ObamaCare: Fighting On
by Dr. David JandaOn Sunday morning, March 21st, I sent an e-mail to a handful of individuals, including Mike Flynn of Big Government.com, who have been very supportive of my efforts in informing people, family and businesses on Prevention, cost containment and health care reform. The topic was the impending passage of Obama Care and the stripping of Freedom and Liberty from every American which will be the end result.
One of the people I contacted was, Dennis Gartman. One of the nation’s and world’s leading financial analysts, investors and financial public educators through his work in the media. Dennis is the founder of The Gartman Letter….a daily financial road map for corporations, individuals, investment funds and governments. Dennis asked if he could include my e-mail in The Gartman Letter. Below is Dennis’s article concerning my e-mail.

GENERAL COMMENTS ON THE CAPITAL MARKETS ON ONE WELL KNOWN DOCTOR’S PERSPECTIVE ON HEALTH CARE:
Our friend, Dr. David Janda, is a nationally well known orthopaedic surgeon in Ann Arbor, Michigan, involved in delivering health care for 29 years.
David’s a clinical researcher in Prevention and Health care cost containment and he founded The Institute For Preventative Sports Medicine which is the only health care cost containment organization of its kind in North America. According to the Federal government, one of his studies has lead to the prevention of 1.7 million people from being injured every year in the U.S. and saved $2 billion in health care costs per year.
David also wrote a bestselling book….The Awakening of a Surgeon…… featured on The Oprah Winfrey Show and it’s been referred to as a “Weapon of Mass Instruction” as it tells people and families how to take control of their health care and to free themselves from the insurance companies, from the HMO industry and most importantly from federal bureaucrats.
That being said, David wrote to us last evening as the health care legislation was making its way to the House floor. He’s told us in the past about the ills involved in this legislation, but now it has passed and it has come to this. We believe David’s thoughts, as a physician of some renown to be worthy of our clients’ collective attention, He wrote:
It is Sunday and it looks like Obama, Pelosi and Reid have succeeded in passing their health care plan which will destroy every person, family and business in Our country. In the process they have shredded The Constitution and Our democratic republic.
Thank you for all that you have done in informing the public and allowing my voice and my information to be heard. I believe my perspective as a “grunt” on the front line of health care delivery and 29 years experience in doing so matters. By networking my information, you allowed me to share my insight with the American public. The democrats and progressives believe the war has been won…..wrong….they might have won the battle but the War has just begun.
In the next several weeks I will be sending out an e-mail announcing that I will be leaving the medical delivery profession. My wife and daughters support my decision. The legislation authored by Obama, Pelosi and Reid is a violation of The Hippocratic Oath I took 29 years ago…..”Do No Harm”. The core of their legislation is to deny and ration care…..the most inhumane and unethical means of cutting costs. I have dedicated my life….day and night to my patients for the past 29 years…..I have attempted to add to the oath through my research and published studies which have focused on prevention…. “Preventing Harm”.
Their legislation puts me in the position of harming the very people I have been helping for the past 29 years.
In 1920, the federal government instituted legislation that took my great grandfather’s business away from him. He owned a brewery in Chicago. He died a broken and destroyed man within a month of that event. Ninety years later, the federal government has passed] a law that will take away my beloved profession of health care delivery. I will continue to fight and will not meet the same fate as my great grandfather. If I can be further service to you please call on me.

When good men like David leave medicine we know that we are in very serious trouble. Mark our words; a year from now the state of medicine and health care here in the US will be demonstrably worse than it is now; it shall also be demonstrably more expensive and it will be even more demonstrably less available to anyone and everyone. Last night’s legislation was what the Left has been aiming for many, many years. They’ve succeeded in nationalizing health care, and they’ve succeeded in sending men such as David to the sidelines. We are all the worse for it…. demonstrably so.

I appreciate Dennis’s friendship and kind words. I do plan on continuing to fight to repeal and replace this prohibitive legislation on behalf of America, my fellow citizens and my patients. The medical “oversight” component will occur on January 1, 2013. I will continue at my post on the front line until December 31, 2012 then I will continue the fight from another front. The battle might have been lost for Health Care Freedom on March 21st but the War is far from over in bringing health care freedom to every American.

Who in their right mind goes through the time, expense, hard work of medical school, earns a title of prestige and respect, takes on a profession of huge responsibility – just to become another government drone?

I'm in college now, and if half the people who say they are pre-med make it into any health care profession, then I'll be eating a lot healthier and taking much better care of myself. No way I'm going to trust any of them to perform a surgery or take my blood pressure.
The rationing of care in the Obama health law is based on fake science – the Accountable Care Organizations (ACO) will establish national standards of who gets what – for every illness. Hospitals will not be reimbursed if they give more care than the government standard.
Good plan! My son will be sitting his last set of finals at ASU in a few weeks and some of the students can not speak in full sentences let alone write above the 6th grade level. It is frightening that the HC reform Act is willing to lower admission standards for Medical School.
This ObamaCare will force patients to give up their personal doctor visits, and instead "Tweet" when they are sick. This is an OUTRAGE. Please see the article at SPN Headlines:

I think perhaps you give them way too much credit. Collection wisdom and common sense in the SWAMP is in really short supply!
Our Government stole 4 trillion dollars from social security and now its in big trouble. But we do have a huge box of IOU's… sigh. Every Government program runs over budget and produces little. Why would we ever want Government involved in anything they don't have to be? Why let them and there special interests drive up our everyday costs with more regulations and earmarks?
The progressives achieved there goal of growing Government with the passing of this heath care bill. Our cost will go up our level of care will go down. They cut funding to the states who were already struggling to cover the seniors in our current system. But they did cover the young and lazy!!!!! This mess has to be cleaned up we can't afford it. We need to strive to become what we once were a nation defined by people having the freedom to achieve their dreams through hard work.

I figured as much and know your are not giving them kudos for brightness. I am just in a fiesty mood today as well.
The best place to affect systemic change is within the system. The system failed too many times to make changes, so outside action became necessary. The good doctor sounds like the elitists in our universities when he decides to quit rather than stand and fight the system from within. I would rather he stay a medical professional and practice Civil Disobedience instead of running away.
If he can't provide the care that is necessary under law, than he should BREAK THE LAW. Where are there police who will lock up doctors for healing people. What jury will convict a caregiver of giving care. If there are concrete problems with the new laws (when they go into effect) than the best way to fix them is probably Jury Nullification. Laws are merely words on paper until somebody enforces it. If juries refuse to convict, the law returns to mere words.
I would stand behind the doctors who stand strong against unjust laws, but they must remain standing and not bow out before the battle has even begun.
Vote out an incumbent this year!
Government heath care has nothing to do with health. It has everything to do with power and control. Just like medicare and medicaid, after a while this will create a "voting constituency" that will get pulled and tugged on by elitist politicians trying to grasp for more power and control. The spiral down hill continues. This "health" nightmare must be repealed.
No problems, dude. We are all headed for medical tourism, Mexico, Thailand, offshore on ocean liners. As far as I am concerned, Obamacare means lousy service, rationing and long waits except for those who are willing and able to travel, and get our insurance from overseas. It's what they do in Canada…by the way, I never got a word from any doctor or insurance company I did business with before this vote. I think they thought this new Obamacare would make them rich. Don't worry. Within 3 years, most health insurance will be gone and it's medicare for all.
I'm sure the Republicans 2012 front runner Mitt Romney will fix healthcare. He said he fixed it in MA without raising taxes.

No thanks I know of a couple of clinics already established being staffed with top notch surgeons just south of the border. Mexico's new economy will be Medical Tourism. I would never have thought it could happen but it has already begun. They started practices down there a few years back and there is no med malpractice and they can fly in and out in about an hour. I am sure the media will pick up on this one day this year. No insurance, cash only and they only provide certain types of care at this time.

Dr. Janda, if you are so concerned about the rising cost of healthcare, then why are you a member of the American Medical Association, an association that promotes an artificial shortage of doctors so that their salaries are artificially high?
No less than Milton Friedman, the conservative economist, pointed this out long ago.
"In his classic book Capitalism and Freedom, Milton Friedman describes the American Medical Association (AMA) as the “strongest trade union in the United States” and documents the ways in which the AMA vigorously restricts competition. The Council on Medical Education and Hospitals of the AMA approves both medical schools and hospitals. By restricting the number of approved medical schools and the number of applicants to those schools, the AMA limits the supply of physicians. In the same way that OPEC was able to quadruple the price of oil in the 1970s by restricting output, the AMA has increased their fees by restricting the supply of physicians."

I am NOT a member of the AMA. For your information….less than 20% of physicians are members of the AMA. I'm sure this will disappoint you…..I resigned from the AMA years ago, when after trying to get the Ivory Tower Elitists that run the AMA, adopt a patient centered health care reform plan. They were NOT willing to listen to "grunts", like myself, that take care of patients on a daily basis. I suggest that before you start throwing grenades…..know who the enemy really is.
My observation is this. They added all those people to the health care roles for the votes and the votes only. The same they are going to do for illeagal immigration, for the votes. They dont care that the syetem will be strained and the dr's leave. They dont care about the health of ANYONE. Its all about the votes. The poor are to stupid to know this. They are cheering in the streets cause they think they are going have free healthcare. Freedom is not free and neither is healthcare.The dr's are the ones who will take the hit because they will not get paid. We have poor souls calling our offie(Dr.Office) saying the medicaid people gave me this number. Our response in alot of cases is The Dr. is not taking any new pt.'s at this time. Tragically, it's already begun.
My mistake. I assumed that since you were against healthcare reform, that you were a member of the AMA which took a stand against the reform. Evidently, you agree that there should be a public option, as do 73% of medical doctors.

Is he repeating the use of Demonstrably because Obama uses it all the time? I hate how small his (Obama) vocabulary is, always using the same talking points and predictable "big words".
According to what I've read, the bill imposes financial penalties on a certain proportion of doctors (tied to Medicare payments) who refer to specialists "too often"—meaning more often than the other 90 percent.
They don't need to put people in jail. Just bankrupt them.

A recent study through a peer reviewed medical journal revealed 46% of physicians will leave the practice of medicine due to the institution of Obama Care. Dr. Elaina George, posting on the Bigs, has openly stated that the new docs coming in are mostly foreign – many from medical schools in the Caribbean.
I know but I prefer that option for a major issue than an MD who got into Med School based on stuff other than academic tests. If this stands, future generations will really lose. We can get top notch care even if expensive for the rest of our lives. Our children and grandchildren may not even have the option.
Hopefully educated here and working for the VA to repay their education costs.

From all that I have read across many sources you are right on. My own Physician is getting ready to exit his practice within the next 3 years if this stand. He is 48 years old. My Daughter works for a major non-profit hospital and many of the surgeons have already begun establishing clinics south of the border to allow patients to continue to recieve care that the government will not be approving. General Surgeons and Cardiac Care and several other specialties are building out small private hospitals and will continue to care for those patients who can afford to pay. No malpractice premiums and very limited government control for those who want it.
So sad.

READ THE DAMN BILL they have councils to decide what treatments for what patients. Not the Mr Smith you do not pay enough taxes. It will be Mr Smith you are 65 and 15 lbs overweight and smoked till you were 50 and we will not approve a treatment to keep you alive but we will give you a pain medication to make you more comfortable.

I applaud the excellent and insightful comments expressed in this forum.
