Possible O’Keefe Explanation: He Was an ACORN ‘Secret Shopper’
by Capitol ConfidentialThe recent statement published on Big Government by James O’Keefe and the existence of videotape showing the full project intended for Senator Landrieu’s office should put an end to the irresponsible chatter about Watergate Jr. or any other slanderous attacks of wiretapping by the “objective journalists” of the mainstream media.
We’re not naïve enough to believe the attacks will stop, but there is something to be said about holding your fire until you have some clue about what’s going on. The Washington Post and other outlets have been forced to walk back their outrageous statements of wiretapping and apologize for their accusations of seeking to destroy a phone system of the federal government. As amusing as it’s been to see O’Keefe’s antics demonstrate media bias, there is the concern about an obscure portion of the United States Code about misrepresenting yourself to gain access to a federal facility.
According to O’Keefe, videotape of the event will fully exonerate him. If we take that at face value, then all that is left is the charge of misrepresentation to gain access to a federal office. This may be the cause of some squirming by the four young men, because the federal government and
its officers do not like to be trifled with, and the ability to bring punishment to US citizens for minor offenses isn’t limited to smoking a joint without the benefit of having a judge as a blood relative.
The relevant portion is 18USC § 1036 , which states:
Whoever, by any fraud or false pretense, enters or attempts to enter—
(1) any real property belonging in whole or in part to, or leased by, the
United States;shall be punished as provided in subsection (b) of this section.
(b) The punishment for an offense under subsection (a) of this section is—
(1) a fine under this title or imprisonment for not more than 10 years, or
both, if the offense is committed with the intent to commit a felony; or
(2) a fine under this title or imprisonment for not more than 6 months, or
both, in any other case.
As the story leaks out about the real purpose behind the sting, expect media pundits and leftwing bloggers to begin harping about entering the building under false pretenses and demanding the full range of punishment. As you can see, that’s 6 month imprisonment and a fine as the maximum, which is still serious, but not a felony.
It is still instructive to look at other examples of entering official government buildings under false pretenses, especially when the perpetrators are none other than the fine staff members of ACORN (you just knew there was going to be an ACORN link, didn’t you?). Considering the media tour Bertha Lewis embarked on to claim O’Keefe’s arrest “is further evidence of his
disregard for the law in pursuit of his extremist agenda,” we can take a look at the kind of secret undercover investigation of which Bertha Lewis does approve.
In ACORN vs. Deborah Scott, a lawsuit brought by ACORN and its allies against the Missouri Department of Social Services, an undercover member of ACORN went into state offices posing as a poor woman seeking welfare.
ACORN refers to this action as “secret shopper,” and uses it to bolster their case accusing the DSS of not providing voter registrations low-income citizens.
During the Week of May 7, 2007, Nyana Miller a staff member of
ACORN, conducted DSS offices surveys in St Louis City, St. Louis County,
Jackson County, and Clay County to determine whether they were providing
voter registration services as required by the NVRA. Miller conducted
“secret shopper” office visits to determine the availability of voter
registration services, signs, and the readiness of the staff to offer voter
registration services. She also surveyed DSS clients leaving DSS offices to
determine whether the client was offered voter registration services during
his or her visit. When Miller visited offices, she identified herself as a
person interested in applying for food stamps and tool contemporaneous
notes.
One wonders if there are any relevant Missouri fraud statutes about using false pretenses to apply for state aid. Miller conducted “secret shopper” office visits, where she identified herself as someone interested in applying for food stamps. UNDER FALSE PRETENSES! Shocking. This show of flagrant disregard for honesty doesn’t seem to be addressed in the rest of the court documents, but certainly we can agree that when it suits their purposes, ACORN has no problem lying to government officials to gather evidence. They like it so much they use the information gathered in court documents that would eventually bring them almost half a millon dollars in lawyer’s fees.
Perhaps we should start calling the escapades of James and his friends as ”secret shopping” office visits. It sounds so much nicer than “attempted wiretapping,” or “felonious misrepresentation with intention to tamper.”
Whatever you call it, the double standard is exposed. In coming weeks, I expect to see O’Keefe exonerated with a slap on the wrist, but the public will remember only the accusations of wiretapping. So congratulations, media. You can unfurl that banner that says: Mission Accomplished.

Based on the original perception that he was wiretapping, I can see justifying a transgression on the part of the left by claiming O'Keefe getting off lightly for having committed a "felony" back in January of 2010.

The right honestly believes that anyone who claims to be conservative should be immune to any form of prosecution for any crime. That's the reason these guys need to be prosecuted. Outrageous? Guys pretending they are phone company repair people and have a van outside with listening equipment? From guys who would love to hear and publish what their political enemy is saying in what they think are private conversations? The simplest explanation is wiretapping. The story told by O'Keefe seems far more implausible than wiretapping, and could be more easily characterized as "outrageous" than the suggestion of wiretapping.
I can't wait for the movie. If their entry in the building is anything like the Keystone Kops of the TSA it should be hilarious.

Unlike the Executive Branch the Legislative Branch does not consider their offices to be Federal. If you try to access an Executive Branch office you are not allowed to proceed unless you are: 1) a building employee with an ID card; or 2) your are escorted by someone from the office you intend to visit. If you go to the office of a Member of Congress, you merely walk through a security screening that checks for weapons, etc. By holding themselves out in this way, the Members of Congress have been able to say that their offices are the "people's offices", and, as an additional benefit, they've been able to hold themselves above laws that they have enacted, such as smoking in federal buildings.
I haven't read anywhere that O'Keefe's group bluffed their way through security, so I doubt that a Federal offense was committed. I'm sure that this will end being just another nuisance issue, as other Member of Congress offices deal with from time to time when unwanted/unwelcome visitors show up to create a disturbance.

If the media you cite were truly as left-wing as this site is right-wing, they would be accusing O'Keefe of planning to intercept phone calls from a senator's office so that they could then sell state secrets to terrorists. The truth is, we do not know what O'Keefe was up to, but what we do know is that he and his compatriots will freely lie. So while he offers an explanation now which doesn't make a whole lot of sense (what exactly were they trying to accomplish again? that the phones in the office were working a month after someone complained they couldn't get through?), such an explanation should be viewed with the same skepticism as Landrieu's office staff viewed O'Keefe and Co's claim of being telephone company repairmen, and the skepticism that ACORN staff should have viewed O'Keefe when he said he was a pimp who wanted housing advice. The man in not a purveyor of truth.

O'Keefe's statement says Landrieu stated her office phones have been "jammed for weeks." I read that to mean that a lot of people were calling so not everyone can get through, not that the phones are not working.
O'Keefe's explanation does not make a lot of sense.

The only times I have seen or heard anything about violence at a Tea Party event ,or being called for during such, was from opposition to said event. If, by chance, you are referring to people waving swastika signs and espousing violence, I would have to correct your mistaken assumtion that those were SUPPORTERS of the Tea Party movement. Having been the organizer for 3 local Tea Parties, we have been commended for leaving the facilities cleaner than we found them, for obeying all laws, permit requirements, and got back our security deposit for each. Our events have been open to the public, and attended by all types/colors of patriotic and mostly conservative people. It is simply not the truth that you state, so either you have no personal knowledge and are guided by the vile reporting of the MSM, or you intentionally discredit those of us who simply do not agree with the political philosophies and ideals of the people in our government (including former and present administrations).

Polls are normally skewed towards a particular result, so I'd be careful staking my claim on polls. The election statistics from 2008 don't support your claims. 53 percent of all voters were women. Obama won the women demographic by 56-44 percent.

ACORN has blocked the full release of the tapes with threats of lawsuits, but only a complete zealot would refuse to believe what's is recorded in full living color. In this case, O'Keefe has broken no laws. The two guys dressed as phone company workers entered under false pretense, so they'll have to sweat it out, but not a single accusation has been leveled at O'Keefe other than the original, which has now been acknowledged to be wrong.
Not a big deal, the investigator on the scene saw these four and made a snap judgment. I prefer that they be over-cautious instead of being too lax. Now that most of the story is out, only a few true believers are out here claiming O'Keefe is going to jail. It's OK, everybody's got to have a religion. BTW, ACORN was certified to give tax advice, so for them to advise people how to hide income and claim illegal activities as tax deductions is technically a crime. However, O'Keefe's crew is facing prosecution for violating the obscure "false pretenses" clause while ACORN openly bragged about entering government facilities under false pretenses (and have done so on a number of occasions), yet no one is looking to prosecute them. It's not going to be in the papers (heck, Charlie Gibson was unaware the story even existed until after Congress cut off their funding), nor will you see anyone in the government racing out to prosecute them for these minor violations. There are always groups that will be able to flaunt the law, while others get prosecuted over minor infractions. Sometimes money is the key contributor, other times it's about who you know. In this case, it's about having a protected class of professional victims that no one is looking to pick a fight with unless they have to.
I too want an effective federal government – stay within the confines of what the Constitution states is the federal government's limited job. Our government size (local, state and federal) has increased way out of proportion with the increase in our legal population. I too believe that it is the federal government's job to protect us – that's clearly the most important duty. But the social engineering that's gone on over the past decades is not the federal government's job at all.

According to the FBI affidavit, Flanagan and Basel entered the federal building at 500 Poydras Street on Monday about 11 a.m., dressed as telephone company employees, wearing jeans, fluorescent GREEN VESTS, TOOL BELTS and HARD HATS. When they arrived at Landrieu's 10th-floor office, O'Keefe was already in the office and had told a staffer he was waiting for someone to arrive. When Flanagan and Basel entered the office, they told the staffer they were there to fix phone problems. At that time, the staffer, referred to only as Witness 1 in the affidavit, observed O'Keefe positioning his cell phone in his hand to VIDEOTAPE the operation. O'Keefe later admitted to agents that he recorded the event.
After being asked, the staffer gave Basel ACCESS TO MAIN PHONE at the RECEPTION DESK. The staffer told investigators that Basel manipulated the handset. He also tried to call the MAIN OFFICE PHONE using his cell phone, and said the main line wasn't working. Flanagan did the same. They then told the staffer they NEEDED TO PERFORM ON THE MAIN PHONE SYSTEM and asked where the TELEPHONE CLOSET was located. The staffer showed the men to the main General Services Administration office on the 10th floor, and Flanagan and Basel went in. There, a GSA employee asked for the men's credentials. They said they left them in their vehicle. The U.S. Marshal's Service apprehended all four men shortly thereafter.

O’Keefe and Landrieu/Watergate 2?
Contrary to what the lame stream media (LSM) portrayed the James O’Keefe/Senator Landrieu story to be, it turns out to be much to do about nothing. Although ill-advised what they were trying to accomplish was to show that Senator Mary Landrieu was not responding to her constituents so they were checking to see if the phones were working. Everyone should know by now that the Democrat/Statists were not responding or listening to their constituents. They could see it from the town halls. Therefore, it was a non-story.
However, it’s ironic the LSM did not really question or investigate the Senator about the 300 million dollar bribe she received for her vote on the healthcare bill or why her constituents were unable to get in contact with her. They also ignored and downplayed the ACORN story. Instead, they thought they had Watergate two and wiretapping. They were dreaming and hoping to take down some big time conservatives with this story and had to retract some of their over zealous reporting…
…Biased Ed Schultz even made the comment to Bertha Lewis of ACORN that the arrest of O’Keefe vindicated ACORN. Nothing could be further from the TRUTH. ACORN is a corrupt organization and is being investigated in numerous states for voter registration fraud, not to mention the videos made by O’Keefe of ACORN exposing more corruption regarding underage slave prostitution. Then again what did you expect coming from this BLOWHARD, after all Schultz said he would CHEAT TO WIN and vote 10, no 20 times if he lived in Massachusetts. By the way ED that is a crime.
The LSM likes to be the FIRST to report a story even if they do not have all of the FACTS. I would prefer to have the facts right and not be so concerned with being the FIRST. When the story first broke these questions came to mind, which for the most point have been answered….

Who was with you? Why were they with you? Were you taping and if so why? Did you seek permission to tape the interview? What were you trying to accomplish?

As stated James O’Keefe was trying to show Senator Landrieu was not responding to phone calls from her constituents. The means he went about it was ill-advised, because O’Keefe has a target on him. Therefore, when he tries to expose corruption and misdeeds his methods must be done way above board.
Sleazy MSNBC is at it again this morning, saying James was intent on committing a felony. Just how low can they go?
He'll get his day in court later this month. I'm just going on what he has confessed publicly… and that is a crime. Whether he is held accountable or not is still to be determined. But in the court of public opinion he is already guilty of being a knucklehead.
