BREAKING: San Diego ACORN Document Dump Scandal
by Derrick RoachOn October 1st, 2009 California Attorney General Jerry Brown announced that an investigation had been opened into ACORN’s activities in California, resulting from undercover videos showing employees seemingly offering to assist the undercover film makers with human smuggling, child prostitution and even tax advice to boot.
Although ACORN has denied any wrongdoing, some of the employees involved were terminated, and ACORN has publicly stated that they would fully cooperate with any investigations that followed.
Interestingly, the local head ACORN organizer in California, David Lagstein was caught on tape earlier this month speaking to an East County Democratic Club.
Mr. Lagstein stated: “…the attorney general is a political animal, but certainly every bit of the communication we have had with them has suggested that the fault will be found with the people that did the video and not the people with ACORN.”
Continuing, Mr. Lagstein stated: “…we are fully cooperating, some of the investigators visited our office this morning and I think they really understand what’s going on.”
Shockingly, we now learn that the ACORN office in National City (San Diego County) engaged in a massive document dump on the evening of October 9th, containing thousands upon thousands of sensitive documents, just days prior to the Attorney General’s visit.
BigGovernment.com has learned that not only did this document dump occur, but the documents in question were irresponsibly and brazenly dumped in a public dumpster, without considering laws and regulations as to how sensitive information should be treated.
I am a local licensed private investigator. I took it upon myself to keep an eye on what the local ACORN office was up to, in light of the release of the undercover videos. I retrieved these documents from the public dumpster.
Documents shared with BigGovernment.com include information exposing not only the inner workings of ACORN in California, but also personal, sensitive information belonging to employees, members and clients of ACORN. ACORN and its few remaining defenders insist that the “good” ACORN provides outweighs the transgressions exposed in the recent undercover video sting. But, ACORN’s massive dumping of these documents and the cavalier manner in which it betrayed the trust of its supporters betrays that talking point. (Unlike ACORN, we have redacted sensitive and personal information.)

ACORN’s political agenda is also exposed, with thousands upon thousands of documents revealing the depth of the political machine that is ACORN, and its disturbing ties to not only public employee labor unions but some of the most radical leftist organizations.
The laws governing how sensitive, personal information such as social security numbers, driver’s license numbers, immigration records, tax returns, etc. must be treated are very stringent, and thus it seems as if ACORN may have committed serious violations in that department alone, with thousands upon thousands of potential plaintiffs.
Included throughout this post are a couple of photos showing the dump site, as well as just a small sample of the type of documents summarily dumped by the San Diego office of ACORN. In addition the video clip, from the evening of the document dump, shows ACORN operatives clearly engaged in some kind of discussion – likely related to the activities of that evening.
Over the weeks and months ahead, BigGovernment.com will continue to release information from this shocking document dump by ACORN, slowly revealing the ugly truth of ACORN: the fact that their stated mission of helping the poor and downtrodden is just a ruse and a cover for an organization that is highly partisan and highly political, and thus rotten to the core.

Any lawyer will tell you that the worst thing to do if you think an investigation is coming is to destroy potential evidence. Documents known to have existed, or that any reasonable organization should have had, but that cannot be produced in discovery are always presumed to be prejudicial against the party who should have had the document.

Why?. . .time to rollout all the points and discuss events, discoveries, and what next — more time to inform vs a quick tv news show segment.
Why not blitz the radio markets to get the buzz out on this latest evidence discovery and gain the ear of those who prefer their information from radio news shows? Maybe enough disgruntled Americans left to start directly requesting answers from Holder, Brown, and the rest of the "See, Hear, Speak – No Evil" crowd.
Many of the radio shows reach the folks who might not have as much time to spare to watch tv or view internet.

OK, I am gonna try to keep my political compass from influencing my comments.
So, lets have a look at this objectively- ACORN employees illegally dumped a LOT (by the appearance of it) of sensitive documents and failed to follow the proper protocal REQUIRED BY LAW. Because they are documents that are related to the entire organization, culpability falls on the organization itself. LOTS of sensitive information has hit the pavement on this one- so who will ACORN call to task with regard to this serious breach of the law? I am betting you will have one mid-level executive come forward and take the blame and get fired and vanish into obscurity (probably well funded, after a tear filled admission about how it was all HER idea because she wanted to get home to her sick child or something).
If no one investiages this seriously, then the people of San Diego who have had their sensitive information "Leaked" should take legal action against ACORN for their flippant, careless, and illegal actions regarding their documents.

I'm sure the careless handling of these documents is another reason to revoke ACORN funding – and Congress has a nice, slow week to contemplate the implications. I'm anxious to dig through here and what sort of govt. docs – like IRS notices?? – were dumped.

Just so you know, even the bits that have been shown here (with the redactions in place to protect the identity of the individual) would be enough to secure a conviction of ACORN. The laws are quite specific on how identity based information is to be handled- how would you react if you logged on to the computer and saw that your Doctor had discarded your medical records in such a fashion?

First, anything in the dumpster is accessible to the public. Possibly property of the dumpster company, but legal standing would rest with the dumpster company, not ACORN.
Secondly, the dates on the I-9 (federal form certifying eligibility) are backwards. The supervisor signed off on the form (4/8/09) BEFORE Lilibeth did (4/16/09). That is illegal and possibly indicative of a coverup for ACORN hiring illegal immigrant workers. The ID that is copied does not appear to be legit as well.
I just got around to watching the through the window video. Not much there BUT sometimes that is the best part, Think of what is going through the heads of those Acorn workers. How long were they watching? What did they see? What other things were they doing to investigate us? If you thought you saw the cockroaches scurring before to cover things up. This is a marvelous idea since it will hit ACORN where they are most vulnerable: the pocketbook. This lawsuit would also pressure Congress to permanently defund ACORN. One problem is that I am sure ACORN will declare bankruptcy, and reincorporate as a new entity.

Thank goodness for this private investigator who thought ahead and decided to keep an eye on things. I am sure that all the documents have all been copied and inventoried, because I feel sure that they will be subpoenaed by the state. The idea of a class action lawsuit by those who's personal data was mishandled is brilliant. I think the more ways that this organization can be attacked the more likely the story will be disseminated and reported. This sounds like a perfect foil for a SNL skit, which might be the very best way to introduce the issue to the general public.

There has been much made of the undercover video by James and Hannah, because it was done without the consent or knowledge of the ACORN employees. I have also heard that they were not supposed to be video taping on private property… If those things are true, why can a PI video tape people who are obviously occupying private property? Are there special rules for licensed investigators?

I think this depends on local laws. However. A PI is not an agent of the court, so he does not have to follow normal evidentiary rules (if I have this right). Dumpster diving may be "malum prohibitum", but it collected evidence of "malum en se" (Bad because prohibited vs bad as such), and PI's certainly have to keep the rules of evidence in mind. I'm hopeful.
