Freedom Alliance Responds to Allegations Against Sean Hannity

This week, false and malicious allegations about Freedom Alliance were posted on the Internet and we want to address them with you. We don’t know the motivation for these vicious smears, but we will not allow them to go unanswered.
First, we want to thank you for your support and assure you that Freedom Alliance’s record of financial stewardship and programmatic achievements not only meets, but exceeds standards of program efficiency set by most charity evaluators. We are extraordinarily proud of our work at Freedom Alliance and stand by our efforts 100 percent.
False Accusations
1. The blog posting accuses our friend Sean Hannity of personally benefiting from Freedom Alliance. This is FALSE. Freedom Alliance has never provided planes, hotels, cars, limos, or anything else to Sean. Sean gets nothing from Freedom Alliance except our gratitude for his personal generosity and for all he has done to help the troops and our organization. We have never had to ask Sean for anything, he always generously offers his help before we have a chance to ask him. But to be clear Sean pays for all his own transportation, hotels, and all related expenses for himself and his family and friends and staff, which over the years has added up to tens of thousands of dollars. He does not use any Freedom Alliance Funds or Concert funds in any way, period.
2. Sean Hannity has contributed $100,000 to the Wounded Warriors Foundation, over $200,000 to the Freedom Alliance, and over tens of thousands of dollars to other military charities and individuals. We only make this information public because of the outrageous slander against him. Sean has no management or operational involvement in, or control over, Freedom Alliance. He has been a selfless patriot in his efforts to raise funds for the education of children of armed services personnel.
3. The blog posting accuses Freedom Alliance of spending less than 20% of money raised on program activities. This is FALSE. Listed below are the amounts that Freedom Alliance spent for each of the past three years and the categories on which they were spent. The figures are taken from our Federal Form 990 which is filed with the Internal Revenue Service and posted on our web site and audited by an independent auditor using Generally Accepted Accounting Principles. This financial record not only meets, but exceeds standards of program efficiency set by most charity evaluators.
4. In 2008, Freedom Alliance spent a total of $6,745,717. Of that:

79 percent ($5,317,970) was spent on Program Activities 14 percent ($945,950) was spent on Fundraising 7 percent ($481,797) was spent on Management
In 2007, Freedom Alliance spent a total of $7,461,350. Of that:
• 81.5 percent ($6,084,474) was spent on Program Activities • 13.5 percent ($1,011,501) was spent on Fundraising • 5 percent ($365,375) was spent on Management
In 2006, Freedom Alliance spent a total of $7,064,839. Of that:
• 77 percent ($5,434,538) was spent on Program Activities • 18.5 percent ($1,308,414) was spent on Fundraising • 4.5 percent ($321,887) was spent on Management
5. The blog posting accuses Freedom Alliance of spending money intended for student scholarships on other expenses. This is FALSE. Freedom Alliance has distributed $3.4 million in Scholarships and created a Scholarship Trust Fund with the additional money that we have raised for that program. That fund now contains $15 million, over $10 million of which has been raised by Hannity and the concerts. Our scholarship program is managed with the understanding that it will be needed for at least the next 20 years as there are children who will ultimately receive a scholarship who are now only a few years old. As indicated on our Federal Form 990, these funds are restricted and used only for future scholarships.
6. Our Scholarship Fund is one of four programs operated by Freedom Alliance. Supporters may donate to a specific program or for general operating purposes. In 2008, Freedom Alliance received $2.1 million in scholarship donations. The same year, we awarded $802,250 in scholarships and applied $1.3 million to our Scholarship Trust Fund. The funds donated by Sean Hannity directly — or through the proceeds of the Freedom Concerts — and the support of thousands of Americans are used for these purposes:
• Freedom Alliance Scholarship Fund: Providing scholarships to those whose parents have been killed or severely injured in their service to our Country. There is now over $15 million in the scholarship fund for the students as they come of age.
• Support our Troops: Many events each year are planned and executed by our staff to show appreciation and provide special opportunities for those actively serving in the military.
• Leadership Academy: A program for high school students in which they are encouraged and trained to serve their country.
These programs would not be possible without the support of Mr. Hannity and many others.
We are proud of our work and numerous accomplishments. We are grateful to our supporters whose voluntary contributions make it possible and we thank you. While it is discouraging to have our record misrepresented in such a malicious way, our work is important and, with your support, it will continue.

For our fifth and final article for Chapter 1 of the Federalist 2.0, we will explore the impact of factions (groups
of people with similar interests) and their associated insurrections (negative actions on society) and the
relationship these factions have to the Union of the United States of America. Thus, among the numerous
advantages promised by a well constructed Union, none deserves to be more accurately developed than a
Union’s tendency and ability to break and control the violence of factions. Factions, the friend of popular
governments, never find themselves so much cultivated due to their character and fate, as they tend to
appear due to a government’s propensity to this dangerous vice which can unleash factions that do not
preserve liberty. We will not fail, therefore, to set a due value on any efforts which, without violating the
principles to which one is attached, provides a proper cure to prevent the birth of oppressive factions. The
instability, injustice, and confusion introduced into the public governing councils by ill intended factions, have,
in truth, historically been the mortal disease under which popular governments everywhere have perished;
such that factions, that are adversaries to liberty, continue to identify these facts as their favorite and fruitful

Political faction is a grouping of like-minded individuals, especially within a political organization, such as a political party, a trade union, or other group. There is no single, widely accepted definition of factions or factionalism, nor broad agreement as to whether factionalism is inherent in certain institutional structures. The individuals within a faction are united in a common goal or set of common goals for the organization they are a part of, not necessarily shared by all of that organization's members. They band together as a way of achieving these goals and advancing their agenda and position within the organization. Complaints are everywhere heard from our most considerate and virtuous citizens, equally the friends of
public and private faith, and of public and personal liberty, that our government is too unstable, that the
public good is disregarded in the conflicts of rival parties, with their progressive advancements, and that
legislative measures are too often decided, not according to the rules of justice and the rights of the minor
party, but by the superior force of an interested and overbearing majority which has the power to implement
their brand of governance and justice. However anxiously we may wish that these complaints of growing
trouble have no foundation, the evidence, of known facts will not permit us to deny that they are in some
degree true. It will be found, indeed, on a candid review of our situation, that some of the distresses under
which we live have been erroneously charged on the general operation of our government; but it will be

prevailing and increasing distrust of the growing number of public works and engagements, and alarm for the

individuals have infiltrated our public administrations, leading their factions, with the consequence of
governing with Reason and Vice instead of Reason and Virtue. This brings us to our first “Principle of Faction
and Insurrection”, “When the citizenship of a nation complain of a government that is unstable and
increasingly oppressive, the fault does not lie in the overall structure of the government [the economy or the
citizenry], but will usually be the fault of those whom are governing the citizenship, since they have an eye of
selfish intent on the behalf of their own factions, which will lead to decisions born from Reason and Vice
resulting in unstable and oppressive governing laws and regulations.”
A pure democracy . . . can admit no cure for the mischiefs of faction . . . . There is nothing to check the inducements to sacrifice the weaker party . . . . Hence it is that such democracies have ever been found incompatible with personal security or the rights of property; and have in general been a short in their lives as they have been violent in their deaths.

By a faction, as we understand it, would mean a number of citizens, whether amounting to a majority or a
minority of the whole, who are united, actuated and motivated by some common impulse of passion, or of
interest, adversed and misaligned to the rights of other citizens or to the permanent and aggregate interests
of the community. Such that there are two methods of curing the mischief of faction: the one, by removing its
causes; the other, by controlling its effects. Where there are also two methods of removing the causes of
faction: the one, by destroying the liberty which is essential to a faction’s existence; the other, by giving to
every citizen the same opinions, the same passions, and the same interests such that no faction can grow
power significantly enough to oppress another faction, group or individual. Thus we come to our second
“Principle of Faction and Insurrection”,”There are two methods in which to cure the existence of factions, the
first would be to remove its causes; the second would be to control its effects”. Then the third “Principle of
Faction and Insurrection” would be, “ “Historically there have been two consistently used methods for
removing the causes of factions, the first method is to destroy individual liberty, through the materialistic
elimination of the owner ship of property, in order to extinguish the mechanisms that allow factions to thrive
and the second method is to give to the citizenry a idealistic norm where there would be equal opinions,
passions and interests such that no faction would be able to grow separately from the idealized norm.”

It could never be more truly said that of the first remedy, that it is worse than the disease. Liberty is to faction

The fourth “Principle of Faction and Insurrection” would then be, ”The first object of government is the
protection of the diversity in abilities and faculties of mankind from which the rights of property originate, thus
eliminating the options to manage the effects of factions through restricting liberty or implementing legislation
to achieve uniformity of interests within the society.”
When we say, that all men are equal; we mean not to apply this equality to their virtues, their talents, their dispositions, or their acquirements. In all these respects, there is, and it is fit for the great purpose of society that there should be, great inequality among men.

North, should pursue legal action against those who have made these actuations and put them out of business. The constitution describes only two specific crimes, treason and slander. It’s too bad that there are only punitive penalties for slander, it should be a felony with prison time.

The latent causes of faction are thus sown in the nature of mankind; and we see them everywhere brought

opinions concerning religion, concerning government, and many other points, as well of speculation as of
practice; an attachment to different leaders ambitiously contending for pre-eminence and power; or to
persons of other descriptions whose fortunes have been interesting to the human passions, have, in turn,
divided mankind into parties, inflamed them with mutual animosity, and rendered them much more disposed
to vex and oppress each other than to co-operate for their common good. So strong is this propensity of
mankind to fall into mutual animosities, that where no substantial occasion presents itself, the most frivolous
and fanciful distinctions have been sufficient to kindle their unfriendly passions and excite their most violent
conflicts. But the most common and durable source of factions has been the various and unequal distribution
of property. Those who hold and those who are without property have ever formed distinct interests in
society. Those who are creditors, and those who are debtors, fall under a like discrimination. A landed
interest, a manufacturing interest, a mercantile interest, a moneyed interest, with many lesser interests, grow
up of necessity in civilized nations, and divide themselves into different classes, actuated by different
sentiments and views. The regulation of these various and interfering interests forms the principal task of
modern legislation, and involves the spirit of political parties, and their associated factions, in the necessary
and ordinary operations of the government. Such that the fifth “Principle of Faction and Insurrection” is then,

capacity to obtain and hold varying amounts/types of property. The regulation of the various and interfering
individuals and groups, which can hold differing amounts/types of property, forms the principal task of
modern legislation and involves the integration of political parties, and their associated factions, in the

oppress another group or faction.”

“The second objective of a government, based on a democratic republic, is to provide for the effective path to
elect representatives who represent the citizenry while also providing methods to determine the efficacy of
public measures that are tempered to protect against the impact of the negative influences of factions; with
the ultimate power of the citizenry to remove, through impeachment, those representatives whom they elect.”

How about the People for the American Way? I love the choice of these organizations to appeal to the dumbed-down sheeple. "Freedom" is a 60's concept of abandonment of responsibility. This nation was founded on LIBERTY. Yet you embrace it because your only goal is to confuse and mislead people. I don't see you opposing the Patriot Act or the wars that are leading us in to economic enslavement (by foreigners, no less!).
It is then just to remark in favor of the position that the current challenges result from a governing body that is
more focused on the satisfaction of their faction’s needs than the need to guide a republic to the welfare of
all citizens, which for our situation could be universally admitted to be peculiarly critical, and to require the
governing class’s action to be absolutely necessary to do something for our own relief or for our own
representation of a faction’s interest, the predetermined patron of what has been actually done may have
taken their bias from the weight of these more noble considerations to govern with honesty and integrity, as
well as from considerations of a sinister nature. The predetermined adversary, on the other hand, could
have been governed by no excusable motive whatever. The intentions of the first may be upright, as they
may on the contrary be culpable. The views of the last cannot be upright, and must be culpable. But the truth
is that these papers are not addressed to persons falling under either of these characters. These words
reach out for the attention of those only, who add to a sincere zeal for the happiness of their country, a
temper favorable to a just estimate of the means of promoting a government guided by a strong and
benevolent character that would use Reason and Virtue in deciding the matters of the Union. The seventh
“Principle of Faction and Insurrection” then would be, “The government framework must support the
selection of individuals whom possess the character to do what is right for the general good of the Union,
while rejecting activities that will eventually support a faction’s needs at the expense of the Union.”
Is the relinquishment of the trial by jury and the liberty of the press necessary for your liberty? Will the abandonment of your most sacred rights tend to the security of your liberty? Liberty, the greatest of all earthly blessings — give us that precious jewel, and you may take every things else! Guard with jealous attention the public liberty. Suspect everyone who approaches that jewel.

Among the difficulties encountered by the convention in the 1700s, a very important one must have been in
combining the requisite stability and energy in government, with the inviolable attention due to the
mechanisms of liberty and to the republican form required to keep it functioning. Energy in government is
essential to that security against external and internal danger, and to that prompt and salutary execution of
the laws which enter into the very definition of good government. Stability in government is essential to
national character and to the advantages required by it, as well as to that repose and confidence in the
minds of the people, which are among the chief blessings of civil society. An irregular and mutable legislation
is not more an evil in itself than it can be detestable to the people if it becomes regular and active in its
intent; and it may be pronounced with assurance that the people of this country, enlightened as they are with
regard to the nature, and interested, as the great body of them are, in the effects of good government, will
never be satisfied till some remedy be applied to the alterations and uncertainties which characterize the
State administrations. On comparing, however, these valuable ingredients with the vital principles of liberty,
we must understand at once the difficulty of mingling them together in their correct proportions. The genius
of republican liberty seems to demand on one side, not only that all power should be derived from the people, but those that are entrusted with this power should be kept independent from the people, by a short
duration of their appointments; and that even during this short period the trust should be placed not in a few,
but a large number of hands. Stability, on the contrary, requires that the hands in which power are lodged
should continue for a length of time without change. But is also true that a frequent change of men will result
from a frequent return of elections; and a frequent change of measures from a frequent change of men can
result in a constant that does not progress on the boundaries of liberty: where we realize that energy in
government requires not only a certain duration of power, but the execution of it by only a single person.
Such that we come to the eighth most important “Principle of Faction and Insurrection” for the security of
liberty, “The third option for controlling faction’s negative effects would be to construct a political system that
would control factions by not allowing them to take hold in the first place. With the duration of political
positions short and the strength of political positions diluted among many individuals who must share in the
power and responsibility, no one individual or group can place an anchor of faction to the detriment of the
individual, group or Nation. With the primary premise of this function, to set to blowing ashes the flames of
passioned factions, to ensure that encroachments on liberties such as the freedom of religion and freedom to
obtain and hold property [and grow wealth] through open economic means are thrust into a labyrinth of
hurdles of checks and balances such that resulting legislation would result in no legislation or would
transform the legislation into something that ensures the smallest minority is heard and protected from
abusive controls.”5

I really don't have a dog in this fight at all other than wanting corruptioin and misuse of funds examined for all of those who have contributed to this charity. I believe spotlight is the best disinfectant and would like to have the Freedom Alliance explain why so little of what is raised does not go to those the charity says it directly benefits. While any charity will have administrative costs, etc…. this seems beyone egregious.
Hopefully, Freedom Alliance and Sean's company will illuminate a full audit of the amount spent in addition to the amount of money RAISED. I understand how charities can be highjacked sometimes (see Wyclef Jean's reputations with this Haiti Relief group) having volunteered for an organization in college. To say the least, there are many questions to be answered still.

I finally had a chance to look at the tax forms and look at Freedom Alliance's website.
I think part of the problem is Mrs. Schussel's misunderstanding of what Freedom Alliance does. Their website states "The Mission of Freedom Alliance is to advance the American heritage of freedom by honoring and encouraging military service, defending the sovereignty of the United States and promoting a strong national defense."

A charitable (no pun intended) reading might be that Sean lends his name and efforts to a charity that is living high and mighty, without properly monitoring where the money really goes. 12% of proceeds to the vets and their families? Hundreds of thousands to consultants? A million plus for printing?

In fact, the Freedom Alliance “response” doesn’t answer any of the questions I raised and goes on to lie more. They don’t address why they gave a triple amputee only $200—and in fact there are many of these examples provided in their tax return addendum, but I only cited a few for brevity’s sake. They also lie and claim that they gave a lot more money to charity b/c they categorize it as “program expenses.” But I’m sorry—calling $3 million in consulting fees, printing, and postage “program expenses” doesn’t change the fact that it still went to their cronies, not to a fund and not the soldiers who only got on average less than $900 apiece. It also doesn’t change the fact that out of the money spent (I didn’t use the money they claim they raised for their scholarship fund) the vast majority goes to those kinds of expenses.
Also, the “scholarship fund” is really a war chest for something else. We’ve been at war since 2001, when we went into Afghanistan, and we’re winding down in Iraq. Unless the kids were born in 2001 or thereafter, many of these kids are in college now and Freedom Alliance is giving them a pittance toward their college tuition, while they continue to build this massive warchest. With a giant multi-million dollar fund, why aren’t they giving the kids a free, complete ride to college? And how many kids of deceased troops will there be in the future? Enough to exhaust a multi-million dollar fund? Doubtful.
Moreover, because they hoarded millions of dollars, their returns show the fund shrunk by several million dollars with bad investments and market losses. That money could have put these kids through college for the entire time. What’s their excuse for the soldiers with no limbs and with severe burns? Are they waiting for two decades from now when technology is better? $165 for a soldier who is blind and his face blew up? No excuse for that. Their “response” is simply a non-response and an attempt to cover up the fraud.

Folks, I'm not an accountant, an actuary, or a lawyer, but $15 million is not a lot of money for a scholarship fund that intends, and expects to remain solvent well into the future. Basic Investment 101 is that you do NOT spend your capital (the $15 million); you spend the income FROM the capital.
Conservative investments might throw off about 7% annually. 7% of $15 million in simple interest is $1,050,000. If you give each kid $5,000 a year, that's going to fund only 210 kids. Obviously, they can't give each kid a full ride, and help very many kids. They have to make choices. Maybe you'd make different choices, but they appear to have chosen to help more kids, and so given each less than $5,000.
And, some money must be used to build up the fund itself. It would be the height of irresponsibility NOT to build up a capital fund if you expect to be funding scholarships for the foreseeable future.

Bill, I agree with your assessment. I've looked at the 2006 and 2008 tax returns that are on the Freedom Alliance site, and it's easy to see that the number of students receiving grants/scholarships has increased from the number required to fill two pages in 2006, to five pages in 2008.
And to Tim's comments, Freedom Alliance runs a scholarship fund as part of it's mission.
Frumforum has a good investigation and rebuttal of the Schussel piece, and she's submitted a comment or two in response. IMO, as one that used to hear her interviewed on the SF Bay Area's conservative talk radio station KSFO, I think she's gone a bit off the deep end in the last few years, adopting a "my way, or the highway" attitude.

This is interesting. Now, my first instinct is to trust Sean, who I used to listen to all the all the time on WABC. Sean's contribution cannot be understated.
He is trying to help the troops. On the other hand the freedom concerts seem a bit like a conservative's "We Are the World" concert. Get some celebs on stage, self promote, and talk about good intentions, and what really are you accomplishing other than having a political rally? The best way to help the troops might not be to hand money out to families, but to establish a fund so that the interest can be used in the aftermath of wars to aid injured vets. But that's just how I see it.

Nevertheless I believe that a lot of Debbie's accusations that Sean Hannity was personally treated to transportation or funds of any sort has been contradicted by the press release from Freedom Alliance. While it may be true that soldiers have been severely injured and been paid very little by this charity, your criticism is a little too over the top to be believed as serious and sincere. You see, there are many reasons for the charity to be stingy with its money right now.
Reason 1: One, it takes size for a fund to really be able to dish out money left and right. Until then, it should be managed carefully so it can grow to that size as quickly as possible. Is this not a fair argument?
Reason 2: Also everyone lost big with the recent downturn, and everyone is vulnerable to bad investments. Although the downturn MAY have been anticipated and extra charitable donations given out. But if no downturn materialized, that would have been a miss step considering Reason 1.
Reason 3: I'm not a grunt but I get the impression that the VA does its damnedest to take care of the injured vets. The wounded warriors program, plus disability pay. We know we will be taken care of and do not expect any charity. Unless we have really unusual, special circumstances where we are in need of extra extra help, we do not expect any other charities to step in. Uncle Sam clearly is trying to hog that glory and the VA budget proves that point.
Reason 4: How much money is enough for a wounded soldier? $5,000? $10,000? Even if someone gave me $18,000 I could pay for only one year at Hillsdale, excluding books, food, everything else. Or I could buy a car, all cash. And my life would remain pretty much the same. This fund does not have enough money to make the thousands of injured soldiers out there financially independent. Not even close. And if the fund continues to shrink, the annual Freedom concerts will be a waste of time for all attendees, because the long term viability of the fund will always be compromised. (like Social Security).
Reason 6: The downturn you mentioned in 2005 may be putting the fund behind schedule for goals set to grow the fund to a certain size by a certain date. This is important, again refer to reason 1.

FA gave away $800,000 in scholarships per Schlussel's column. Because people like you and Schlussel don't understand what the FA does, doesn't mean mean FA is wrong, immoral, or misusing funds.
Freedom Alliance has been around long before Hannity was popular, Schlussel and you seem to think its sole goal is as a scholarship fund, that is but a small part of their mission as CLEARLY defined on their website.

I have attended Freedom Concerts in the past and will continue to do so! I have seen first-hand the good work that the Freedom Alliance and Sean Hannity are doing. Just wondering: what good works has Debbie Schlussel (the one who posted the accusations on her blog) done?

If you go through the PDF she posts, you can see it broken down by type. For instance, the 2006 return shows they only spent $300+ on scholarships which falls under program expenses. She is making a valid point.
I agree though that she is pretty belligerent and flies off the handle a lot. In this case though, I think she is on to something.

interesting that in the response to the accusation that the Freedom Alliance has spent less than 20% of monies received on program activities, the response given by the Freedom Alliance speaks only of money spent, rather than of money spent versus money received, which I thought was the accusation. It is also impressive that management costs are so low (~300K in one year): perhaps the staffers spoken of are largely volunteers.
I can see in the explanation that a good deal of that money seems to have gone into the scholarship fund, but in the interest of clarity, it would have been nice if Freedom Alliance had included money received versus money spent or placed into a scholarship fund: in their explanation, I see no reference to money raised, which is at the core of the accusation.
The scholarship fund is also interesting: I suspect the fear is that once the war is over, the scholarship fund might be susceptible to plunder as time passes and those eligible for the fund (and those who contributed to it) forget about it.
Look this isnt that complicated. If Freedom Alliance wants to legitimately defend the organization they need to stop lumping massive amounts of money under the vague term "program activities". The amounts given for Scholarships and Grants to wounded soldiers is in fact itemized on the organizations tax returns and IS in fact a very small amount of its revenues. The defense offered by Freedom Alliance is that they provide "other" services and programs besides the grants and scholarships. The problem is that none of costs for those services and programs is itemized. It all gets lumped into this "program services" catagory. Be straight up guys and tell us how much and where and when you spent money for programs like support our troops, leadership academies etc etc. If you dont itemize where you spend the money you end of leaving a cloud of suspicion suggesting that you are playing accounting games.
I guess "Freedom" in Freedom Alliance refers to the freedom to fly around in Gulfstream V jets. Shame on Hannity and the enablers here at FA. Just more typical right-wing entitlement mentality. Since you're a republican, your elite status comes above a child's education.
