Judge in Virginia ‘Global Warming’ Investigation Blocks Inquiry Into…His Wife’s Former Employer

HornerAs you can read here, retired Albemarle County (Virginia) Circuit Judge Paul Peatross has ruled that Virginia Attorney General Ken Cuccinelli may not have access to records under Virginia’s Fraud Against Taxpayers Act, as he seeks to determine the propriety of Michael “Hockey Stick” Mann’s claims made to obtain research funding. Judge Peatross’s ruling protects Mann, the University, and specifically the Department of Environmental Sciences, at least for now.

Here’s the rub, on which I will have more to say. I attended the hearing a week ago Friday at which the parties argued the University’s motion to dismiss. The Deputy AG Wesley Russell’s arguments dominated, so badly I almost felt sorry for the University. The judge’s queries were puzzling, as he pleaded with the University’s counsel to come up with some argument how he might rule in their favor, as were other comments (continue reading).
Before the hearing commenced Peatross, substituting for the vacationing chief judge, cited his wife’s 1982 degree in environmental science from UVA – oddly, he then said “but not in global warming” — as part of a rather spare recitation of why he was hearing of this case (which he attested he had never heard about until reading the briefs that morning. A prominent case in the local, state and national news assigned to his old court! This man takes his retirement seriously…), and articulating his history so that counsel might decide whether he carried any conflict such that he should not hear the University’s motion.
That fact of her 1982 degree from Mann’s former Department, apparently, was relevant. Okay. But…
The fact that the judge’s wife had in fact previously worked in that Department of Environmental Sciences — the very Department that stands to suffer should he have ruled in favor of the Attorney General – was somehow not worth disclosing to counsel.
I only learned of this after the hearing by others who had also worked at the same time Ms. Peatross did, in messages expressing astonishment that her husband would decide such a matter given the obvious appearance of an inability to objectively hear it.
Also not worth disclosing was that Ms. Peatross’s relationships go much deeper, being, e.g., lauded for her role in producing a book edited by the Department’s then-chairman during Mann’s alleged hijinks, as well as, it appears, at least two of his papers.
But that she has a degree from the Department in 1982 merited consideration in determining the judge’s suitability to hear the case. And only that.
Amazing.
Now, to be completely accurate, it is an open question whether Ms. Peatross worked for the Department of Environmental Sciences, or simply in the building, physically (which I am told with no doubts that she did), for one of two particular former colleagues of Mann’s (and one supervisor at the relevant times) in their consultancies. The latter response, if it were the case, would beg other questions about mixing research and consulting. Which is to say, there is no good answer to the question. Which may be why the University refused to answer it when I asked. Four times. The two former colleagues of Mann for whom Ms. Peatross worked, according to a very basic Google search, also declined my invitation to clarify.
Charlottsville (I live here) is indeed the epitome of a company town – with UVA the company – as is surrounding Albemarle County. An adverse ruling leading to release of Mann’s relevant documents was the biggest possible black eye for a university that zealously promotes its prestige derived, in part, from Thomas Jefferson having founded it…a history the school’s lawyers rather sadly invoked up front in their brief arguing that, while some people are subject to laws, others simply cannot suffer the indiginity (if you’re thinking “Hollywood and Roman Polanski”, I’m way ahead of you). Well, of course. It’s on Jefferson’s headstone up on the hill, no doubt.
But while that particular argument of “academic freedom” did not prevail, the University did nonetheless manage to persuade Judge Peatross to block the taxpayer from discovering whether the University’s employee, Mann, engaged in fraud on the taxpayer. Again, this is for now as, according to press reports, Mr. Cuccinelli intends to press on with a new civil investigative demand (CID). It was not a complete victory for the University but, if you attended argument and/or read the briefs, you know such an outcome was not a consideration.
However that turns out, this series of events at best provides a very uncomfortable appearance of failure to disclose. Indeed, it seems to clearly rise to the level of a basis for the judge to recuse himself, instead of asking counsel, in his presence, whether they thought he was possibly biased.
The last thing our institutions of government need right now is more reason to question their operation. This is unfortunate and could easily have been avoided. Having read Cuccinelli’s briefs and seen his Deputy argue rings around the school and its hapless case for hiding the truth, I feel the truth will inevitably out, if later and after more wrangling than was necessary.

When he got home his wife must have laid out a better case than the University Council.
One hopes that on appeal this little matter might come up.
Sounds like the Judge has consumed so much Kool-Aid he is suffering from Kool-Aid toxicity which is beyond the point of intervention and healing. When caught early, mild cases can be healed.
So the law can block investigation into illegal activity when there is a clear conflict of interest. Liberalism in action.

If this judge was a honorable man he would have recused himself but, being a progressive he twisted the court into a ruling that should be overturned. He should be made into a poster child for what progressives think of the rule of law – justice for me (at any cost) but not for thee!

It is time to remove all those who are unable to separate their personal agenda from their jobs. This judge seems to have made his decision based on what was best for him and his wife, what ever happened to a judge following the written laws that have been passed by the elected representatives? If some ones does not do their job in the private sector they are fired and a replacement is found, it is time that govt employees face the same realities as every one else.

Its judges like this that reflect poorly on our court sustem, on being an un-biased observer and on our constitution. These judges have had their personal influences on our legal system for years. What's worse, is that future rulings will be based on this type of idiocy, instead of the rule of law and the constitution.
Make no mistake "green ideology" IS "liberation theology" it permeates every sector of our society now from kindergartens to military, from courts to the industrial sector, statist media and the churches themselves.

Judge Peatross is retired and was filling in. Had he not been retired he may have been more careful in his ruling. Also, if he had a shred of integrity he would have not heard the case and deferred to another judge based on his familial connection. The judge serves as another example of the lack of integrity, honor, and good judgment found so often in public service.
Virginia AG Cuccinelli is doing the peoples business. Of course the judge is doing his personal business. Rule of law? For some.

After looking at some of the historical temp records, this is as you stated a warming period since the last ice age. The Earth goes through many warming and cooling periods, and we have little understanding of exactly how and no means of controlling it either. Blaming CO2 as the only factor does prove their lacks of facts or knowledge on how climate actually workds. CO2 only makes up less than 10% of all greenhouse gasses in the atmosphere while 90%+ is water vapor.
But as noted by others here. The environmentalist dont give a damn about the environment, all they want is to take more and more of your money to keep them funded or rich. Then on top of that, give their policial buddies even more to force us to use worthless crap. The only "Green" the environmentalist care about is the "Green" lining their pockets.

We should demand a thorough investigation into this Global Warming fraud. If I remember correctly, the whole cap-n-trade bill is pretty much based on the same sceme as Enron. Its just this time, the Global Warming fraud is on a much larger scale and involves alot of players who should be jailed and removed from both the scientific communitiy and political office as well as defund corrupt organizations and stop wasteful programs to.
Once the legal system in this country is corrupted we are lost, and the progressives seem to be gaining the high ground within our judicial system. They are interpreting law from the bench rather than following it. Now that smacks of social justice or worse.
The judge should have recused himself for having a clear conflict of interest. His failure to do so shows him to be corrupt. He should face a review of his actions and punishment for hearing a case with a personal bias.
If he was truly retired, then he should not have been sitting in judgment.

Agreed. This happens often in the judiciary. A judge wants to go on vacation and needs someone to hear the cases while away. They do get to chose who they want to fill in however.
Here's the really sad part about the whole AGW issue. If the proponents were reasonable and not out to change everybody and just proposed reasonable solutions then pretty much most people would have gone along with their ideas.
For example,
* replacing lightbulbs with CFLs makes sense in some cases and saves money so people do it.
* sorting garbage makes sense IF the something is actually done with the sorted garbage. So people do it.
* Shutting off lights saves money, so people do it.
* Driving less or buying a more fuel efficient care makes sense, so people do it.
But then the AGW crowd does the following:
* Propose taxes that would "necessarily cause utility bills to sky rocket"
* Implement garbage can chips and then fine for not being perfect about sorting garbage. $100 a pop.
* Using tax money to fund the purchase of cars.
* Throwing tax money at T.Boone Pickens, Gore and others so they can profit from green tech.
* Regulating the hell out of our lives and hiding behind good intentions and "saving the world".
* Name calling, ridicule, constant attacks for not being a drone.
* Screaming EVERYTHING is a crisis and if we don't act now we all DIE!
* Scaring the HELL out of children.
* Banning and blocking all other views and positions and only presenting one view to our children who are forced to attend public school ie use our tax dollars to impose special interest on our own kids.
* Implementing legislation that destroys jobs, growth and savings.

I'm not a judge but sounds like the judge made a big mistake (maybe he's senile). Sounds reasonable that if only one dollar of state money is involved then the AG has a legal obligation to investigate. Which it sounds like the AG is about to start doing again. So it is just a matter of time before Mann has to pony up or explain why he destroyed the evidence.
They should be limited to sitting judges to select from for a temporary replacement, a retired judge can the freedom to do exactly as this one has done

Usually the chief judge or in some places the court administrator, assigns the temporary judges. Depending on the to be vacationing judge's relationship with the chief or administrator he/she may have a lot to say about who gets the case.
The State will first ask the judge to reconsider and remove himself. If he refuses, then an appeal will be taken. It is generally an immediate appeal that can be taken before the underlying case is resolved at the lower court level.
The "science" took place in state owned buildings, using state owned equiptment and even lit and heated with state provided carbon spewing electricy. The use of the State facilities should be more than enough to invoke the State law.
He did say retired and I don't understand that. How does a retired judge make a ruling? Don't know what I'm missing.

As a person educated in engineering, I trained MYSELF to question anything and everything regarding science. Even to the point of when someone claims a particular theory is no longer a theory. It is very clear you are unlearned regarding science.
With ANY discipline in science NOTHING is EVER settled until PROVEN, without any question, by 100% of all scientists. If there is even one person who can deliver a POTENTIAL valid argument against said PROVEN science, then nothing is "settled" especially through CONSENSUS. For a simple example just for you, gravity is PROVEN therefore it is now LAW.
Through your argument regarding creation, you believe this is then “settled” through consensus. You could not be more wrong and need to seriously consider where and when did the perversion of science begin. If you still question, then read my paragraph above.
