What Happens When a PI Dumpster Dives Behind a San Diego ACORN Office?
by Doug GilesHe strikes the flippin’ mother lode! At least that’s what happened to private investigator Derrick Roach at the National City (San Diego) ACORN office. Yep, Roach scored big-time on the cockroaches of ACORN when he staked out their San Diego workplace.
According to señor Roach via BigGovernment.com, after the release of the San Diego ACORN sting videos—which my daughter Hannah, James O’Keefe, and Andrew Breitbart dropped on the Nation’s head—and following Governor Schwarzenegger’s call for a probe into this batty zoo, Roach took it upon himself to get busy and see if he could ferret out more funky filth from this nefarious gang.
And, as stated, Roach scored more than Dwayne Wade would playing hoops against blind five-year-old, one-legged narcoleptic midgets.
What did Papa Roach come across? Well, my children, it was stuff like …
- Information exposing the inner workings of ACORN in California.
- Sensitive personal information belonging to employees, members and ACORN clients, such as social security numbers, driver’s license numbers, immigration records, and tax returns.
- ACORN’s political agenda is also laid bare, with thousands upon thousands of documents revealing the depth of the political machine that is ACORN and its disturbing ties not only to public employee labor unions but some of the most radical leftist organizations in existence (I wonder which politicians we will discover are in cahoots with these goofy clowns?).
The timing of this 20k plus page paper plunk of sensitive and incriminating 411 is kinda interesting as well. Check it out:
- On October 1, 2009 California Attorney General Jerry announced that he was going to do a little look-see inside ACORN’s hull to determine if their San Diego office was as innocent as Bertha Lewis, David Lagstein and the Mange Stream Media screamed them to be.
- “Coincidently,” just a few days prior to when AG Brown was slated to pay them a howdy-doo, low and behold, on October 9, ACORN San Diego decided to do a bit of midnight spring cleaning and dump all their docs in a public dumpster to spruce up the joint before the AG’s arrival.
- Unfortunately for poor ACORN, PI Derrick Roach was parked outside waiting for them to do something stupid like dump 20,000 plus pages of their corporate papyrus and their clients’ personal records in a trash bin behind their slim shady facilities.
By the way, are there laws governing how personal info like social security numbers, tax returns, driver’s license numbers and stuff like that should be handled? I’m thinking there would be. Hmmm, I don’t know. Maybe Media Matters will look into it; if there are laws demanding stringent care and disposal of sensitive info, it looks like ACORN, prima facia, could be in deep crap with a stack of folks for placing their private stories in a public dumpster.
I would now like to address you, Mr. Roach. Good job, old chap! As Hannah Giles’ father and one who has been on the receiving end of the ACORN/Mange Stream Media stick, please take my advice and brace for the vilifying crunch from these numb nuts.
They’re are going to hit you with retarded stuff like …
- How dare a conservative PI jump into a dumpster and steal trash?! It’s unethical.
- You’re not a legitimate trash man. You’ve never been to trash man school.
- The trash did not give its consent to be removed from the dumpster. California law requires garbage to give its go-ahead before it is embraced by another.
- FOX News paid you 100 kadrillion dollar$ to dumpster dive.
- You tried this at thousands of other ACORN dumpsters and came up snake eyes.
- No other ACORN office would ever dispose of their clients’ records like this, except, of course, for that Oklahoma ACORN branch that left all their computers and crap on the curb after they got kicked out of their building for not paying the bills.
ACORN, naturally, is going into full damsel in distress mode, stating it was an accident and a coincidence that it occurred right before Brown and his boys were to perform their investigative colonoscopy into ACORN’s corrupt underbelly.
ACORN also blathered that Roach stole their trash. Stole your trash? Hey ACORN, once you place your clients’ sensitive info and your political playbook into le garbage it is public domain. Every hooker running a whorehouse with underage sex slaves knows that.
Lastly, will the little darlings on the left report this? Will Eric Holder call for a brutal investigation into the ACORNucopia of corruption of which BigGov and some citizen soldiers have uncovered? Garsh … who knows! I guess we poor little serf’s of Obamaland will just have to wait and see.

California has a destruction law for personal information. As of January 1, 2001, businesses in California must destroy, or arrange for destruction of all customer records no longer being retrained by the business that contain personal information on customers.

Why would they throw away applications for public assistance? The only possible reason would be that they were engaged in Fraud. They could be making fraudulent applications for Food Stamps and then selling the food stamps on a the street. Also San Diego is a border down. An applicant could live in Tijuana and have a PO Box across the Border in San Ysidro — 15 minutes south of San Diego. You could collect welfare, Food Stamps, SSI, Medicaid, Healthy Families and live in Tijuana, Mexico. You could either be an American Citizen living in Tijuana or a Mexican Citizen with a Green Card. You could even be an illegal alien and have a friend or relative pick up you benefit check or foodstamps across the border in mexico. Somebody could visit a San Ysidro supermarket and watch the amoung of foodstamps being used.

I was in Social Service administration 30 years or so. Pitching confidential client informaton in the garbage can is so wrong on so many points. Any of my staff who would have done this, would be immediatley terminated. There better be some people from ACORN in San Diego going to jail. Attrorney General Moonbeam better put them in the Blue Star Hotel; otherwise he must be recalled. Governor Schartzwhatever has to get on this immediatley.

Most of these documents are NOT "smoking guns" and are desperately being spun to look that way even though most of these documents posted on this website can be downloaded off the internet directly from ACORN sites (YEYB Statements for example). The credit report from "Andre" has me convinced that ACORN may very well have violated Subtitle 21, Title 5 of the Gramm-Leach-Bliley Act as well as the California Financial Information Privacy Act (CFIPA). BUUUUTTTTTTT…….so did the Private Investigator, "Papa Roach". This credit report was provided by a TCI and specializes in mortgage loans and appears this credit report was obtained in the capacity of a third party lending specialists and DEFINITELY is covered under the Subtitle 21, Title 5 of the GLB Act. There is a serious problem though, investigating this.

If you were to turn to pages 27 & 28 of this report, you'll see the exact legal requirements that a licensed private Investigator is allowed access to recognizable non public personal financial information and what by law, a licensed private investigator is allowed/required to do with this information. Stealing them from a dumpster and then selling or giving them to a blogger is definitely not allowed under Subtitle 21, Title 5 of the GLB Act. The licensed private investigator broke the same damn law!!!
Now any licensed private investigator knows that the most sacred element of any investigation is preserving the evidence chain. By preserving the evidence chain, that doesn't include selling or giving evidence to a blogger to post on a website. Hello? Now how do we know these documents actually came from the dumpster? How do we know these documents weren't downloaded or provided from other agencies since a licensed private investigator certainly has the credentials? How do we know these documents weren't manufactured in Photoshop or Illustrator? The burden of proof is now on the licensed private investigator because he violated the sanctity of preserving the evidence chain by involving a third party and seriously tainted the evidence. What, there's no Republican District Attorneys in California that he could have turned this evidence over to? In other words, the licensed private investigator (papa roach) sh#t-canned any possibility of a thorough investigation into ACORN over these documents and you hail this guy as a hero? Are you nuts?

It's not what I "think" I know about the law, I actually provided a link to the actual law so you can read it yourself. How resourceful of me. I also believe that if ACORN carelessly discarded this non public information in the trash than they should be held accountable. The fact that the documents were stolen and posted on the third party's wewbsite is the reason WHY we have these laws to prevent this sort of thing from happening and subsequently individual's identities getting hijacked and put on a website.

Don't you just love the fact that ACORN is so "soil my panties" upset over this that they are sending their operatives out to blogs to post additional misinformation? But they don't even know the law! Oh, here's a question for you: "what's the difference between a code violation and the law"? Lots! Be patient. Justice won't happen on Holder's watch. He is PG (Protector General) not AG. His incompetence and failure to do his job may however precipitate civil unrest, which will not be a good thing. If we can overcome the barricades at the voting stations, and we get the chance to govern again, there will be a target-rich environment for prosecution. Just hope we can prioritize our limited resources.
First, yes. I want a nationwide thorough investigation of ACORN complete with hard drive resurrections and dumpster searches with data analysis by forensic accountants. I want protection for whistleblowers and followup on what they have in their stories and in the documents they may provide. Secondly, it is 20,000 pages, not 2,000 pages. It only makes a difference if you are actually carrying it out to the dumpster, or loading it all into .pdf files after doing the job that law enforcement refuses to do. I can only hope this leads to a lot of stuff that actually could be used in court if a conscientious prosecutor could be found. Justice denied leads to justice sought by other means. When the ref ain't callin' fouls, the rules don't matter.

The deicious part of this is the total incompetence with which they prepare for a raid. Even a call from the AG's office (OK, I made that up, but it explains a lot) warning them didn't help. I agree and that's usually a far stretch for me considering previous posts I put on this website defending ACORN. Most of these "smoking gun" documents are a joke and contain information that would be discarded in the trash. The one document that caught my attention was the credit report from "Andre" that was obtained from a company specializing in securing mortgage loans. This appears to be a clear violation of the GLB Act.
The problem I have is how are you going to find a conscientious prosecutor to prosecute on this evidence when the licensed private investigator violated the sanctity of the evidence chain and tainted the evidence by providing it to a third party (biggovdotcom), subsequently breaking the same law himself? Roach is a licensed private investigator and obliged to follow the exact same laws. The question to ask then is why is this evidence on this website when it belongs in the hands of a prosecutor?

If prosecution was expected the evidence would have been immediately surrendered. It has been assumed as common knowledge that neither law enforcement nor the courts are available for this subset of alleged misbehavior. However, it is clearly possible that the document dump was in response to a tip-off of the coming raid. I believe that a lack of investigative enthusiasm was anticipated. Obviously, someone foresaw the document dump prior to the raid and was absolutely correct about the tip-off. Again, the perception (my perception, shared by many on this site I believe) is that justice has become unobtainable when ACORN is involved, and the evidence will be destroyed if submitted to authorities. Sad, but I truly believe this is the case.
OK. It's a general liberal rule. As a former, reformed liberal myself, I can attest to the fact that it is common practice when one cannot win one's argument (because one is clearly either wrong or illogical), the next tactic is to name call or ridicule the other side. My theory is that it has to do with a lack of emotional maturity. In other words (I'll use plain language here so you can understand it), liberals act like children when they are on the wrong side of an argument because they are still children emotionally (narciccistic, selfish, feelings of immortality/indestructibility). I used to be like that. Then I grew up and became a conservative.

What law enforcement agency or prosecutor would open an investigation of a crime based on the contributions of a private investigator and than allow the same crime to be committed by the private investigator? All the documents would have been confiscated as evidence. It's safe to assume there really isn't much more available in "smoking gun" documents from this dumpster raid. That misconduct is sure to get a prosecutor disbarred.

Most major brokerage houses now deal with mortgages and mortgage back securities and derivatives such as REITs for example. As a Financial Adviser, the same privacy laws when it comes to maintaining the sanctity of your client's non public financial information apply to you as it does to ACORN and the licensed private investigator. As a Financial Adviser, you're kind of supposed to know this as not only part of the Gramm Leach Bliley Act but as the (revised) Uniform Securities Act of 2002 as well as Blue Sky Laws.
