California’s Regulatory Fantasyland: Brass and Lead Edition
by Chuck DeVoreLast night was one of those nights when I was mad as hell at the California State government and their foolish, micro-managing, Big-Nanny ways. (Caution, dear reader, such rage at the machine has been known to cause the temporary insanity of running for public office.)

The cause of my extended rant? AB 1953, a law passed in 2006 that goes into effect on January 1, 2010, the purpose of which was to define lead-free plumbing from 4% in fixtures down to the European Union standard of 0.25%. Not that the science supported this change. Once lead was removed as a gasoline additive, taken out of paints, and removed from plumbing (the Latin word for plumbing is where we get the chemical symbol for lead: Pb), human lead exposure dropped significantly. Having a small percentage of lead bound up in a brass alloy plumbing fixture isn’t going to add a statistically meaningful amount of lead exposure to anyone.
Today’s story began when my family bought a 4-bedroom house in Irvine in 1998. The house, built in 1979, had the original chrome-plated sink fixtures when we moved in. As soon as I could afford it, I installed solid brass bathroom fixtures.
Well, our master bathroom faucet sprung a very slow leak on the cold water handle a few months back. Having a few spare hours, I found the leak on the valve, took it apart, and trekked down to Lowe’s.
Lowe’s didn’t have the part, so I went over to the plumbing fixtures aisle and looked for a replacement. Then I looked again, and again. There was a sole, lonely brass fixture in the vast expanse of hundreds of makes and models. I frowned. My wife, Diane, likes brass. She doesn’t like chrome. And, she really hates “brushed nickel” or anything that looks like someone took steel wool to a chunk of corroded pot metal, pronouncing it “antique.”
Then it hit me. The culprit was AB 1953! The floor debate over this bill came rushing back to me as anger built up in aisle 14. AB 1953 was why retailers catering to the do-it-yourself crowd were manifesting the changes demanded by this law. The result: traditional brass plumbing fixtures are vanishing quickly as they will be illegal in California next month and the low-lead brass manufacturers have yet to meet demand.
I debated against AB 1953 as it passed the Assembly for the first time on a 41-37 vote, the minimum needed to pass. It went to the senate, was amended, and passed 21-18, again, with no votes to spare, always a sign of a particularly bad bill in the very leftwing California Legislature. The bill came back to the Assembly for final passage: 42-36. In its three floor votes, AB 1953 only picked up one Republican “aye,” but, as he does with depressing frequency, Governor Schwarzenegger signed the bill anyway.
So, here we are in California, a state with America’s fourth-highest unemployment rate; a state losing 3,000 productive, tax-paying citizens every week to places such as business-friendly Texas. But, a state carrying 32% of the nation’s welfare caseload with what Forbes Magazine calls the 50th worst business tax and regulatory climate in the nation; and a state with a legislature that thinks nothing of layering new rules on top of new rules in the constant quest to make California the most perfect state in which no one can afford to live or find a job.

Today almost 90% of all brass alloys are recycled.
That should keep the greenies happy.
To enhance the machinability of brass, lead is often added in concentrations of around 2%. This lead is present on the surface of the material, and thus presents a health concern similar to that of pure lead. Silicon is an alternative material, however when silicon is used in a brass alloy, the scrap must never be mixed with leaded brass scrap because of contamination and safety problems.
Oh, so by switching to no-lead there are now separation issues before recycling. Isn't that nice? So now scrap recyclers have to chemically test every piece?
Plumbing: By January 1, 2010 in California, lead-free brass (brass containing less than 0.25% lead) must be used for "each component that comes into contact with the wetted surface of pipes and pipe fittings, plumbing fittings and fixtures." The common practice of using pipes for electrical grounding is discouraged, as it accelerates lead corrosion.
Do these regulatory geniuses understand modern electrical wiring, and why it can be required to ground plumbing for safety reasons?
And finally for further legislative brilliance:
Keys: In October 1999 the California State Attorney General sued 13 key manufacturers and distributors over lead content. In laboratory tests, state researchers found the average brass key, new or old, exceeded the California Proposition 65 limits by an average factor of 19, assuming handling twice a day. In April 2001 manufacturers agreed to reduce lead content to 1.5%, or face a requirement to warn consumers about lead content. Keys plated with other metals are not affected by the settlement, and may continue to use high lead content alloys.
And what do you see where they cut the teeth on a plated key? Brass. How long does it take normal pocket wear to rub the plating off and expose the brass. Not long.

Let's not forget that Goodwill and the Salvation Army will no longer accept toys because of the same type of lead hypersensitivity idiocy. (In all fairness, I don't know if this is strictly a California thing.)
I am actually relieved by this story. When I saw the headline I thought they were doing another ammunition-banning scheme. Perhaps mandating a lead-free, more earth-friendly, "sustainable" bullet material. Like compressed algae.

Flashback: 1999>I'm in the shower in a fairly posh Monterey CA hotel, as a trickle of water leaks out of the shower head. I call the front desk, as I gaze out of the window at the PACIFIC OCEAN, to report the defective water pressure. I'm told that the shower pressure is a water-conservation measure mandated by the legislature. Still looking at the OCEAN, I hang up the phone while screaming "desalinization, morons" but the drip-drip-drip continues.
My conspiracy theory for California. The Liberal Elite wants to depopulate the state by at least half. Crank up taxes and fees until most of the middle class flees in disgust. When state revenues tank, start cutting back on the handouts causing the work ethic challenged to flee as well. How many of California's problems would be solved if you just convinced hal fthe people to move to another state? Power shortages, water shortages, traffic congestion? All you really need is the ruling class and enough peons to garden, clean up and work as waiters and chefs at the fancy resturants.
Not happening but that would explain some of the insane things the government of California does.
This is the type of nonsense that lets me feel better and better about moving out of this state.

System leaks in the utility's distribution pipes and valves account for more losses than any low-flow or low-flush devices save. The utilities should have a required upgrade and maintenance schedule to meet prior to idiotic rules for joe homeowner.
Also the contribution of lead to homeowner consumption is a function of the home or building's piping, its condition and type and once again the water utility's distribution system type and condition of pipe.
The California legislature must be full of the brain dead. They must believe that a replacement faucet is going to save the planet just like driving just one Prius would. Not likely. Can it help? Yeah, but not enough to even make a measurable impact.
California should focus their few resourses on cloning saber-toothed tigers. Remember them? Back in the olden days the saber-toothed tigers ate people stupid enough to mess with them or dumb enough not to run. With a fresh batch of saber-tooth tiger clones we could clean up California's tainted gene pool. The Govenor even knows a thing or two about clones. He could help.

My ancestors came to California during the Gold Rush. Once my kids are done with High School we may move to Arizona. It's impossible to compete with other small business in other states due to the screwed up government here.
I don't live in California for its intelligent legislation! They do crazy things we can't stop, such as the AB 1700 assembly bill that passed and began on November 1st, 2009 which allows the CA government to "loan" themselves 10% of our paycheck. I don't know of anyone that heard that one sneak through.

I'm from Phoenix, home of the "Open Borders Napalitano" fame who is now in charge of Homeland Security. Arizona is my heart and soul but I couldn't move back with only Sheriff Joe Arpaio (aka Uncle Joe) upholding the laws while fighting congress and Arizona representatives to do it. Living in CA would be a nightmare if not for the farming community that is down to earth, wonderful people. They believe in gun rights and the Constitution which is probably why CA greenies have stopped their water.
If you go to Arizona, you will love Uncle Joe Arpaio.

I can't believe what they've done to this state. It's like watching a train wreck in slow motion. I can't help but think that at some point the state is going to collapse under the weight of its own idiocy. I woke up today and turned on the news and guess who was on, blabbering incoherently about green cars? The head buffoon himself, Schwarzenegger. He can't find a way to stop this state from hemorrhaging capital and resources, but holy shit is he excited about cars that run on urine, alfalfa, and soy beans. It makes me want to beat myself in the head with a hammer.

Manufacturers will not carry double inventory so soon the entire USA will be receiving either "no lead" or low lead product. This will lower both quality and selection as well as increase price. Scumbag lawyers will be purchasing faucets and testing lead content in the hopes of suing some deep pockets retailer or manufacturer. I doubt the consideration of alloy cost ever crossed the minds of the lawmakers.
The alloy (Eco-Brass C87850) that is used in creating the brass fittings that comply with the standards of AB1253 is 60% higher in price than traditional brass alloys.
Now I manage a foundry that produces these castings (Stateside, a debate for another time), we have no problem making these castings, the price is high, but my question is is it necessary or are we going to far with the passing of AB1253?
The business side of me says I am all for it,
but my common sense side tells me that we are going to far.
Wow, just wow. I've been saying the same for years. Every single day it seems we are slapped with new regulations as the legislator and governor work to create a utopia that we can't live in.
We've got fireplaces that we can't use, car windows that block cell phones, GPS and garage door openers, a ban on black cars coming, diesel engine regulations that will make everything more expensive (see killcarb.com), "green" energy requirements and now bans on ammunition. I don't know how long I can stand to live in this paradise.
My wife and I make six figures each and we're just aching to leave the state for a place with more personal freedom and lower taxes. We're taking our engineering and nursing skills with us.
In CA, you are still required to pay taxes on out of state purchases if the item is used in the state. It could be the most ignored law on the books since the cell phone in car use ban. CA just LOVES to tax us.

Adding to your compounded problems, our Great Governator said (on December 3, I think) that we must continue
