Federal Judge Colluded with Prosecutors and Law Enforcement, then Presided over Trial
by Capitol ConfidentialA federal judge conspired with the Bush Department of Justice to plan the largest immigration raid ever in the United States, and then presided over the trial of the plant’s manager, eventually sentencing him beyond even prosecutors’ recommendation.
New documents show Linda Reade, the chief judge of the U.S. District Court for the Northern District of Iowa, was involved in the planning of the Immigrations and Customs Enforcement raid on the Agriprocessors kosher meatpacking plant at least six months before it occurred in May 2008. She asked for briefings from law enforcement and went as far as to ensure the raid was conducted around her vacation schedule.
But the judge never said a word of this to the defense lawyers for Sholom Rubashkin, the Agriprocessors manager, when she presided over his trial on bank fraud. She didn’t recuse herself from the case, either.
Rubashkin was convicted of causing $20 million in loses to a bank because he overstated Agriprocessors’ assets to get a larger loan. The raid destroyed Agriprocessors and the bank then called the loan. Reade sentenced Rubashkin in June to 27 years in prison. That’s more than Jeffrey Skilling, convicted of causing $80 million in losses from Enron, who got 24 years. And Dennis Kozlowski, the former CEO of Tyco, got 8 ½ to 25 years in prison for a $150 million fraud.
Rubashkin’s sentence is extreme, especially for a first-time, non-violent offender. After all, six former U.S. attorneys general sent Judge Reade a letter arguing against a multi-decade sentence for Rubashkin before she announced her decision. And prosecutors asked for 25 years.
“Without disclosing to defense counsel her meetings with the U.S. attorney and the support she expressed for the raid, she presided at Mr. Rubashkin’s trial, and then immediately had him imprisoned, and sentenced him to two years more in prison than the prosecution requested,” Rubashkin’s attorney, Nathan Lewin, said in a press release Thursday.
Judge Reade told the defense lawyers that she engaged in “logistical cooperation” with law enforcement officials for the raid, which included prosecuting more than 450 illegal immigrants who worked at Agriprocessors. The Justice Department set up a temporary courthouse at the National Cattle Congress in Waterloo, Iowa, to process the immigrants.
But Reade clearly did more than coordinate moving her office. She told law enforcement officials she was “willing to support the operation in any way possible.” She participated in a meeting that discussed “an overview of charging strategies, numbers of anticipated arrests and prosecutions, logistics, the movement of detainees, and other issues related to the [Agriprocessors] investigation and operation.”
And just before the raid, she asked for a “final gameplan” from prosecutors and “requested a briefing on how the operation will be conducted.”
And Bush Justice Department officials concealed the truth about Reade’s involvement to Congress as well.
The new documents are just coming to light because of a Freedom of Information Act request that has just been fulfilled for Rubashkin’s defense team, even though it was filed before the trial began. Rubashkin’s attorneys say they had to sue the Department of Homeland Security to get all the information.
Rubashkin’s legal team has asked for a new trial, and want a different judge to rule on whether Judge Reade should have disqualified herself from the case. They are also appealing the conviction and sentence Reade handed down.
This case has gotten a lot of media attention recently, with former Rep. Bob Barr calling on the Justice Department to investigate concerns about sentencing disparities. But now it seems we have a better understanding of why that is.

Linda Reade needs Impeached.
If a few dozen Judges were Impeached then perhaps Judges would begin to think before a case comes up, and think as they sit in Judgement of a case, and think before they rule on a case.

I don't know why this is news. Federal judicial corruption has been running rampant for a long time. First clue is, most, if not all federal judge-ships are bought and paid for through campaign M.O.N.E.Y donations. How in the world can a president that was elected from one part of the country, be able to appoint hundreds of district court judges that he knows little about, that are located in another part of the country? Yes, some come through recommendations, but most are appointed from a M.O.N.E.Y donors list.
I agree with a above poster that stated if a few dozen of these corrupt rascals were impeached, then maybe the rest would get the message. It ain't gonna happen. Why? Because the federal courts have congress cowarding under their desks under the courts self manufactured term of "judicial independence." If we can ever get congress to get over that line of BS, then the courts may stand a chance of being Constitutionally straightened. I support the judge, ………. Having followed this case she did not interfere with evidence, she did not plant nor was any evidence planted. The case was held in public, the charges were fair, he was found guilty and the sentence was more realistic than other sissie judges

It wasn't "the raid" that destroyed Agriprocessor, it was the wide range of criminal activity carried out by him and his business, from illegal slaughter practices to the economic fraud to the hiring of illegal labor. He's a criminal, was essentially running a criminal enterprise routinely snubbing their nose at US law, and got the sentence he deserved. That others in similar shoes didn't get the sentences they deserved and were let off more lightly doesn't mean he should be as well. But he's been a cause celebre and portrayed as a "victim" from day one from certain parties, who will use this(and any other straw they can grasp at) to try to spring him or get his sentence reduced, downplaying his own criminal acts, as they always do(worst of all are the Chabad Lubavitcher's, which Rubashkin was)

In the last Rubashkin puff piece in Big Government written by Bob Barr, neither Barr nor Big Government bothered to reveal the fact that Barr is on Rubashkin's legal team. I sent an email to BG complaining about it but apparently they did not think the fact that Barr receives a steady pay check from Rubashkin was relevant to its readers. This is really piss poor journalism.

All those arrested in the raid had to be brought before a magistrate in less than 24 hours from the time of their arrest. This meant that they needed courtrooms, judges, attorneys, interpretors, clerks, computer equipment, remote courtrooms, video cameras, etc, available and ready to arraign these people. None of this was kept secret from anyone. I have nothing to do with the case and live thousands of miles away from Iowa and I read about it on the internet. So for the defense to claim that any info was kept from them is pure bullshit. It's a ridiculous motion that is destined to fail.

A judge is supposed to get a case AFTER the prosecutors make one. A judge is not supposed to help MAKE the case:

I’m so sorry that the mean old gay judge didn’t rule the way you think he should have, but your assertion of judicial abuse is utterly absurd. Any argument to the contrary is completely without merit, and only goes to show that you either have no understanding of the judicial process or a complete disregard for the constitution.
The will of the people is represented by the Constitution of the United States, and no state or group of voters from that state have any legal authority to pass a law that goes against the will of the people as defined by that constitution. These are the facts, and cannot be disputed.
Note that I’ve not said that the ruling was correct. That would be my opinion, and my opinion, like yours is worth just about as much as it costs.

Seems the only way to stop judicial abuse is to impeach some of them, and put them in jail. Some states require elections for their judges…..seems a little too political but at least we would know where they stand prior to being seated. Perhaps those who have been appointed should face an election after they have served a six year intial appointment, that would give enough history of how they approach the constitution in their ruleings. They should face the voters of the Judicial district they serve. We need to rid ourselves of life-time appointed judiciary. They need to face the citizens from time to time.

This article starts out by accusing a federal judge of conspiracy. But when I read the rest of the article, as well as the articles in the hyperlinks, I can't find proof of any specific unlawful or harmful acts that the judge allegedly committed. I also note a factual error in AP writer Michael J. Crumb's article. The prosecutors, not the judge, dismissed the immigration charges against Rubashkin.
Rubashkin's legal team have asked for a new trial under US Code – Section 455(a): Disqualification of justice, judge, or magistrate judge. This section states: "(a) Any justice, judge, or magistrate judge of the United States shall disqualify himself in any proceeding in which his impartiality might reasonably be questioned." In the spirit of this section of the USC, this article, and the earlier one by Bob Barr about Rubashkin, should be removed. I do not believe the articles were written by impartial persons.
Was he in a position to know they were illegal? Is he able to access the federal data bases that would allow him to verify their eligiblility? (That was in it's self illegal, "accessing the federal data bases", last I heard. Maybe it was legal at the time of the offense. We don't know.)
Everything is in doubt because of the Judge's improper actions.
The ones written on her hand? I believe they were covered. (Did she stare at her hand as much as Obama stares at his telepromptor? Did she ever look at the audience or the camera, as Obama never does while speaking?)
The reason the MSM does not generally report on the mis-deeds of judges is not weird – it's simple and political. To those on the Left (=MSM for the most part), judges are the tools used to undermine their opponents laws and regulations. It is far easier for a judge to invalidate an existing law or effectively redefine laws to fit the Left's narrative – case in point, the Prop 8 ruling in California. While not all such actions will survive appeal, enough do to effect the desired change and making changes via judge is far easier and cheaper than doing it constitutionally.
Using judges to legislate behavior and morals is one of, if not the, most powerful tactic of the left. If judges as a whole were to get the scrutiny they deserve, that would undermine one of the Left's most powerful weapons.
Hence lack of reporting on aberrant and illegal behavior by judges.
There may not be much to this. "Collusion" covers a lot of territory, from the harmless to the criminal. I wouldn't assume that the judge is guilty of nefarious dealings until I read much more about the particulars. Merely "coordinating" with law enforcement doesn't seem like an obvious crime. 450 defendants is a pretty big crowd; I'd guess that some sort of coordination between the judiciary and law enforcement would be necessary to handle such a number.
She did not conspire, but worked with Federal law enforcement to manage the hundreds of criminal aliens who would be arrested and prosecuted in her district. You can't bring in that many criminal cases without making arrangements with the courts and the Chief Judge has those administrative responsibilities.
She should recused herself, then.
This Judge should no doubt be impeached. Whether WE The People are dealing with left or right there is NO DOUBT about right and wrong!
Multi decade conviction for a white collar criminal is unjustified, but a poor druggie can get life…..What an upside down world we live in!!! This whole "Judicial" carnival is getting so ridiculously bias, it is pathetically rigged!!!! Convict the poor, let him/her rot, exploit every technicality to release your white collar friends!!! Retry him, select a "Progressive" Judge to defend/Judge him!!!
GIve me a break. From what (admittedly little) I have read Rubashkin is a lackey. Nonetheless, EVERYONE is entitled to a fair trial, guilty or not.
Innocent until proven guilty. Would you be okay with a judge that may or may not have compromised juidicial ethics and his/her impartiality, if it was your trial? I would guess not.
FYI There was a separate federal case on the immigration charges…and HE WAS CLEARED OF ANY MISCONDUCT.
