You Don’t Have a Constitutional Right to Free Speech
by Derek HunterYou’ve undoubtedly heard someone, maybe even yourself, say that you have a Constitutional right to free speech, right? While that seems to make sense, it’s not true, or at least wasn’t before the government got so big that it started intruding into areas of our lives in which it has no business; and it is part of a modern mentality that has the potential to harm our individual liberty.
To understand what I’m talking about, the first thing you have to understand it that the Constitution does NOT grant you rights, it protects the rights you inherently have from government intrusion. The First Amendment in the Bill of Rights is this:
Congress shall make no law respecting an establishment of religion, or prohibiting the free exercise thereof; or abridging the freedom of speech, or of the press; or the right of the people peaceably to assemble, and to petition the Government for a redress of grievances.
Just look at the part that addresses speech, “Congress shall make no law…abridging the freedom of speech…” Nowhere does it say that you are granted the right of freedom of speech, it says you have it, were born with it, and the government cannot do anything about it. But that’s not how it’s viewed or even talked about by politicians these days.

By saying that someone has a Constitutional right for free speech implies that it is granted to you and, therefore, can be taken away at some point by amending the Constitution. While legally this is possibly true, trying to get that amendment passed would have about us much of a chance as getting a safe driver of the year award named after the late Teddy Kennedy. But the mentality that uses and teaches that erodes, even a little, our basic liberties.
While our Founding Fathers agreed that our basic right to free speech was granted by God, you don’t have to be religious to embrace the idea that we were born with it. In fact, avowed leftist atheists are often the ones wrapping themselves falsely in the First Amendment with the claim that the government protects what they have to say. But it’s not exclusive to leftists, people on the right often cite this mythical right granted them.
So what’s the problem with it? Who cares if they know the truth as long as the outcome is the same? It feeds the mentality that is becoming more and more prevalent in society today; that you don’t have natural-born rights, that your rights are granted to you by the government. This leads to people looking to the government to solve more problems and involve itself in more issues than it was ever intended to, or is Constitutionally allowed to.
Once someone feels indebted to the government for the right to speak their mind, it’s not too great a leap to expect food, shelter and even health care from it, too. Good things will flow from the government if you believe good things are already flowing from it. If you do not have a fundamental understanding of where your basic rights come from, and that our government was founded upon those principles, it’s natural that you would look to government for more.
But our government is a limited one, or at least is supposed to be, and was founded to be bound by the Constitution to prevent it from doing most things, not to become most things to anyone.
Even President Franklin Roosevelt understood the limited powers of the federal government when he proposed his “second Bill of Rights,” a list that included health care, by the way. While he didn’t propose amending the Constitution to include these “rights,” the mere fact that he had to propose them is acknowledgment that they did not exist in the Constitution. If they did there would be no reason to propose them, he’d simply have to point them out to a public that had spent more than 150 years missing them in our founding document.
Modern liberals understand this, too, or at least used to. In 2004, Congressman Jesse Jackson Jr. proposed amending the Constitution to add a right to health care for all Americans. It when nowhere, but the act of introducing it was passive acknowledgement that it doesn’t exist.
Jackson’s flaw is that of many liberals in this country; not that they want to help people, but that they want to use the power of government to do it. The Constitution expressly limits what the federal government can do. It isn’t a rough outline of somewhat good ideas, or even a framework in which government should attempt to exist unless it is found to be too constraining. It is not a “living document,” it is the shackles placed on what our Founders feared could grow into the type of monster they had just rebelled against.
The Tenth Amendment, often ignored by courts and politicos (what I refer to as the red-headed step-child of the Constitution), plainly states this philosophy:
The powers not delegated to the United States by the Constitution, nor prohibited by it to the States, are reserved to the States respectively, or to the people.
If the Constitution does not explicitly give the federal government the power to do something, it doesn’t have it, the states and the people do. The government, as the Constitution stands now, could no more legitimately take away your right to free speech than it could provide you with health insurance or vote to make the sun rise in the west.
So next time you hear someone talk about their “Constitutional right to free speech,” correct them. While it may seem minor, it is a fundamental piece of their liberty they are ceding to a misunderstanding of our country. And once one piece goes, it’s a lot easier for others to follow.

Democrats are nothing more than self-righteous control freaks trying to hide their own self-esteem problem. It’s not rocket science to see through the mindset of these “do-gooders”.
Good post. One of my “pet peeves” in the dialogue about the Bill of Rights is the notion that those rights enumerated are those rights that our government has given us. Nothing could be further from the truth. A supreme being has given us those rights. These are natural rights. Some of the founding fathers even felt that there was no need to amend the constitution with those rights because they were so obvious. Thankfully, those founding fathers who felt the need to enumerate those rights in the constitution just to “be on the safe side” won out. They may have very well been able to envision something like we have today with our Democratic congress and President Obama.
The whole notion of "God given rights" is anathema to the garden variety leftist in America.
This is the primary front in the culture war, I think.

The left's assault is usually focused on removing God from our founding. Belief is irrelevant. The result of that mindset is the nullification of the word "inalienable", thus, our rights fall to man, therefore, politics.
This article is BS. Most Americans have sold their "freedom" to big government or big corporations in exchange for "security". The result is that the voice of big government and big business is delivered by big media, effectively silencing dissent. And when that doesn't work, they bring in their lawyers. Why do you think most comments are submitted anonymously? Theoretically, yes, it's true. But try speaking truth to power and find out where it lands you.
Thank you for clarifying this important point. All summer the left has tired to shut up the people, not yet by laws, but by intimidation and name-calling. The people were heard loud and clearly yesterday. "Thank you God for my right to speak!"

Theoretically, Obama promised to deliver hope and change. In reality, we can now pretty much abandon all hope that his socialist agenda will not effect permanent, disastrous change on our country.
Yet the majority is cowed into submission to avoid having charges of bigotry and racism leveled against them.
It's nice that a few can afford to express their opinions. But the rest of us could easily lose our jobs or our businesses for daring to speak out against Obama.

Firebreather: There is a good book, entitled Liberal Fascism authored by Jonah Goldenberg. It is eye opening. The words "Liberal Fascism" and "YOU LIE" need to become our battle cry.
This is an excellent article and touches on some valid points of natural law and the role of the individual and the State. Unfortunately the debate is only taking place on one side. The other is too busy subverting the meaning of the Constitution and replacing with the rights of the State to impose and bestow all kinds of rights.
You have a flaw in your reasoning. First you point out that our rights are not granted to us, but the consitution recognizes our rights are inherent:

So, after arguing that rights are extraneous to the consitution you imply that liberals are creating rights not in the constitution (after you've already argued that rights are not from the Consitution.):

Since Amendment 9 of the Bill or Rights says:
The enumeration in the Constitution, of certain rights, shall not be construed to deny or disparage others retained by the people. There doesn't seem to be anything odious on the surface about people "proposing" that there are other "rights" not explicitly enumerated. That's why we have public debate. The consitution is a living document in the sense it can be amended. I agree that the "wiggle room" allowed by "General Welfare" and the 9th amendement have been abused to find "a right to Privacy" and a proposed "right to health care", and I would like to see the constitution amended to constrain these false rights, I can't hold it against a man that makes a public case for rights not explicit to the consitution.
Excellent article and an astute distinction; you are indeed correct. Something I've done for longer than I, perhaps, would like to admit – carry around a pocket-sized version of the US Constitution and Declaration of Independence. I was listening to Trevor Loudon on your "biggovernment TV site today and he exactly describes the process of infiltrating free societies with communist and fascistic dogma and then taking over those societies. It's scary slow in it's progress, and sudden in it's entrapment.

When you enter a college campus in this country your First Amendment rights get checked at the classroom door most of the time. They are by far the most egregious abusers of free speech rights thanks to the left hijacking our colleges.
I advice anyone with a kid going to college or there now to visit the FIRE Foundation site to see what they are doing about this and how bad it really is,

Trouble with all that commentary is that it focuses on the idea that government somehow infringes us the most. That's not true. When I get up each day my life is overidden by forces that are tied to privatized actions and infringements, not government ones. The government can't read my e-mail, my boss can. The government can't trade videos of me shopping between pals or snickering over my internet downloads; private security at malls and internet service providers can. The government must open many of its records and files to the public for scrutiny so that websites like this can criticize them and help keep them in check. Private companies by default don't have to, and can severely water down or obfuscate it in those rare instances when they do.
So, great intellect, bad post on the premise that, I guess like this website in general, it fights a toothless and irrelevant "monster". Show me a post or a website that challenges powerful companies and maybe then I'll be impressed. Knocking government is just too "easy".

It may be so, that opposition may come from tyrranical powers, but that does not nullify the truth in this concept that freedom lies within us regardless of what may be done to us to surrender that god-given right. Ask John McCain what compelled him to survive the camp in North Vietnam.

You're right. WE also need to uncover the corruption and powers of big business that intrude on our everyday lives. We use grocery cards to get discounts, but at the same time, we are being played for marketing purposes. We use credit cards and our purchases are tracked and then mysteriously we get coupons and ads in the mail directed towards our spending habits.
So what do we do? Who do we need to look into specifically? What big businesses should we research? I'll help start the web crawling.

When we're discussing free speech, I think it's important that we be mindful of who we allow to champion our cause. And again, I just have no respect for most of these idiot blowhard pundits.
WOW!!! Right on the money, Dave!! You brought to rememberance(sp?) something a former employer once told me. She had it right in front of her in a "legal opinion" that the "constitutional rights" "granted" to "citizens" did not extend to "workers" in the "workplace".
However, I would like to point out that it is the "government's" rules and regulations (undoubtedly pushed by "big business" lobbying groups) that have allowed businesses to become what they are.
When Wal*Mart went public and got big, it signalled the end.
Don't like that your employer can read "your" email? Don't use the email system they provide you for your personal business.
Don't like that a mall can videotape you walking around their property? Don't shop there.
There is no requirement that any of us do business with any private entity, ANYWHERE. On the other hand, we're required — under threat of imprisonment — to send some government bureaucrats details of our financial history every year. Next up will be government having unlimited access to our health records "for our own good".
If you've let your life be "overridden" by private organizations, that's your own fault. Excepting the most limited of circumstances, they cannot use force against you. The government can.
(BTW — if your ISP is tracking what you access, it's doing so as a result of government regulations. Otherwise they'd have no interest in keeping such records.)
Not to feed the anti-business paranoia, but when you're at work you're on your employer's property, using their property. While they cannot prevent you from saying whatever you want, they can certainly fire you if they wish. They may also require you not to come onto their property armed, to conform to a minimal standard of dress and behavior, and to deal with people you find distasteful.
Great article. Now, if every congressman and the President could/would read this…Oh, who am I kidding? Every last one of them would deny, vote against, or over rule, according to their own socialist agenda. That doesn’t mean however, that we should cease fighting back to protect our precious freedoms. To the contrary, let’s increase our efforts and stayed focused and unified. Apathy is something we can’t afford.
I agree Rob. If you don't want the "perks" of businesses, don't use them. And the government regulations are getting in the way. I just wonder what this world is going to look like in 10 years from now with technological advances in video and tracking. Anyone realize that OnStar is now part of the government with the takeover of GM? And when will they give GM back to the private industry with that kind of control?
I'm not sure because I don't debate the contributions of their products, or the effects of their charities. I was more remarking on the idea that in the arena of human rights, anything the government does against me as a person is way down the list after about a million things a corporate boss or organization can. And I can do little to vote a change (unless I'm a large investor).
But I also want to make clear my second point which is that you can do far more damage to yourself as a person trying to lead a clean normal life fighting corporations than you can a government. If you start screwing with the money flow and prove yourself effective at is, you'll find life in a downward spiral fast. I think your point was that those organizations are liberal in effect, but in reality, they are *still* the status quo. And still in charge. Take two children early in life in our culture and watch as one goes on to fight liberals, and the other goes on to fight corporations and the status quo. Guess which one is more likely to be discredited and destroyed by 60.

That is a great point about the God given right of free speech not a Constitutional right. As I was looking at the MSM websites yesterday they showed pictures of the Washington protests, and in the pictures you could see, as they called “hand-made signs”. In my opinion one could get better news coverage from those “hand-made” signs rather then what the MSM had to say about it. All those signs were made by individuals who are free thinkers who are not controlled by the media. This is what we need and the old media will eventually be exposed for who they are. Make those signs and let them know what YOU think not what they want you to think!
The thing of it is, Dave, that government does intrude upon our daily lives more than any single corporation, or all the corporations combined. You just don't see it as obviously. Look around your room now. Everything in that is more expensive, and in some ways probably less functional due to government regulations and paying off inspectors. The government controls how much water your toilet can run, how much wattage can be in your lightbulbs. The government literally takes your life away from you, in the form of taxes, with the threat of force every year. Every 10 they try to get detailed information about your life, and will threaten you if you do not give it up.
This is the same government that is engaging in should be illegal wiretapping (thank you patriot act), and is looking through web based communications of people it considers threats. Unlike, say, Wal-Mart or Costco, or Walgreens doing this, the government can send police to your home to generally screw up your life if they want.
There's government regulators for your food, some in cases laughably ineffective. Ever heard of the chicken inspectors and their union? They stand on an assembly line in factories looking at the raw chickens as they go past and look for bacteria, or other disease causing microorganisms on the chickens as they go by. The worst part is, you are paying for this. These government mandated costs to the producers get passed down to you, the consumer. The government mandated corporate taxes get passed down to you, the consumer. Government is literally everywhere in this country.
Think you can bake some cookies and go sell them door to door? Depending on where you live, you may get hit with gigantic fines, and possible arrest because you did not cook them in a handicap accessable industrial kitchen, mandated by your local regulatory government boards.
Dave: You are right, and I agree. It is never a good idea to be the first one standing on the corner, screaming "Fire" at the top of your lungs. All that will do is draw the fire, and ire to oneself. You become a target in the sights of "those people". Just ask Joe Wilson. He's the first sonofabitch that told the truth in politics in a generation……..
And a good example of fighting for that right would be hiding behind a pseudonym, having recognized the level of oppression you might expect for "owning" your views on a national forum. Meanwhile, your opponents brazenly label you as a racist and a bigot with no fear of reprisal. And that's how the silent majority eventually becomes a permanent minority. The PC movement was highly effective, no?
But the author doesn't even inspire – just offers up a simple platitude parading as an opinion. Yes, it ties into the Tea Party concept nicely, apparently written to "remind us" of how things used to be…
But maybe I'm being a hard ass and just refusing to be inspired today. Who knows?

As for the ISP not wanting your data, I suppose that might be true. I guess as long as that information never proves valuable or helps to make more money, which could never happen, they have no interest in your online data. Right?
I think the danger in your assertion on this point is that now, suddenly, government regulation is a scapegoat for companies that LOVE your data. (sigh) "There's just nothing we can do about storing your downloads on our hard drives forever, that's just nasty ol' government making us do it. But as long as we are, wouldn't you just love more information on a trip to Bermuda? Just like the one you took to Puerto Rico last June?"
And finally, my biggest point here is, we live in a world of compromise. There is nothing inherently wrong with using video to improve security, user experiences, marketing (I'm in the business in fact), protecting against potential liabilities exerted by employees, or, reaping the sows of what highly profitable and organized companies present to our society. My favorite place in the world is Bryant Park in NYC – a private corporate enterprise that cleaned the park up from its sordid drug-dealer's paradise, past. These are all fair, great, and something I can and do live with every day. I'm merely saying that on a project list, if I were to rebel as loudly as everyone here about something, I would tackle certain things first long before I would the one institution where I at least can vote for change: Government.
When you lift a finger to fight for human rights and democracy at all, you're fighting both corporations and government (oh – and theology, religious dogma), and maybe countless other entities not yet known. As I see it, though, one is less malleable than the other and that de-prioritizes "big government". If I lived in China or the ex-Soviet Union, it would be a different story.

The Constitution of the United States lists all the powers granted to the Government by the People. It is not Government that grants rights to the people it is the other way around. That was the real difference in the formation of this country. The people gives government power to govern and the people can take those powers away. The people are the supreme authority in this Republic. The people recognizing that a limited government is preferrable to anarchy have granted the government limited powers enumerated in the Constitution. All other powers reside with the States and the People. The individual States are granted limited powers by the residents of those states by thier constitutions.
On the subject of fresh baked cookies, I just enjoyed a nice cool glass of non-pasteurized farm fresh raw milk from our local dairy. What's strange is that, every time I go out there, I almost always spot a few cars with Obama stickers. I suppose, in their fantasy world, Obama would be "smart" enough to allow them to continue enjoying the milk – when the truth is that the farmer would most likely be locked up for touching the cow's utter, if he hadn't already been sued out of business for allowing his son, a non-union laborer, to put on a pair of work gloves.

I went over to Huffpo yesterday and the mental/emotional level has to be somewhere around high school level. The article was a Bill Maher one and most of the comments were of the "you go Bill!" and "those evil Necons!" variety and nothing resembling substance. Reading those posts makes it abundantly clear how Obama got elected– no substance necessary to a leftist voter. Too bad so many independent voters got swept up in the hope/change rhetoric. Hopefully the facts are getting through now and they won't let their emotions get the better of them again.

It is all about the seductive nature of power ladies and gentlemen. Power corrupts and absolute power corrupts absolutely. We as citizens have and are witnessing the slow and now accellerating decline of our freedoms. There are always legitimate reasons to give government the authority to deal with the day to day job of governance but there is never a reason to give government the power to rule.
Problem is Dave, government is the least likely organization to change. It is the hardest to change from your list, by far. If you don't like what a corporation is doing, stop doing business with them. It's as simple as that. If you don't like businesses advertising to you, contact them and ask them to stop. It really is that simple. If you don't like what the government is doing to you it's going to take months and months of legislation before you get anything close to progress from them.
Government really is a gigantic boogyman who literally is everywhere in this country. Yes we have it better than Soviet Russia and China, but that doesn't stop people from seeing the problems here. If you constantly compare to the worst case scenario, nothing is going to look bad. It leads to a spiral where problems creep up on you in a slow incrimental fashion, and you're don't realize it until you're buried under them.
Also, they cry when you punch them in the face. But it feels REALLY good. Oh, wait – violence is bad, unless it's against the unborn – or lately, anyone who disagrees with Obama about anything at all…

As for your last point Dave, it seriously depends on how the children are fighting. Say they both grow up, become learned educated people and speak out against the corporate and government Ideologies. In that case, the person speaking out about government will be more discredited (Vis A Vis the Main stream Media) than the one fighting corporations. Challenging the status quo is the rallying cry of the political left in our country, and you see their influence everywhere. President Obama himself said small government is an outdated political ideal that is not worth discussing. When the president discredits you, that's pretty big.
Now, say one goes on to preform terrorist actions against their ideology, and the other lives a simple life away from their influence, of course the terrorist one is going to be more discredited, that goes without saying and doesn't really help your argument.

Well granted I didn't know anything about ACORN until today's run through this blog and the controversy around the video. Going only by its published material however, its intent is not to operate as an openly corrupt organization seeking to undermine people. There may be corruption *within*, and it may need to be *changed*, and Jame's video, BTW, may certainly prove to be great insight to that – god knows – but my satire against James on that video is more about where he chose to spend net time.
I don't like conservatives for their many roads back to selfishness as I see it, but when George Bush suggested funding faith-based charities, I supported that. I support giving people who want to spend time here helping others, that chance, no matter what. I even explicitly acknowledged that SOME of those organizations funded by such a plan would actually go corrupt or have corrupt people working within. That did not deter my support. The forces that exist to take away unconditional help are too sweeping and dangerous not to.
A few ACORN workers got rooted and fired as they should…what's James plan to help those who may stand now not to advance because ACORN may have to fold? He doesn't have one because he wasn't thinking about that. His and Annah's focus was on hatred and scoring against "liberals". That's what makes that wrong and why my Jesus satire is opt. Why he did it and what happened to the thousands of people who might have been helped as a result of his approach will be the question that will one day be asked. It's that simple. Are you also aware of the allegations of voter fraud, voter intimidation, and countless other felony violations attributed to ACORN through the years? Yes, ACORN's stated intent is not to operate as a corrupt organization to siphon lots of money through the government and launder it, can you think of an organization that is? Judging what they are by what they say that are is unfortunately, terribly naive.
Also, it's not like ACORN has a monopoly on helping people. What if ACORN goes down and other, non-corrupt, more efficient community programs go up in it's place? Hannah and James did a great net good then, by removing an organization that has hundreds of alleged felonies, and is willing to sponsor a child sex slaving ring, and replacing it with a wholesome organization.
It's too early to declare what they are doing as an evil just because some people will not be helped exclusively by ACORN. I'm willing to bet in communities around the US there are other groups who could help the poor and are not corrupt or as corrupt.

What those who try to take away God given rights forget is that a God given right cannot be taken away by anything short of violence and oppression. Our right to speak freely comes from our will and ability, not a mandate. They may impose law upon it but law has never been the means by which anyone, including God, has stopped any action in that mankind is naturally in rebellion against law. The only thing that can be done is to impose consequences on the exercise of free speech and then it becomes a question of whether people are willing to accept the consequences of their words. One of my “pet peeves” in the dialogue about the Bill of Rights is the notion that those rights enumerated are those rights that our government has given us. Nothing could be further from the truth. A supreme being has given us those rights. These are natural rights. Some of the founding fathers even felt that there was no need to amend the constitution with those rights because they were so obvious. Thankfully, those founding fathers who felt the need to enumerate those rights in the constitution just to “be on the safe side” won out.
Or, as the Declaration put it:
"We hold these truths to be self-evident, that all men are created equal, that they are endowed by their Creator with certain unalienable Rights, that among these are Life, Liberty and the pursuit of Happiness."
Which, of course, implies that there were other rights that Thomas Jefferson didn't feel the need to mention because they were contingent upon — an obvious natural outgrowth from — the big three that he did list.
The only way to protect the republic our founding fathers gave us is to make sure our children and grandchildren learn American history and understand the provisions of our Constitution. We need to instill the conceptsof limited government and self-sufficiency. Good article! It's far easier to choose a new company to work for, or purchase a product from, than a new government. Government has a legal monopoly on force, and therefore it most certainly is what actually matters.
It's been around a LOT longer than that. In fact, even our Founding Fathers had one foot in the door.

But that's part of the problem! A Constitution is just a piece of paper, no matter who writes it. This is what happens when, as Tage Lindbom puts it, when God no longer rules, but "man" does. As Rousseau understood, you still have to have some sort of "transcendent" authority to justify each and every governmental system. Rousseau didn't want God, so he came up with the semi-mystical "vox populi." The Constitution is the last retreat in the West for a transcendent authority since the West has abandoned God in its every day life, preferring "keeping your beliefs private."

Great reminder for those folks who still don't know the limited powers of our federal government. I was at the rally in D.C yesterday and was surpised at the number of people who showed up. As I was parking my car there was a couple pulling in from N Dakota. I bet there were well over 1 million pissed off Americans who came because they could not just sit by and allow this marxist to undo what we have fought to enact and preserve for over two hundred years. Most of the people were my age (66) and older. These folks know their rights and where they came from and will die protecting them.
This is an interesting article, but I don't necessarily agree, completely. The simple fact is that, from our founding, this trend was an inevitability. The minute "man" became the source of authority, we were doomed. Even the "god" of the Founders was subject to human "wisdom" and conceptualization. The Faith was subject to redaction or revision whenever it conflicted with human "wisdom." Even John Adams, so dedicated to "facts" and "evidence," had no problem becoming a Unitarian, but "facts" and "evidence" (human "wisdom") was more important than Truth. Our culture has been completely destroyed by the epistemological dualism of the Latin theologians, the Reformation, and the all-pervasive effects of the so-called "Enlightenment" and "Renaissance."
Simply put, our entire Western culture was inverted, placing the human ego at the top of the decision making process in all matters, including what aspects of the Faith we follow (the Reformation simply applied the mistakes of Rome to each person as an individual). Our worship of "freedom" and "individuality" are nothing more than manifestations of extreme human egocentrism – because we define these terms solely in materialistic perspectives. Our approaches to "science" and "faith" are also effected by the cultural/theological/philosophical trends of the West that also, lamentably, now infect nearly the entire world.

For the atheist or agnostic, this trend is actually a good thing. It places man where he "should" be – at the top. But for those who still attempt to emphasize that the rights in the Constitution are "God-given," we need to understand more deeply the tradition the Founders actually came from, represented, and espoused. Though they seem "more Christian" or "spiritual" than most people today, I believe it is essential to recognize that any type of Christianity espoused by the Founders was absolutely cut free from the original Christianity in that the Faith was subject to human "wisdom" (again, see the above-referenced article).
Unless we understand these first principles in our culture, we're doomed, I believe, to keep arguing around the same loop. And we're going to keep losing. Conservatives appeal to a document whose sacrosanctity is as arbitrary as any claim to "morality" by an atheist, and the liberals are beginning to challenge this. At least liberals understand that the true source of power in the West is the human ego, manifested individually, in a group, or (as is often the case) by proxy.

47 USC Section 312(a)(7) states, The Federal Communications Commission may REVOKE a station license for the wilfull and repeated failure to allow access to a candidate for federal elective office to give a speech on behalf of his or her campaign.
This statute applied only to broadcast stations, as the FCC removed cable stations from this First Amendment obligation, leaving in place only their obligation to 315 "e quill" time, with the idea that any program inviting any outsider on to their show would be subject to requests from any self declared loonie in the audience – therefore, don't invite anyone.
In 2000, FCC created an earmark in an appropriations bill, removing PBS stations from any obligation to air political speech by candidates for federal elective office, which is why you did not see one political speech on any PBS station during the last election cycle. The "earmark," slipped into an appropriations bill, is UNCONSTITUTIONAL. But the earmark remains until someone challenges in Federal District Court. I'm the guy prepring the challenge, the only person in our whole political history to make a speech as a candidate for president on a PBS station (1988) which you can see on youtube.com/poetprophet.

Nobody seems to know or teach the Constitution anymore. I have a book called "The Brief American Pagent" that I got in a college classroom. It is a condensed American History book that has great appendices for important documnets, not the least of which is the Constitution. I read and refer to this all the time.
We need to educate ourselves about our inherent rights as Mr. Hunter tells us we have. This is the only way we will not let them be infringed upon! Most in this country think we are a "democracy" and don't realize we are not – we are a representative republic. The problem is that the representatives we elect are not representing the voters, they are representing the lobbyists. We need a law banning all lobbying. This will return our country into a representative republic!

Today too many people do not understand this most basic thing about this country. That is the meaning written in plain English for all to read and understand. Everytime the government puts a new regulation, new program, new law on the books the people loose more of thier GOD given freedoms. Courts, Congress, and the Executive branches have all grabbed more and more power for them selves. The checks and Balances became out of wack when it somehow became understood that the Supreme Court was a final authority. It was not. It was to have very limited powers. The Supreme Court in todays understanding is Unconstitutional. No power was granted the Court in the Constitution to be able to construct remedys. All the court was supposed to be able to do was be the final Court of Appeals and the arbiter of whether some law or policy fell within Constitutional authority.

The Declaration of Independence also supports this by saying "That to secure these rights, Governments are instituted among Men, deriving their just powers from the consent of the governed". This means the people, the citizens, permit the government to exercise authority on their behalf. The U.S. Government was not established to rule over the people but to consolidate their power for the good of the people. Our "leaders" have lost sight of their purpose and continually display that they believe they KNOW what's best for us by constantly lecturing us rather than consulting us.

Not sure I get what you mean. As Mr. Hunter states, our "rights" don't come from the constitution, our rights come from human reasoning recognizing that if we are all created equal, then we have fundamental rights that stem from our very existence. The constitution is the restriction on what other people are allowed to force me to do through the mechanism of government. Haven't you ever read "Common Sense" by Thomas Paine? If you want to change the constitution, I'm all for it. Go through the steps of convening a consitutional convention, and gain the consent of the governed.
There is also nothing in the constitution about this so called separation of church and state.

Related to the concept of natural rights is the Constitutional term "natural born citizen". A natural born citizen is someone whose citizenship is determined by the laws of nature and not of man. If you are born in the US to parents who are both citizens (born or naturalized), you don't need a human law (not even the 14th amendment) to say that you are a US citizen. You are obviously and "naturally" a citizen — you are a natural born citizen!
This is why Obama is not a natural born citizen, even if born in Hawaii. One of his parents was not a US citizen at the time of his birth. Obama is Constitutionally unqualified to be President.
Brother, I have been teaching this in my government and U.S. history classes for years. Most of my students believe the government gives them their rights. I take them to the actual documents – the Declaration of Independence and the Constitution – to show them otherwise. The purpose of government is to secure our rights. It does not grant them.

I don't really take much stock in Rousseau's arguments seeing as he was the theorist who came up with "tablula rasa" -or "blank slate." That is one of the worst theories ever postulated! I also do not believe the West has completely abandoned God as you think, but rather there is a resurgence of faith and this is why you are seeing an uprising occuring in the public right now. The Judeo-Christian heritage in this country is making a come back through the politics of the day, because people are sick and tired of their rights slowly being eroded away. Also, if it is "just a piece of paper" as you say – you may be like some in the original founding of our nation who wrote that they only expected this experimental government to last 1 generation – 25 years. Pretty good experiment to have lasted over 10 times as long. We are the longest lasting constitutional gov't on the earth. All due to a little "piece of paper" as you put it.
