Wisconsin Senate Republicans Did Not Violate the Open Meetings Law
by Joel GriffithOn March 7, the Wisconsin Senate passed a bill reforming the public sector union bargaining process. For weeks, the Senate remained at an impasse on the issue as absent Senate Democrats denied the quorum required to move forward. By redrafting the bill to exclude certain fiscal items, a 2/3 quorum was no longer required to vote on the legislation. The Senate promptly approved the bill 18-1.
After passage of the bill by the Senate, the Joint Committee of Conference then received the bill. This committee’s responsibility is to make changes to similar pieces of legislation passed in both the Senate and House. Once these changes are approved by the Joint Committee of Conference, the legislation is then submitted for approval by the legislative chambers. For a bill to be submitted to the governor for his signature — and thereby enacted into law– the language in the bill passed by the Senate and the House must be identical. In this case, the Joint Committee of Conference approved the language of the bill passed by the Senate verbatim, submitting this to the House for Approval.
Typically, consideration of legislation by this committee for the mark-up process takes weeks. However, the committee completed its work on this public sector union bill just hours after posting notice of its upcoming meeting.
Much criticism has been levied at the Wisconsin Republicans for the actions of the Joint Committee Meeting. In a dramatic outburst, Representative Peter Barca proclaimed, “This is a violation of the Open Meetings Law!” What does the law say? The portion which the Democrats claim is being violated is Wisconsin Open Meetings Law, in particular §19.84 of the statute.
§19.84 (1) Public notice of all meetings of a governmental body shall be given in the following manner:….(2) Every public notice of a meeting of a governmental body shall set forth the time, date, place and subject matter of the meeting, including that intended for consideration at any contemplated closed session, in such form as is reasonably likely to apprise members of the public and the news media thereof. The public notice of a meeting of a governmental body may provide for a period of public comment, during which the body may receive information from members of the public.(3) Public notice of every meeting of a governmental body shall be given at least 24 hours prior to the commencement of such meeting unless for good cause such notice is impossible or impractical, in which case shorter notice may be given, but in no case may the notice be provided less than 2 hours in advance of the meeting.”
At first glance, it appears that due to the lack of a 24 hours notice to the public, the Joint Committee of Conference violated the Wisconsin Open Meetings Law. However, there is much more to this statute. We must also take into consideration §19.87 regarding the notice required by legislative meetings.
§19.87(2) No provision of this subchapter which conflicts with a rule of the senate or assembly or joint rule of the legislature shall apply to a meeting conducted in compliance with such rule.
Is there is a rule senate or assembly or joint rule which qualifies for this exception to the general Wisconsin Open Meetings Law notice requirements? To determine this, we simply need to take a look at the Wisconsin rules for the legislature.
Joint Rule 27. Committee hearings open to public. Unless otherwise provided by law, every committee hearing, executive session, or other meeting shall be open to the public. If time permits, advance notice of every regularly scheduled committee hearing, executive session, or other meeting shall be published as provided in joint rule 75.
Since this was not a regularly scheduled meeting, Joint Rule 75 does not apply. Joint Rule 27 requires only that such a non-regularly scheduled meeting be open to the public, without proscribing a time requirement.
In addition, the Senate Rules clearly agree with this analysis.
(2) A notice of a committee meeting is not required other than posting on the legislative bulletin board, and a bulletin of committee hearings may not be published.
Senate Rule 93 (3)
(3) The daily calendar is in effect immediately upon posting on the legislative bulletin boards. The calendar need not be distributed.
The Senate clerk indeed posted notice of this committee online. The Senate rules require no notice of a committee meeting besides such a posting on the legislative bulletin board. This requirement is far less than the 24 hour notice guidelines specified §19.84 (1) of the Open Meetings Law. However, we saw in §19.87(2) of the same statute, that a senate, assembly, or joint rule does in fact trump this much more stringent notice requirement!
Accusations that the Wisconsin Republicans violated this law are incongruent with reality, distort the law, and qualify as demagoguery.

School boards and local governments across Wisconsin are rushing to reach agreements with unions before a new law takes effect and erases their ability to collectively bargain over nearly all issues other than minimal salary increases.
The law doesn't go into effect until the day after Secretary of State Doug La Follette publishes it and it doesn't supersede contracts already in place, fueling unions' desire to reach new deals quickly. La Follette said Monday that he will delay publication until the latest day possible, March 25, to give local governments as much time as possible to reach agreements.
Republican Gov. Scott Walker had asked La Follette to publish the law Monday, but the Democratic secretary of state said he didn't see any emergency that warranted him doing so. La Follette opposed the bill and said he sat in his office watching parts of a weekend protest that brought as many as 100,000 people out in opposition to the law.
"This is the biggest change in Wisconsin labor management history in 50 years," La Follette said, describing his reasoning for holding off on its enactment.
The law ends collective bargaining for public workers over everything except salary increases no greater than inflation. It also forces state workers to make benefit concessions that amount to an 8 percent pay cut on average.
Walker also is proposing a nearly $1 billion cut in aid to schools in his two-year budget plan that would take effect in July. He argued that for that reason, districts needed to get more money from their employees to help mitigate the loss in aid. Walker also wants to limit the ability of schools and local governments to pay for the cuts through local property tax increases.
The Wisconsin Association of School Boards is telling districts to be cautious about approving contracts that will make it more difficult for them to handle the cuts in aid Walker is seeking. Since Walker unveiled the bill on Feb. 11, between 50 and 100 of the state's 424 districts have approved deals with unions, said Bob Butler, an attorney with the association.
The vast majority of them included benefit concessions consistent with what Walker proposed under the new law, Butler said.
The Madison school board met in a marathon 18-hour session Friday night to reach an agreement with the local teachers union to approve a new contract that runs through mid-2013.
That agreement freezes wages and requires the same pension contribution as state workers will be required to pay starting later this month under the new law. It also allows the district to require health insurance premium contributions up to 5 percent in the first year of the deal and up to 10 percent in the second year.
The Racine school district voted to approve a new contract with its teachers union on Wednesday evening, as Walker's collective bargaining proposal was being approved by the state Senate. Several local governments, including the city of Janesville and La Crosse County, also have pushed through contracts in the past month ahead of the new law.
Schools and local governments would be foolish to rush through deals that don't account for concessions at the same level or greater than what is called for under the law, said Republican Rep. Robin Vos, co-chairman of the Legislature's budget committee.
If they don't get the concessions, then they can't complain about the difficulty of dealing with cuts, Vos said.
"Ultimately they're the ones who are going to have to deal with the ramifications," he said. "I can't imagine they're going to be able to talk out of both sides of their mouth."
If districts lock in deals with unions that don't have concessions to help make up for the aid cuts, that could force them into making "mass layoffs," said Walker's spokesman Cullen Werwie.
Eliminating collective bargaining, except over salary, puts both local teachers unions and the school districts in unchartered territory as they try to figure out how to work with one another without the previous structure, said Mary Bell, president of the statewide teachers' union that fought unsuccessfully to stop the bill.
"This bill creates chaos and that doesn't benefit anyone," Bell said. "There's a great deal of anxiety, as you might expect."
La Follette said he heard from many schools, cities and counties urging him to delay enactment of the law as long as possible. Waiting the full 10 days afforded under the law is his office's usual practice anyhow, La Follette said.

Any judge hearing such a suit would also be bound to consider the inevitable counter-argument that the extremely short notice and such tight security would have been unnecessary were it not for National Socialist Democrats' efforts to thwart the legitimate conduct of business in the Wisconsin Legislature at every turn. How would such evidence get into the record? You need to stop thinking about government in terms of bigger or smaller. No one wants a big government just for the sake of being big. We just want goverent to work to achieve certain goals like safety and clean air. Both of these things cost money and have important benefits that are difficult to quantify monetarily. Businesses benefit many people by providing goods services and employment, but they also utilize many public services and therefore have a responsibility to the public to not threaten safety And the environment. If you disagree with how that balance has been struck that's perfectly reasonable, but always framing the debate as the size of government means you always advocate for fewer rules. Clearly fewer rules is not better in all cases so why not advocate for better rules instead. Then we can make progress towards common goals rather than constantly argue polemic that doesnt account for the complexities of the real world.

As for nuclear power, of course it has to be well regulated, since it can be exremely dangerous. Safety regulations, building codes, etc. are necessary.
In my opinion there's been too much heavy-handed regulation which has done more harm than good. Other people could find places where more regulation would be beneficial. Overall it's a matter of 'quality' not 'quantity', and that requires constant evaluation and adjustment, and there hasn't been enough of that. More science, less politics and emotion.

The State Employees and their union is a monopoly. That's the crux of the situation. They have no competition, ok; so that's why I label them as a monopoly and how can we negotiate with a monopoly? We can't
The workers have no choice over which Health Insurance to use. They are foreced to use WEA Trust insurance company. This company is Owned By The Union and they earn a huge profit with their arrangement.
I have not yet proven the following statistics, ok:
The WEA Trust charges the State about $28,000 per year for the family plan, health insurance.
Blue Cross/Blue Shield charges about $13,000 per year for the same thing…WEA Trust is literally gouging everybody, and might be a RICO Offense!

This is all very amusing, that is, watching Dumbocrats and their Unionistas. They scream from the mountaintops that this isn't fair, they had no time to debate, they had no input, etc….
No time for debate? They didn't know? Come on… Why did they leave the state? They leave for 3 weeks BECAUSE they don't want to have ANY vote on legislation, which they obviously have knowledge of, otherwise how would they know they were for or against it, and they claim they have no time.
Dumbocrats had their 3 WEEKS to debate this and possibly put in their two cents. I think Republicans would have been willing to work with Dumbocrats on at least some things, granted, not the overall purpose of the bill, but they gave that up by acting like a bunch of Spoiled children who lock themselves in their room when they have a temper tantrum.

I actually lost my house because I got very, very sick with Pancreas and digestive problems which caused me to lose 100 lbs. And live in total agony. I could not work o matter how I tried to struggle through, and I Lost my house. The unions, Dumbocrats and even Jesse "the J-off" Jackson say they want to destroy your family and take away your house…. Yeah, by what essentially amounts to a 9% pay decrease because you have to pay an whole extra 5% of your retirement and a whopping 12% of what is undoubtedly the best healthcare money can buy… Besides that of politicians, unionists and Jesse Jackson types that "represent" and "support" them.
They're destroying workers rights? Afraid of the working conditions of 100 years ago? How stupid are these people? Like we would go back and remove child labor laws, or maternity leave. Elections have consequences, and the last election, whether you like it or not, was an historic, ENORMOUS win for Republicans, Conservatives and Tea Partiers. What does that mean? It means the American people WANT them tondo what they say, NOT what Dumbocrats want. It's that simple. We won, Dumbs lost. It's not bragging or power grabbing, it's what elections are for.
The American people saw Dumbocrats spending trillions of dollars on garbage we don't want, so we voted them out and replaced them with people that actually use their brains.

Newbie here. Wondered if anyone has heard whether there may be some angst or waivering on the part of three Rep senators due to intimidation or whatever, and that is the reason why there has been no move toward a revote. Anyone with details?
