Federal Court: No, the Government May Not Prevent Further Discovery of the Takeover of AIG
by Frank GaffneyThis week we broke the story of possible criminal wrongdoing in the government takeover of insurance giant AIG. In the last several months, the US government has tried, unsuccessfully, to throw out plaintiff Kevin Murray’s case, alleging that the government’s takeover of AIG puts it in the position of supporting and promoting Islam and Shariah finance.
In the discovery process attorneys for Murray, David Yerushalmi and Robert Muise (of the Thomas More Law Center), discovered that the takeover itself may have been illegal, and have attempted to get Treasury Secretary under oath to try and untangle this mess. Again, the Fed and the Treasury Department tried to stonewall.
This past Tuesday, Federal district court judge Lawrence P. Zatkoff rejected the Treasury Department’s and the Fed’s effort to prevent any further discovery while the government attempts to convince the Sixth Circuit Court of Appeals to overrule Judge Zatkoff’s earlier ruling rejecting the government’s motion to dismiss the federal lawsuit challenging the government’s takeover of AIG on First Amendment-Establishment Clause grounds.

Tim Geithner: The “extraordinary move to depose a sitting Treasury Secretary”
The lawsuit, captioned Murray v. Geithner et al., was brought by attorneys David Yerushalmi and Robert Muise, representing the plaintiff, Kevin Murray, a tax payer and former combat Marine who served in Iraq. The federal lawsuit alleges that the U.S. government’s takeover and financial bailout of AIG was in violation of the Establishment Clause of the First Amendment.
Specifically, at the time of the government bailout (September-December 2008), AIG was (and still is) the world leader in promoting Shariah-compliant insurance products. Shariah is Islamic law, and it is the identical legal doctrine that demands capital punishment for apostasy and blasphemy and provides the legal and political mandates for global jihad followed religiously by the world’s Muslim terrorists. By propping up AIG with tax payer funds, the U.S. government is directly and indirectly promoting Islam and, more troubling, Shariah.
After the court rejected the government’s motion to dismiss the case and granted Plaintiff’s attorneys until May 2010 to conduct discovery into the AIG takeover, the government filed a motion asking Judge Zatkoff to certify the case for immediate appeal of his denial of the motion and to stay all further discovery. Today the government got its answer: No and no.
In what is an extremely well-written opinion, Judge Zatkoff scolded the government lawyers for filing the wrong motion at the wrong time and then proceeded to tell them they would have lost in any event because his earlier denial of the motion to dismiss was proper and well-considered.
The Court’s recent decision is especially timely and critical for Plaintiff Kevin Murray because his attorneys had previously filed a motion to compel Secretary Timothy Geithner to sit for a three-hour deposition. The basis for the “extraordinary move to depose a sitting Treasury Secretary” arose because Plaintiff’s counsel had earlier deposed the witnesses provided by the Treasury Department and the Federal Reserve Board and the government witnesses either testified inaccurately or feigned ignorance. The only one with all the answers turns out to be Secretary Geithner.
While forcing high government officials to sit for a deposition in civil litigation is extraordinary, federal rules allow a court to take this step when the government official has personal knowledge of a relevant element of the litigation and where the moving party has no reasonable alternative. In this case, attorneys Yerushalmi and Muise argued in their court papers that this exception fits their circumstances in spades.
“The witness designated by the government to testify on behalf of the Fed was less than forthright in his sworn testimony,” Plaintiff’s counsel Robert Muise of the Thomas More Law Center explained. “To his credit, he admitted he had prepared for his deposition by reading media reports and not actually reviewing the relevant documents. That might suggest that his lack of candor was willful blindness.”
David Yerushalmi, who is co-counsel with Robert Muise, laid out the grounds for the motion:
At the time of the takeover decision, Secretary Geithner was the head of the Federal Reserve Bank of New York and he was the leading advocate of the AIG takeover. Moreover, he designed how the U.S. government would not only bail out AIG with tax payer dollars, but how the government would illegally take control of 80% of the voting shares through what was patently an illegal and invalid trust arrangement. It is apparent from the discovery we’ve conducted to date that this was done purposefully and with an intent to conceal the illegal takeover with a fraudulent trust.
Attorneys Yerushalmi and Muise want to ask Secretary Geithner:
- Why he forced AIG to take on so much debt that AIG’s credit rating, already in peril, was sure to collapse without yet additional government funds, essentially guaranteeing AIG would remain a ward of the state?
- Why he imposed such Draconian terms on AIG that there was no way it could survive without additional billions from U.S. tax payers?
- Why he then used AIG to secretly funnel 100% payoffs to AIG’s counterparties, including his colleagues and friends at Goldman Sachs, Merrill Lynch, and the European giant, Société Générale. In other words, why did Geithner decide to destroy AIG’s chances of survival as a private entity while surreptitiously saving and preserving private ownership of other domestic and foreign financial companies? And,
- Why he took control of 80% of AIG’s voting shares without legal authority to do so and used a fraudulent trust arrangement to conceal the illegal takeover?
Breaking News: The court just today granted plaintiff Murray’s motion for leave to amend the complaint to include yet additional TARP funds provided to AIG after the filing of the complaint. While the court did not allow the plaintiff to add AIG as a defendant as he had also requested, Murray’s attorneys tell us that they had accomplished enough discovery to know where to look for the skeletons in AIG’s closet in any event.

This will become one of the most important cases in the last 50 years. Bravo to the Federal Court that stood up against an out of control leftwing federal govt that's behaving like a crime syndicate. Ultimately this case will prove radical abuse of power and criminality. Those involved should face prison time.
Great topic. The New York AG is trying to shakedown Bank of America. Snatch some money. They of course devoted a lot of energy to take out AIG over the years and run off the leader. This is a distraction.
AIG needs to be exposed. The movement of money to cover BNP Paribas and other partners has never been brought out.

I love this! This is the kind of writing that Americans need so that we may understand what's going on at the corrupt cabal in Washington. Obama can plead that "we all get along" in the hope to suppress the truth being illuminated, but with smart people going after the corruption, the courts allowing access to not only the criminals but their records, and reporting like this the country will return to freedom and prosperity.

I am just afraid that it will make it to the Supreme Court and they will say it has no merit just as they did in the takeover of GM and Chrysler. For our system to work the courts have to do their part or we are doomed to fail. If the courts enforce the law and the constitution we have got a fighting chance of getting out of this mess.

May this case go forward unimpeded and the perpetrators be brought to justice and SOON. The
corruption being revealed in this Administration is beyond belief, and we are only seeing the tip

I think that Glenn Beck will have something on this next week. I believe the hesitation is to give the lawyers enough time to gather definitive evidence of all the wrong doing. Quite possibly there is more to this than an illegal trust. Not only that, I can imagine all kinds of scenarios where this could involve other people all the way from boardrooms to the White House. Keep in mind that Tim was not well vetted, right along with the rest of the Obama appointments. Everyone quit looking once his tax issues were exposed. Geithner is far from a fall guy. He is much more into the good ole boy network in New York. He has protected his buddies from losses that they should have realized from their stupid investments at the direct expense of the tax payers.
The guy cheated on his taxes, made AIG pay out larger amounts than they would have, and now is tied to supporting the enemy. This all happened under Bush (I know, Bush's fault) who was being told by Tax Cheat Timmy and Bernanke that if we didn't pump a Trillion Bucks into the banks they would fail. Then forced all of the big banks even the ones that didn't want money to take money.
The current "Obama" administration is now holding the acceptance of TARP funds even paid back against those banks. His advisors are the same ones that made all banks take the money. So it seems like Timmy is up to his neck in this because it is his advice that has put us into the current mess.
Yep 100's of thousands all driving to DC parking their cars and blocking all roads like the farmers with their tractors have done in the past, but this can be done with a 1000 x's more vehicles.. keep a few hundred trucks/cars outside of the city so when the tow trucks move in we can block them off shutting off any hope of removing/opening up streets..

For example imbelice if I own a bank and lend to a Protestant, Catholic, a Jwish man and a muslim there is nothing wrong with that. To continue it is wholly reasonable therefore that if I own such a bank and sell it or it is taken over by the government because I fail under the conditions of the insurance provided by the government there is no connection other than a meaningless one to religion. Now if I was running a relion based loan or some other program that's another story but the piece doesn't speak to that at all so that's my question, I hate to keep restating it but I realize your grasp of engrish is feeble at best.
Also you need to go back and read the Establishment clause before you push your drool cup aside to continue your pie hole venting and respond again.

Can you not read? Yes I can see them mentioning shariah law above. However that was it there was no detail just a statement I was asking for that detail. I don't like: AIG, Tax cheat Timmy or the bailout but the article just throws shariah in there without a shread of any proof offered that shariah would benefit. Scooter Libby was a miscarriage of justice. It was small potatoes. Valerie Plame was outed by someone else whose name I can't remember to Robert Novak, columnist, and Patrick Fitzgerald knew it from the beginning. He went on a fishing expedition and cornered Libby because Libby couldn't remember when he said what, albeit unintentionally. Plame was no longer a covert operative and hadn't been one for over 10 years at the time of the indictment. It was a total waste of taxpayer dollars.
This AIG mess could bring down an entire ship.

I'd love to see this in court on national TV. I watched Watergate every single day and could not take my eyes from the TV. I learned to give great respect for some people in those days, even some politicians. Making that TAX CHEAT sit in the witness chair in front of the American people is exactly waht we need to bring the Imperial Govenment to its knees, and I mean both sides of the political fence. No one is without blame.
I sincerely hope this is a real issue with real evidence, i.e. paper trales.
And please do not say that this case is too arcane for people to understand. They said that about the Tea Party, too.

We don't mean to sound impatient, but we've seen enough. The country is in the middle of the worst financial crisis in 75 years, and the second-most-important person in charge clearly isn't the right man for the job.
When both engines on US Air Flight 1549 quit after takeoff, Capt. Sullenberger did not cling stubbornly to his preconceived view of the situation. He did not float endless versions of the same bad plan to air traffic controllers to see what they thought of them. He did not spend months preparing for a moment just like this only to be seized by indecision when it arrived.
Instead, he just took the controls and landed the plane in the Hudson.
Note that this was not a risk-free, popular, or easy decision. When air traffic controllers learned where Sullenberger was headed, they thought everyone in the plane was dead. But if Sullenberger had taken the easier route, and tried for Teterboro, they all would have been dead–along with a bunch of folks on the ground.
Before taking office at the end of January, Tim Geithner had many months to develop a solid plan for what to do. He had the opportunity to see what was working and what wasn't and to consult with dozens of experts, many of whom had no stake in the matter (unlike the Wall Street kingpins who seem to have shaped Geithner's inaccurate view of the situation). He had the opportunity to see and understand that what America needs most right now is clarity and decisiveness.
Then he took office. In the five weeks since, Tim Geithner has:
Given a speech billed as the solution to the financial crisis in which he promised something vague, someday, that sounded an awful lot like the bad plan that didn't work in the past administration (which really isn't that surprising, given that Geithner was the one who came up with the earlier bad plan).
Floated multiple versions of the same plan into the press hoping that one would be enthusiastically received by someone other than Wall Street (no dice.)
Refused to seriously discuss the consensus opinion of most neutral economists and experts: That the banking system is insolvent and that the solution is pre-privatization.
Given Congressional testimony in which his brusque, defensive manner and weak responses have inspired no confidence and served only to make people wonder again why Obama picked him for the job.
and, most importantly, Tim Geithner has:
Refused to revisit or defend his almost certainly inaccurate view that this crisis is merely a temporary price decline caused by a lack of liquidity, rather than a collapse of a debt-driven economy. You can't cure the patient if you're treating the wrong problem.
With a few years of seasoning in a normal environment, Tim Geithner might turn out to be a fine Treasury Secretary. But this isn't a normal environment, and we don't have a few years.
The engines of the US economy just quit. We're losing altitude rapidly. And the co-pilot flying the plane clearly doesn't know what to do.
So it's time for the captain to take over again, before Geithner takes him and the rest of us down with him.

We are in this economic crisis because Bush/Obama/Progressives bailed out the world, not just a couple banks.
Besides, many of the toxic assets that TARP and TARP II were supposed to buy up are still sitting on the books of these banks.

Real simple. It is not illegal for AIG to support Sharia law with their practices. However, since the gov't owns almost 80% of AIG, it is illegal for the gov't to support Sharia law with their practices. They tried to get around this by having a holding company as the legal entity (holding the shares) instead of the gov't. Which is also an illegal practice for the gov't.
I hate to break this to you fox, but Bush was not a small gov't fiscal conservative. He was a big Gov't fiscal liberal.
Only difference is that Bush loved his country. Obama, not so much.
