Obama NLRB Nominee Craig Becker’s Smoking Gun?

One recent piece of evidence to add to the growing Becker rap sheet:
In last week’s U.S. Senate Health, Education, Labor, and Pensions Committee hearing, Obama nominee Craig Becker clearly tried to put distance between himself and his former client ACORN:
Sen. John McCain (R-Ariz.) asked Becker this question:
“Do you perform work for and provide advice to ACORN or ACORN-affiliated groups while employed by your current employers or on a volunteer basis?”
Becker responded, “Senator McCain, I have never done so.” (Emphasis added)[2]
Becker statement to the Senate Committee is that he has never provided legal advice to ACORN or to an ACORN affiliate while employed by SEIU; but, an ACORN produced report directly conflicts Becker’s statement.
ACORN’s “2006 YEAR ENDING – YEAR BEGINNING REPORTS” publication (a compilation of reports filed by ACORN organizations) declared that Becker while serving as SEIU Counsel was also a counsel for ACORN:
“Legal Representation – In the past we have used Steve Bachmann and the CCI legal team; SEIU counsel, Craig Becker; Art Martin in Southern Illinois…” (Emphasis added)[3]
In addition as the National Right To Work Committee’s report on Becker noted, ACORN’s Founder Wade Rathke produced some interesting commentary about Becker that contradicts his statement as well:
“Here’s a big win no matter how you shake and bake it: Craig Becker being nominated for a seat on the National Labor Relations Board (NLRB)! … having crossed paths with Craig for more than 20 years, finally we have a situation where a brilliant, effective, and pro-worker/pro-union lawyer will be on the NLRB. …
“I can remember Keith Kelleher[4] negotiating the subsidy for [ACORN’s] SEIU Local 880 in Chicago and always making sure that there was the money for the organizers, but that SEIU was also still willing to allow access to Craig [Becker].”[5]
Rathke even credits Becker with the massive forced unionization of home health care workers.[6]
“For my money Craig’s signal contribution has been his work in crafting and executing the legal strategies …leading to the membership of perhaps a half-million such workers in unions like SEIU, AFSCME, CWA, and the AFT.
“Craig was the key lawyer from the beginning in the early 1980’s who was able to piece together the arguments and representation that allowed those of us involved in trying to organize home health care workers in Illinois, Massachusetts, …His role was often behind the scenes devising the strategy with the organizer and lawyers, writing the briefs for others to file, and putting all of the pieces together, but he was the go-to-guy on all of this.”[7] (Emphasis added)
Becker Sought International Jurisdiction Over NLRB
Becker has appealed to international organizations to apply pressure to the NLRB arguing that the NLRB should follow “mainstream international laws” rather than U.S. laws.
In 2006, Becker as AFL-CIO Associate Counsel spearheaded an AFL-CIO complaint to the United Donations against the NLRB ruling that nurse shift supervisors are indeed supervisors. The AFL-CIO appeal to an international body beyond the sovereign government of the United States and the NLRB. This is the very same NLRB where Becker now wants to sit as a member.
“‘This will demonstrate how far outside the mainstream of accepted international law the U.S. is moving,’ said Craig Becker, a legal counsel to the AFL-CIO.” (Emphasis added)[8]
Becker’s ACORN associations and his deference to international laws are only a fraction of Becker’s whole public record that calls his nomination into question and the need for you to act now to stop his confirmation by your U.S. Senators.
Here are some additional reasons that you might mention to your U.S. Senators when you call or e-mail them:
Craig Becker wrote that Secret ballot “elections are profoundly undemocratic.”
- He believes that a worker’s choice should be between which unions workers should be forced to join; he does not believe a worker should have the choice not to join to a union.
- Becker argued that just as U.S. citizens cannot opt against having a congressman, workers should not be able to choose against having a union as their monopoly-bargaining agent. “‘Employees’ only choice,” explained Mr. Becker, “should be over which set of union officials get ‘exclusive’ power to negotiate their wages, benefits, and work rules.”
- In addition, Becker through his writings has attacked the members of The National Right To Work, and will be incapable of fairly judging any cases that the National Right To Work Legal Defense Foundation brings before the NLRB.
Becker does not express a belief in individual rights of workers to freely choose to join or not to join a union. He supports the idea that workers should be forced into collectives like unions that dominate and control individual working conditions. Becker’s beliefs are the antithesis of American democracy and liberty, and his beliefs will have disastrous results if implemented by the NLRB.

I'd love to contact my Senators offices but, to be honest, I can't even try to fool myself that Durbin and Burris would do anything but ignore it and vote in favor of this nomination anyway.

One good bit of news today, Sen Ben Nelson expressed his disapproval of Becker and his intention to vote NO.
We'll see if he follows the same pattern as the health care bill though.

I know how my Senators in TX will be voting, yet I contacted them anyway. Those of you in places like IL and MD should speak up for sure!! Durbin, Burris, and others NEED to hear from the people, whether you think it will sway a decision or not.

Just as Toyota was engaged in tense negotiations with federal officials over problems with sudden acceleration, the automaker's North American subsidiary donated more than $75,000 to two major political committees.
The U.S. subsidiary of the Japanese automaker donated $50,400 to the Democratic Governors Association in November and December of last year. The company gave $25,000 to the Republican Governors Association in November, having already sent a check for $25,000 in April.
Most of the contributions landed as the car maker began tense discussions with the U.S. Department of Transportation over mounting concerns with random acceleration in several of its models.
Toyota is not allowed to donate directly to federal office holders or candidates. But these contributions were legal. Corporations — even the U.S. subsidiaries of those with foreign owners — are permitted to donate to the major gubernatorial fundraising committees, and no limits have been placed on how much they can give.
Still, these donations appear to have been unusual. Toyota does not have a large public footprint when it comes to political giving. There is no report of the company making a similar donation to the governors associations during the prior three years. And the automaker does not have a registered political action committee under its company banner, though foreign-owned corporations can establish and contribute to PACs as long as the PACs are overseen by an American citizen or green-card holder.
Toyota Spent $5 Million on Lobbying in 2009
Most political contributions bearing the corporate name have come from U.S. dealerships. For instance, Wilfred Templeton Fort Myers Toyota in Florida gave the RGA $20,000 last year. And a PAC formed by Gulf States Toyota, a regional association of 150 dealers, handed out $1,000 donations to eight Republicans and four Democrats from Louisiana, Texas and Oklahoma.
The automaker does, however, spend prolifically on lobbying. Last year, Toyota spent more than $5 million on its lobbying efforts, according to figures compiled by the Center for Responsive Politics. Eight major lobbying firms identify Toyota as a client.
And as the company's difficulties have become more complex, its Washington team appears to be growing. Earlier this month, Toyota hired the DC public affairs firm The Glover Park Group. The Washington-based firm includes principals Joe Lockhart, a White House spokesman under President Bill Clinton, and Joel Johnson, a former Clinton senior adviser, as well as Kevin Madden, a communications specialist for Republican presidential hopeful Mitt Romney.

Their response is to reiterate their 100% support for Obama and all his policies. Durbin and Burris are just bad, immoral people that are like a cancer growing on our republic. They don't have a shred of decency. Thankfully, Burris is leaving but I think that seat will have to be pried out of Durbin's cold, dead hands.
Senators Reed and Whitehouse of Rhode Island are Obama appendages. A snowball has a better chance in hell.

He outright ignored a DVD of dozens of people asking straight up questions and an additional letter signed by over a hundred people asking him again to respond to what was delivered to his office. Unless he pulls a Dodd and skates out, he will be in a position to have to address his choices publicly – when the time comes.
As Mr. # 2 in the Senate has time to chair a campaign for the intended Democrat successor for Burris (Alexi), at a time when the Senate isn't performing, he only adds to the things he will be answering for soon enough.

Bush 43 made several, but none who'd been rejected (effectively) by filibuster; he appointed those whose nominations never even came to the floor for a vote.

Nobody wants to ruin America. It is collective bargaining and it is an American tradition.
The unions are not out to strong arm anyone. They are simply exercising the same rights of assembly as the teapartiers. It's still a free country.
The middle class in this country was built on union labor. Even if you don't belong to a union you benefit from the higher wages corporations are forced to pay to compete for labor. Just the threat of unions is often times enough to motivate employers to treat their people right.
These are not lifetime appointments being held up in the senate. They are the upper management the president needs to conduct the business of state.
Sen. Shelby announced this week he is putting a hold on 70 Obama nominations until he gets the $30 billion in pork he wants for his state. Apparently he backed off when the senate ethics committee threatened to look into his ties with defense contractor lobbyists.

Neither were the holds put on the President Bush nominees "lifetime" positions and maost of them were of far more importance than today's denial.

That is a weakness that I see mostly on the right fringe… accusing political opponents of being less patriotic or American than ourselves. For one thing, it is almost never true. And it's just bad form.
Unions aren't your enemy. All working class Americans should be thankful that we have collective bargaining to ensure fair pay and benefits. Even if you don't belong to a union you benefit from those who have come before. Just the threat of collective bargaining cant keep employers honest.

Tell that to the people of NYC whose taxes go to pay many hundreds of teachers who can't be fired, who have committed sexual crimes against innocent kids, but who are paid to sit in what is called "runner rooms" and paid their full salaries and benefits. That's but one example; I can give you at least 50 others.

This isn't necessarily over yet because a big potential problem remains, namely the real possibility of a recess appointment by Obama to this position. The question remains as to whether or not he will be appointed in such a manner given the decreasing support for Obama. So, I encourage everyone to continue trying to contact your Senators to let them know that this also is UNACCEPTABLE.

Federal Union workers should not be allowed to vote in ANY federal election, they should have given up that right when they joined the union and don't allow the people a voice in their contracts negotiations..
