A Victory for Fiscal Sovereignty and a Long-Overdue Defeat for the IRS
by Dan MitchellA Swiss court just threw a wrench in the gears of an IRS effort to impose bad US tax law on an extraterritorial basis, ruling that UBS does not have to hand over data to the American tax authorities.

This ruling nullifies an agreement that the Swiss government was coerced into making with the US government last year. In typical arrogant fashion, the IRS already has indicated that it still expects acquiescence, notwithstanding Switzerland’s strong human rights policy on personal privacy. The Bloomberg story excerpted below has the details, but it’s worth noting that this entire fight exists solely because the internal revenue code imposes double taxation on income that is saved and invested and imposes that bad policy on economic activity outside America’s border. But just as other governments should not have the right to impose their laws on things that happen in America, the United States should not have the right to trample the sovereignty of other nations:
A UBS AG account holder won a Swiss court case preventing data from being disclosed in a ruling that may impede a U.S. crackdown on overseas tax evasion. The failure by U.S. citizens to complete certain tax forms or declare income doesn’t constitute “tax fraud” that would require Switzerland to disclose account data, the country’s Federal Administrative Court ruled in a judgment released today. …“The prosecutors at the Justice Department are not going to be happy with this opinion,” Namorato said in an interview in Washington. …U.S. Justice Department spokesman Charles Miller declined to comment. …The Internal Revenue Service said in a statement that while the agency hadn’t reviewed the ruling it “had every expectation that the Swiss government will continue to honor the terms of the agreement.” …Switzerland distinguishes between tax fraud, which is a crime, and tax evasion, which is a civil offense.
This battle is part of a broader effort by uncompetitive nations to persecute “tax havens.” Creating a tax cartel for the benefit of greedy politicians in France, Germany, and the United States would be a mistake. An “OPEC for politicians” would pave the way for higher taxes, as explained here, here, and here. But this also is a human rights issue. Look at what happened recently in the thugocracy known as Venezuela, where Chavez began a new wave of expropriation. The Venezuelans with money in Cayman, Miami, and Switzerland were safe, but the people with assets inside the country have been ripped off by a criminal government. Or what about people subjected to persecution, such as political dissidents in Russia? Or Jews in North Africa? Or ethnic Chinese in Indonesia? Or homosexuals in Iran? And how about people in places such as Mexico where kidnappings are common and successful people are targeted, often on the basis of information leaked from tax departments. This world needs safe havens, jurisdictions such as Switzerland and the Cayman Islands that offer oppressed people the protection of honest courts, financial privacy, and the rule of law. Heck, even the bureaucrat in charge of the OECD’s anti-tax competition campaign admitted to a British paper that “tax havens are essential for individuals who live in unstable regimes.” With politicians making America less stable with each passing day, let’s hope this essential freedom is available in the future.

The United States used to respect the rights of soverign citizens, the rights of individuals, the rights of truth, liberty and the pursuit of happiness. Somewhere along the lines, those rights got co-opted, and co-mingled, with the Superceding Rights of the Government over the People.
The IRS is a symbol, of an out of control Government.
I'm glad to see there is starting to be some push back. I think down the road you will see a class action lawsuit of some kind by the GM bondholders. The governments action went directly against the Brandeis decision. Naked government power that was in effect theft.

Maybe someday… some prominent politician or group thereof, will come forward and propose that double+ taxation be stopped. The US is in wacked-out, third-world-type financial condition now the the incredible debt and the government spending on overdrive and the government on overreach. It will be hard to reform the tax code as the leftards that put us in this mess will argue status quo or we can't pay the bills. We really need tax code reform (flat, VAT, something) now more than ever. We can grow our way out of this mess with conservatives in government and massive federal reform. I hope we're reading about these initiatives in a few years….

While I hate the IRS I think some of you are jumping to conclusions simply because you don't like the government or the administration.
First, the people/accounts in question are a bunch of rich people that are attempting to not pay their legal taxes in the United States. I for one don't appreciate this. They have moved part of their money overseas and are attempting to hide the income from that money so they don't have to pay US taxes on it. That is tax fraud and in anybodys book that is a crime.
The question in this whole case here is whether or not the tax haven (Switzerland) will allow its banks/brokerage firms to disclose the account information to the US Government. I do not believe they should have to. However, I do believe the US Government should use all of its investigative tools and prosecutory powers to indict and convict the US Citizens of tax evasion and throw their asses in jail.
I pay my taxes. I may not like it but I pay my taxes. There is no excuse for supporting those people that don't report their income and pay their taxes. When they don't pay their taxes in full WE get to pay more.
There would be no need for offshore bank havens if this country was on the up and up.

Don't kid yourself, WE will always be paying more in taxes, no matter how this plays out in Switzerland, as long as we allow a "progressive" government full power over a progressive tax code. That's just the nature of the beast.
If this country ever had the courage to transition over to a Fair Tax or a Consumption Tax, what you would see is a tidal wave of funds flooding back into the U.S. No matter what sorry shape this country is in now because of "progressive" policies, it is still the best and most fertile place on earth for investment, if only we didn't punish those who would choose to invest their money here.

With all due respects, I disagree.____If the tax structure were not odious and burdensome in this country, tax havens would not exist. There would be no need for them. It would be a moot point. Switzerland, Liechtenstien, the Caymans, the Bahamas and a host of other "consumer friendly" areas exist for one purpose, to serve their respective clientele, no different than Deleware or Nevada serving corporate clients.
You have to remember – these people pay NO tax on this money. To these people what is better? Flat/Fair tax or NO tax?

The tax structure in this country is bad – real bad. But as I have said in more than one of these posts much of the money going to tax havens is to avoid paying taxes – any taxes – on the earnings.
US Citizens have an obligation under US law to report and pay taxes on their incomes. As long as there is any level of tax in the US you will have people that choose to hide their incomes in Switzerland, the Caymens or any of a half dozen other places. That is morally wrong.

Personally, and I can't quite remember the exact quote, or who it came from, but remember hearing it said that as a citizen, we have an obligation to pay our fair share of taxes, but a duty to ourselves to not pay one dime more than we should.

The progressive tax code and regulations which both government parties support dictate who will have the depression and who will have the recession and who will succeed. The bank bailouts once and for all dictate the connected won’t be allowed to fail and working people won’t be allowed to succeed and will be stuck with the bill.

The problem is that people are often taxed repeatedly on the same money over and over. If you're a working stiff, like me, we don't have this problem so much. Is it fair that someone spend their life building a business and creating wealth for themselves and their families only to have the IRS take most of it away. It borders on communism.
Only after we do that to the politicians first. Otherwise it will resurrect itself.

Our tax laws aren't fair. Our tax laws aren't logical Our tax laws are overly complex. Our tax system should be changed to something that is simpler, logical and more fair. Read that to mean NOT PROGRESSIVE.
All that being said – I happen to think that smoking a whole bunch of weed or doing really long lines of coke should be legal. But they aren't – and using your logic those people shouldn't be prosecuted because I don't happen to agree with the law. The only thing to remind all of us posting, The IRS is the inforcement arm of the government. The IRS did not write the tax code, they did not set up special exemptions to benefit interest groups, that was all done by our wonderful elected officials. Have any of you ever written your representative and complained about a tax problem? Do you know what that representative does with it? They send it to the IRS to answer, because they have no clue what the consituent is talking about. In most cases when it gets down to the nitty gritty, the issue the taxpayer is upset over was voted for by the representative. Don't blame the Police-officer for inforceing the laws. Now to further the aggrevation lets conscider Charlie Rangle and Tim Geitner..but that is another can of worms.

My farmer grandfather had the IRS come to the door back in the 30s and beat the hell out him over $20 they claimed he owed for selling vegetables on the side of the road. Before they left they smashed all the glass and beat dents in his truck.
A very sensible decision by Switzerland's Administrative Court! If they had coooperated with the Obama administration, we could not count on gettting 5 votes out of the Supereme Court, which is where a case would go if someone was forced to surrender his Swiss account.
The Obama administration is every bit as socialist as the governments of Hitler, Stalin, and Mao.
Actually most laws are in broad terms, and then it is left to the appropriate department to write the regulations that apply the law. The IRS deserves part of the blame.
The whole deal was weak anyway, they were only going to hand over info on 4600 accounts out of the 19,000+ the IRS really wanted.And to top it off the whistleblower got 20 month jail time for his efforts…

To an extent you are right, it really is our elected officials that have placed these excessive burdens on us. But I've also seen many instances of the IRS trampling on the rights of taxpayers. I've seen the IRS attack people for political purposes and I've seen them needlessly destroy people for no other reason than to create fear of them.
Yes I know that for the most part the IRS consist of people that are just doing their jobs, but their collection branch tends to be over zealous and there are not nearly enough checks and balances on them.

Every democrat must be thrown out in Nov and fiscal sanity must be restored. Instead of bailing out banks, unions and nationalizing industries we need to bring the corporate tax rate down to 5% for the next 10 years. Payroll taxes should be suspended for the next 3 years. All tax brackets should be reduced by 50%. The federal govt will have a revenue windfall and the economy, including Wall Street [that's where your 401k is invested liberal idiots] will immediately begin climbing upward.

As one of those "bunch of rich people" let me fill you in on the reality.
I live in Belgium. In 2008 I paid, are your ready for this, 56% tax in Belgium. That is right, 56% tax. Now normally, I would be able to deduct up to $85,000 on my gross income and also deduct the taxes paid to Belgium to avoid double tax.
However, the US gross income is determined by the average exchange rate with the local currency. So, just because the dollar was in the tank 1.6 dollars to the Euro, I suddenly became 'rich' in dollars. The fact that I averaged 3,200 euros a month net doesn't matter to you does it? No, by US government standards, and yours it would appear, I'm 'rich'.
Well, because I'm 'rich', even though this is due to a shell game based on a crappy exchange rate, I had the 'joy' of paying Alternative Minimum Tax. That's right, paying 56% tax in Belgium wasn't enough, I had the honor of kicking another $10k or so to the US, because I'm so 'rich' you see, I fell into AMT.
Why? When I'm "rich' and fall under AMT, I LOSE all my Belgian tax paid as a deduction. That's right, there are no tax deductions for local tax paid under AMT (which is BS anyway due to an exchange rate, it isn't like my Belgian income jumped 60% because the dollar tanked. I'm PAID in Euros). But to you I'm rich, right? So that is OK I guess…
So, I paid 62% tax in 2008, all this on a take home salary of about 3,000 euros a month net.
DO you know what countries tax on nationality? The US, Cuba, North Korea, and Zimbabwe. That's it. Everywhere else taxes on residency.
Also, we expats have no representation in Congress. Do you think they care about us? Hell know, we are free money to the government with no constituency power to get them thrown out. WE GET SCREWED.
So, obviously, you like the company of Zimbabwe, North Korea, Vietnam, and Cuba as far as foreign earned income tax planning? Oh, that's right, I'm abroad so I must be 'Rich". According to US statistics, I am. Funny, I don't feel very rich, and I'm sure the vast majority of the people with UBS trying to avoid these stupid double taxes are exactly like me.

IRS went into operation without being properly ratified was my understanding, too. However, it was ratified later on.
They don't have any. We don't see that many European tourists coming here to America. They have internal problems, I suspect, that aren't brought to light. One situation that Berlin has, is a very large presence of Islam in their society. There are more Muslims in Berlin than in Turkey. (History Channel -?)

The Best Tax System I've found to be in the Old Testament. Those funds went to the "State" and to the "church", which were separate instituions but "cemented" together with their Religious Belief(s). Businessmen paid 10% on their net profit. Workers paid nothing. Eventually, the 10% tax (tithe) was too much, so it was reduced to 10% – every 3 years. The Administrators, of church & state functions received no salary. Land had no value unless it was used for something. & many more benefits that reduce or eliminate financial pressures. Foreigners could not own land in their country, neither hold any Office until after a certain length of time. Some foreigners could never hold office in their country.
Lots of us not watching much TV, and we're cheering the Swiss.

The discussion is about the ability of US citizens to use foreign accounts to hide their money offshore. It also is about the US Government ability to gain information about those foreign accounts to prosecute "tax cheats" that are US citizens.
By my quick approximation you paid 6% US tax on your income and I am sorry to hear that because that income should be sheltered against taxation in the US – under US tax law. The AMT does blow. But, do I hear you complaining about paying 56% tax in Belgium? NOPE. Maybe you should stop complaining about US tax policy and start re-thinking the whole Belgium thing. Or, if you like the whole Belgium thing you could always give up your US citizenship and become a citizen of your little socialist utopia.
As I said before – I don't like US tax laws but they are the US tax laws. If you don't like them elect representation that will change them. Otherwise compute your taxes to your best advantage under the tax laws.

Would love the "Fair Tax". The present system is not just a revenue stream for the government but gives government "control" over it's citizens and controlling our behaviour (Sin Tax, Fat Tax etc.).. The dirty little secret of Belgium is that capital gains are…0%. In fact, any profit I make with my consultancy is taxed at the corporate rate of 30%.
So, the 911 for you is that my current marginal tax rate, in socialist belgium, is actually LOWER than it would be if I was back in California.
In fact, I can even lower my tax exposure by investing the 21% VAT that I can legally hold for 4 months. Any return leveraging the VAT offsets the payment.
So, you tell me, is it right that capital gains and corporate taxes are LOWER in belgium, arguably the highest tax and one of the most socialist countries in the world, than the US?
You say I should elect a representative that will change US tax laws. How? I am not a US resident, I don't have local representation. If I claim one I will pay state taxes. My domicile is Belgium. I can only vote on the Federal ballet.
Why should I have to worry about double tax? A German doesn't (unless he lives or invests in the US). In fact, virtually no other nationality does unless they earn income in the US. The arrogance is staggering.
It's a little known secret that we pay more taxes than some socialist countries. And we get nothing in return for it. This nation is run by a criminal mob and it's reflected in our tax code.
