DOJ Defends ACORN Funding Ban While Gutting It
by Chris BergThe Harshbarger investigation is getting a lot of attention this week; and rightly so. ACORN hired former Massachusetts Attorney General Scott Harshbarger to conduct an “independent” review of the organization in an effort to provide ACORN some cover to show that they were serious about reform. The Harshbarger report concludes that ACORN was not at fault, rather the blame should rest with its founder Wade Rathke, the intrepid aspiring journalists Hannah Giles and James O’Keefe who revealed ACORN’s most recent corruption, and the low level ACORN employees and members who were featured in the videos.

This attempt to whitewash ACORN and its employees’ wrongdoing has been appropriately decried by Representative Darrell Issa, the Republican National Lawyers Association, and contributors to Biggovernment.com.
ACORN’s pending litigation against the federal government has received less attention. Last week, unbeknownst to all but avid court or ACORN watchers a pivotal moment occurred in the lawsuit. Peter D. Leary, an attorney at the Department of Justice filed a brief defending the Congressional efforts to defund ACORN. His brief defended the defunding, while severely narrowing its scope and application.
Congress was clear in its decision to defund ACORN. The plain language of the Continuing Resolution (CR) is unmistakable:
“None of the funds made available by this joint resolution or any prior Act may be provided to the Association of Community Organizations for Reform Now (ACORN), or any of its affiliates, subsidiaries, or allied organizations.”
The Department of Justice has however issued a memorandum severely narrowing its application.
Harvard Law School professor and Acting Assistant Attorney General David J. Barron concluded that the CR “should not be read as directing or authorizing HUD to breach a pre-existing binding contractual obligation to make payments to ACORN or its affiliates, subsidiaries, or allied organizations where doing so would give rise to contractual liability.” He reaches this conclusion by parsing the definition of the term “provided.” I wonder where Professor Barron was when President Clinton was attempting to define the word “is.”
This memorandum and its conclusions defy both logic and common sense.
Now we turn to the brief filed last week by the government. It defends the defunding of ACORN noting that the Executive Branch has interpreted the CR ban on funding narrowly, and relying heavily on the fact that a CR is by definition temporary in nature.
The brief relies on the Barron memorandum noting that “the Executive Branch has interpreted [the ban on funding] more narrowly, such that ‘section 163 does not direct or authorize [Agencies] to refuse payment on binding contractual obligations that predate the Continuing Appropriations Resolution.’”
To reinforce the point that the defunding is only temporary attorney Peter Leary states that “[t]ellingly, three of the four full-year Fiscal Year 2010 Appropriations Acts that have been enacted since the CR went into effect contain no provisions foreclosing plaintiffs from applying for or receiving federal grants.” The message is clear, Obama’s Justice Department will defend the actions of Congress to defund ACORN so long as they are only temporary and the free-flowing access to federal funds is restored soon.
This brief may be music to the ears of Representative Jerrold Nadler. If you recall he’s been fighting the ban and advising ACORN’s attorney on the issue. While DOJ has not gone so far as to agree with ACORN, it has eviscerated the intent and substance of the ban on funding.
It’s time for Congress to permanently defund this corrupt organization. Congress must protect the taxpayers and ensure that no more federal funds are not subject to waste, fraud or abuse by ACORN.

Keep writing to your representatives and protest any funding to ACORN. I send at least an email a day and try to get a letter or two a week (of course, my representatives are Brad Sherman, Barbara Boxer and Diane Fienstein, so I may be writing for not). Also, I keep talking to my friends (who think I'm crazy because I was a liberal only a few years ago) and some are starting to see the light (they at least admit that the MSN is no longer an unbiased source of information). Keep up the fight to keep our country free. I also want to thank Mr. Breitbart, BigGovernment.com, and all of its contributors for reporting news by way of facts. All it takes is a day or two reading the blog, an open mind, and a dash of Fox, Beck, Hannity and Mark Levine and almost anyone can see that the American way is being threatened from within. I truly think that if the conservatives stick to fiscal issues, small government, and stay away from folk's personal lives (I think there are many people that vote Democrat/liberal only because of social issues, which issues should mostly be state's rights anyway), that independents and former Democrats like myself will help right the ship in 2010.

ACORN and its ilk are too valuable for the statists in Washington to let it die. Gutting the defeunding law does not surprise me a bit.
This administration is criminal!
All of these contracts contain clauses that allow the funding to be terminated for cause. The actions of the Acorn employees constitutes an attempt to aid in the commission of a crime. It would be very east to terminate ALL of these contracts IF the federal justice department wanted to.
The current attorney general of the US is incompetant at best and a traitor to his country at worst. After watching his reasoning for having a trial of detainees that WILL put a lot of government money into his friends pockets, I believe him to be a traitor.
Let's face it. ACORN is Obama's alma mater. And Obama has the checkbook. They will never be cut off from the government tit.

The funding of ACORN will be the new Washington shell game. They will change names and carry on. I believe only the people have the power to change the status quo. If you have money in a bank that runs a foundation that gave into ACORN's blackmail, change banks and let them know why. If you support a charity that passes funds on to ACORN, write them a letter of protest and let them know you will not be making any more donation until and unless support of ACORN removed from their grants programs.
I protest AARP's support of the health plan by not only not joining AARP, but by letting the many insurance companies that send me offers with the AARP logo on them that I not only do not support AARP, I will not purchase any product from any company that supports AARP by paying them a spiff on all policies sold or buying thier mailing list.
We the people have the power, we just need to start using it.

Time is running out; for it will be 'the people' who are learning that reliance on ones independent character, not party affiliation, that will bring a new day to our political environment . . . And there is absolutely nothing that ACORN or their shadow organizations can do that will keep them on the public dole. . . in the long run.
It’s hard to get the message out to the people when the Administration controls most of the media. It he had half the scrutiny Palin had he would have been toast. Cry baby. The most corrupt administration ever.
They are hugely relevant RBLUM. It just seems like no matter what they(the WHOLE Organization) do, they will always be protected by some liberal in the justice system, and Obama will say, “I’m not aware of that, I haven’t been following it”. This will be a long 3 years.
