Health Care Reform: The Dog That Was Not Allowed To Bark
by Dr. David JandaLast week, Congressman Thad McCotter introduced a Bill HR 4500, The Freedom From Rationed Health Care Act, that invalidates a little known, hidden part of the Stimulus Bill. That hidden part of The Stimulus Bill created the rationing and enforcement boards. Significantly, this “minor” fiscal trim makes the first part of ObamaCare null and void.
On November 7th, 2009, Speaker Pelosi marched to the podium and paraded her lap dogs to the microphone to proclaim “Victory” for herself, her Democratic House colleagues, and President Obama. What about every other American? The “Victory” was the passage of the second part of ObamaCare, “The Health Care Bill.” That’s right, the second part of ObamaCare is the 1,990 page bill that created 118 new boards, commissions, offices and bureaus. The same bill that will be paid for with (1) $740 billion in tax increases, (2) a cut in Medicare to Seniors by $500 Billion, and (3) a cost shift of $34 Billion to States in unfunded mandates.
This “Victory” was Pelosi’s and President Obama’s second victory on the health care front. The first occurred under the cloak of darkness and obfuscation, in February 2009. Hidden in The Stimulus Bill and passed into law were the ominous Obama, Pelosi, Reid rationing and enforcement health boards.
On that same evening of November 7th, few know that the GOP Leadership proposed an Alternate Reform Package, and each and every member of the minority signed on. This Alternate Reform Package received no fanfare. The problem was, the President and Speaker Pelosi blocked the Alternative Health Care Reform Package from being discussed or even introduced on the floor of The House……it was “The Dog that was NOT allowed to bark.” How open minded, how transparent and how American is that !?!
We cannot afford to ignore the GOP input. This Alternate Reform Package addressed the main issues needed in reform:
- Empower the public,
- Lower health care premiums,
- Establish Universal Access Programs for those with pre-existing conditions,
- Reduce junk lawsuits,
- Prevent insurers from canceling a policy,
- Allow Americans to purchase insurance across state lines,
- Expand HSA’S, and
- Promote Prevention and Wellness.
On November 4th, Glenn Beck allowed me to “borrow” his audience and to give them a frontline assessment of the health care legislation pending in Congress.
In my discussion with Judge Napolitano on the Glenn Beck Show, I hammered on the facts that (1) the Rationing and Enforcement Boards were already created and passed into law through the Stimulus Bill, and (2) the President had already appointed the members, funding them to the tune of $20.6 BILLION. When I pointed out that these boards were charged with directing healthcare “at the time and place of care,” Judge Napolitano expressed outrage at the prospect of these government entities insinuating themselves into the previously private and confidential doctor/patient relationship. The biggest outrage is the fact that no one seems to know that THIS IS ALREADY LAW! These rationing boards threaten your privacy, your control, your health, your treatment possibilities, and your future.
Enter Congressman Thad McCotter. He acted upon the information in my interview and added two very important Sections to The Alternative Bill :
DIVISION D—PROTECTING THE DOCTOR-PATIENT RELATIONSHIP
SEC. 401. RULE OF CONSTRUCTION. Nothing in this Act shall be construed to interfere with the doctor-patient relationship or the practice of medicine.
SEC. 402. REPEAL OF FEDERAL COORDINATING COUNCIL FOR COMPARATIVE EFFECTIVENESS RESEARCH. Effective on the date of the enactment of this Act, section 804 of the American Recovery and Reinvestment Act of 2009 is repealed.
With the addition of these two Sections, the subterranean health care coup within The Stimulus Bill, would have become NULL and VOID. However, by Pelosi’s and Obama’s block of the alternative bill the rationing boards survived.
Enter Congressman McCotter again. On January 22, 2010 he introduced a Bill, The Freedom From Rationed Health Care Act, that would make the health care portion of The Stimulus Bill extinct.
I thank those in Congress who were willing to listen to ‘the grunts on the front line of our health care system and to create the alternative Bill. I thank Congressman McCotter for (1) having the “guts” to call out the President, the Speaker, Senator Reid for their subterfuge in enacting the rationing and enforcement boards, and (2) for proposing a remedy for the unpalatable Democratic draught….not once but twice.
Health Care is too important to enact by default. It deserves debate and dialogue. It is too important to relegate to back room deals, special interests, and bureaucrats with NO functional medical knowledge. We need a simplified health care system that can deal with reality, not smoke and mirrors. We do not need to add expensive bureaucratic gridlock that limits your access to treatments and care and decimates our health care delivery system. We need to diagnose the ailments in our system, and identify solutions that do not create worse side effects and complications. The” dog that wasn’t allowed to bark” addresses these issues. Congressman McCotter’s new Bill should put the “rabid dog” being pushed by Obama, Pelosi and Reid in a cage for good.

That proclaimed “Victory” by Madame Pelosi and Barry the Brazen was their “Mission Accomplished” moment. Perhaps Keith Olberman will start counting the days, since they proclaimed their ill timed “victory”.
This will be Obama’s defining moment, his crowning achievement. It will go down in history as his Jimmah Carter moment. But it will be his Iranian Hostage Crisis Moment.

What's amazing to me is the constant lying by the President, Madam Speaker, and other prominent Democrats and MSM personalities. They have consistently said that rationing of healthcare is a myth and that anyone who believes it is a right-wing-extremist lunatic, even though they've known it was there all along.
I am continually surprised at the shear deviant cunning of this administration when it comes to pulling things over on the majority of the American public though. They knew a long time ago that not even a simple majority of Democrats would be safe voting for a Healthcare Reform bill that included rationing of care. Instead of trying to do the impossible, they instead snuck it in a completely unrelated bill. I only wish this level of ingenuity and cunning was being used to invent new ways of finding terrorists around the globe and providing our military with better intel.

I keep reading the headlines saying that the President and other prominent Democrats are reconsidering their options on passing this Healthcare Catastrophe in the light of Senator Brown's victory in Massachusetts. I hate to say it, but I think that's a complete and utter misread on the situation.
They realize how unpopular their agenda is with the American people, and they also know that their super-majority is the only thing standing between them and the American people until the midterm elections. Instead of drifitng towards the middle for the rest of his first term (like many pundits are saying), President Obama and his Democrat super-majority are going to go full steam ahead with as much of their agenda as possible before they lose it.
And, knowing our President, I'm sure we're going to see plenty of him, Gibbs, Axelrod, and Pelosi on television telling us that they've heard from the American people and that they're going to put the brakes on healthcare and cap-and-trade and move more to the center, even while they're maneuvering to immasculate the filibuster and find other ways to get this legislation passed.
So, they were technically telling the truth? The Death Panels aren't in the Health Care Bill? Jerks.

My representative had a phone conference town hall (cool idea I thought) and mentioned that he had been involved in and signed the alternative health care reform bill. This is in MD as an aside. Their are some conservatives in MD still.
I tried to mention this alternative bill as an example that Republicans had indeed come up with an alternative and I was basically told I was delusional on the forum I posted it on because no one had ever heard of it before. Republican politicians don't need to be better just at defending themselves against the accusation of racism, but also getting their alternate proposals before the masses in this country that only watch the MSM. It will be difficult because the MSM doesn't like to let these views on very often but maybe it will get easier over the next few months. They need to figure out a way, and all of us that know of alternatives need to do our best to educate others who haven't heard of them and don't frequent sites like this.

To any Republican [RINO] who votes for the health care bill in it's present form, be advised that you are setting yourself up for retirement – though it probably won't bother you that much – since you are still on the public dole.
If there is to be a health care bill it should be "bi-partisan" with Republican's and Democrats participating. It should not be only one-sided and beholding to "bribed" Senators and Congressmen. It should also not try and redo the whole system at once. If they want to tweak it to prevent "precluding prior illness, etc. fine. But don't FU the entire mess and give us the Health Care System of a third world country.
Finally, BHO need to realize that the election of Scott Brown was not like his election. Mr. President, as a retired Police Officer, had I been the Officer in question and received your invitation to the summit, I would have respectfully declined to attend.
Why am I not surprised by this revelation. As more and more of these criminals are unelected and decent human beings are placed in power, God only knows what we will find. My understanding was that the stimulus money was used for the first part of the program–to establish the network of computers in all hospitals and doctors' offices–all of which was necessary for the comparative research to kick in. The second part was to be set up in the Health Care Reform bill. It's the second part that would have triggered the Commission that would have been the bureaucracy to run the network. Am I wrong on this?

I have read it over but I could find nothing in this section that gives the Council any authority to do anything except assemble reports. I am not familiar with all the ins and outs of Govt. Double Speak so I might be wrong.
It is very upsetting however that it has taken this long to learn of this however. This is what happens when Bills of unusual lenght are passed. Section 804 is less than one page and authorizes the creation of yet another Government Entity. The devil is in the details my dear friends.
On this off-topic subject I have had recent experience, in my local area. On a local Univ. sports
website, many local & regional folks were burning up the boards, after the firing of our Head
Football Coach We had days & days of open conversation & free exchange of ideas. It took
place over the Christmas break, however the trolls showed up in force by about Jan 5. We be-
lieve they were hired by a public relations firm the Univ. employed, after realizing the horrible
backlash they were receiving was not dieing away as they had anticipated. These operatives
who came in were very subtle, quite conversational for a while. The first group were from the
Universities Law School, probably got extra cred for tamping down the anger of the masses.
These law students were easily spotted due to their language, excessive wordiness, & some
other attributes that I will not give up. They were among us for about 5 days, after which, myself
& a couple other folks began to engage them with direct questions about their loyalties. They
immediately disappeared. Non-combative souls. Then came the agitators. They joined us on
the blog, immediately began singling out the weakest among us. They double teamed, even
triple teamed the elderly, the housewives, etc. They were vile in their attacks, to the point of
down right disgust. After being methodically attacked from weakest to strongest, within 3 weeks,
there is no one posting regularly on the website for the last 5 days. Their mission was clear to
many of us from the outset, however we could not counteract their effect sufficiently to buoy the
weaker & less committed among us. It was actually a form of crowd control, being exercised
via keyboard. Of course, now my antennae are "up" watching for this type of strategy to be em-
ployed by this corrupt & evil government we are now suffering under. Remain vigilant all.

The first question I will ask any "new" candidate for office: Did you graduate from law school?
We have waaaaay too many lawyers in Congress. Time for some regular "Joes" to walk those
hallowed halls. The lawyers have been trained to argue either side of any problem with equal
effectiveness. They are dispassionate drones, who see conflict only as an opportunity to exercise
& display their mental prowess. Seems to me that law school washes away all their common
sense. Add to that their almost universal sense of superiority & entitlement. Can you spell dis-
aster? Some of the conservative Congressmen had to know about this hidden agenda in the pre-
vious bill. Why were they not shouting from the rooftops? Why were they not alerting their consti-
tuents in their districts / states? Why did they not use the "Tea Party" platform to speak to the grass
roots on this problem? I'll tell you why, because they are drones, it's all like a gigantic chess game
to them. When these progressive fiends secretly pass evil legislation in the dead of night, the other
side actually chuckle amongst themselves at what has been put over on us, average Joes. We
have elected them to represent us & instead they have banned together against us. With their ex-
emption from Health Care Legislation they have bestowed upon themselves "Royalty Status". Time

Nothing in section 804 of HR1 as passed gives the government any ability to ration health care. I wish people would read the bill before commenting or at least the relevant section. It is a vryshort section about thirty lines long please look it up.
However having said that Health Care reform must be stopped and I do not oppose getting rid of section 804 in HR1as it it is still a waiste of money and a creation of mor government.

The so called "death panels" had bipartisan support in the House and Senate for the government to help pay for end of life treatment option counseling. Chuck Grasslely supported the idea until Sarah Palin coined the term "death panels" and forced Republicans to run away from it.
It's too bad because it could have helped a lot of people and families facing end of life decisions.

Sorry to differ, but I have been involved with hospice for a long time. We do not need these panels, and there are already many resources to help people choose between their options. The purpose of these panels is to deny resources to people and to choose for them.
Your anecdotal experience aside, there is a need that is not being filled. Hospice staff are amazing at what they do and deserve our thanks, but they are not free.
The sooner we vote these people out and revoke the particularly heinous parts of these bills, the better. Just when you think they can't get any more despicable, POW! they do it.
This is outrageous if it's true! I can't find the specific parts of the bill that Dr. Janda is referring to with the rationing boards and the death panels. Can someone let us all know so we can read them ourselves?
I did not say that they were free, although many are, leaning on volunteers. I also think that when taxpayer money is paying for treatment, there should be some (limited) amount of oversight. However, the panels envisioned by the social planners will make treatment decisions, and that is best left to the patient and the doctor. My experience of being involved with "end of life decisions" for over 30 years is that the government adds more stress and clutter, and should be involved as little as possible.
All the legislation would do is pay for it. This was never about government agents showing up at your death bed to speed your demise. But that is how it is portrayed when people like Sarah Palin got a hold of it.
I'll give you that it was effective as a political tactic. I'd just like someone to admit that it was all about politics and people don't really believe our government wants to kill us.

Of course it's outrageous. Everything this administration does is outrageous. Why would Congressman McCotter introduce a bill AGAINST it if it wasn't true? They are counting on the fact that YOU CAN'T FIND IT IN THE BILL!! Remember, it had to be passed RIGHT NOW!!!! Noone could read this bill because it was such an EMERGENCY!!! I have always been very suspicious of ANYONE who wanted me to HURRY UP AND DO SOMETHING especially if it was going to cost me money. Usually, it was a salesman on the phone who was offering me a "great deal". I learned my lessons the hard way. And now so have the American people.

Perhaps your right. I did get a speeding ticket on the local air base last year and Obama should have seen it coming. I have been driving too fast for many years now and Obama's weak speeding policy has allowed me to run wild. So add it to our list.
Does it bother anyone that we have to read it here or see it on the Glenn Beck's show? We should be hearing it form our Senators and Representitives. They have failed us. They aren't representing our interest only their own.

It's time for us to stand up and DEMAND that only that which is provided for under the Constitution be allowed, and those who will not support such an effort be removed……. by force if necessary! To openly and actively vote or support something of this magnitude which undermines our rights under the Constitution is nothing less than an act of treason against the republic.

Hey mikatollah, you don't get it. It is the way Obama and his appointed administration heads handle the terrorist. They need to get as much information as possible and then try them in a millitary court. But if you don't understand that already you never will.
OK Pelosi kept the bill from being discussed on the House Floor. The MSM has tried to ignore any GOP proposals so it can collude with the Obama admin in caricaturing the GOP as the "Party of No."
But I do fault the GOP for not trying hard enough to publicize its efforts. I knew about the various other GOP proposals. I follow the hc debate avidly. I had no idea the rationing boards had been put in with the Stimulus, until now. Most Americans have no idea the GOP has made any proposals at all, or what they are. There's no excuse for that. The GOP has been anemic in putting out its message to the American public.
It reminds me of when the bloggers had to carry Bush's water for him during the Iraq war, because he wouldnt explain anything or defend himself.
GOP! Don't do that! TALK!
We must be aware that people who receive Medicare and/or Medicaid medical care are already under observation from the Obama death panel. Anyone who has had a yearly check up lately knows that they have gotten a third degree about personal habits and past medical history. I think preexisting conditions may be more of a problem for Obama care than insurance companies.

I get it. You think we will be safer if we try suspected terrorists in a secret court that is not answerable to a court of appeals and answers only to the commander and chief.
