Kyoto II: Whose “power to tax”?
by Christopher C. Horner
James Sensnbrenner (R-WI), Ranking Republican on the House’s Select Committee on Energy Independence and Global Warming (really), issued a warning last week about Kyoto II. The proposal is being tugged by that vast majority of the world, rejecting its constraints, but demanding, at present count, $140 billion per year from U.S. taxpayers in atonement for past, present and future damage from weather which our government now says is our fault. It includes this gem from leading Kyoto free-rider (in perpetuity), major greenhouse gas emitter India:
India’s government says that the West owes billions of dollars to developing nations to compensate for climate change. In its submission to the United Nations Framework Convention on Climate Change, the Indian government argued that this funding should be a legal obligation that ‘cannot be subject to decisions of developed country governments or legislatures.
Oh, dear. Re-read that demand. Such an entanglement would, of course, be problematic. Barring further surprises from the current Supreme Court, we have to assume it surely would be found unconstitutional. For example, from Jeremy Rabkin’s recent talk to Hillsdale College reprinted in the July/August Imprimis:
The Constitution provides for treaties, and even specifies that treaties will be ‘the supreme Law of the Land’; that is, that they will be binding on the states. But from 1787 on, it has been recognized that for a treaty to be valid, it must be consistent with the Constitution—that the Constitution is a higher authority than treaties. And what is it that allows us to judge whether a treaty is consistent with the Constitution? Alexander Hamilton explained this in a pamphlet early on: ‘A treaty cannot change the frame of the government.’ And he gave a very logical reason: It is the Constitution that authorizes us to make treaties. If a treaty violates the Constitution, it would be like an agent betraying his principal or authority. And as I said, there has been a consensus on this in the past that few ever questioned.
Such notions are, however, considered quaint by many in our current governing class, which Rabkin also touches upon in his piece. But the recent Nobel inanity was surely in part an effort to herd an occasionally reluctant Obama administration back toward the internationalist fold by December, when we are expected to agree to Kyoto II.
As I have written elsewhere, that December deadline will surely slip (even in part possibly to avoid having whatever is done subject to the intense media attention accompanying each year’s talks), and it remains an option to simply declare that this treaty is “not a treaty” in order to avoid the Constitution’s requirement of two-thirds Senate ratification.
All of which says you needd to commit to vigilance on this issue, as batty as it generally comes across. Because the consequences are serious.

NO!
Simple and straight forward: There is NO CLIMATE CRISIS. Al Gore and his accolytes have been perpetuating the myth that man alone is the cause for changes in the climate. Were we to implement their draconian measures and stop all human caused pollutants, one good volcanic eruption would erase any gain. The arrogance and the hubris of the environmentalists is beyond belief. The Kyoto II as with Kyoto I is nothing more than a weath re-distrbution scam to send more money to the despotic governments of the world for the false promise that they will not destroy their forests and will use the money to advance their society. This have never been accomplished before and throwing more money at it will make the chances of real change impossible to emerge.
STOP THE STUPIDITY NOW, STOP SPENDING MONEY, SAVE THE DOLLAR AND SAVE OUR COUNTRY
Paying fictional greenhouse taxes is another way to make us weak. It's the financial version of Obama's worldwide apology tour, and if it passes it will win him the Nobel Prize for Economics.
enough is enough is enough
What a load of CRAP! India and China pollute the world and they want to kill jobs here? The EPA is withholding mining permits and jobs are being lost. Any further action that is pro enviro-religion is going to kill the U.S.
This is the greatest fraud ever perpetrated on mankind. Brought to US courtesy of the United Nations, Goldman Sachs, Al Gore, Timothy Geitner and George Soros.

The Global Gubmint types have always sought a way to put the great mass of humanity under a yoke. Kyoto-Green-CO2 Taxes are basically a way for them to tax people for the mere fact of being alive, which involves the exhalation of CO2. The taxes are for the care and feeding of their elite bureaucracy who will benevolently tell the rest of us how to live while exempting themselves from the rules they impose upon us.
I decline the offer.
Don't forget MICHAEL MOORE!!!???!?!!!
What would we do without his Salient and Poignant Viewpoint?
Call it what it is: International Global Climate Terrorism.

"Now they obfuscate, bluster and attack those who dare to even ask questions let alone expose the problems. Tolstoi said, “I know that most men, including those at ease with problems of the greatest complexity, can seldom accept even the simplest and most obvious truth if it be such as would oblige them to admit the falsity of conclusions which they delighted in explaining to colleagues, which they have proudly taught to others, and which they have woven, thread by thread, into the fabric of their lives.” But this is much more than not admitting falsity of conclusions. It’s now apparent they could not admit the falsity because they were contrived. Their falsity was built into the political, social and economic fabric of the entire world. "
Vigilance on this issue and every other. There is nothing with which this Administration and Congress can be trusted.
Their new slogan?
Trust us. Borat won the Nobel Piece Prize……….
This is ridiculous…now they want citizens to pay taxes to the world? I knew this "world government" concept was gaining steam, but come off it. It's bad enough what we pay to support the UN being in our country, plus the money for our policing all it's events. I say we say "no" and also kick the UN out of this country as a step in not recognizing a world government.
That IS the point – to find a pretext for a tax to support a global government.
If they want to save the world, every government of nations should share the burden and pay up. Al Gore is a scam artist.
Hear, hear!
So very true, and well put.
EFFECTIVE IMMEDIATELY: Require the EPA to perform an ECONOMIC IMPACT ANALYSIS – Prior to enforcing any action on it's alledged transgressors. This analysis to be performed by indepentdent bi-partisan committee. We can no longer afford to allow the EPA to have veto authority to any part of our economy. They are by default the most powerful agency in this country. If you don't believe me ask any one of the 30,000 unemployed farmers living in the richest and most productive farm land in the country who for the sake of a NON_NATIVE 2 inch fish, have returned this land and its people to destitution. STOP THE EPA NOW
Wrong answer. Compromising with dictators and other totalitarian states so that we can be controlled by a bunch of corrupt bureaucrats is not an attractive prospect.

I agree wholeheartedly! Thank you. The EPA is hurting us bad enough, who needs Cap 'n Tax or Kibuki II?
I will second that
The EPA is THE OMNIPOTENT POWER IN THE USA. Anything they dictate is immediately enforced and woe be the man or woman to say otherwise lest they be branded as destroyers of planets. In a land presumed to be governed by checks and balances, when it comes to this agency, the EPA there are NO CHECKS and NO BALANCE!!!!
Everyone above said it better than I could, so what is to be done? Another march on DC, which will only display our outrage. WE need to take some sort of action before this country goes down the tubes and I am at a total loss as to what that might be outside of a revolution. Stop paying taxes? I'm afraid that 2010 elections will be too late to save us whatever is left of our money.
In a short time, we will all be gasping for breath thanks to the radical agenda and it won't have anything to do with any climate change. Anger and outrage on here is like preaching to the choir because we all agree.
What, you missed the Drudge-linked BBC piece?
But research conducted two years ago, and published by the Royal Society, seemed to rule out solar influences.
…
And the results were clear. "Warming in the last 20 to 40 years can't have been caused by solar activity," said Dr Piers Forster from Leeds University, a leading contributor to this year's Intergovernmental Panel on Climate Change (IPCC).
Also noteworthy:
The UK Met Office's Hadley Centre, responsible for future climate predictions, says it incorporates solar variation and ocean cycles into its climate models, and that they are nothing new.
In fact, the centre says they are just two of the whole host of known factors that influence global temperatures – all of which are accounted for by its models.
Since the "science" is still so new they are still finding potential influences and figuring out how they interact with each other and other elements involved, is it not truly remarkable how the models continue to confirm their "facts" no matter what?
Rule of computers, and computer modeling, "Garbage in, garbage out."
We must all do our part to fight global warming!
Immediately stop buying anything possible that comes from China, India, and any other country that demands we cut back our emissions while they can do anything they please.
Heck, if India demands we pay them for "Climate Change" related damages, boycott any "customer support" where you hear an accent, and demand straight to the company they use American personnel!
What, no "Moonbats Moon First!'?
I expected more protests during the NASA crash….
I have to ask myself and others: Why is it that when the Earth is warming Mars also is warming up. When the Earth is cooling Mars also is cooling.
When Global Warming advocates can address this issue I will start to listen. Let them tax the motherland first, Mars!
This is off topic as pertains to this article, but y'all need to take a gander at this. CON-gress defrauded US again.
<a href="http://www.youtube.com/watch?v=ANUGT6CmBpw&fe…” target=”_blank”>http://www.youtube.com/watch?v=ANUGT6CmBpw&fe…
It is about time for Breitbart to release some more videos of ACORN. CON-gress did not cut funding completely. It was only suspended for a month. Ironically, at midnight on Halloween, CON-gress opens the spigot again and starts re-funding ACORN.
Even if it is true (we know that it is not), it is not the wisest use of our money. Bjorn Lomborg has long been refuting Kyoto's ability to make a marked change in the temperature of the earth. Here is a link that should be viral, causing people to think about what should be done to make a better world.

Funny. I thought the term was "WANKING MEMBER" of the Committee on Global Warming Bull$h!ttery.
BY THE WAY, DID I POINT OUT THAT ALGORE IS A DIP SHIITE?
1) there is no anthropomorphic global warming. 2) This would be taxation without representation… Didn't we fight a war over that with the most powerful country in the world at the time?
You want that money, you jerks, come and get it! I'm not giving you jack! All part of the plan to run this country into the ground. Over my dead body…literally!
I am so sick of taxes! I just joined The Free Enterprise Nation so that my money can actually be represented INTELLIGENTLY. Please join me if you too feel this way.
