Khalid Sheikh Mohammed: Terror Trials in the Big Apple
by John M. O'HaraIt is a Friday and President Obama is abroad. What better time for the President and the Department of Justice to announce that 9/11 coordinator Khalid Sheikh Mohammed and some of his fellow terrorists will be tried in a civilian court in New York City?
Yesterday, I wrote about the curious connection that major Obama and ACORN supporter Bruce Ratner has to the Department of Justice – the very department that refuses to initiate a criminal trial of ACORN. It just so happens that Bruce Ratner’s brother, Michael Ratner, shares the terrorist coddling sympathies of Attorney General Eric Holder. As Michelle Malkin documents, Holder not only pushed for the pardoning of actual terrorists in his last stint at DOJ, but he was also a senior partner at a law firm representing detainees at Guantanamo. While Michael Ratner has not represented Khalid Sheikh Mohammed, he did represent a handful of terrorists and won them the right to challenge their detention in U.S. courts under habeas corpus. This is just one of many legal “victories” that have paved the way for folks like Khalid Sheikh Mohammed to be tried in civilian court on our soil.

This particular example highlights the underlying notion that terrorists should be privy to the same rights as United States citizens. In this instance, President Obama did in fact exercise his discretion (if you can call it that) by allowing the trial to take place in civilian court. Attorney Brian Levi serves as the Director of the Center for the Study of Hate and Extremism at California State University. As Levi noted today, “As a legal matter President Obama could very well also have tried these five detainees before military tribunals, as five others are…”
There is longstanding precedent for the use of military tribunals to deal with the difficult situation of unlawful combatants captured in a time of war. As Arthur Herman wrote in Commentary, this is the original path the Department of Justice and the Bush administration sought:
The rules on Gitmo detention and on interrogation constituted a valiant attempt to deal with an unprecedented legal situation. The same was true of the system of military “commissions” or tribunals for trying suspects at Gitmo. Here the Justice Department largely followed the precedent of tribunals used by the American military during World War II, and upheld by the U.S. Supreme Court in its 1942 decision Ex Parte Quirin.
As 9/11 victim relatives Debra Burlingame and Tim Sumner lay out in a letter and petition to President Obama, and as anyone who has watched an episode of Law and Order can surmise, there are a host of thorny issues that could arise in the civilian trial of an unlawful military combatant. These detainees weren’t Mirandized. Secondly, their extended detention, a defense attorney could claim, was in violation of the assurance of a swift and speedy trial. Furthermore, given that they were caught on a battlefield, the chain of evidence is not up to par with the (rightly) strict standards of our civilian courts. Could their cases be dismissed outright? These are legitimate legal concerns raised with these cases.
The actual threat to New York City that high value detainees bring is even more frightening. The security and logistics necessary to bring these people to New York and secure them there are both expensive and risky. If only we had a special place where we could keep these guys safely away from American cities and citizens, away from terrorist stunts to release them, and still give them three square Halal meals a day, a copy of the Koran, art classes and inter-cell block soccer leagues. Oh wait…we do, but the President is closing it.
I have the solution. Perhaps Bruce Ratner is willing to donate a portion of his real estate empire to house Khalid Sheikh Mohammed and his buddies in New York. Maybe he could come up with another eminent domain-stimulus-ACORN scheme where he doesn’t even have to pay as much for it or where he could even turn a profit? Now that’s a win-win-win!
In all seriousness, what’s a concerned citizen to do? As with any policy concern, you can call your elected officials to respectfully register your opinion. Then you can sign the petition headed for President Obama’s desk.

How does this play out: Maybe the answer is easy to find. Harold Koh was picked by this administration to be one of the top State Departments lawyers He was Dean at Yale Law school and you don't leave that job just to push papers at State Department. Harold Koh has written that Shari law can and should be used within the American Justice system in some cases. Koh also believes in Transnational Law.

Transnational Law also known as International criminal law is an autonomous branch of law which deals with international crimes and the courts and tribunals set up to adjudicate cases in which persons have incurred international criminal responsibility. It represents a significant departure from 'classical' international law which was mainly considered law created by states for the benefit of states, but tended to ignore the individual as a subject of the law.

Now that these idiots are going to come to New York, will the lawyers try to change the venue to a different city? They are enemy combatants. The Geneva Convention is designed to protect uniformed soldiers of a nation at war with another nation. It is designed to inject a civility in war (if that's possible) to keep it from becoming the brutally cruel and inhumane conflict devoid of respect for human rights that terrorists have made it. Non-uniformed enemy combatants under the Geneva Convention are treated as spies and subject to summary execution.

For millions of Americans the memories of 9/11 are fresh and easily tapped. It's like a fresh wound. One keeps scratching at it, because it itches. If you cannot find it in your heart to sympathize with the citizens of New York who will once again have to live in abject fear, fear of retaliation, then there is something really wrong with you.
I was nowhere near New York on 9/11, and yet every time I see an airplane flying low in the sky, I take note. My fellow citizens were brutally murdered on that fateful day, for no other reason except that they were Americans and infidels. The only other attack on US soil was December 7, 1941 – Pearl Harbor. And, at least on that day, the USA was involved in a declared war.
Please don't respond by telling me that the USA "deserved" 9/11. That would be the same as saying that a woman deserved to be beat just because. I am quite sick and tired of that old retort. And quite frankly, I refuse to debate that issue at this time.
The heart of the issue here is very simple – by trying these people in a United States civilian court, we are granting non-US citizens, US rights, and setting a VERY dangerous precedent.
I personally believe, if I can figure this out, without a legal degree, President Obama, who has a legal degree, certainly has. So, the question becomes, why would Obama authorize this action? (And, if you don't think it was Obama who made this decision, then do not bother replying to this post.) What, exactly, would he have to gain?
And, please don't give me platitudes about innocent until proven guilty. First of all it is "presumed" innocent until proven guilty. And, again, that is a right afforded to citizens of the USA. Keep in mind that although you are a citizen of the USA, that you do not carry your rights with you to foreign countries. When in a foreign country, you only have the rights afforded to you by that country. If you get into trouble in a foreign country, and can't make it to the US embassy before you are "detained", then, pretty much, you are screwed.
So in closing, I ask, what is the upside to trying these "enemy combatants", who by the way, have already admitted guilt and asked to be executed (presumably to gain their reward from Allah), as "civilian citizens"?
The Geneva Conventions apply in wars between two or more states. Article 5 of the GCIII states that the status of a detainee may be determined by a "competent tribunal."
"If civilians directly engage in hostilities, they are considered 'unlawful' or 'unprivileged' combatants or belligerents. They may be prosecuted under the domestic law of the detaining state for such action."

IOW, the U.S. is perfectly within its rights to declare terrorists enemy combatants, give them a military tribunal and execute the sentence. And them.

arby – you seem to be missing the salient point – these POS's are NOT citizens of the USA, and therefore do not have any of the rights afforded USA citizens by our Constitution. They do not have the right to due process. They do not have the right to be represented by an attorney paid for by us, the taxpayer.
At the very best they are enemy combatants. They are not citizens of another country, wearing another country's uniform, fighting a declared war. They are terrorists. They planned the attack that killed 3000+ Americans who were mostly on their way to work.
Do you have any idea what could be subpoenaed by this trial? Do you know that the undercover CIA agents involved in this case could be forced to testify, and therefore blow their cover? Do you understand that the defense will make this a trial about US foreign policy. Do you realize that this trial will be live-broadcast all over the world? This trial will make the OJ trial look like Saturday afternoon TV.
Do you understand that all it takes is one juror to result in a hung jury? All the defense needs is one juror who may be sympathetic, one juror who cannot convict if the death penalty is on the table. I have served jury duty on criminal cases before, and I can attest to the fact that the jury selection process leaves a lot to be desired. Throw in the political correctness mindset, and this is a recipe for disaster.
One last point, I am not willing to pay for these terrorists to live on death row for 20 or 30 years while I pay for some attorney to fight the conviction. What about you?

They never had status under the GC outside of Art. 3. They aren't soldiers of a nation, let alone one that signed the GC. The Military Commissions Act only formalized a process that was already recognized in the GC, that the victim nation has the right to deal with unlawful combatants under its own laws, not the articles of the GC.

Have you followed all of the cases? Are you aware that Bush, in Nov. 2001, issued a Military Order: Detention, Treatment, and Trial of Certain Non-Citizens in the War Against Terrorism?
Do you know why prisoners are held at the Guantanamo Bay Naval Base, Cuba?
There have been several cases, several differing opinions. There’s a litany of laws, including ones decades old, all coming together to create complications and quite frankly, when someone asks ridiculously simplistic questions like you, they only show how ignorant they are.
Even Supreme Court rulings have been very close (5-4) so excuse people who don’t view such complicated issues as simply as you do.

The economy struggles, the deficit is exploding, the dollar's going down for the count, job reports keep getting worse every month, unemployment is reaching epic proportions, the MSM is finally (though half-heartedly) starting to question the veracity of stimulus claims, health care is going on life support, cap and trade is DOA, Iran is taking foreign policy down in flames and Afghanistan is giving them an Excedrin headache morphine won't moderate.
This trial is going to suck the air out of the entire news cycle like a black hole. It'll be 24/7 coverage as long as it's in progress. It's the ultimate distraction to get agendas implemented under the radar while everyone is glued to the trial.

Foreigners, who are not residents of this nation, do NOT deserve the same kind of civilian trials that we give our own citizens and residents. We didn't haul in the planner of Pearl Harbor and put him on trial in the states! Neither did we how show trials for the captured Nazi higher ups on this soil.
For those who believe that this is a good thing, I want to know WHY that is. The reasons I've seen posted and heard some pundits say are ridiculous and make no sense at all……………unless one factors in the unsaid reasons; they want to use this to indite President Bush, VEEP Cheney, the CIA, and anyone else they hate !
What people need to understand and what Obama and his ilk don't give a damn about are :
1) Anyone who serves on this jury will be in mortal danger, as will the judge, the prosecuting lawyer, those in the audience, and everyone in the building this trial takes place in.
2) NYC will again be in the cross-hairs.
3) The population of NYC and probably those in the tri-state area will again be plunged back to the horrible memories of 9/11. This is a direct slap in the face to anyone who lived through that day; especially those who were injured themselves and/or their family and friends.
4) What happens if this POS gets off? And that truly is a possibility, with Obama and his gang running things !
5) If he just gets a slap on the wrist sentence ( being imprisoned ), he will be a MARTYR. Filth WILL try to get him out, help him get messages out ( anyone else remember what went on with Lynn Stuart and the BLIND SHEIK ? ), and he can recruit other inmates for al Qaeda. Putting him in solitary confinement will be seen, by some, as "torture" !

My guess as to why Obama is putting these characters on trial is threefold. He wants to give stimulus money to trial lawyers, He wants to provide a forum from which to promote "my Muslim faith", and He wants to use it as a ruse from which he can prosecute Bush and Cheney. I predict a five year circus culminating in civil war in which Chris Matthews loses a leg.
Let’s see, I do have a spare nickel, and will bet that before the end of these trials we have another Terrorist Attack. This will (if made public) be tied to the trials of these idiots in Public Courts.

We are upset about this because we are now doing something that has NEVER been done before. By bringing them to New York we are giving these people who killed 3,000 innocent people in an act of war. The one terrorist we did catch on US soil, spent 4 years to get convicted. This was the missing 911 terrorist. This is a Military matter and should have been tried under a Military Tribunal.
This is going to be a circus that will replace the OJ trial as the center of the news life. I think that it is a major mistake to bring these people to the US.
