Statement from James O’Keefe
by James O'KeefeThe government has now confirmed what has always been clear: No one tried to wiretap or bug Senator Landrieu’s office. Nor did we try to cut or shut down her phone lines. Reports to this effect over the past 48 hours are inaccurate and false.
As an investigative journalist, my goal is to expose corruption and lack of concern for citizens by government and other institutions, as I did last year when our investigations revealed the massive corruption and fraud perpetrated by ACORN. For decades, investigative journalists have used a variety of tactics to try to dig out and reveal the truth.
I learned from a number of sources that many of Senator Landrieu’s constituents were having trouble getting through to her office to tell her that they didn’t want her taking millions of federal dollars in exchange for her vote on the healthcare bill. When asked about this, Senator Landrieu’s explanation was that, “Our lines have been jammed for weeks.” I decided to investigate why a representative of the people would be out of touch with her constituents for “weeks” because her phones were broken. In investigating this matter, we decided to visit Senator Landrieu’s district office – the people’s office – to ask the staff if their phones were working.
On reflection, I could have used a different approach to this investigation, particularly given the sensitivities that people understandably have about security in a federal building. The sole intent of our investigation was to determine whether or not Senator Landrieu was purposely trying to avoid constituents who were calling to register their views to her as their Senator. We video taped the entire visit, the government has those tapes, and I’m eager for them to be released because they refute the false claims being repeated by much of the mainstream media.
It has been amazing to witness the journalistic malpractice committed by many of the organizations covering this story. MSNBC falsely claimed that I violated a non-existent “gag order.” The Associated Press incorrectly reported that I “broke in” to an office which is open to the public. The Washington Post has now had to print corrections in two stories on me. And these are just a few examples of inaccurate and false reporting. The public will judge whether reporters who can’t get their facts straight have the credibility to question my integrity as a journalist.

Frankly, it seemed patently absurd that a bunch of film guys would try amateur hour wiretapping. It's not television, people don't just dress up and sneak around with British driving caps on their heads and pull wires as doofus secretaries get sent off on coffee runs. But the trick is to get out of the gate first with a story that has elements that resonate with people. "Wtaergate" still evokes a Pavlovian reaction, that's what they wanted. The MSNBC approach is to quickly segue to implying all the ACORN work is now suspect. So, we know what the trick is for. Holder may not prosecute, but statute of limitations has a whiel before running out. Still vunerable.
The lying culture that exists in Washigntonand the media is so slick, it's hard for decent people to predict the angle of the attack and the quickness with which one lie is abandoned for a new one the moment it is perceived as not working.

Ok this is the thing, James did the right thing here just went about it in a wrong way however as a former Hill staffer I know that offices will turn off their phones or shut down all lines but two if the calls get to be too many. That Landrieu took that money and her constituents didn't want it and were calling so furiously her staff shut the phones down to a line or two doesn't surprise me. If they shut them off compeltely well…dioesn't shock me eitehr. Thats normal for a staff in times like this.

When you say massive fraud and corruption at ACORN, you must also be aware that ACORN's entire budget is less than one, one-hundredth the ten billion dollars that several independent investigations have determined that Halliburton and KBR defrauded US taxpayers during the Iraq War. Landrieu's office appears to have acted in nefarious ways since at least Thanksgiving. Believe it or not, her lack of "customer service" has caused other legislators to have to divert their attentions to taking widespread customer dissatisfaction throughout Louisiana.

Mr. O'Keefe's statement does not touch on why it required three of them in Sen. Landreau's office – and according to the FBI affadavit, two of them dressed as, and representing themselves as, telephone repairmen, requesting access to the telecom closet on the floor Sen. Landreau's office is on – nor the presence of the fourth individual outside waiting in a car, with (according to one source, not the FBI affadavit) a "listening device".
If Mr. O'Keefe's intention was to simply record video/audio of phones ringing and not being answered, he or any single individual could have easily done that with a video-capable cellphone, sitting quietly in the office waiting area.

I will be interested to know how or why the FBI was investigating O'Keefe in such a way as to arrest him on site and the person in a vehicle at some distance. Were they being trailed/watched on a regular basis? Was the FBI assigned to watch them in case they exposed something else harmful to the progressives? Who gave that order?
I will also be very curious about what the exact charge will be against them. Is there a law against walking into public Federal offices and asking questions about phones? Is there a law against misrepresenting yourself as working for a company you do not? What LAW was broken?

I am mostly curious as to how FBI got on the case so quickly and filed their paperwork (which also seemed to be jumping the gun. and fueling the media) Did the buildings security call the FBI immediately based on lack of creditials? Is they FBI watching you?

Each story out there has a brief introduction about James' ACORN notoriety. We get another news cycle that mentions this corrupt organization… Sparked by a real investigative journalist (team), but snowballed by the very people who would rather it just go away, this entire episode seems to have been executed by someone who knows the system, and has, like the pied piper, led the rats out into the open (again).

first of all, when I have a busy day at work and don't return a few calls, I tell clients my line's been 'jammed'. That's an accepted colloquialism for 'busy,' not 'broken.' Landrieu may in fact be a jerk and a bad congresswoman who doesn't pay attention to her constituents. But it's just silly to interpret her comment as suggesting she's claiming her line is broken.
Second, I donated $15 to your defense fund against those frivolous ACORN lawsuits, because I believed, and still believe, that you acted totally legally in that case and were on the right side of that issue. But I really don't want the $15 I donated for your civil defense against ACORN going towards your criminal defense in this matter, since I don't support you in this one. Can you assure me (and other folks that may have donated with the same point of view) that you won't fund your criminal defense with the donations solicited in this other matter?

The staff can always claim that there were so many calls that they could not get anything done in the normal office and they had to set up a special phone bank in another office, so there's a weakness to the suggestion that they video the staff not answering phones.

What James O'keefe stated as his intent here is something that is happening all over this country via great numbers of people in various ways.
On September 5th of last year, the people of CentralIllinois912project.com came together in what was called the In absentia town hall meeting. Dozens of people stepped to a podium and posed their statements and questions. That our elected officials refused to attend did not stop us from trying to engage them. This gathering was documented in DVD format and then delivered to the offices of Durbin, Burris, Schock, Hare and Shimkus.
We waited patiently for their responses. When none came, a letter signed by over a hundred people was sent to them, email and snail mail, reminding them that we are still waiting for their answers and that we would persist until we gained them.
Shimkus sent an email talking about how many town halls he has had and general positions, Burris sent a canned response that had nothing to do with what his office received, and Schock decided to hold a town hall meeting where he took all the questions people asked him . Durbin and Hare didn't respond at all.
This kind of happening supports why Ok'eefe went to the lengths he did. Elected officials all across this country are ignoring their constituents, hiding from them, and I thank O'keefe and everyone else who exposes that fraud for what it is.

The questions that we hear being asked of the ACORN employees were dubbed in after the fact. We don't know what the actual questions that the ACORN employees are responding to because he will not release any of the unedited tapes.
Also, O'Keefe never actually wore his juvenile "pimp" outfit in any of the ACORN offices—he simply recorded himself walking down the street in it and included it as part of the film for some dramatic flair.
That is not journalism—it's a hatchet job. And no doubt it is the same thing he was attempting to do to the Senator.
The reason he was hailed a hero after the ACORN hatchet job is because Republicans hate ACORN. And Republicans hate ACORN because ACORN signs up poor people to vote, and those people tend to vote Democrat. It's that simple.
No doubt, after the acclaim he got from the first illegal taping of ACORN, he was led to believe that any illegal activity was OK as long as it was targeted against Democrats.

Two things…. First if you're going to comment on an online forum, understand that IP address can be attached to your comment–which in some cases can tie a specific computer to that comment.
Second, I think an investigation into the practices performed by immigration offices nationwide would be quite interesting. I've heard stories of criminals who were let go free because they weren't U.S. citizens and because the arresting officer didn't want to file the paperwork. First hand, I've seen individuals submit false documentation to employers (fraud anyone) only to be told by local law enforcement that Border Patrol agents require 48 hour notice and local law enforcement can only hold them for 24 hours (again didn't I just turn someone in who committed identity theft and fraud?).
By going after acorn you undermined one of the democratic parties most illegitimate organizations, how about going after one that seems to be much larger? If these agents aren't doing their jobs why do they continue to get paid?

It's a federal building run by the GSA. You don't think they aren't a little touchy about security. Once these guys pretending to phone workers couldn't come up with phone company ID, the GSA folks were probably on the phone to the FBI. The FBI building is 20 min away. Have you read the FBI affidavit? Google it. The two guys posing as phone workers confessed and that's how they got O'Keefe and the guy in the car, Dai who then admitted to the FBI they were in on it.
The affidavit says they violated 3 laws.
1 entering a federal building under false pretenses
2 maliciously interfering with the communication system of the US Government
These would be against the two in hard hats. The other two would be charged with
3 aiding and abetting in #1 and 2 and they would get the same sentence.

That's the point, PAT. They're not answering the phones OR it gives a constant busy signal OR their voice mailbox is full and constituents can't even leave a message OR (as in my case here in Texas) the phone just riiings and riiiings and riiings; that's it. No answering service picks up, no nothing.
The only way to find out what the HELL is going on is to go to the office and either
a) hear the phones ringing and observing with your own eyes the aides ignoring them or
b) MOST LIKELY the ringers are turned off on the main lines given to the public, and the only way to see if the phones are ringing and not being answered would be to view (and videotape) the main phone switchboard with its lights blinking, but no ring being heard in the office. Hence, I imagine, Mr. O'Keefe's colleaques trying to get visual access to the phone closet. Clumsily, no doubt, but what do you expect them to do, explain in detail what they are doing and tip the aides off?

You are correct, I know my progressive (code word for communists) senator wouldn't answer their phones or respond respond to messages fax and e-mail. I went to one of their offices and they actually required that I fill out a form and fax it to their D.C. office because that is the only place they are willing to meet with citizens they are supposed to represent.

James, I would suggest a lot more due diligence on your part in several ways. First, develop a list of attorneys you can trust to brief you on the legal ramifications of any project you wish to initiate. Also, I don’t really think a “gotcha” expose was necessary in this case. I would have recommended an entrance with a camera out in the open, ask the question, and then let them step on their own tongues attempting an answer. Finally, research, research, research, is you best defense in any and all cases. Follow an old concept from military training. The best way to defeat an enemy is to know him better than he knows himself. The service you provide is way, way, too valuable for you to make any more mistakes out there.
