They were charged with “misdemeanor” violations for smashing a black man on the cement and calling him n*****.
The Post Dispatch just broke the news:
Six people arrested in August outside a raucous town hall meeting in south St. Louis County have been charged with misdemeanor ordinance violations.
The six, including a Post-Dispatch reporter, had attended a demonstration outside an Aug. 6 forum called by U.S. Rep. Russ Carnahan, D-St. Louis, at Bernard Middle School in Mehlville to discuss health care reform.
The charges were filed Tuesday by the St. Louis County counselor’s office, which prosecutes misdemeanor ordinance violations in unincorporated areas. All are to appear in court Jan. 21.
The maximum penalty upon conviction would be one year in jail and a $1,000 fine.
Some bloggers have been writing for months about the lag between the arrests at the politically-charged event and the filing of charges.
County Counselor Patricia Redington insisted it had nothing to do with politics, influence or pressure from any official.
“These charges are like the 90,000 other charges we file each year,” she said.
Post-Dispatch reporter Jake Wagman, 30, of University City, was charged with interfering with a police officer. The charges allege that he failed to obey repeated commands “to leave the site of an ongoing disturbance.”
Elston McCowan, 47, of St. Louis, and Perry Molens, 50, of De Soto, each were charged with assaulting a person and interfering with police. They are accused of scuffling with and injuring Kenneth Gladney, a demonstrator with the Tea Party, a group generally opposed to Democrats’ universal health care proposals.
By the way… Gladney was not a protester. He was selling merchandise at the event.

Hey Patrick O'Connell — Maybe your own paper should have been covering this terrible injustice and how the DA has been dragging his feet, and put a little pressure on him like some of us did! I agree. It took them that long to find an obscure violation to charge them with. So knocking the crap out of someone is the same as blowing up someone's mailbox with a cherry bomb or knocking over their garbage can? I couldn't agree with you more. We all need to watch to make sure there are no shananigans. I've gone to court a few times where the verdict did not make any sense or a bench warrant was quashed. We need to make sure a million spotlights are shining on this case.

I'm very curious on how they treat this case in court. I haven't had any luck in our court system. I was hit by a drunk driver at a stop light and the DA tried to get rid of me on 3 different occasions. The third court date, he did it again and the judge thanked me for being their each time. WHAT? Why was everyone trying to get me to leave before the case was called? Lets do Mr Gladney a huge favor and make sure his case is watched by everyone!

What are the chances of any convictions here? Unless Mr Gladney can get some top flight legal help and airtight witnesses you can see this ending in a 'no contest' with a small fine (paid by SEIU of course) with 'time served' as penalty and then the espunging of the records can take place so the next time they do it (and they will- it's what they DO) there'll be no priors.

The American legal system has never been about justice.It's always been about money and power.The only people who think that the United States has the best legal system in the world is lawyers and any one who has made money in a law suit.

CC – Depending on the state Assault is the actual touching someone to intentionally inflict physical injury. In some other states that defines Battery where Assault is the threat, or in NY State that would be harassment.
In New York there are degrees of Assault, 3, 2, and 1. Three being a misdemeanor whereas the deft. Intended to cause physical injury – whether or not the deft did or didn't that’s the charge. Assault 2 is where the deft intended to cause serious physical injury and added in is if the deft used a foreign object, such as a bat – in other states that’s Aggravated Battery. Assault 1, well that’s basically a plea bargain for attempted murder – felony obviously. Hope that helped!

It’s only a hate crime if a protected minority is attacked. Minority status, or true hatred is besides the point. This innocent black man, Mr. Kenneth Gladney, who was attacked as he sold merchandise to conservative Americans is not seen as a victimized liberal African American; as such, he is SOL on the special protections that liberal African Americans would be guaranteed to receive under even less violent similar circumstance. Also note, his attackers are not charged with stiff charges, not lambasted by all forms of media on a nightly basis. They have not languished in jail, but rather they walk free, uncharged for several months. All people are created equal, but some are more equal than others.

If his attorney(s) don't elevated this to a hate crime, then they are in SEIU's pocket. Buying attorneys is the "Chicago Way".
Usually it is a misdemeanor except in aggravating circumstances such as the status of the victim (spouse, law enforcement, etc), the presence or use of superior numbers or deadly weapons, and so forth.
This incident clearly warrants felony charges, 'hate crimes' prosecution and federal civil rights investigation into the SEIU's organizational role in this beating, including its later statements and actions re McCowan and Molens.
Another liberal refusal to protect the civil rights of the 'wrong' minorities. This is indistinguishable from the Jim Crow era where public officials openly terrorized blacks with impunity.

Kenneth Gladney and his attorneys should file a large civil law suit against the people who beat him and the SEIU for large amounts of money. This is the way the back was broken against the KKK and the amount of the payment successfully sued for was more that the KKK could afford to pay.

For those of you that are locals though, I would protest to the State Attorney General or even the local Feds to have the charges elevated to hate crimes since they were yelling slurs while they were wailing on him. The FBI defines terrorism as:

Since the union thugs sole purpose (here and all across the country) was to intimidate or coerce, by force if need be, a segment of the population in furtherance of a political objective, SEIU is by definition a domestic terrorist organization. FYI, Redington's numbers don't add up. Almost every misdemeanor arrest from the week of August 3 has been adjudicated (118). The open cases appear to be all felonies. More remarkable is the fact that it took over 3 months to file charges in a case where STLCO Police were the witnesses and suspects were arrested on the spot.

I just smell an opportunist here. Watch the video, the man is walking around without any discernible injuries, he was not bleeding and did not appear to have any swelling ( And I have seen plenty of people after a fight that looked many times worse than this guy did. He was walking around just fine, he was animated, he was conscious, he did not seem to be seriously injured. His medical records from that night's hospital visit would show how serious his injuries are/were. If he file a civil suit, the discovery process will bring them to light.
That is not to say the SEIU guys had any business even crumpling a hair on his head, or touching him in any manner, let alone like that. But he changed his story too much. Above is a link from a guy saying "This is Ken Gladney's account of events" but I saw the video, he clearly, and twice says he was "Trying to sell my flags" yet in his speech to the tea party express he gave 30 times he claims he offered the flag for free. One, it was not his merchandies to be giving away, he was selling them, not that important except for the fact that Ken Gladney's story seems to change a lot, cross examination with someone like that would be a barrel of fun.

I was watching Glen Beck today and Michael was agreeing with Glen about the way our government is dragging their feet on charging those men from SEIU for kicking that black man in the head, and body, calling him the N word and getting away with it, so far! They should be charged with bodly harm and calling this man a terrible word. What is wrong with this picture? It seems as though the government who is in control right now doesn’t care about this black man who was just selling some merchandise to make a living. I’m glad I wasn’t there because I probably would have barged into these bullies and given them a good kick, or sock where it hurts, and I’m a 68 hear old grandmother.
