Democrats Waging War Against Laws that ‘Target’ Illegal Immigrants
by David WohlSobriety checkpoints have become big business for California law enforcement agencies over the last decade. The National Highway Traffic Safety Administration paid for 2,553 checkpoints last year, resulting in hundreds of arrests for driving under the influence. Authorities say the checkpoints explain why deaths caused by drunken drivers have dropped to an all-time low in the golden state.
Since 1995 the checkpoints have also resulted in the seizures and impoundment of thousands of vehicles driven by sober motorists who just happened to have no drivers license. The 30 day impounds cost unlicensed drivers well over $1,000 on average. Large numbers of the non-DUI impounds have involved cars driven by illegal immigrants.
Enter California Democrat Assemblyman Gil Cedillo. The lawmaker, who is a member in good standing of the National Council on La Raza, has tried unsuccessfully nine different times since 1998 to get bills passed in the California State Legislature that would allow illegal aliens to obtain driver’s licenses. “One Bill Gil”, as he is referred to by some because of his repeated efforts legalize illegal drivers, has now managed to get through the back door what he could not get through the front door.
Starting January 1st a new law, authored by Cedillo, will prohibit cops from impounding the cars of drivers who have no license as long as another licensed driver can drive it away. Presumably the unlicensed driver will shortly thereafter resume driving their car, illegally.
This problem, in large part, was the basis for the current law. The new law does not mean that unlicensed driving is now permissible in California. It just means that the consequences of driving without a license, starting in 2012, are virtually non-existent. The law of course never targeted Hispanic drivers nor did it target illegal immigrant drivers. It targeted unlicensed drivers.
The new law has one unlikely and surprising supporter. LAPD Chief Charlie Beck told the LA Times “It’s a fairness issue. There is a vast difference between someone driving without a license because they cannot legally be issued one and someone driving after having their license revoked.” Is there really, Chief? The argument can certainly be made that someone who took the driver’s exam and was issued a license prior to their license being revoked, is a more competent driver than someone who’s never done so.
Two nationwide studies by the AAA Foundation for Traffic Safety concluded that 13 to 14 percent of drivers involved in fatal crashes did not have a valid license at the time. Another study from the 1990’s conducted by the California DMV noted that unlicensed drivers were five times more likely to be involved in a fatal crash than licensed ones. The studies did not consider the reason for the drivers being unlicensed. Nor should Chief Beck.
Gil Cedillo is not alone is his crusade to defend the rights of illegal immigrants. On the national level, the Obama administration, via embattled Attorney General Eric Holder has brought suit against Utah, Arizona, Alabama and South Carolina. All four states have taken action to deal with what officials say is an uncontrolled flood of illegal aliens, many of them criminals, into their states.
Holder claims that allowing each state to create a distinct and independent set of immigration laws will lead to an unwieldy “patchwork” of immigration statutes. This despite the reality that the in substance the various state laws would be largely similar. The state officials, and those who support the law apparently feel that dealing with a patchwork of state immigration laws is preferable to dealing with federal immigration laws that are simply not being enforced—or at best are being enforced selectively.
It’s certainly understandable if state and local officials in Utah, Arizona, Alabama and South Carolina are skeptical. The federal government has insisted “trust us, we have your best interests at heart” all while those same federal officials are, at tremendous taxpayer expense, suing them in Federal Court.
It’s election season. The Hispanic vote is highly sought after by both Democrat and GOP candidates. Any thought that politics have not played a huge role in the way immigration laws are enforced and changed is naive. For too many Democrat lawmakers, the line between preserving civil liberties and defending their “meal ticket”, AKA the Hispanic vote, has become blurred.
There’s a strange irony when lawmakers and activists complain about laws that target lawbreakers. When a nation founded on the rule of law becomes a nation whose laws, especially immigration and criminal laws, are dictated by political agendas, we’re all in trouble.

Surprisingly in 2012 Kansas State Democratic Leaders will mark the second year in a row that will introduce jobs legislation with an explicit immigration-enforcement component. The 'Kansas Job First' plan would require state and local governments, and their contractors, to use E-Verify for vetting new hires.
“With Families are still struggling to keep a roof over their head, to pay for their child’s doctor bills, to keep their gas tank full,” Senate Minority Leader Anthony Hensley said at a Dec. 21 new conference announcing the plan. The E-Verify component is expected to be similar to that contained in Bill H.B.2026 which was introduced in Jan. 2011. The odd thing about another state immigration law is they could sponsor Lamar Smith's Law (R-TX) and start to eliminate illegal aliens from the workplace. Doesn’t Sen. Hensley know that three Democrats, have gone against their own party and signed onto the nationwide H.R. 2885–E-Verify, ‘The Legal Workforce Act?
Related legislation announced would crack down on businesses that misclassified their employees as independent contractors to avoid paying payroll taxes or minimum wages. Or most recently in California in not applying federal immigration laws the state is weighed down with illegal aliens as is Nevada. They even now condoning that foreign nationals who are driving without a driver’s license not have their car impounded. As a legal resident see how far you get without a driver’s license or insurance. Does the Sanctuary State—the haven for criminal illegal aliens, ID thieves and a rising crime rate, think they are immune from federal intervention? My story about ID theft is similar to most of the hundreds of thousands of other people. I’m a retiree now, but it wasn’t so long ago that I was a partner in a small business. The company based in Indianapolis was succeeding quite well. I was suddenly taken ill and whisked off to hospital. During the time in hospital one of the 4 graphic artists the company had hired, found my Social Security number, Drivers license and other pertinent ID in my desk. It wasn’t until I returned to the office in the large house we owned, when the mail man gave me registered letters from large stores and when the phones began ringing from aggressive debt collectors that I was made aware of the credit theft that confronted me? I was enlightened when I applied to the three main credit bureaus; somebody had taken advantage of my illness and stole my personal information.
The graphic artists we had hired temporarily had already completed the work and had since vanished. After realizing the seriousness of my situation I hired a attorney office to try and resolve my problem. So far, many of the accounts have been repaired. However, I refused to pay for something that was not mine, so I’m still haunted by debt collectors. As yet my credit report is still in the red, but I have upgraded credit score. However there are still four accounts that remain my responsibility, even though the amount owed is just $3,600 dollars. Prior to this predicament, by chance I found that three persons were using my SS number to get employment. I informed the Social Security Administration and they had located one of the criminals, working as a Security guard in a Security business in Houston, TX. The SSA told me not to worry and so far, the problem has not been cured to my satisfaction?
People are complaining to the Social Security Administration, the police and other agencies, but little or nothing has been done to halt this very lucrative enterprise? Millions of innocent victims are having their personal ID stolen and even being accused of running up revolving accounts and other credit. Billions of dollars are being stolen and the—DO NOTHINGS—In Congress have not even recognized it as a damaging issue, that must be stopped.

In Arizona the 30 day mandatory impound laws for those who want to drive without a license, or more specific a license which has been suspended or revoked for any reason, has been a true success story. This is one of those few laws put into place that really makes an impact. In AZ if your license is suspended or revoked from the issuing state your car gets impounded for 30 days and is not released until your license is reinstated, which sometimes can even exceed the 30 days. It doesn't matter if the car belongs to the driver or not, or if the owner is with the driver at the time of the stop the vehicle still gets impounded. Also, the operator could have a valid drivers license from their state of residence but may have had their driving privilege suspended or revoked in AZ for not paying traffic fines from a citation issued in AZ and the vehicle will be impounded for the 30 days.
This law is very instrumental in getting those people who have suspended/ revoked licenses to go down to the DMV and get their license fixed or reinstated like the person should have done before this, but didn't want to pay the reinstatement fee or the fines associated with a previous ticket.
It's amazing how fast someone will get their license fixed once their vehicle is in car jail. However, to release the vehicle to the owner at the time of the stop when they have allowed someone with a suspended/ revoked license driving it is wrong. The vehicle still needs to be impounded for the 30 days therefore making the owner responsible for being part of the problem.
In AZ this does not discriminate against illegal aliens due to the fact if the person can provide evidence of ever having been issued a license/ permit from any jurisdiction the vehicle is not impounded for 30 days, but again, the person driving must provide evidence of being issued a license/ permit from another jurisdiction.
Just my personal thoughts on a very good law which has a proven track record of getting people to take care of their obligations from past tickets.

I am not voting for any GOP Presidential candidate that does not state that they will enforce the immigration laws.
One thing I didn't see mentioned in the article was any mention of Liability insurance. One reason why my insurance premiums are so high here in San Antonio is because of all of the illegals driving without a license and without insurance.

Nothing makes sense anymore!…We certainly have been asleep, and too quiet about all the crap that has been going on….People have to start showing local, state and national pols how mad they are about illegal immigration, borrowing and spending, and all the other problems that we allowed to go on for way too long…I don't think taxpayers should be paying medical bills for illegals, educating them, or anything else…I wonder how many people complain to those forcing sanctuary states and cities down our throats??? Is the interpretation that Democrats think illegals are out there driving without driver's licenses a correct interpretation? If you target someone, it usually for a reason, such as driving without a DL. Therefore, democrats are saying illegals are targeted because they don't have DLs.

This should be very simple to deal with.
When a person who was stopped without a license, only to be let go, kills or maims someone when they get behind the wheel again, the politician and the police department need to be sued.
If they have immunity, the parents, wife, or husband of the victim must make a SERIOUS stink about how he loss of their family member was a direct result of this ruling.
Let's see how quickly the tide turns on these dirtbags who are willing to risk the lives of American people simply because they want to shore up their base.

For the past 30 years, or more, each of the 'groups' has been getting together and building their constituencies to fight the rest of America. Yeah, reading that made me want to reply to him, offer some support or maybe just commiserate. We here in the rural Texas Panhandle are having some of that same industrial style thievery going on. We use one-quarter mile long center pivot irrigation systems to water our crops, and more and more guys go out to start up their system only to find the entire quarter-mile of wiring that runs down the top pipe, about ten feet in the air, is GONE… The thieves have also figured out they can jerk underground wiring that is laid inside conduit, by hitching a vehicle on and pulling it out. That is mostly in quarter-mile lengths too. We have had to quit using the conduit for that reason, just lay the wiring in the bare ground. Of course it is well insulated, we were merely using the conduit for extra protection. Any steel or scrap iron we have laying around our farms strangely disappears, even stuff that has been laying about for a quarter century. There is an epidemic of scavenging going on to the point that one must just accept property not inside a locked barn is fair game. Next I expect to find 150 horsepower hollow shaft electric irrigation motors weighing around a ton going missing overnight. I'm sure there is at least 500# of copper in them… Society is breaking down before our eyes, and NO entitlement programs have been cut YET!

What no article mentions is that an unlicensed driver is AUTOMATICALLY un-insured, as well.
NO insurance policy covers a car driven by an unlicensed driver.

Who is a natural-born citizen? Who, in other words, is a citizen at birth, such that that person can be a President someday?
The 14th Amendment defines citizenship this way: "All persons born or naturalized in the United States, and subject to the jurisdiction thereof, are citizens of the United States and of the State wherein they reside." But even this does not get specific enough. As usual, the Constitution provides the framework for the law, but it is the law that fills in the gaps. The Constitution authorizes the Congress to do create clarifying legislation in Section 5 of the 14th Amendment; the Constitution, in Article 1, Section 8, Clause 4, also allows the Congress to create law regarding naturalization, which includes citizenship.
Currently, Title 8 of the U.S. Code fills in the gaps left by the Constitution. Section 1401 defines the following as people who are "citizens of the United States at birth:"
Anyone born inside the United States *
Any Indian or Eskimo born in the United States, provided being a citizen of the U.S. does not impair the person's status as a citizen of the tribe
Any one born outside the United States, both of whose parents are citizens of the U.S., as long as one parent has lived in the U.S.
Any one born outside the United States, if one parent is a citizen and lived in the U.S. for at least one year and the other parent is a U.S. national
Any one born in a U.S. possession, if one parent is a citizen and lived in the U.S. for at least one year
Any one found in the U.S. under the age of five, whose parentage cannot be determined, as long as proof of non-citizenship is not provided by age 21
Any one born outside the United States, if one parent is an alien and as long as the other parent is a citizen of the U.S. who lived in the U.S. for at least five years (with military and diplomatic service included in this time)
A final, historical condition: a person born before 5/24/1934 of an alien father and a U.S. citizen mother who has lived in the U.S.

Separate sections handle territories that the United States has acquired over time, such as Puerto Rico (8 USC 1402), Alaska (8 USC 1404), Hawaii (8 USC 1405), the U.S. Virgin Islands (8 USC 1406), and Guam (8 USC 1407). Each of these sections confer citizenship on persons living in these territories as of a certain date, and usually confer natural-born status on persons born in those territories after that date. For example, for Puerto Rico, all persons born in Puerto Rico between April 11, 1899, and January 12, 1941, are automatically conferred citizenship as of the date the law was signed by the President (June 27, 1952). Additionally, all persons born in Puerto Rico on or after January 13, 1941, are natural-born citizens of the United States. Note that because of when the law was passed, for some, the natural-born status was retroactive.

A dear friend was killed by a drunk driver ( illegal immigrant from Sonora Mexico). He had no license, no registration ,and no insurance. The police (ICE) returned him to Mexico….no penalty for his crime.
It is very easy to identify ( profile ) illegal immigrants especially their vehicles. They invariably have no insurance or licenses.
Approximately 50% of drivers in Arizona are uninsured ( they don"t have any assets worth protecting… why get insurance?) This is especially true for illegals.
