nothing like the sacred document created by our principled founders. We have the power to restore the Constitution through the States. They can pass legislation to take back their power and push the Federal government back into their Constitutional box.
Article V is the only way to put congress back in its proper place, to undo what the progressives have done, and return this country to what is was always intended to be. We must do it. But what Amendment(s) would be passed is a very big question.
We should: 1) repeal Health Care; 2) repeal the 16th Amendment (replacing the IRS & IncomeTax with a Fair Tax – for many reasons); 3) repeal the 17th Amendment; and 4) establish term limits.
Honestly, we cannot be resigned to a bad system. If we can't get off our asses and take the steps necessary to preserve/restore our freedom, then we don't deserve it. The federal government must not be allowed to exceed its bounds, but be checked by the authority of the States, and the People.
Furthermore, it is perfect time to do away with the whole idea of an income tax which can be nothing but a cancer to our economy. It's stupid to tax income. But it is also a very effective means for Washington to control far more than they should ever be allowed. I think the FairTax can almost win the war against the progressive agenda as well as pulling us out of the Great Recession.

Can a constitutional expert answer the following please: can a bill passed via reconciliation be repealed via reconciliation? This is an important avenue to pursue, not because we wish to abuse the process like the Left but because their wretched handiwork should be undone by the same rules.
After repeal via reconciliation the Right should amend the rules to strengthen reconciliation and more narrowly define what can be done via reconciliation.

Obviously, you have never had a class in economics or business. All businesses pass the costs of their non-paying customers down to their paying customers. Hospitals are no different. So they pass down the costs of their deadbeats to the persons with insurance and the government. All 50 states have already submitted over 700 applications for an Article V Convention call, far in excess of the 34 applications required to cause Congress to call. Th applications can be read at http://www.foavc.org. The author states we should call a convention regardless. Obviously he was unaware of the public record of applications. He is entirely correct. Congress MUST call a convention regardless and cannot intervene by simply ignoring the Constitution. If you take time to read the FOAVC website and there is a lot to read, you'll discover Congress has refused to call for a long time. Either Congress is forced to call or we must accept the government is entirely out of control. This is unacceptable.
The average total of the medical bills in the study exceeded $19,000 per debtor. That means the amount written off was $18 billion. I guess that is chump change. Currently, the hospitals write off about 20% of their bills. Speaking from experience, approximately 1,000 children develop a brain tumor each year. Unfortunately, one of my sons was a statistic. His medical treatment will end up costing about $1 million when he is through. Assuming 35% of all Americans do not have insurance, the total for this group would be $350 million per year.
Defund the whole mess by attaching it to an appropriations bill and then hold on!! Folks are beginning to wake up, wait until your health insurance goes up, and up and up. This was sold as an affordable health care for all, not a give-away program to some and an additional tax burden for most.

You've got that right. Obama himself has said that this plan will coast an ADDITIONAL $60 Billion a year on top of what is spent now (which means it will be 10 times that). So under Obama-nomics rules it makes sense to spend $60+ billion to save $18 Billion. No wonder our economy will soon be in line with most 3rd world countries. They guy couldn't run a lemonade stand.
Starting after mid-term elections hopefully we can start the process of defunding Obamacare.
Thanks to congressional and Obama boneheadedness the economy isn't going to snap back in time to save him. I think a more weary, broke and anxious public will produce more doubters and interest into the lefty utopian socialist big schemes that will hold back permanent recovery.
Article V will require a significant "consensus" across a large swath of America. Josie makes a very good point, we must begin ourselves to find opportunities to serve and populate local municipal and state governments. The grassroots level is where America will be won or lost.

Yes this is the way!!! In addition, states can make it "popular" by campaigning that we're tired of letting the federal government take all the hard earned money OUT of our state. The state of "blank" need to help it's people FIRST. This was how our country was set up and succeeded very well. Time to abolish the income tax!!!

You couldn't be more wrong! Under Article V, Congress has to call the convention if 34 states call for it. That's it! End of story! It is up to the States, not Congress to decide how the convention will be run and who the representatives attending will be.
The whole purpose of this part of Article V is to give the States a check on an out of control Congress unwilling to control itself.

So you were a doctor, were you? Must not have been too successful if you're making more money driving a truck. I doubt many doctors will decide to get into some other line of work.

That the right considers this "socialized medicine" either shows how ignorant they are of what socialism actually is, or how deluded they have become about where the center actually lies in America's political spectrum. All this did was hand PRIVATE insurance companies 30 million new forced clients. And the idea came from Mitt Romney, originally. Plus, you get 100 million dollars MORE funding for abstinence/ignorance sex-ed than the Bush administration gave. Open your eyes and start being objective.
