Court Delivers Blow to FCC in Ruling
by Capitol ConfidentialIn a blow to the Federal Communications Commission (FCC) and its Chairman, Julius Genachowski, the U.S. Court of Appeals for the District of Columbia Circuit today ruled against the agency in a case brought by Comcast. At issue in the court action was the question of whether the FCC currently has sufficient authority to regulate broadband services. The Court has now determined that it does not.

Already being interpreted as a major slap in the face to the agency, the ruling could have major implications for how Genachowski proceeds in implementing his vision with regard to broadband policy—a vision that critics charge encompasses heavy-handed, excessive and unnecessary government regulation. As Capitol Confidential has previously reported, Genachowski is a champion of a policy known as “net neutrality,” which is broadly opposed by a coalition of internet service providers (ISPs), communications workers, minority, women’s and artists’ groups, and large numbers of congressional Republicans and Democrats.
The ruling leaves open three options for Genachowski in continuing to push for heightened regulation. First, the FCC can appeal the decision to the Supreme Court. Second, the FCC could urge Congress to rewrite legislation. Third, the FCC could pursue what some observers have dubbed a “sweeping reclassification” of broadband services under an existing set of rules which relate to telephone services.
At present, broadband services are treated as an information service, and regulated relatively lightly. Were the reclassification approach taken, however, that would cease to be the case—and net neutrality would be instituted, albeit indirectly.
Previously, ISPs have urged the FCC not to go this route, should it be rapped on the knuckles by the Court. However, it likely presents Genachowski with a more efficient pathway to achieving his vision with regard to broadband services than would an appeal to the Supreme Court, or Congress pursuing legislation. As Reuters reported over the weekend, “the Supreme Court… might not hear the case or take years to deliver a final ruling.” Telecoms experts meanwhile say that Congress looks unwilling or unable to act.

Net Neutrality is electronic socialism. It has to be stopped. The internet must remain a realm of free enterprise and free expression. Net Neutrality will kill that.

This has to be one of the most unintelligible pursuits of this administration. The internet as we know it was built from its infancy specifically to be nothing more than a conjugation of completely unrelated, privately held and controlled networks. Many in the industry (myself included) would argue that it is this very foundational premise that has made the internet the entity that it has become. To suddenly place heavy handed government control on something that was designed specifically NOT to be under any centralized control seems to me to be simply tinkering with the proverbial recipe of success. If it isn't broke, why do we want to fix it 'till it is?
The FCC has been out of control for years. It has outlived its usefulness. If you look at its history , its rulemaking has been overturned by the courts ( and not exactly arch-conservative ones) more often than any other federal agency. meanwhile, with all our morass of regulations – South Korea kicks the crap out of us on broadband and media generally.
There is no way a government bureaucracy can keep up with this high-tech world. They are still trying to decide between VHS and Betamax. We're trying to decide between Blu-Ray and on-demand.

One of the things I've been seeing lately with even the LOWER courts actually ruling CORRECTLY with the Constitution – they SEE the writing on the wall with the MAJORITY of American's wanting the Government to get back in line with it. They know that if they stick their necks out and make REALLY stupid rulings against the Constitution – there is a good change they WILL get called to the carpet and thrown out.
Yes! Well, it's good news, (sort of) for now. Reclassification is what Genachowski really wants. I'm sure they're exploring every avenue (creating new ones) to weasel their way into greater regulation / control, just as they did with deathcare.
How about university professor, grade school teacher, and high school teacher neutrality. I think that would go over like a lead zepplin. Or how about all media neutrality.

I agree that the government should stay out of the commercial (private sector) business of internet access. Please keep in mind that the internet, like many other products, started with the government. In the case of the internet, it was initially government funded research and development for inter-networking, then came commercialization and introduction of privately run Internet service providers in the 1980s.

The comments all seem to point in the same direction but I guess I fail to share the joy.
Who won and what did they win:
1. It looks like there is now a precedent in law allowing a cable company to block a site or sites for “business” reasons.
2. In most locations there is no cable competition except for the scheduled franchise renewal process.
3. What is to prevent a deal between a government entity and the cable franchise owner to block disruptive internet sites?
4. It is also possible that this could come back to bite the cable provider. The cable company’s defense when sued over content has been that they are a common carrier and have no control over what is posted. It would seem like this case will be harder to make if they are currently scrubbing selected sites/applications.
While nearly everything this current administration has done has been guns blazing with little regard for the Constitution or anyone that gets in their way, in this case they may be playing the long game?

I am glad the FCC lost, but they are campaigning under the guise that Comcast was blocking sites from their users access and probably disabling certain programs(torrents I am guessing) from connecting to the internet.
They are both evil, but the FCC is trying to act like the savior, it is their typical socialist strategy and we see through it. The judicial branch is all we have left.
1 – Just because Comcast is wrong does not make the FCC right, they have their own agenda. Ask the right questions and your thinking will get further.
2 – I have lived in many places, some non-metropolitan, and none of them only had one option for internet. Satellite providers, wireless carriers, and dial-up are just some. You can have cable with one and internet with any of the others.
3 – FCC is the government, they don't want to make a deal they want total control.
4 – They do not block legitimate applications or sites, I know about comcast from Technology Law class. They do block programs that, although they do not condone piracy, allow piracy to flourish.

Broadband carriers are providers and have little to do with the Internet. They do not block legitimate applications or sites, I know about comcast from Technology Law class. They do block programs that, although they do not condone piracy, allow piracy to flourish.
The Internet is not a right.
Internet Providers own the lines that the information travels on, broadband was not put in by the government and cannot be regulated by the government. If Comcast did not have to pay for the installation of their network then there would be more competition, sadly it is far to expensive for other companies to lay down their lines.
You think God-King Obama will let a little thing like courts stop him from his plans? He'll do what he always does, whatever he wants, constitution be damned. The man is a menace to freedom!

my i-net service using a sierra wireless 3 g watcher (air card). I live in a rural area & never have a prob-
lem in my home territory. However when I go to a large town where AT&T is the dominant provider, my
air card will connect, AT&T comes up as the automatic server, then immediately kicks off. I can put the connections mode on manual & pick a provider, but on auto AT&T will not allow me to go on line. I've
even found some hotels are 'blocking' my 3g watcher now, forcing me to use their i-net connection. I
asked at the front desk, but of course the guy behind the counter plead ignorance.
You can bet that Obie and his boys are working feverishly to circumvent any judicial rulings. Don't let your guard down.

If the net is not neutral then the cable companies can control what the users get. The cable companies want to determine what internet services their users can access. All services should be equally available to the users. Cable companies and phone companies want to keep you paying outrageous fees for channels bundled to maximize their income not to bring the users the best values. Many new companies are springing up to provide communication services and media chosen by the users. If there is not net neutrality these services can be throttled in their infancy by the cable, phone and satellite companies.

I'm a little confused after hearing about this ruling and reading the posts here. Was this about restricting access to content on the internet or restricting competition of the ISP's? I've seen many celebrating the win, but I heard today that the FCC is just going to write a policy to take care of it. (Reminded me of the EPA – can't get Cap & Tax through, so they just write a regulation to get to their end goal.) They said they would simply reclassify the internet business as a utility so they could control it.

Considering that Obummer has made it clear that he has no intention of adhereing to the Constitution or protecting this nation, impeachment proceedings should begin just as soon as the Republicans take control of Congress this November.
