The President’s Health Care Proposal: Trying To Get Blood From A Stone
by Dr. Elaina GeorgeIf the goal of the President’s proposal was to drive doctors into hospital based practices or community health centers, or if it was to break the spirit of providers and bend them to the will of the government that holds the threat of criminal prosecution over their heads if they are found to be Medicare cheats, or if the goal was to dumb down the practice of medicine by ramping up the power of the HHS secretary and the evidence-based medicine posse, then the President’s proposal for health care reform was successful.

However, we as physicians are individuals. There are approximately 890,000 doctors currently practicing in the US. Those of us who want the autonomy to practice medicine the way we were trained, those of us who run a private practice who are entrepreneurs at heart, those who are tired of being pitted against our patients and other physicians (the specialist vs. primary care physician meme), and those who are just sick and tired are NOT going to take this. Those of us who can will retire or leave medicine all together. Those within the system will simply opt out.
The President’s summit on Thursday amounts to nothing more than six hours of theater. Not one physician in Congress has been invited to attend. The physicians for single payer have also not been invited. It is his chance to hear from the people on the front line, and it is obvious this bill is NOT about the health of our people. It is about raising revenue, controlling the medical industrial complex completely. How else can you explain the proposal for the government to a) take over control of the cost of insurance premiums; b) limit provider medical decisions based on cost, and c) control what is medically covered for the patient. Under the proposed health care reformed, the government will control how much an insurance company can charge, decide what is covered medically, and sanction the provider for deviating from the norm.
These are some of the proposal highlights that concerned me the most:
Delay and Reform the High-Cost Plan Excise Tax.
Part of the reason for high and rising insurance costs is that insurers have little incentive to lower their premiums. The Senate bill includes a tax on high-cost health insurance plans. CBO has estimated that this policy will reduce premiums as well as contribute to long-run deficit reduction. The President’s Proposal changes the effective date of the Senate policy from 2013 to 2018 to provide additional transition time for high-cost plans to become more efficient. It also raises the amount of premiums that are exempt from the assessment from $8,500 for singles to $10,200 and from $23,000 for families to $27,500 and indexes these amounts for subsequent years at general inflation plus 1 percent. To the degree that health costs rise unexpectedly quickly between now and 2018, the initial threshold would be adjusted upwards automatically. To ensure that the tax affects firms equitably, the President’s Proposal reforms it by including an adjustment for firms whose health costs are higher due to the age or gender of their workers, and by no longer counting dental and vision benefits as potentially taxable benefits. The President’s Proposal maintains the Senate bill’s permanent adjustment in favor of high-risk occupations such as “first responders.”
- Unintended consequence, this can have an adverse affect on people with chronic illnesses who often have expensive policies because the insurance companies deem that they are very expensive to underwrite. It is adding insult to injury to have to pay 40% more for an insurance policy that is a lifeline. Those who can’t afford the premiums will be forced to choose lower cost premiums on policies with less coverage and restricted services with resultant restriction of access to care.
Comprehensive Sanctions Database
The President’s Proposal establishes a comprehensive Medicare and Medicaid sanctions database, overseen by the HHS Inspector General. This database will provide a central storage location, allowing for law enforcement access to information related to past sanctions on health care providers, suppliers and related entities. (Source: H.R. 3400, “Empowering Patients First Act” (Republican Study Committee bill))
- This has a chilling effect on doctors and other healthcare providers who run afoul of government. There is no mention of what steps exist for the appeals process before you are put on the hit list. Moreover, allowing ‘law enforcement to have access to information’ will have the intended effect of making providers obey the system without deviation because of the threat of criminal prosecution. .
Modify Certain Medicare Medical Review Limitations
The Medicare Modernization Act of 2003 placed certain limitations on the type of review that could be conducted by Medicare Administrative Contractors prior to the payment of Medicare Part A and B claims. The President’s Proposal modifies these statutory provisions that currently limit random medical review and place statutory limitations on the application of Medicare prepayment review. Modifying certain medical review limitations will give Medicare contractors better and more efficient access to medical records and claims, which helps to reduce waste, fraud and abuse. - Providers will be subject to more random reviews at the pleasure of the government. This has the potential to waste productivity and adds to the stress that providers already experience in dealing with Medicare. Providers are already subject to a 10,000 fine per occurrence for committing fraud (Fraud extends to overbilling AND under billing Medicare). Providers will be looking over their shoulder even more then they do now. With audits and criminal prosecution looming, it will only drive more providers out of Medicare further decreasing the Medicare patient’s access to care.
Broaden the Medicare Hospital Insurance (HI) Tax Base for High-Income Taxpayers
Under current law, people who earn a salary pay the Medicare HI tax on their earned income, but those who have substantial unearned income do not, raising issues of fairness. The House bill includes a 5.4% surcharge on high-income households to improve the fairness of the tax system and to support health reform. The Senate bill includes an increase in the HI tax for high-income households for similar reasons, an increase of 0.9% on earnings above a specific threshold for a total employee assessment of 2.35% on these amounts. The President’s Proposal adopts the Senate bill approach and adds a 2.9 percent assessment (equal to the combined employer and employee share of the existing HI tax) on income from interest, dividends, annuities, royalties and rents, other than such income which is derived in the ordinary course of a trade or business which is not a passive activity (e.g., income from active participation in S corporations) on taxpayers with respect to income above $200,000 for singles and $250,000 for married couples filing jointly. The additional revenues from the tax on earned income would be credited to the HI trust fund and the revenues from the tax on unearned income would be credited to the Supplemental Medical Insurance (SMI) trust fund.
- Increases and extends taxes
Medicaid for Working Families
Beginning in April of this year, States will be allowed to expand Medicaid eligibility to more individuals. Starting on January 1, 2014, all low-income, non-elderly and non-disabled individuals will be eligible for Medicaid. This includes unemployed adults and working families – all people with income below $29,000 for a family of four (133% of poverty).
The Federal Government will support States by providing 100% of the cost of newly eligible people between 2014 and 2017, 95% of the costs between 2018 and 2019, and 90 percent matching for subsequent years.
All states will be treated equally and will not receive any special matching rates under this provision.
- Great, except it does not address the problem of access to physicians who take Medicaid. The number of providers has been dropping every year and those that still take it are stretched beyond their capacity.
Investing in Primary Care
The Act invests in grant programs that support the training of primary care providers, including family medicine, pediatrics, general internal medicine, and physician assistantship. It also provides payment bonuses to primary care physicians.
- In fact there is a shortage of doctors in general – both primary care and specialists. Good medical care dictates that a patient has access to both for comprehensive care. There are times that the primary care physician must refer a case to the specialist. If this system is implemented, it will be harder to find one who 1) will not have an available appointment for months, or 2) one who will be within the system. The reform effort has made specialists superfluous, and because of that a two level system will likely result. Those who have the means will leave the system to get specialty care, and/or individualized patient centered care (concierge, fee for service).
It is clear why there is an emphasis on training and expanding the workforce by adding additional, health care providers like the physician assistants and nurses. There will be an exodus of physicians from this system and they will have to have someone to replace them

I had a eureka moment last night. I think it is over, dead. Why? Remember about a month ago when Parachute Pelosi did her last Fly-By with the MSM? She said it would be passed; that they were ready to go over the wall,and if that didn't work they would pole vault over, and if that didn't work, they would parachute in. Well, she hasn't been seen in public since. Either she has gone to ground, or is in the body shop for a little nip-tuck; but in any event, she is strangely silent, even for her. A month is an eternity for her to be out of the limelight.
I think she is distancing herself from her Massah's debacle.
But Obama has been so spot-on with all of his promises, projections and estimates.

I think so too. The problem with this bill is it is only a tax and regulate type setup. If you want to fix healthcare start with the hospitals. Its simple eliminate fraud from these facilities and pay for the uninsured visits to the emergency room. Once hospitals realize there getting something for the free care they will relax costs for other types of care. Then separate elective care and necessary care and tax the hell out of boob jobs, lypo, and the rest. Turn this tax into a subsidy for the hospital. Boom your on your way to reform. Seriously instead of taxing CO2 tax vanity.

We already have national healthcare and everyone seems to miss the point. What is Medicare? What is Medicaid? Who pays the bills for the illegal immigrants going to the emergency rooms? The redistribution is here now. The wealth is being siphoned off through our costs at the pump. Want to fix it. Put the lazy no loads to work. Get off the entitlement band wagon. This isn’t rocket science. Four simple things to get it rolling. 1.) Tort reform 2.) Open competition across state lines 3.) Tax breaks for healthcare providers who treat truly indigent people 4.) Here's my question… my current insurance policy limits total payments for the life of the policy to $1 million. If that is the typical policy and this proposal will cover an additional 31 million people, why does it cost $2 trillion? Why can't we provide these 31 million people a government provided HSA account with $1 million in it for each of them for health care only and give them the care they claim they are being denied? Total cost… $31 million dollars.

I personally think this is the way they will "convince" us to go to a single payer system. They keep playing with these stupid numbers and will eventually say that it would only cost us $300 million to insure each person in the country. Look at all the money we just saved by just providing each citizen a $1 million health account. Am I missing something? I am sure there would be a way to ensure the money was spent on health care costs and if it wasn't then you are out of money and out of subsidized health care once the money runs out. You could use the money to either provide direct cash payments to the providers to negotiate the best rates or use the money to pay for the premiums of your desired insurance plan.
I tend to disagree with the "stripped-down bill" idea. These people are ideologues. If they weren't they could have turned this debate into a win at any time by including one big republican idea (tort reform, portability, etc.) They didn't. They couldn't. They are bound by their ideology to demand their way, all the way. And that is why they will fail.

To the Editor:
Submarines have always fascinated me. Their role in the last century cannot be overstated. From the simple man powered submarines of the civil war to the USS Nautilus’s journey under the North Pole to the modern submarines that form a critical part of the US nuclear deterrent. As over engineered as these ships are, when a torpedo hits, decisions have to be made to save the ship. Sometimes those decisions have to be made under extreme stress, and the result of the orders leads to the death of fellow crew mates. As one space fills with water, pulling the ship inexorably to the bottom, a sailor in the dry space must close the hatch to save the ship.
The United States is analogous to a submarine wounded by enemy action. Instead of an enemy firing a torpedo, we, via all of our poor political leadership have fired one upon ourselves. The political classes collective record, how ever well intentioned, has lead us here, through massive spending, borrowing, and making promises to citizens that cannot be met. Character at a point of pressure is the most important asset a leader, officer, or soldier possesses. Why? Because sometimes it is necessary to close the hatch to save the ship. The question to my mind is which party possesses the capacity to do that now.
While the collusion of both parties are to blame for our sinking ship. It is the Republican party that is desperately trying to close the hatch and save the ship. The Republican party is standing against three pieces of legislation that will forever resign this nation to a continual decline and eventual ruin. The first is commonly understood to be “health care,” this legislation will forever alter a citizens relationship to their government. If it passes medical attention will become a right that must be met by force of law. As the saying goes, if you want to make something expensive, make it free. The failure of this solution to meeting the medical needs of people is deeply felt by those who lost loved ones because the English or the Canadian governments denied vital care. Liberal Democrats have another scheme to launch on the American people this one is called “Cap and Trade” – essentially this nightmare would allow the federal government to tax a citizen when they drive, breath or turn on the light switch. Kirsten Gillibrand has personally advocated for it in the editorial page of the Wall Street Journal, I assume Senator Gillibrand expects that by creating the next Wall Street scam will lead to voluminous campaign contributions on the back of the American taxpayer. Finally, there is “Card Check,” this gem would eliminate the secret ballot from the process by which a business goes from being a non-union to a union shop. Thus, the Union leadership would be in a position to put massive pressure on those who voted “no.” Republicans have stood, and are standing against all of this – in fact on the “Cap and Trade” front Republicans have earned bipartisan opposition to it.
All the while the water is rushing into our ship and the choice must be made in nine months; will the citizens of this great nation choose to stand with the leadership of the liberal democratic party, that is trying to keep the hatch open, so we all go down, or will the American people choose to stand with the Republican party, that is trying to close the hatch? I have confidence that the American people are ready to not only support the Republican party, but help close the hatch and save the ship. America is ready to sacrifice all but our liberty and our economic freedom – this has, and will always be true, and has happened in the past, it is “We The People” leading the charge. Right now the only organized political party that has the capacity to close the hatch is the Republican party.

I have a question. If this is such a good plan that he has, and is so neccessary for saving the economy, and the economy is in such peril now. Why is it taking 4 to 8 years to help these people who are in such need. Doesn't that seem cruel? It only confirms over and over again that this is not about doing anything for the people it is all about the monies they can suck from the people. Yes, they want it all. You bet. But they HAVE to get something; they are convinced that the '94 election debacle was because they DIDN'T pass Hillarycare, not because they failed. To keep the base rallied, something that gives the Feds control over health care- even if it is only a framework- will be a last minute deal.
That too, may fail. Hopefully. But this is a slippery lot, and they won't quit on this…

He is at the very least an ideologue, who is intent on forcing his socialist agenda on the people of the United States in spite of their powerful resistance. His relentless assault on the economy of the United States is nothing short of treasonous. He has and is showing total disregard of the US Constitution, causing great suffering to American families and business, and for the first time in history has placed the United States on a path that virtually guaranties our total economic collapse. Broken promises are one thing, but he has repeatedly been caught in bold face lies to the American people.
The biggest favor he could do us all would be to admit:

I will leave that to whomever the people, in their wisdom, choose to elect as president in 2012.
But, being a me-first kind of person, he'll say nothing of the sort. And this is why we (me included) hate his sorry ass. I wish we could impeach him, Reid and Pelosi, all on the same day.

Hey, if you know that you're eventually going to be price-fixed, it makes sense to raise those eventual rates as high as you can while you still have the freedom to do so.
For those who will be newly covered under this plan. Will they receive top notch coverage that will pay all of their medical expenses, or will they get medicare/medicaid along with big deductibles and limited coverage? When they are hospitalized due to severe illness, will the family still be bankrupted by the substantial balance that this plan fails to cover? If so, then what is the point in spending trillions of taxpayer dollars. I can go to the hospital now without insurance and receive basic treatment, along with thousands in medical bills. How will this be different. My mom is on Medicare and still spends 600 a month on supplemental insurance because medicare doesn't cover anything. This is nothing more than a giant govt power grab and the taxes to go with it.

If they're nuts enough to use reconciliation, then the Repubs should insist upon full procedure for it. They should get to go line by line and remove anything that is not a direct budget measure. In the end, all they should be left with is a massive tax bill for nothing. They can sign that and likely will because they're loons that way, but it will just guarantee their political doom.
Maybe, but I sense they know this is a tough sell and it is more designed to whip up public support for something the insurance companies want anyway. I am not sure they view this as done deal yet.
I see your point. But keep in mind that if they were really "convinced" that '94 was a blowout for failing on hillarycare, they wouldn't have needed bill clinton going out to convince them of that idea.
As for keeping the base rallied, most of the pragmatic democrats realize that they cannot win if they alienate the Independents along with the Republicans. The Republicans are already locked against them, but if they pass the unpopular bill, the Independents will seal their fate. And if they pass a watered down bill they'll lose a good portion of their own base.
I think that many of them realize that if the bill meets total failure now, they will at least be able to run on the promise to try again, as well as the claim of Republican obstructionism.
Of course you may be right. I just don't believe the democrats are dumb enough to believe passing "anything" is better than passing nothing.
