Pelosi Health Care Bill Blows a Kiss to Trial Lawyers
by Capitol ConfidentialThe health care bill recently unveiled by Speaker Nancy Pelosi is over 1,900 pages for a reason. It is much easier to dispense goodies to favored interest groups if they are surrounded by a lot of legislative legalese. For example, check out this juicy morsel to the trial lawyers (page 1431-1433 of the bill):
Section 2531, entitled “Medical Liability Alternatives,” establishes an incentive program for states to adopt and implement alternatives to medical liability litigation. [But]…… a state is not eligible for the incentive payments if that state puts a law on the books that limits attorneys’ fees or imposes caps on damages.
So, you can’t try to seek alternatives to lawsuits if you’ve actually done something to implement alternatives to lawsuits. Brilliant! The trial lawyers must be very happy today!
While there is debate over the details, it is clear that medical malpractive lawsuits have some impact on driving health care costs higher. There are likely a number of procedures that are done simply as a defense against future possible litigation. Recall this from the Washington Post:
“Lawmakers could save as much as $54 billion over the next decade by imposing an array of new limits on medical malpractice lawsuits, congressional budget analysts said today — a substantial sum that could help cover the cost of President Obama’s overhaul of the nation’s health system. New research shows that legal reforms would not only lower malpractice insurance premiums for medical providers, but would also spur providers to save money by ordering fewer tests and procedures aimed primarily at defending their decisions in court, Douglas Elmendorf, director of the nonpartisan Congressional Budget Office, wrote in a letter to Sen. Orrin Hatch (R-Utah).”
Stay tuned. There are certainly many more terrible, horrible, no-good, very bad provisions in this massive bill.

This entire Health Care issue is making me sick.
I am appalled at the hubris and contempt that this CON-gress has shown to America. Quite frankly, it is time for a purge.
Wow, that's a nice catch. I'm hoping that is in the talking points of every single Republican making a public statement for the next week or so (along with Howard Dean's quote about the Dems not wanting to upset the trial lawyers who give them so much money). At some point the Republicans need to get a more coherent message to make the most of their limited coverage in the MSM. People will start paying attention if the message makes sense to them.

The evidence that says that malpractice suits drive costs up is tricky.
Doctors practicing "defensive medicine" by doing unnecessary things (which drives up costs) won't actually have any impact on their liability for malpractice. They do it anyway because they think it will. Medmal suit-related costs could be pretty easily offset by simply educating doctors about the legal meaning of malpractice, and what will and will not lead to liability.
Besides, those damages caps don't really put a dent in costs. Texas implemented caps in (I think) 2003, and malpractice insurance premiums went up double digits the next year. The insurers came back to the legislature with their tails between their legs and had to admit that medmal caps only saved about 1% of their costs. Oops.

In a country of so many nationalities and ethnic groups, each unwilling to bow to a common Western originated national culture and ethos, the lawyers are the lubricating system that causes each group to assail the other. Many Doctors are paid by the number of procedures they perform. Is it possible that some of them recommend tests so that can charge more and not because of malpractice…it is just a thought.

If they come back with a "pre-existing condition" they are considered "service-connected" and covered FOR LIFE by the VA health care system. I think it has worked that way since Lincoln was President – keep reading and eventually you'll catch up.

A lib. i know was complaining about how the disabilities act makes it hard on small businesses, and the frivolous lawsuits and what not, so i told him the trial lawyers were the biggest contributors to his democratic heros, didnt seem to bother him. Wrong on both counts
1) Can't speak for Texas but since Mississippi around 2006 put in caps our premiums have dropped 10 – 15% each year (and will again for 2010). The rush to file suits the day before the new law took effect was comical. Once there was a cap there was suddenly no malpractice, at least as far as the plaintiffs' attorneys were concerned. No 33% of a fortune for them, no need to file all those papers. Therefore our malpractice carrier (a mutual organization that the insured parties actually own) doesn't have to pay too many lawyers to defend against suits, cutting costs substantially.
2) I learned as an intern that if someone wrote a recommendation in a chart you were bound to follow it, no matter how idiotic and unnecessary it seemed. If a CT scan seemed normal someone would recommend an MRI scan. When I asked "what do you expect to see on an MRI that wouldn't have been seen on the CT scan?" I never got an answer. However, I was told that IF (a big "IF") there was something there that could be seen on an MRI but not a CT, and IF (a second big "IF") this was later discovered, then I could get sued for not diagnosing it earlier. "How would you like to explain to a jury that an "expert" had recommended this 2 years ago and you ignored them then?" So all these unnecessary tests get done so my kids' college fund stays secure from hypothetical and highly improbable scenarios. That's the reality.

As a practicing physician I am not the least bit surprised by this. I have said all along that this is nothing but a government takeover. There will be a response by physicians to the bill if passed as it is clear they think we don't care if we are government puppets who will work for free and will bend over and enjoy it. Doctors everywhere except in academia will have a response.

You must be a lawyer. I am a doctor and can tell you that defensive medicine is real and has a big effect on health care cost, and also does protect doctors from liability in many instances. Untold dollars are wasted each year in our ER's from the ordering of tests for protective measures.
For example, a 20 year old female comes in with pelvic pain, just started this morning. The vast majority of these patients have a ruptured ovarian cyst or other benign process. Unless they have indications of infection, to treat them symptomatically and instruct them to return if pain persists or worsens is the most efficient and cost effective. What do we do to protect ourselves from the tiny chance of something more sinister going on? We order a CT or ultrasound, thousands of dollars wasted.
Also, I have personally experienced a lowering of malpractice premiums when caps are instituted.

Trial lawyers in medical malpractice lawsuits require they get paid from 35 percent to 50 percent of what they win for a client. PLUS all expenses, of course. The Democrats protect the lawyers in this corrupt racket, and in turn the lawyers give the Democrats a slice of the winnings. It's not just doctors that need relief from lawsuits, but medical equipment makers have huge liability insurance costs because if something goes wrong, the lawyers go after not just the doctors but the equipment manufacturers, and the companies that make parts that are used in the equipment and anyone else remotely connected.
These costs are all past on to the consumer.
We also have to force hospitals and clinics to make available the doctors records to potential patients so that bad doctors are driven out of business.

While there is no one that denies there is a need for reform, why the extreme government takeover? There are many problems with this bill as written. If you step back though and simply look at the numbers – we are going to spend by the best estimates $800 billion to cover an additional 5-6% of the population. By the CBO's estimates there will still be uninsured. One question – why? There are many good alternatives which would cost the government very little. One would be to take away the insurance monopoly exemptions and allow national coverage. This would increase the liability pool and in theory decrease rates. The other scenerio would be to have the government subsidize a catastrophic injury pool. This would allow insurance companies to divulge themselves of the most costly cases and allow people who have catastrophic illness to actually get coverage.

In the final analysis, the bill does nothing to decrease health care costs (and in fact arguable increases costs with excess taxes and fees on medical device and pharmaceutical provdiers which get passed on to the consumer), does nothing to take care of the expenses of people who must file bankruptcy for medical conditions not because of medical bills but because they can't work and therefore can't pay their other bills, and does nothing to improve the lives of the primary care physician (recent AMA study shows 60% of primary care physicians are looking for another job and 50% do not take Medicare – a government program). Let's look at ways that would work, not just have the government take over health care which doesn't.

Listen, I'm a doctor at a major metro hospital. Actually even Chief of Medicine. I'd say we fully order about 1/3 of all tests, etc. to avoid potential lawsuits. Want to cut the healthcare bill buy 33% and still have 95% of the benefit? Give us some meaningful tort reform and watch what happens. Anybody telling you anything else is full of it. Unfortunately the lawyers are loosing site of true malpractice reform. Most tort reform caps NON-ECONOMIC damages. This means the amount given for pain and suffering. If you have suffered true medical malpractice, you can still get what you lost because of the malpractice, you just can't get rich off of it anymore. Most states don't go far enough though. Many cases of questionable malpractice get settled for $100,000 to $300,000 because it can easily cost $100,000 – $250,000 just to defend a suit that goes to court and results in a verdict for the doctor. True reform would put an end to these nuisance suits as well.

First: The bill is designed to destroy private sector health insurance and health management. One way among the many is apparently to have the lawyer damage fees sky-rocket and bankrupt the insurance companies. In Texas, these measures include caps on non-economic damages like pain and suffering, etc. Not surprisingly, Texas has enjoyed an increasing number of top-notch health-care practitioners. So while the trial lawyers have definitely taken a hit, Texans in general have got access to some really great health care. Shouldn't the rest of the country follow Texas's lead? Instead, we get this apparent turd of a bill.

many, many, many lawsuits are settled out of court to avoid the cost of litigating, even when they have no merit. this is more the enemy than penalizing a flagrantly irresponsible physician when someone suffers dearly for it, which in fact is actually palatable. the lawyer shouldn't get 35% though. the job isn't worth that and it is a squeeze game.
if that is fair, the next emergency that i see will have me collect on someone's life savings, instead of according to a government "suggested" fee schedule

The answer to medical malpractice is to do away with TRIALS. Why is a doctor hauled in front of a jury as if he/she committed a crime? A mistake was made. Medical mistakes/ malpractice should NOT be adjudicated rather it should be decided on by a panel of health providers/experts ( docs, RN's etc). You could have a judgement in a month. The typical malpractice case takes FIVE years. It should be about finding out the truth and justice not about the billable hours and lawyers. Plus civilian juries don't even know what they are hearing…why?? CAUSE THEY AREN'T DOCTORS!! Consequently awards are based on emotion or if the doctor was " a meanie" or what the tie the lawyer was wearing. Lawyers are ruining the country…

Sadly, amnesty exists, its just not going to be law. Amnesty will continue with cities offering sanctuary shelter for illegals. Also, what we have here is a major push to regulate health care because it has allegedly become too expensive for some. If you accept the premise, there's nothing illogical or inconsistent about wanting to keep the "reform" simple and attack a large root cause. Runaway litigation costs are a large root cause that would be very easy to eliminate through tort reform. Perhaps it's not optimal — but it's a hell of a lot more optimal than what this Congress is proposing.

Unfortunately, our soldiers cannot get coverage in the free market system for their pre-existing conditions. This is true. They are, however covered by the VA for all conditions that are a result of their service to our great nation. This doesn't say much. The VA is wrought with fraud and incompetency. But Nancy's bill (and all of the other health care bills) do nothing to address the VA health insurance issues. At the very most, Nancy's bill transfers the responsibility of caring for our veterans from the public sector to the private sector. Since when is the private sector responsible for what the government does?
Don't get me wrong. I would gladly pay more in taxes if I knew, without a doubt, that my increased tax dollars were going toward the medical care of my heroes. But, sadly, that is not what Nancy Pelosi's bill is all about.

Those that believe that health care can be had for free, or even less expensively if provided by our inefficient government deserve the healthcare they ultimately get. If only we could preserve the good while providing the utopian nightmare to the socialists.
Capping the amount that can be sued for, or imposing limits on lawyers, is not the answer. It's the fair thing to do, sure, and would reduce costs slightly – but the real issue with American liability is people being allowed to sue fraudulently and at no risk to themselves. What we need is a system where people are required to be relatively responsible (suing because you used a product in an obviously wrong manner should get thrown out of court) and honest (suing over something that didn't actually happen should force you to pay all court costs for the defendant). Fix those two issues and you'll see a significant reduction in liability insurance costs, and by extension medical equipment and doctor costs. Drugs will probably remain expensive, but this could be fixed as well by pushing more use of generics and by making it easier to start a drug company (lack of competition and massive government buying has made for a huge amount of bloat).

A government run system that will fail the same way the current system is failing our troops. I can say this as an active duty military member. I do not know where you get the “preexisitng condition” aspect of your argument because every military member is entitled to military care and is not denied based on some pre-existing condition. The reason the care is questionable is exactly the reason why government should not be in the health care business. The porgram is run based on a spread sheet and the bottom line not based on quality of care. The system current military system cannot support the influx of care being needed because of GWOT (OEF and OIF). Can you imagine what will happen when the government starts to get into the business of taking care of people that are not already pre-screened. i.e. military personnel are pre-screened and have to meet pysical criteria to be let in and continue to meet minimum levels of fitness and health to remain in the military and receive medical care. I can only imagine what will happen when the government starts to deal with the rest of society and the system has to address individuals that have serious long term medical conditions from the get go. The only thing I agree with is to thank the troops.

I would imagine you also accept that a physician's job takes a lot of work, and that there is no downtime from the stress. have you any idea what medicare reimburses complex medical care? medicare plus 5? The Med/Malpractice reform was passed in Texas because the Media hyped how it would severly reduce medical insurance for the general public due to lawsuit abuse. Now I'm not a Doctor so If some on here claiming ther med/malpractice insurance has gone down then great for them. Us patients on the other end have seen our insurance premiums increase every year REGARDLESS! My wife is in Education and we get our healthcare through the state(district) – our premiums have increased – coverage decreased and copays have increased more since this law was passed than ever before. The real thing to look at here is that over 220,000 people die in this country every year from admitted medical mistakes NON FRIVALOUS. What most don't take into account is the fact that frivalous lawsuits are almost always thrown out of court or given little awards by smart juries. Sans the old lady with the hot McDonalds coffee accident – most of these types of cases arn't awarded anything.
California has a cap on punitive damages. It has been an essential part in keeping health insurance affordable in that state. I ought to know. I live there. You, Zach, are all wet.

On the other hand, my wife has a serious disease, when I changed jobs, we had a form letter from the insurance company saying we were covered all that time so coverage of financial lose was extended without question. Most larger companies have open enrollment anyway where preexisting doesn't matter, it doesn't matter because it does not cost the insurance company anything, only the pool of people in the group.

Would I study for 14 years, work 100+ hours a week, weekends, holidays and carry a pager 24/7 only to have goverment support a lawyer watching my every move… and to have my salary CUT every year……I promise, the smart ones will quit…the lines will get longer and you will be a number. Do we need health care reform? Absolutely! But we need physicians, nurses, social workers, and patients to reform our health care. Not a bunch of political gurus and lawyers who know nothing about health care, nothing about medicine, and who care only about the next election and the amount of money coming in to support their campaign.

I think the writer has misinterpreted this provision, it's even worse. The federal government plans to give money to states if they find other ways to resolve medical cases, I’m guessing using things such as Arbitration, Mediation and the like as opposed to going to trial in a courtroom. Going to trial costs the state money. They are saying the only thing the states can’t do if they want this money is to limit the fees for the personal injury attorneys, or the amount of the damages they can get.
First of all, the Arbitration/Mediation thing is a whole cottage industry in itself for lawyers and ex-judges. If I remember correctly they used to charge around $300-$500 to hear a case. A case generally lasted about 2-3 hours. If they heard 2 cases a day we’re talking about $1000 a day. How would you like to pull in $5000 a week with little overhead? Each party usually paid ½ for the fee to file arbitration. That fee comes out of the pocket of the insurance company and the client, never from the personal injury attorney – it’s taken from the award after the attorney takes his 1/3 cut if he wins. Most insurance companies don't like to go to Arb or mediation because the Arbitrator will generally "split the baby" and award 50% of what the trial attorney was looking for because they don't want to ruin the chance at future filing fees from either the trial attorney or insurance company.
This is a win/win situation for the trial attorneys and does nothing to address the issue of tort reform.
This is a great plan and will do wonders, as did the clunker program costing $24,000 for each clunker! Government has no success in running large scale programs, e.g. postal service. Disrupting existing plans that insure 85% of America to extend converage to the other 15% for a cost of $1 trillion somehow just doesn't compute, especially when predicated on the notion that it will be funded in great part by reducing fraud by $500 billion in existing programs the government is currently running . Social Security and Medicare are going broke and this will only hasten the process. Stupid is as stupid does. Obamacare miserably fails the smell test.

Most of the country has SOME Conservative principles, but only 40% self-identifies as Conservatives (and many of those are the "RINOs" you spit on). Facts are the most important thing, and unfortunately many Conservatives choose to ignore them. McCain received very little support from Conservatives (some even claiming the stayed home or voted for Obama out of spite), yet he still received the second most votes ever for a Republican in a down cycle (outperforming local Conservative candidates in almost every district in the country). You can choose to pretend that someone running on an "I'm a Conservative and the rest of you can go to Hell" platform would dominate, but you'd be wrong. Reagan is worshiped by Conservatives, but he was a huge believer in speaking the the Center (and even the Left) and working with them as much as possible without compromising core values.

I went to see a doctor a few years ago with a minor infection which required a $4 prescription to treat. I had no insurance, and I told him so. He ordered $700 in tests! Nearly all of them had nothing to do with my infection, but I didn’t know it at the time! He wanted to prevent a lawsuit — just in case!
This is the real reason why health insurance costs so much. Nothing will be fixed, and it will only get worse.

One more thing. Republicans didn't run on a Fiscally Conservative platform in 2000 and 2004. They ran on Gay Marriage, anti-abortion and immigration reform. They never passed anything that affected any of these corp demos because that's how they were winning elections. While there may be a few who ran on the smaller government platform, most had nothing to say about removing legislation to allow domestic drilling, nuclear plants, building the border fence (or some other comprehensive policy), health care reform, or spending cuts. They got elected by appealing to the Socially Conservative wing, then governed like it. Now that everything is train wrecked (mostly while they were in the driver's seat), people are living a revisionist history about who they voted for and how they were "tricked."

I am an anesthesiologist, and starting in 2010, I will be taking a 40% pay cut in my salary. When I read components of this health care bill and all the breaks that insurers, medical device makers, trial lawyers, and pharmaceutical companies, it gives me a sickening feeling…because eventually it will be the health care provider (me) that will bear the brunt of these costs. This is on top of all the across the board Medicare cuts coming in 2010 as well.
America, you know what the next crisis is? Healthcare provider shortage. It has already started, and it will be getting a lot worse. Physicians are people too, and we are reaching the breaking point with the increasing red tape, increasing costs, and poor reimbursements. If I am to be expected to take another 40-50% pay cut on top of what I already have agreed to in 2010 just so that trial lawyers, pharmacaeutical companies, and insurers can continue business as usual, you can forget it. I will leave this profession entirely, and expect a lot of my collegues to leave, too.

I would like to see all legislation shut down, until all the ethical issues are resolved. It is wrong to have so many people under ethical clouds doing business as usual, where we the American people that they are to serve, are seving a different master.
Personally I would like to see all members of congress with ethical problems put in the stocks, and let people warlk by them and heap the scorn and abuse on them that they deserve, rather then letting them go into plush offices and hide from those that they serve.

The real crisis in our healthcare system is that 50% of physicians have stated that they will retire or greatly reduce their patient load if this so called "health care reform" aka Socailzed Medicine takes place. Physicians don't want government dictating how they will treat their patients. My husband is tops in his field and his patients depend on him. He cares deeply for his patients, but he's ready to retire if this insanity passes. I can assure you that he is not alone. Ask your physician what this will really do to your healthcare. I am a physician in Texas. 1.) My rates have gone down substantially every year. 2.) I, along with all my colleagues, practice significantly LESS defensive medicine. 3.) In response to B Bishop- you are quite disturbed if you are trying to put any monetary value on a child's life. You obviously do not have any clue as to the meaning of economic vs. non-economic award caps. The "cap" as it is referred to is on the NON-ECONOMIC "Pain & Suffering" award, i.e. the amount that a flamboyant litigator practicing his heart-tugging dog-and-pony show to a "jury of my peers" (laughable in its own right!) to hit the lawsuit lottery (minus 40+% to said lawyer). In the case of a child, various factors are taken into account to estimate the lifetime earning potential of the patient. This is the future ECONOMIC loss. If you and your wife are college educated professionals, it can be argued that your child would be the same and a lifetime earning amount, hence economic loss and award, could be in the millions. Is it a perfect or completely fair system? Of course not. But it at least tries to inject some amount of common sense sanity to the process of determining the "Value" of a true medical error. It also provides a disincentive for the proverbial "ambulance Chaser" trial lawyers to promote the concept of sue all that moves. BTW- as to a jury of my peers- If the unscrupulous trial lawyers lobby is so hell-bent and determined to abolish jury award capitation, then I should be allowed an actual "Jury of my Peers," 12 physicians- my same age and specialty who practice in a similar socioeconomic environment with a similar scope of practice. We could all sit back by a campfire with a blanketand watch as hell freezes over!

It is that FEAR of litigation and the skyrocketing malpractice insurance claims that drives specialist and GOOD physicians out of your states. They don't want to practice in that environment. And do you know what that causes?? NO SPECIALISTS!

So the day that you come to the ED…or one of your family members comes to the ED for care…..and we cannot provide what you need because we don't have the specialist is around the corner. Just ask your friends in some of the worst malpractice suit states.
Tort reform just makes sense. It allows doctors to practice better, efficient, cost-conscious, medicine. No one argues that an injured person should not receive some recourse. But that recourse should be responsible and not cause undue hardship on the medical system as a whole.
We need to insist that anyone we support will work to repeal Healthcare Reform if it does indeed pass. One thing Congress can do, if they are so inclined, is repeal things that are not working or will not work.

One major problem to this ignorant line of bull is that our veterans come home and are provided health care via the VA. I know because I am one of them. The VA treats me for anything I go into the clinic for with in 2 weeks of calling. For anything that is not a military related issue, they pass the charge to my employer provided insurance. What ever my insurance doesn't cover, I do. That is the American way. If you want health care, get a job that offers it as an incentive package.

a) We'll have a public option that will pay the same as Medicare, Lets' pretend that Medicare is not already bankrupting the system with below cost payments.
b) We'll cut Medicare reimbursements by 20% since doctors make too much. But wait, only about 25% of medical fees go to doctors, the rest pays for the overhead, the nurses, the people who make the hospital work, supplies, utilities. Thus, doctors will be left with nothing but will work harder to survive.
c) We can not put curbs on legal fees because that would not provide proper incentives to attorneys.

This health care bill is a wolf in sheep's clothing. Despite Obama and his minions’ denials and distortions, the current bill is going to fund abortions with public funding, illegal aliens will be covered, over 5 million jobs will be lost in medical and insurance sectors. There are death panels in it. There is NO tort reform in lowering medical expenses. TAXES will be raised as a result of this bill. Our national debt will be raised several trillion dollars because of government controlled health care (those accounting tricks which push a trillion dollars into state accounts are disingenuous and dishonest).
I demand that all congress members oppose this bill in its present form. Yes, we need health care reform, but we do NOT need to do much more harm in its reformation. Lets focus on the basic improvements first, such as allowing insurance companies to compete across state lines, and in reducing malpractice pay-outs to reasonable levels. Lets consolidate, re-organize health care systems so that duplication of tests and information are eliminated.

In every civilized country the loser in court must automatically pay all the costs of the court and the defendantm both direct and indirect – that's why. Here you can sue and if you lose you just walk away. Trial lawyers like it that way, and also our eco-nazis who have put a number of industries out of business together with many millions of jobs. That and the strong unions forces our industries to outsource. My estimate of a true tort reform would cut the $3 trillion/year cost of our health care by about a third, or one trillion/year; no more frivolous law suits, no more useless defensive medicine tests. Charles, you have adequately displayed your ignorance. If a plaintiff's attorney brings a suit and loses, he gets no money at all, period. Expenses for experts and trial prep are a loss. All of the time it takes to prep for trial, which is significant, was a waste. You assume that plaintiff's attorneys just file claims all willy-nilly without risk. They will not bring a lawsuit unless there is a significant possibility of winning due to the significant risk of losing a lot of time and money. The instances of frivolous claims are grossly overestimated by the ill-informed, such as yourself. Further, there are fees at all levels of litigation to offset some of the cost of litigating a claim.
Proceeding with further penalties, as you suggest, would act as a bar to legitimate lawsuits from those that cannot afford to front the costs of litigation out-of-pocket.

….Our government is grossly deceiving the public on the true costs of any of its current health care plans. How could they possibly cover all the “needy & illegals” plus cover pre-existing and current existing serious illnesses without any increase in premiums. The four ways it will be paid for is by (1) direct taxes, (2) indirect taxes and fees on medical equipment, services and increased insurance rates, (3) tax credits and/or subsidies and (4) borrowing the money. Where do you think the tax credits or subsidies will come from? The government has no money, so the money, in addition to all of the taxes, has to come from deficit financing, which will be paid by your children and grandchildren.

I know the Obama Administration wants our returning American wounded/disabled to get their own Health Care. However, health care for our returning Vets is supposed to be provided by the VA, first year for everyone and forever for service connected disabilities.. What does the IRS have to do with Universal Health Care ?? So even though it only HELP 5-6% of Americans (per their own documentation) and this is going to be the POOREST part of society which is guaranteed voting base for Dems… it now MANDATES FOR 100% OF US CITIZENS THAT YOU HAVE TO BUY HEALTH INSURANCE. And such tax could easily be raised in the future as all taxes can !!! Forget tort reform right now, this is the core socialization move of the WHOLE BILL. This is not universal free health care this is MANDATORY health care or else for everyone !!!!

I have tried faxing, calling and writing. The Politicians have canned responses and no matter what you say they respond with the same canned response. If you mention Health Care Bill they sendyou the same anwer to everyone. I am so frustrated with trying to get my opinion to the politicians. They don't care and are going to do what they want no matter how we feel ! ! !
I will never vote for an incumbent again. They are all crooks. They are now trying to play God to us by rationing our medical care especially if we have been able to retire and get medicare. They are increasing aid in the Medicaid sector (to illegals and all their relatives) and taking ours away even though we have paid for it all our lives. I don't thnk we have a chance since it will be completed before the next election ! ! !

My own personal experience is that big business, big insurers are bad and definately evil (because the dollar is more important than life itself). Government and trial lawyers have come through for me and my wifes, several times now. They rescued us everytime: Give me government ran health care over what we have now everytime.
Typical misleading statement here. Texas malpractice premiums dropped b/c of the tort reform. They may have gone up a year after because of the increase in lawsuits that were pushed through trying to "beat the clock" on the tort reform. I was leaving Texas the year it passed (finished by fellowship there) so I had heard about that effect. Look up the data 3 years after the bill went into effect and you'll see it dropped malpractice premiums.
Whether or not it drops "defensive medicine" costs I'm not sure. I can tell you I order lots of tests I'm 99% sure will be normal to avoid having to answer the question "why didn't you think of that" in a future theoretical lawsuit. Not only do we need to control the huge waste of money our current legal system puts on the practice of medicine but we also need to change the culture for both doctors and patients….let doctors use their training and experience to make the calls.

Peolosi is an arrogant, botoxed hag who flat-out refuses to hear our voices, Reid just refuses to do anything but ram this junk forward. Frank is just another over-fed and out of touch idiot. Obama has his own agenda and has special interest obligations to the SEIU. He loses health care reform and he loses their support. (boo-hoo!)
Is it any wonder this disaster they call health care reform is working it's way forward? They're NOT working for the citizens who pay their salary, or for the constitution they swore to uphold and defend. When questioned, they don't even know what's even in the Constitutiont!!!
Clearly, they are too arrogant to recognize the correlation between constituent approval ratings and re-election trends, or have no desire to be re-elected. Once their terms are blessedly over, they'll be packing it up and skedaddling it back to their home states with their tails between their legs. But let's make sure this monstrosity is defeated so the new generaltion of legislators won't have to waste time and money cleaning up even bigger messes made by this sad joke of a senate.
The easy solution to this problem of alternatives to tort lawyers and malpractice suits is criminal enforcement.
Playing games with people's lives are not within the scope of government powers, or those of lawyers.
When those alternatives are absolutely guaranteed to work, health care reform is not so big a deal.
Legal and Medical hit and runs are easily solved by criminal enforcement as an absolute for malpractice and negligence. In that light, medical reform may be welcome.
It is about time that change sweeps this nation's health care. It has turned into a big business which has completely lost sight of its primary focus, care. There is so much policy and bureaucracy that there is little in the way of actual care. We need a change and the one we are hopefully soon to get is already bringing about positive outcomes. There is a push to bring preventative care to our system. Groups like the American Cancer Society are pushing to bring smoking cessation treatment mandates to insurance. This is small step, but could have a loud impact.
Cutting costs within the entire medical industry, from law, to medicating is bad for some people, but good for the industry overall and for the future of health care.

If the damages of a medical mishap equals the worth of the lost function and/or increased pain and suffering, then the worth of the successful medical treatment ought to be the same. If, for instance, medical malpractice results in the loss of a finger, and the award is X dollars, the procedure to repair or save a finger should be equal!
If the Ob-Gyn is sued for 1 million dollars because "malpractice" caused cerebral palsy, the successful delivery of a healthy future lawyer should also be worth 1 million dollars.
