Big PhRMA Payoff: Hidden Tax on Pedialyte, Prenatal Vitamins, and Pain Relievers
by John BerlauIf you want to see how Obamacare will hit you and your family in the wallet, look no further than the inside of your medicine cabinet. Open the cabinet door and you may see an antihistamine such as Claritin for allergies, pain relief medicine such as Tylenol or Excedrin, Pedialyte to prevent your kids from becoming dehydrated when they are sick, and prenatal vitamins if you and your spouse are expecting another one.

All of these items in your cabinet have two things in common. One is that they are classified as “over the counter” (OTC) medicines and available without a doctor’s prescription. The other is that if you pay for any of these items with money in your flexible spending account (FSA) or health savings account (HSA) – and according to this guide from FSA administrator Benesyst , all of these are eligible expenses — you will face an effective tax increase of up to 40 percent on these items in the health care bill that passed the U.S. House of Representatives and is poised to pass the U.S. Senate.
Both bills restrict individuals with these pre-tax accounts to buying a “medicine or drug only if such medicine or drug is a prescribed” one. And ironically, this tax that will raise health care costs substantially by creating incentives for the use of more expensive prescription drugs even when OTC drugs are just as safe and effective.
Both FSAs and HSAs allow Americans to pay for medical expenses with pretax dollars. An HSA goes along with a high-deductible insurance policy and gives individuals a tax deduction for money saved that can be used for health care expenses. An FSA has similar tax advantages, but contributions to it are deducted from an employee’s salary, and money in the account must be used by the end of the year.
In 2003, the Treasury Department and the Internal Revenue Service ruled that OTC medicines could be paid for by FSAs and the newly enacted HSAs. In a press release that sounded unusually compassionate for the IRS, the agency stated:
Drugs are increasingly becoming available over-the-counter without prescription. Many health plans no longer cover the cost of these drugs as over-the-counter. While an over-the-counter drug is less expensive than the prescription drug, the cost to many consumers increases because the price paid by the consumer for the over-the-counter drug is greater than the co-payment by the consumer when the drug was covered by insurance. This is especially an issue for individuals who remedy chronic health problems by regularly taking an over-the-counter medicine.
Then-Treasury Secretary John Snow added in the release, “Since many prescription drugs have moved to the over-the-counter market, this action today makes paying for them a little bit easier to swallow.”
Specifically, the government ruled that since the tax code written by Congress did not specifically require that “only medicines or drugs that require a physician’s prescription be taken into account” for health expenses, OTC medicines were eligible. The ruling made clear that although health accounts could not purchase items for general health such as toothpaste, they could be used for medicines that treat specific conditions, such as an “antacid, allergy medicine, pain reliever and cold medicine.” Companies that administer FSAs and HSAs have developed extensive lists of a variety of OTC items that are covered. The Benesyst guide fills two pages with an alphabetical list of eligible expenses that includes everything from analgesics to wound care.
But Section 9004 of the pending Senate bill and Section 531 of the House bill that passed in November changes the tax code so that “distribution for medicine” from HSAs and FSAs are “qualified only if for prescribed drug or insulin.” Yes, the bills are merciful enough to allow diabetics to purchase insulin under these tax plans, but if you or your family members need Pedialyte, prenatal vitamins or numerous other over the counter health items, you will see a tax hike that could be huge.
Since HSAs and FSA contributions are exempt from both income taxes and 15.3 percent payroll tax for Social Security and Medicare, and since these together can reach more than 40 percent of an employee’s salary, the effective tax increase on these medicines could be more than 40 percent.
And this tax change will almost certainly cost the health care system billions more dollars in unnecessary spending both to the government and private insurance plans. The Joint Committee on Taxation estimates that the tax hike will bring in $5 billion in revenues over ten years – itself a drop in the bucket when compared to the bill’s new trillion-dollar entitlement – but that estimate doesn’t take into account behavioral changes as a direct result of this provision.
OTC drugs are much cheaper those available for prescription, but they could now be more expensive to individual consumers given that prescription drugs would still be eligible for favored treatment in the tax plans, and that insurance companies would be mandated to cover many of them. Consequently, any time a consumer has the slightest headache, the financial incentive would often be to see a doctor and get a prescription rather than go to the store and get medicine off the shelf.
This could mean that billions will be wasted on the additional costs for prescription drugs in instances when OTC medicines could be just as safe and effective at treating the illness. A 2005 study in the American Journal of Managed Care found that the Food and Drug Administration’s clearing of antihistamines such as loratadine (Claritin) for over-the-counter sale saves about $4 billion a year in health care costs. Ironically, the liberals and Democrats who normally rail against big pharmaceutical companies are now creating a huge windfall the firms that make expensive prescription drugs by penalizing users of OTC medicines.
The rallying cry for opponents of Obamacare has been “Hands off my health care.” In addition, they now could say, “Hands off my medicine cabinet.”

My company provided plan increased my out of pocket costs 100% last year. Now I can't even save money by going OTC.
Big pharma and the government have been in bed together a long time. Most of the FDA executives are former executives at pharmaceutical companies and vice versa, and they all still have their employee stock shares. It's exactly why some drugs get approval and others don't. They even want us to stop taking natural vitamins, because the pharmaceutical companies can't patent them and drive the costs up. Natural cures are they're enemy. So they've been trying to make them illegal for years now. It's the FDA and the pharma companies that make drugs expensive in the U.S. They even tell doctors what drugs to prescribe. I actually heard my doctor ask her nurse recently, "What is it they want us to advise now instead of Robitussin? That new mucous thing?" And the nurse responded with, "Yes, they want Musinex to be the one we use now."
They get a new drug approved, and we're all steered into using it whether we really need it or not.

I calculated what this change and the possible reduction of the max FSA contribution down to 2500 from 5200. Right now there is no upper limit it is at a companies discretion. My company allows 5200 dollars a year if I reduce my contribution to 2500 this will cost me an extra 1000 dollars in taxes.

Your description of healthcare providers being told what to prescribe by drug companies is misleading especially when most hospital/clinic formularies are restricted for cost effectiveness. Insurance companies insist on less expensive generics and have restricted formularies.
It's always the doctor's ultimate decision on what to prescribe. There is nothing wrong with a drug company educating practitioners on the merits of their products.

I just heard that there is a provision in the bill on page 1090 that would make it illegal for future Congresses to repeal the bill. If this is true, we'll be stuck with it even if it isn't working. Anyone know anything about this?

A lot of healthcare systems are cracking down on this behavior, to the point where doctors are forbidden to accept any gifts from drug reps. But there are still a lot of organizations that allow this bribery to happen.

If I can't save money on health care by choosing to use my money wisely, can someone please tell me how health care costs are going to come down?
I am not surprised by this, Dems. have been looking to kill FSAs and HSAs since their inception. Even the elements we have now with all of the CDHP solutions were watered down to make them less effective than originally planned.
The truth of the matter is that they don't want people to be empowered to make healthcare decisions for themselves. In their eyes, an informed consumer is a dangerous person.
The courtesans of Capitol Hill have all sold themselves to the insurance companies, pharmaceutical manufacturers, lawyers, financiers, and the other special interest groups. This current "perfect storm" of a socialist/statist controlled congress and executive branch is merely following the direction received from their controllers. Somewhat scary times … hopefully cooler heads will prevail in November 2010.

For disclosure sake I will admit that I have a HSA so there is a slight bias on my part. But then again that bias only exists because I have seen how effective they are at reducing cost and promoting savings. In only a few years I have managed to accumulate a very nice savings that is capable of paying my co-payments and out of pocket expenses for several years. While they may not be right for everyone they are perfect for the 18-30 age groups largely comprised of uninsured people called the "invincibles" (IE: Those who choose not to buy healthcare becuase they do not fully comprehend their mortality and may not believe they will get sick) .
If youger people and the "invincibles" were placed into HSA they would have the catastrophic coverage they need today while being allowed to save money for their later years in life when they will most likely develop some major illness or disease. It is my opinion that if these programs were expanded and the deliberate obstacles removed we could implement a solution today that would eliminate the need for yound people today to need Medicare in the future.
So let's socialize Big Pharma, Nathan?

The Weekly Standard reports that Senator Roland Burris (D-IL) had language added to the Senate Manager’s Amendment that could provide ACORN federal health care funds.
The Weekly Standard reports: “According to a Senate legislative aide, the scandal-plagued Association of Community Organizations for Reform Now could qualify for grants under this provision. I work in healthcare too, and I've seen physicians who took the bribes and laughed it up all the way to the five-star lunch that the drug rep provided, and I've seen physicians who take the free samples and give those to the patient in lieu of writing a hundred dollar prescription.
I never suggested we socialize anything–that was you. I merely implied that bribery is bad–in all its forms. I salute those organizations that forbid their physicians from accepting bribes.
Money should go to research and development and national ad campaigns–not ski trips to the Rockies and lobster dinners for one provider at a time.

With my own eyes, I've seen providers get taken out to lunch at nice restaurants. This was at several clinics owned by a large healthcare organization in western Nevada.
Conversely, at a clinic outside NYC, I saw a pharm rep attempt to bribe a physician. The physician responded by saying: "You know the rules. If you do that again, I'm not going to let you back in my clinic."

As an employer who provides an HSA account which covers the deductible on the health insurance plan we provide – this just ticks me off. Our people, mostly young and healthy really like the HSA plan, which accumulates and carries over year to year and goes with them if they leave. Our company does not have to monitor the use – and our employees have been able to use it for vision and dental that is not covered by their insurance. I can't wait to see what other "surprises" the government has in store to undermine freedom of choice.

Why is it that democrats don't understand that increasing taxes on medicine is the exact opposite of creating affordable health care. It will do nothing but discourage people from acting at the 1st sign of illness & studies have shown that people who do so end up getting sicker & spending more on health care. In addition companies so affected would experience lower profits & would be forced to increase rates to compensate.

Funny, I haven't met any of them- Plenty of Dems are still behind him because they can see a picture bigger then their own living room.
I have 3 kids up to age 15, we have NEVER needed Pedialyte- and yes, we have been through all the dreaded viruses- (coming out all ends- bleck- but you're a mom, you know). This OTC "drug" is mostly a scam where regular water will do just fine. I checked with the pediatrician every time- NEVER was it suggested even when I specifically asked about it. Read about it, you'll find it mostly un- needed. If we were to cut down the amount of unnecessary OTC drugs we take (like Pedialyte) I doubt the cost everyone is raging about is actually as big as they think. We are already an over-medicated country.

Live healthy folks and you won't even need this stuff, OTC or otherwise. I have worked in schools for 16 years- heaven for germs- proper hygiene, good eating, exercise- usually enough. When it's not, I have gone to the drug store- but my insurance has only once paid for OTC items. This was always out of pocket for me.
Of course, all of you dumba$$es fail to see the fact that not everyone currently has plans that pay for OTC drugs. This is the problem with Health care Reform in the present version. It mandates insurance for people that could not afford it in the first place and instead of trying to control cost they make decisions like this that make you wonder if they are even paying attention to what they vote for.
Mindy, you are right to say that water is generally the preferable means of re-hydration, but my wife (who is a health care professional) would point out to you that the NORM for a large number of Moms is that they are too busy to be 100% on top of their kids' health – or their own, for that matter – and it is sadly commonplace for kids to have vitamin deficiencies and caffeined-beverage induced dehydration. Particularly young mothers.
So, Pedialyte serves a useful purpose.

You act like giving free samples and free meals away is a bad thing. When I sell tomatoes at the farmers market, and I give someone a free tomato to try, is that a bribe? No, it's just business. And I have had doctors give me lots of the samples of drugs. Saved me a lot of money.
The samples are great. I applaud that, and that is good business. But when you sell tomatoes at the farmer's market, you don't take your potential customers on week-long trips to Hawaii, then charge $45 a tomato.
All I'm saying is that bribes are an expense that can be cut with little or no repurcussions to the pharmaceutical company. That cost savings can then be passed on to the consumer. That $10 pill (that you need 30 of) then becomes a $5 pill. Inevetibly, it will still be prohibitively expensive for some patients, but there's no denying that it's an improvement.

OTC medicines are what keeps the privatized drugs expensive. That and the FDA, and the rest of the worlds food and drug certification programs and departments. OTC requires fewer inspections and are less stringent with the regulations. If the tylenol scare had not occurred, it would be even more relaxed for OTC meds. What the governement sees though, is the cash cow that OTC meds will contribute to offset the taxpayer cost. What is not made open or transparent by the government hacks is that this will also be set upon the consumer not as a healthcare premium which will be sky high, but a supplemental tax at the register. Much like that triple sales tax on gasoline. BOHICA

Haven't you heard of the law of unintended consequences? 40 % of Drs polled said they would seriously consider getting out of their profession if the medical bill went through. Probably that many won’t quit though I believe many will. Look at the doctors that no longer handle Medicare & Medicaid. My mom is a senior. She and her friends are finding it harder & harder to find dr’s that will take new patients in those plans because of the difficulty of dealing with the government and getting their payments.
This WILL cause some people to see doctors instead because they can not afford over the counter meds. This means LONGER wait times to see a doctor. Especially since now we are going to add 30 MILLLION people that can now go and see a doctor and driving doctors OUT of the profession.
SO this means the cost to the government will rise, and the wait time for you to get into to see a doctor will be MUCH longer. Look at the Canadian system if you don't believe me.
And right after that the doctor instructed the rep to hold a meeting in the hotel down the street to show off his line. That way the food could be catered, the doors could be closed and the deals could be done privately. Just like business is supposed to be done.
