Wisconsin Votes Today: What a State Supreme Court Election Means for Obama’s Re-election Chances
by John NolteFirst off, if you live in Wisconsin and haven’t yet voted to re-elect State Supreme Court Justice David Prosser, stop reading this and go vote. Secondly, if you know anyone in Wisconsin and haven’t yet called and urged them to vote for Prosser, stop reading this and go do so now. Put simply, this race is going to come down to who gets their base out and if we lose this one, we’ve not only lost hope for any kind of real reform in Wisconsin, we’ve also given Barack Obama an easier path to re-election in 2012.
Those of you under the misguided notion, that even in the event of a Prosser loss, his 4-to-3 tie-breaking swing vote in favor of judicial restraint will remain on the court long enough to validate Governor Walker’s Budget Repair Bill, had better think again. The Madison judge, Dane County Circuit Judge Maryann Sumi, who has pulled every judicial activist trick in the book to block Walker’s bill on an absurd technicality, has no doubt intentionally decided to run out the clock in the hopes liberal activist Joanne Kloppenburg succeeds in unseating Prosser. Sumi’s delayed her next ruling for nearly two months. This allows her to hold on to the case until the end of May or the beginning of June. Prosser’s term would end July 31, which make it very possible the State’s highest court won’t rule until long afterwards.
See how that works?
This isn’t an accident or coincidence. It’s by design. Delaying the enactment of a law over a technicality regarding an Open Meetings rule no serious person thinks was violated, is one thing. Throwing a wrench in the gears in order to slow down the process in the hopes a more favorable appeals court judge will win an election, is something else. The will of the people is being overturned by the worst kind of judicial overreach my former home state has seen in a long time — which brings me to the bigger picture.
This entire battle is about one thing and, believe it or not, it has nothing to do with “collective bargaining“. The unions don’t care about collective bargaining as much as they care about the money and power that comes in the form of union dues. Right now, if you’re a Wisconsin public employee, union membership is mandatory and the dues you pay — that average around $800 a year — are automatically garnished from your paycheck and funneled directly to the union. Walker’s bill puts an end to both of those obnoxious practices.
Though the bill’s dishonest opponents and their media minions have framed the debate around the concept of ”workers’ rights,” one right Walker gives public workers is the right to NOT join the union. Furthermore, instead of the state collecting dues from those who choose to join, the union will now have to collect dues all on their own. This racket – and that’s exactly what it is — that forces workers into the union, is not only the well spring of union power in Wisconsin, it is also a central source of political power for Democrats, including Obama, in a must-win swing state. Millions of dollars in dues help to pay for the union machine’s crucial get-out-the-vote activities and their massive campaign ad blitzes.
The numbers that terrify Democrats and unions come from states where laws similar to Walker’s have passed that put an end to both compulsory public union membership and the automatic garnishment of dues:
Union officials recognize what can happen if dues payments become voluntary. Robert Chanin, who was general counsel of the National Education Association from 1968 to 2009, said in a U.S. District Court oral argument in 1978 that “it is well-recognized that if you take away the mechanism of payroll deduction, you won’t collect a penny from these people, and it has nothing to do with voluntary or involuntary. I think it has to do with the nature of the beast, and the beasts who are our teachers . . . simply don’t come up with the money regardless of the purpose.”
There is evidence to back up his fears. In 2001, Utah made the collection of payments to union political funds optional, and nearly 95% of public school teachers opted not to pay. In 2005, Indiana GOP Gov. Mitch Daniels limited collective-bargaining rights for public employees, and today only 5% of state employees pay union dues.
A mere 50% drop in union dues would be a terrible blow to Wisconsin unions and the Democrats they support. 95% will all but put their racket out of business. Furthermore, it’s very difficult to see Obama’s path to re-election victory should a powerful union machine be unable to bring Wisconsin over to his win column.
Wisconsin Democrats, with the help of the White House, are playing chess here and have been since they fled the state.
Unless we get out our vote in Wisconsin, this election could very well be checkmate.

These unions MUST be controlled by something other than union bosses, that are only concerned about the bottom line…THEIR money!!! They are getting TOO MUCH power, for NOTHING!!!
Get it RIGHT, Wisconsin …get it right. ROCK the BOAT with your VOTE !!! No activist Judges.
Time for Unions, Democrats and Obama to GO AWAY PERMANENTLY!
Dues "automatically garnished from your paycheck and funneled directly to the union." More and more states are trying to undo this 'tidy' little package deal and make the Union Thugs collect the dues on their own dime. Is the way to go and would save some tax dollars as well.
cut tax, states control
raise wage, people cash
For all you Wisconsin voters. Go VOTE! Polls should be open by now. Show the union thugs that SEIU and NEA have shipped in that you WON'T be intimidated!
What the unions have with mandatory membership and automatic payroll deduction of dues is really nothing more than legalized extortion. Come on WI, strike a blow for real freedom and make sure that this judge doesn't get a seat and that the taxpayers of WI and the rest of the country take back the power that rightly belongs to them.
And what's the name that we should have been reading about if today's election is so important? It is Reince Priebus.
You remember him. He's the guy that replaced Michael Steele at the RNC. He was also the Chairman of the Republican Party of Wisconsin during the 2010 election. He was also credited with the large get-out-the-vote effort that helped to sweep the Republicans to victory in Wisconsin.
So why haven't we heard a thing from him throughout this democrat debacle? Why isn't he involved in the ground game for this election? Or is he working behind the scenes? I have no idea. But if this election goes wrong, I'm going to take that as a sign of things to come from the RNC in 2012.
to put todays election in perspective, in the civil war ,union solders from the north fought against slavery, today OBAMAS UNION ARMIES FROM THE NORTH,are fighting to keep taxpayers IN slavery,if they win its a slippery slope,OBAMA GETS RE-ELECTED,CONTINUEING LOOTING OF TAXPAYERS,and rewarding his union armies, and followers, while milking taxpayers as revenge?
Unions are fleecing America and need to be stopped.
The voting laws in Wisconsin need to be changed.
When you can register and vote on the same day as an election you are only asking for fraud.
Just think of acorn and its sister seiu.
Sorry about the thumbs down! I broke my wrist Friday and am trying to learn to type with one hand! I am left handed and broke my left wrist!
The unions won't give up, they need to be starved to death.
Corrected your error with a thumb up. If you live in Wisconsin get someone to fill in the ballot for you. Hehe
Get well soon.
Today we will see if we are either,……
just all talk or,………
finally all action.
sense not u make

He did not want egg in his face,…..
first time out of the box there Johnny.
I don't what it is about good Republicans when they go national, because,…
they sure seem to turn into wimps when they get to the top.
It really shows us how important we look at every detail that makes up our country. For far too long we really have not paid attention to who gets these judgeship's….. it has given us liberal judges who vote from their opinion, or from laws in other lands instead of looking at our constitution and other prevailing laws.
well if Possner wins in a landslide then we know he's capable of doing a good job of organizing the party nationally. If he doesn't win then that means we're doomed in 2012 and the country is dead.

Congratulations. This represents a new low in journalistic standards even for this site. Every judicial activist trick in the book? Really. HMMMM. Let's see. I do believe the Wisconsin Appellate Court recommended the Wisconsin Supreme Court take the appeal because there was a split in the court decisions regarding the open meetings law. http://www.jsonline.com/news/statepolitics/118594... So the lower courts decision was not some made up ruling similar to holding the Commerce Clause does not apply to inactivity. Say, I have a question for you. Do you think persons who lack insurance ever cross state lines and become sick or injured? Because if they do, doesn't their "inactivity" have very active consequences? And wouldn't some of these consequences include stiffing the doctors and hospitals who provide medical care for their decision? Now that is an activist judge.
Wisconsin this is how big this election is.
If Possner doesn't win and by a landslide than Obama wins in 2012 and the country is destroyed! Do you want your country to be destroyed?

Ummm, this isn't MMfA or HuffPo…
What about voter fraud? I hope there are cautionary measures in place. Maybe everyone should vote late so as they don't know how many votes they need to win at closing…There has to be something that we can do to keep them guessing to the end…don't forget to get photos of the buses busing in the people. May GOD's favor and blessing be with State Supreme Court Justice David Prosser and the "People" of Wisconsin. Go Wisconsin!!!!
maybe you should post pictures.
Well, I'm not quite ready to throw him under the bus just yet. Like I said, I have no idea what he's doing right now. Is he too busy working on a national strategy for 2012 to get involved? Is he involved behind the scenes? ?????
I was hoping someone here had spotted him in the news somewhere. What I do remember is he made it clear he wasn't going to do the Michael Steele thing, being the high-profile "face" of the RNC. But the question remains, what IS he doing? Inquiring minds want to know.
i wonder what your point would sound like if you made it in english
You know, Wisconsin was nowhere on my radar in 2010, and yet somehow they managed to switch that "progressive" State to Conservative, almost Tea Party Republican. That's no small deed.
So how did they do it, unless they had some serious "boots on the ground" to get out the vote? I have to think the political machinery is still in place since November. So it's a test of the Republican Party AND the Tea Party, as to whether we have the staying power to make it to 2012.
My wife and I watch the news on a daily basis and,…….
just the other day, she asked me the name of the person who replaced M. Steele and,….
I, for the life of me, could not remember it.
Reince may not be ready to be thrown under the bus yet, but,…….
he sure as hell ain't driving it.
<DIV>Sorry to hear that, rckmom. Don't worry about it. I'm certain that I've also received some thumbs-down from people who really MEAN it.</DIV> <DIV style=”FONT-FAMILY: arial, helvetica, sans-serif; FONT-SIZE: 12pt”> <DIV style=”FONT-FAMILY: times new roman, new york, times, serif; FONT-SIZE: 12pt”>
I hope the good people of Wis vote for Prosser and take their cell phones with cameras on them.
And I hope they pay attention to make sure there is no foul play by the union thugs.
excellent point there Stan.
Though this vote is important, it’s not the end of the world either way. This is a long game, and the union outburst has exposed this practice of the state withholding and paying union dues is now out there, another wonderful object study for 2012, and the ever popular “judicial activism.” If we find the right candidate, I predict a landslide ala Reagan – Carter for the conservative candidate. Be cool, if you’re in Wisconsin, “GET YOU’RE A$$ OUT AND VOTE!” Regardless of the outcome we are still only at the very beginning of the restoration of the republic.
Every time you discuss Wisconsin there Bo,………
ya talk about everything but the main issue so,………
let me ask you point blank,………
what is it,….?????
Oh, it is in english. The problem you have is you do not like the truth. I have another question for you. Has the Wisconsin Supreme Court ruled on the original appeal? I will help you out. The answer is no. I wonder why? Do you think it has anything to do with the election?
The left likes to tell us that it was a poor democratic turnout in Wisconsin that lead to the republican turn over.
Fact is conservatives and independents came out in such numbers that the cheating democrats couldn't make up the windfall. (600,000 voted in the republican primary while only 220,000 voted in the democratic primary)
Walker only won by 125,000 votes out of 2,000,000.
Rest assured however that the same voters who watched the thug tactics of the MOB mentality Unions will be in the voting both today and their not worried about having to place posters in their bedroom windows.
Most of those warm bodies in the assembly were shipped in astroturf and all they really did was piss off allot of Wisconsin voters who will be showing their displeasure today.
Could I suggest a current best seller by John Grisham, The Appeal. It shows just how easy it is to change the world with money and elections.
Do not be to hard on him, he is merely the product of the Wisconsin school system.
For a minute I thought it was some progressive haiku.
Cut taxes, people make jobs.
Raise wages, unions say more.
Be a progressive, make no sense
Where WI leads, other states will follow. There are quite a few states watching to see the outcome today.
And you know Obama will have his Acorn type people at the polls. These sick people will be digging up corpses in the graveyard to make sure they vote for the Union. We have a Community Agitator in the White House. If the Union wins this, we will be run by the Mob and Obama for years to come.
Yeah we don't want a recount, because Democrats always seem to manufacture more boxes of votes every time! Take pictures, and take License plate numbers of those who bring in more voters ballots. You know the Union will have a bunch appear in the last minute via some guy name Vinny who just happens to work for the SEIU.
From what I've read, Preibus wasn't really "known" by anyone outside of the Party apparatus in Wisconsin. His "strength" was said to be as an administrator, working in the background on the local levels.
So if that's true, I wouldn't expect him to be doing the Steele thing; showing up on all the talk shows, setting up the big parties and showboating.
So I still have some hope that he's operating in the shadows. And my big test for that will be how today's vote goes.
great point.
I would expect a comment like that coming from a communist.
You are one sick little phuck…
LOL
I'm on my way out the door to vote for him now phool.
I don't know what a Progressive is. I'm not into wheel chair politics.

Guber-ment jobs
We’re talking about government employees, most of whom —
when they show up to work at all — sit in comfortable, air-conditioned offices,
kick off at 3 p.m., are entitled to endless sick days,
personal days and holidays,
whose performance can never be evaluated and who retire at age 50.
(Again, I’m not focusing just on Barack Obama here.)
Government employees are even worse than welfare layabouts.
In a triple-whammy for the taxpayer, they are:
(1) hideously expensive,
(2) impossible to fire, and
(3) doing things you don’t want done at any price.
Hey, guess what?
I’m from the government, and I can burn down your garage for $300!
NO! I’M NOT INTERESTED!
OK, fine, I’ll do it for you for $20.
BUT I DON’T WANT MY GARAGE BURNED DOWN AT ANY PRICE!
OK, the guys with the matches and gasoline will
be by sometime between 10 a.m. and 5 p.m. one day next week.
Make Jesus smile…. Punch a Communist.
Wisconsin, here is your best chance to take a side and protect your future and your childrens' future. Vote for control of your lives by public sector unions or keep control yourselves. Which will it be? America is watching!
You asked that stupid question a few weeks ago. I asked you to tell me what is inactive health care as opposed to active health care. You didn't answer then, you won't answer now. I reject the premise of your question as it is not a real life proposition. Thinking people, unlike Union Drones tools, can think for themselves.
Is the uninsured that way due to personal choice? Is the uninsured that way due to being illegally in America? Is the uninsured that way due to stupid laws that do not allow carriers to provide across state lines? Is the uninsured that way due to the meddling of liberal activists judges who implement public policy from the bench instead of applying the law?
Hmm… you actually think life is a bumper sticker slogan you learned from your organizer @ the union shop. Drone.
Now Ralph, the first part of my post was about Wisconsin. The second part was in reply to the author's statement regarding activist judges.
You can bet your bottom dollar the Sheep will turn out en mass and vote the leftist candidate into office.
The right is unprepared to counter this action and will lose the judgeship.
The good union worker sheep will do as they are told and hit the polls in numbers…
I will gladly respond. Let's say you have a heart attack and are rushed to the ER. I bet you will be able to tell the difference between "inactive" health care and "active" health care. Unfortunately for you, your "personal choice" regarding health insurance does not simply affect you. Now let's assume when you have that heart attack and you are rushed to the ER, no one can find your wallet. As a result, they do not know who you are and whether or not you have insurance. What is the medical staff suppose to do? Leave you in the hallway until they confirm whether you have insurance? Or better yet, let's assume they confirm you do not have insurance, are they required to determine whether you have the ability to pay? What if you have the ability to pay for 1/2 of the care? Do they give you 1/2 of a by-pass? I simply can not believe a health insurance mandate which at one time was proposed and supported by the Heritage Foundation is now being fought tooth and nail by the conservatives, including the Heritage Foundation. So much for individual responsibility.
It boils down to one basic question: Will the taxpayers of Wisconsin willfully and knowingly do what their counterparts in Illinois did, and vote themselves a tax increase? That is the endgame here. The chain of events through the Wisconsin legislature and its courts will lead to either a tax increase because Prosser is defeated, or reform because he was reelected and therefore upholds that reform. As amazing as it may be, "feeling good" by voting liberal is worth paying for in some states….(keep in mind that federal bailouts was and is part of the long term plan). Wisconsin voters will get the government and the tax rates that they ultimately deserve.
The Wisconsin legislature can and should IMPEACH the circuit judge SUMI.
It is that simple.
At the very least this lib lemming Maryann Sumi. She is a lemming of the worst kind. One with actual power and notice how it is abused.
Fool you have made of yourself… Sense you do not make… Lemming you must be….
Me three…
Thanks for the well wishes! I live in Florida, but will fight for the WI rights!!
Good column. Wisconsin is pivotal.
ANY emergency room that has a code in thier midst will stabilize the patient no matter what type of insurance they have. They are not going to leave you to die in the hallway. If an illegal immigrant can walk into a hospital and receive medical care most certainly an American citizen can and will receive the same care afforded the illegal. Scare tactics and halftruths do not do America one bit of good. What is the illegal individuals responsibility? None. Medical ethics requires us to save the patient first and worry about money later.
Nolte just nails it!!!! Please vote today if you live in Wisconsin….if you know people who live there call them & make sure they vote….this is the first shot for 2012…email info@justiceprosser.com for in home GOTV calling….just do it please:)
You aren't into making sense, either.
A post by mwade is a post without reason
Government health care at its best …… http://www.dailymail.co.uk/news/article-1371861/N...
Must be a slow day at Huff-Ho.
BO, it's a known fact, the RAT side of the Wisconsin senate purposely left the state to duck a vote. By doing so, they forfeited their right to participate in the legislative voting process. Government can't come to halt if one side fails to act. The RATS are sorrily standing on weak terra firma.
Good grief you're dense.
Why do you keep repeating this over and over and over? I hammered you on it a few weeks back when I pointed out that the federal government MANDATES care regardless of a person's ability to pay. It's called the Emergency Medical Treatment and Active Labor Act (EMTALA).
If you're so concerned about this, fight for the repeal of that law — the law that forces doctors and hospitals to treat people who can't pay. You make absolutely no sense because you keep omitting the inconvenient fact that this problem you're so worried about is caused by the federal government.
I thought you turds on the left hated Jesus. Truely rich. Use him when you need him and spit in his face when you don't. That's a self serving, self centered democrat for you.
Progressive self help tool: http://i56.tinypic.com/nch3ph.jpg Your pull will really count!
The only issue is whether or not they want to hear the case. That is it for now and they have not issued a ruling one way or the other. Not a tough call, now is it?
Oh, no I am not dense. My example shows the reasons why this law is enforced. If the law was changed and you can not prove you have insurance and you do, what is the hospital suppose to do? Take an educated guess? HMMM. Not very appealing if they guess wrong, now is it?
So if the government mandates that everyone carry insurance, this problem will simply go away — much in the same way that prohibitions on drug use have forced people to stop buying illegal drugs.
Keep piling law on top of law and you'll eventually find yourself a criminal of some sort.
Under the current system, when an uninsured person requires medical care and can not pay, the government picks up part of their tab because hospitals and doctors do what every good business does, they pass down this cost to their paying customers. So under the plan, if you have income over a certain level and elect to play Russian roulette with your health insurance, at least you will pay a tax for the privilege.
The Unions & other leftists have sent millions here to defeat Prosser. They have used victims in adds when the victim objected. It has been one of the nastiest campaigns I ever have witnessed here in Wisconsin.
This election will NOT end the work of the 70 plus Tea Party & affiliates that have sprung up in this State in the last 2.5 years.
Yes I voted, Yes I took others to the polls & yes I phone banked aleardy today.
You forgot to add: for cliff watch out you must!
While you claim to not be into wheel chair politics, your posts give the appearance of a progressive (aka marxist, et.al.) politician's drivel.
I know your twisted little progressive gray mass is having difficulty, but It doesn't matter….
How about, on purpose, they just weren't there? When ANYBODY purposely fails to show up for an important function, like to cast a vote, they're out. There's NO legal defense.
Now you are completely in the RIGHT!
Hope the wrist heals quickly so you can continue with both hands in the fight.
Sure respond, but never an answer. A response is merely repeating your bumper sticker talking points. An answer is to admit that there is no such thing as inactive health insurance. It's a straw man you invented and then act surprised when we don't chase our tails around. It's like the left, re labels everything to suit their pre fabricated argument. Like, Bush = bad warmonger
Obama = good warmonger. "Kinetic" who the hell you kidding.
Bush's debtr = bad debt
Obama's debt = good debt.
What a bunch of friggin morons. every last one og you were told that Obama was a marxist, a liar and a hack, yet you voted for the idiot in chief and now you have to make up crap to defend him. Like "inactive" health insurance. Or Kinetic intervention in Libya. Not every one watches MSNBC huckster.

How do you respond to Republican members that are against healthcare reform? #defaultBy Dr. L. Toni Lewis
Jacqueline, a member in California, wrote in with a question many of us have had.
Q: How do you respond to Republican members that are against healthcare reform?
A: Republican, Democrat, Independent, Green Party – it really doesn't matter what political party you are affiliated with when it comes to having questions about the healthcare law (aka. The Affordable Care Act). And one of the things that makes SEIU an incredibly powerful and politically effective union is the diversity of our membership. As of the last presidential election, there were 300,000 SEIU members registered as Republican voters.
(continued):
Think about the present reality: with one in two Americans not fully understanding the benefits and key insurance protections of the law, it is fair to say that everyone responsible for making the law work – including members of Congress and Governors — needs to do a better job sharing the facts about the law, not wasting time and patients' lives trying to delay it or undermine it.
With each conversation I have about the Affordable Care Act, I am constantly reminded that healthcare is deeply personal. If our friends and colleagues are challenging the law or flat out against it, chances are it might be driven by:
a) Misinformation or myths about the law.
(continued):
Sharing the facts about the law can go a long way in challenging the kind of rigid, "party of no" posture that Republican members of Congress have adopted because they want to defund or repeal it. Here's another good place to start.
b) A desire to make something in the law better or stronger or work faster. The law presents an incredibly strong foundation, a foundation built upon the private insurance market (as I constantly remind Republican friends) but we can always decide to work together to improve and strengthen it.
(continued):
As union members, one of the best things we can do is provide our friends and neighbors with the facts about the healthcare law. As for improving it, we know there is always room to make things better, but there is no room for moving backward. And for the millions of Americans already getting help from the law, this is doubly true. Ask your fellow members if they know someone who has benefited from the law. Now, ask them to envision a world where that the Affordable Care Act was never passed. Without the law, what would that person do?
Whether Republican or Democrat, we simply can't afford to go back to a healthcare system where our country spends nearly $2.4 trillion each year and has worse outcomes than our industrialized counterparts, where insurance companies make all the rules, and where there are more than 46 million uninsured patients relying on emergency rooms for their healthcare. We can and must do better. The Affordable Care Act makes "better" possible.
If they screw this one up, let them swirl into the toilet bowl of history where they deserve to be. its the parasites that will parish first when the bottom falls out.. at least the producers will have an easier time rebuilding it.
I see. The problem you have is the Democrats who left are not the ones who brought the suit. Nice try though.
Problem is, you don't see. So who, why, and which side filed a lawsuit….BO Diddle???:
Judge Sumi's War on Wisconsin Republicans
By Peter Raymond
"As Wisconsin voters vote today on a state supreme court election that could shift the balance of power to liberals, it is worthwhile reviewing the judicial moves which led to the contentious restraining order against the newly passed law governing public employee unions.
Last week, Dane County Circuit Court Judge Maryann Sumi heard arguments over several days, concluding on Friday, concerning possible violations of the Open Meetings Law by Republican lawmakers who voted on a budgetary repair bill limiting collective bargaining for public education employees."

should just be taken out for a ride in the country ,the whole family,to give them a fresh perspective on life??
Wonder if the mid America commies can depress the citizens enough to prevent the election of this good man?
I have a question
Are union dues pre=tax dollars ?
It was brought by a county attorney alleging violations in the open meeting law. The lawsuit was not brought by the Democratic legislators.
That would be Jesus Alou, right?
You don't know any other Jesus. But Satan loves you.
You mean the lawsuit was brought by a democrat county attorney. The RAT legislators have no case, and I believe the county doesn't either….but nevertheless, It's all.a stall to get a state supreme court justice replaced, to keep the law from going into affect.
agreed….nice avatar BTW…..
I just pulled up the news and they said right now it's 50-50. You know what happens in close elections. The dems cheat. They find "lost" votes (e.g. Al Franken) and the leftist candidate wins. I hope Wisconsin does the right thing.
If Prosser doesn't win, call for a challenge of Certification of every single vote; especially the absentee votes and the "write-in" votes. Match every signiture with every SS Number. Throw out any discrepancies such as dead people whose SS numbers are usually distributed by the Dems to their lackeys.
