ACORN Whitewash: What ACORN Won’t Tell You About the ‘Audit’ it Bought
by Rep. Darrell Issa (R-CA)On September 16, 2009, with much fanfare, ACORN CEO Bertha Lewis announced that ACORN was hiring an independent auditor to review its internal processes. Yesterday, the former Massachusetts Attorney General Scott Harshbarger produced a report finding ACORN, as a corporation, engaged in administrative negligence.
This of course has not stopped ACORN from declaring victory and calling the report a vindication. Is anyone surprised that a report paid for by ACORN exonerates them? The fact that this review didn’t even include an audit of ACORN’s financial statements speaks volumes. Luckily for taxpayers, there are numerous federal and state investigations currently underway that should ultimately produce a legitimate finding regarding ACORN’s illegal activities.
The reality is ACORN has masqueraded as charitable organization in order to fund and advance a partisan political agenda. There is no mechanism in place to follow where the use of taxpayer and charitable dollars end and where funds used to pay for their political activities begin.
Despite these findings of obvious negligence on ACORN’s behalf, the Proskauer Rose report was not an audit. In fact, among the “7,000 pages” (19) Mr. Harshbarger reviewed, none of those pages included:
- The financial statements audited by ACORN’s CPA, William G. Stamm, of Hrapman Duplantier LLP,
- The bank and accounting statements of ACORN’s bank, Whitney Bank, located in New Orleans,
- The findings released by the Louisiana Department of Justice on ACORN’s mismanagement, and
- A Congressional Report issued by the minority staff of the Committee on Oversight and Government Reform (“The ACORN Report”), which reviewed ACORN’s financial mismanagement and formed the basis of Congressional actions taken against ACORN.
Moreover, there are a number of problems with Mr. Harshbarger’s report:
- The report claims, “Three of the six videos – Brooklyn, Los Angeles, and Washington, D.C. – involved only ACORN Housing employees, over which ACORN has no control.” (12). However, the ACORN Report, cited above, shows that ACORN owns and controls the ACORN Housing Corporation, which, while holding its principal place of business in Chicago, is incorporated in Louisiana and has its employees and staff paid through ACORN’s coffers.
- Additionally, it seems counter-intuitive for Mr. Harshbarger to have reviewed a document, cited in his report titled “ACORN Housing Quality Review Master” (27), if ACORN Housing was truly “separate and independent” from ACORN, the client who paid Proskauer Rose to review it.
- The Proskauer Rose report claimed, “ACORN should develop a simplified national organization and board structure consisting of just two entities – a 501(c)(3) for charitable, non-profit fundraising, advocacy and education with a majority of independent members, and a 501(c)(4) for support of ACORN community organization and political activity, with at least one-third independent members.” (15) This recommendation is misleading as well. Nowhere in Mr. Harshbarger’s report did he mention that ACORN owns and controls a number of 527 political action committees: ACORN PAC, Communities Voting Together, and ACORN Votes. Either Mr. Harshbarger is suggesting that ACORN engage in illegal activities by using its 501(c) (4) to campaign for the election of Democratic candidates, or Mr. Harshbarger is expressing his profound ignorance and a lack of professional due diligence because the Association of Community Organizations for Reform Now (“ACORN”) has never been tax-exempt, but a taxable state-registered corporation filing IRS FORM 1120 for corporate income taxes.
At a joint Oversight-Judiciary Committee forum last week, we heard from state government officials and an ACORN whistleblower about the fraudulent and deceptive tactics ACORN uses to manipulate the same people it purports to serve. The more we have learned about the inner-working of ACORN and its affiliates, the more apparent it becomes that this organization is intentionally structured to deceive and mislead the American people.”

Just about the only way to defeat these Alinsky disciples is to beat them at their own game and vote the ACORN paid Congressmen out of office. They are desperate to get re-involved in the balloting process — after all, we have elections coming up and they must insure their friends get elected.

Over 60% of the submitted voter registration forms submitted by the California Republican Party were PROVEN TO BE FRAUDULENT!!! What was your involvement with that massive amount of voter registration fraud, sir? Did this massive voter registration fraud carried out by the California Republican Party benefit your election in any way? Mr. Issa, what was your ties to Mark Anthony Jacoby and Young Political Majors, the firm hired by the California Republican Party to carry out this massive voter registration fraud? That would take a prosecutor willing to press charges & our current AG has no intention of doing that, he supports them & has given the OK to refund them.
Now, Rep. Issa, is there enough support in Congress to force the AG Holder to do something he most certainly doesn't want to do, namely his job? If not, is there enough to assist states' prosecutors with their investigations, the ones that are actually trying to really investigate? Finally, do you have enough to pressure the states who prosecutors who have been part of the cover up, i.e. Jerry Brown, to either step aside & let a real independent investigation take place?
Democrats have no shame or concern about this country or the consitution. Nixon was forced "by his party" to resign office for much less than what Obama has done with voter fruad and ACORN. ACRON and SEIU are nothing but vote harvesters. They request an absentee ballot for nuring home paitents and known non voters, fill out the ballots and vote. It's simple they win and democrats love it, and see it as legal.
The fact is there are probably two reports. one given to the client in confidence, and one for public consumption. i know. i have done this sort of thing myself.
We should demand that they waive privilege and give us all ther communications with acorn.
I am resorting to "snail mail" again. It seems that politicians respond more to an actual letter than they do to email. Let's try it the old way and see if we can make a difference.

There really is only one word to describe ACORN and its defenders at this point…Pathetic! The libs are hoping this story blows over so they can go back to business as usual. They know the American people have a very short attention span.
Luckily Breitbart knows how to play the game and he's been absolutely brilliant at keeping this story on the front page for an extended period of time. He deserves an award.
It would be nice if the politicians who say they represent the people would actually do something instead of standing up before tv cameras giving lip service.
I'm willing to bet Rep. Issa spent more time writing this article than Harshbarger did "investigating" ACORN.

Harshbarger also notes that the videos were sometimes less than perfect representations of the events they depict. He writes:
The videos that have been released appear to have been edited, in some cases substantially, including the insertion of a substitute voiceover for significant portions of Mr. O'Keefe's and Ms. Giles's comments, which makes it difficult to determine the questions to which ACORN employees are responding. A comparison of the publicly available transcripts to the released videos confirms that large portions of the original video have been omitted from the released versions.
In fact, former President of the New York State Bar Association Steven C. Krane of Porksour was found handling complaints at the First Department against his law firm, partners and himself while an officer of the First Department and then ordered for investigation for the Appearance of Impropriety and Conflict of Interest.__Where there is Proskauer, there is crime, I would not trust this report at all and in fact would investigate Proskauer's involvement in ACORN. Did Obama stop by Proskauer on his way to the White House

Proskauer Rose is an independent report??? Real reporting going on here. Why not report that Proskauer who did this report was found dead center in the Sir Robert Allan Stanford fraud, whereby resigned Proskauer partner Thomas Sjoblom was teaching Stanford employees how to lie to the FBI and SEC in a Miami airport hanger. Proskauer has the most Madoff clients, the clients are now being investigated. Proskauer was sued in a Global Class Action for the entire 7 Billion in the Stanford Fraud. If you are serious about taking down Acorn and inditing a lot of criminals along the way ( Lawyers), then I am the one to call. In New Orleans, they owned the U.S. Attorney's Office under Eddie Jordan, the Union for NOPD, HUD and City Hall of New Orleans. In fact I can show you how Acorn obtained 200 Properties from the City and then received grants to renovate at $50,000 per property. . But they were supposed to sell them to low income families but instead of that they were leased out via section 8. Friends at HUD, HANO and the City Of New Orleans made millions.
