Our Man Ken–There He Goes Again!
by Christian JosiIn yet another admirable display of the right kind of Attorney General activism, Virginia AG Ken Cuccinelli has put House Speaker Nancy Pelosi on notice that what she and the Democratic leadership are reportedly scheming to pass Health Care ‘reform’ is not only wrong — it’s unconstitutional.
Amidst discussion and arguments surrounding health care reform, is the effect passage will have on the re-election of Democrats in the Fall. The health care reform legislation currently in front of Congress is so widely unpopular on both sides of the aisle that Democrats have taken up the idea for a process called, “deem and pass” to get health care reform passed through.
Deem and pass is a process by which House Democrats will be able to avoid taking recorded votes on the Senate health care bill. Given the political environment and discussion within the blogosphere and mainstream media, the motives behind enacting this process specifically for this bill are highly transparent.
In a letter to the Speaker, above, Cuccinelli wrote, “A bill of this magnitude should not be passed using this maneuver. As the President noted last week, the American people are entitled to an up or down vote.” (He’s not exaggerating when he talks of the “magnitude” of this bill. It’s said to project up 2.5 trillion dollars in new spending).
“Based upon media interviews and statements which I have seen, you are considering this approach because it might somehow shield members of Congress from taking a recorded vote on an overwhelmingly unpopular Senate bill.”
“Deem and pass,” in this context, is an egregious violation to the democratic process. I applaud AG Ken Cuccinelli for not only acknowledging this, but also for being willing to stand against the crazies pursuing it.

I also applaud the Virginia AG for taking a stand for States Rights. It is ironic, and chilling that we have come full circle since 1865, to have a States Rights issue once more divide our country.
Where's Gov. Rick Perry on this Obamacare? I've been searching the internet and can't find anything unless he hasn't released any statement.

They were the first State to step up to the plate. Everything is relevant, and I do not know if anyone noticed, but Slick Eddie Rendel, Governor of PA was on Cavuto today, blathering about this issue had nothing to do with States Rights, and that the Federal Government supercedes all States Rights.
Rendel is nothing but a paid whore and UNION hack, bought and paid for.

The states that are trying to nullify really need to say what they are going to do to back up their rhetoric. Is this just grandstanding? The Supreme Court will never side with any state. Will they stand up to the Federal Government with local law enforcement? Will they reclaim state militias? I really want the states to take a stand, but it is just really hard to see how that would happen right now.
Perhaps a coalition of states is what's needed.
If you remove the 10th amendment, The Commerce Claus, and other such inconvenient truths Fast Eddy Rendel, might have a point.

Right, and about 37 states have similar efforts on tap. The "Supremecy Clause" may trump all of these manuevers, but I hope it ties the bill up in litigation long enough to strip down to nothing. That might be the strategy.
Actually, the Supreme Court may side with the States this time around. Between the current makeup of the court (which has a slight conservative lean) plus the gross oversteps in Federal power and method Congress and all are pushing, AND Obama calling out the Supreme Court in his State of the Union (falsely) we're actually quite primed for a showdown between the Court and the other branches. Especially if the Court is backed up by the States.

I'm confused too, but think they both go and get amended in the senate and then the House has to vote again on the amendments for the final bill. But this house vote is to set it up for the reconciliation.

Taking over even one of the legislative branches come November would be a great break on his agenda. We just have to hold off on the Republic-shattering legislation until Jan. 2011 (when a newly elected congress is seated), because I wouldn't put it past Reid and Pelosi to hold a lame duck session to try and push things through after they've lost in November.
I honestly can't claim he is the greatest Virginia. He is definitely on the list of great Virginians, but he's got to compete with so many greats I can't call him the greatest.
That said, I purposely left Lees off, as otherwise I would have had to add on three "Lees" to do them justice.

He was asked a hypothetical about what a lawyer could potentially use to challenge HCR. The question asked about eligibility (birther stuff) and he answered what a lawyer might do.
He has stated before and re-stated again after the interview that he believes Obama is a citizen and the eligibility stuff would not be part of his arguments against Obamacare.

For years, the great men of Virginia who brought this nation into existence have been shamed by Virginia's abandoning so much of what made it great. It was in Richmond that Patrick Henry proclaimed "give me liberty or give me death"; it was in the countryside near Williamsburg that Thomas Jefferson penned the Declaration of Independence, and it was at Yorktown that tyranny was defeated, surrendering abjectly to a raggletaggle citizen army as a band played a tune called The World Turn'd Upside Down. I would guess that the Federal Government would point toward the Supremecy issue, but I'm not sure that applies here because we're not talking about competeing similar legosaltion but rather the impostion of mandates on the individual states, and that would be the issue. I really don't know. We need a Constituional lawyer who, unlike Obama, actually went to class and respects the Constitution.
Obama seems to think of our Constitution as an impediment to his schemes.
The State of Texas voted for the wrong candidate earlier this month. They needed Medina badly but they voted for a career politician instead.
Perry would still need to sign it. Will he? He needs Obama's money to balance his budget.

That also entered into my thought process, but R Lee was one of the greatest Virginians. He is also unfairly treated in many places (though most in Virginia still revere him, even ones educated in public schools believe it or not). I also decided to stick with the founding fathers, rather list all the important Virginians who would stand with us (which would get quite long).
Am from Philly originally and know fast Eddy well. He made the news when he was caught on tape saying that he was behind Hilary b/c he couldn't get [rank and file] in PA to vote for a black man. He had to back pedal double time on that one.

Maybe this has been the strategy all along. Divide and concure. On the eve of President Lincoln's trip to Washington DC, the southern states had already talked about pulling out of the union. Seems they'd had it with the northern states in particular telling them how to run their state economies. So history does have a way of repeating itself. If it's going to happen, let it happen now during my lifetime so I can help ensure the general safety and welfare of my posterities future so they can live in peace.
