Congressman Phil Hare Fails With Vets and Threats
by Bob McCartyEarlier this week, I reported here and here about an incident that took place between Ken Moffett and U.S. Rep. Phil Hare, a two-term Democrat from Rock Island, Ill., who is running for re-election in Illinois’ 17th Congressional District.
It seems Congressman Hare has been selling himself on the campaign trail as a tried-and-true military veteran when, in fact, he does not meet the qualifications for “veteran status” (i.e., he is not a person who served in the active military, naval, or air service who was discharged or released therefrom under conditions other than dishonorable).
When Moffett, a veteran from Moline, Ill., asked Hare if he was going to stop telling people that he was a veteran, a heated discussion ensued. It was toward the end of that discussion, Moffett contends, that he heard Hare instruct one of his aides to follow Moffett to his car and get his license plate number so he could find out who he was.
While complete details of the exchange are outlined in a June 2 letter Moffett sent to Blake Chisam, chief counsel and staff director of the House Committee on Standards of Official Conduct, curiosity got the best of me, and I decided to launch an inquiry into what the law says about Congressman Hare’s alleged actions.
Is it legal for a high-ranking elected official like Congressman Hare to obtain personal information about a constituent by having someone within the state’s Department of Motor Vehicles “run” his license plate number through the DMV computer system?
Dave Druker, press secretary for Illinois Secretary of State Jesse White, told me by phone Friday afternoon that — hypothetically speaking, of course — it is not legal for any employee of the State of Illinois’ Department of Motor Vehicles to provide personally-identifiable information about Illinois license plate holders to elected officials, including members of Congress. In fact, he said, providing such information to a congressman — again, hypothetically speaking and not related to the allegations against Hare — constitutes a violation of the federal Driver’s Privacy Protection Act of 1994.
Druker (sounds like “Drucker”) also explained, however, that the law does makes exceptions for members of the news media when it’s determined that providing them with the information is “in the public interest”. Odd. But I digress.
When I tracked down Congressman Hare’s daughter, Amy Hare, by phone at the Illinois Secretary of State DMV facility in Silvis, Ill., I asked her if her father had recently asked her to “run” the plates of any of his constituents through the “Land of Lincoln” DMV database in order to obtain confidential personal information about them. Not surprisingly, she said he had not.
But will he? He might if he takes cues from folks who contribute to his campaign.
The action Hare is alleged to have threatened to take violates the same law that members of UNITE HERE violated, according to a U.S. Supreme Court ruling in April 2009, when they acquired the personal information of CINTAS employees through confidential motor vehicle records.
Not familiar with UNITE HERE? Here’s a primer: It’s a labor union comprised largely of the same kinds of people and espousing the same kinds of radical ideas as their brethren in the Service Employees International Union. It was formed in 2004 when UNITE (formerly the Union of Needletrades, Industrial and Textile Employees) joined forces with HERE (formerly the Hotel Employees and Restaurant Employees International Union).
According to Federal Election Commission records, the congressman has received $10,000 from that UNITE HERE so far in 2010. That’s the same amount he received from the Purple People Beaters SEIU last year.

If, and when the Republicans take back power, I hope it will become clear to all that: The left will never rest. The only thing that will save this nation is what made it great: individual liberty granted to all under the US Constitution. The Constitution was bastardized in 1913 with the 17th Amendment to the Constitution. To repeal an Amendment is a monumental task, but the 17th Amendment can be REFUTED. Anyone serious about taking back our country needs to get up to speed on the disaster that the 17th Amendment created. It essentially put States' Senators beholding to DC, rather than to the states that they were to represent. Refuting the 17th will stop the left in its tracks.

FYI and you guys may already know this but I asked my son who can find out about ANY candidate who claims military service…and how to do it.
Under the freedom of information act you write to the Dept of the Army or whatever branch they claim to have served in and REQUEST A DD 214 form for the person in question. That will tell you when they enlisted and every duty assignment or deployment they have had anywhere during their term of service.
So if you're interested in knowing for sure what someone's real service record is it's all on that DD214. You should be able to go to the branch official website and print out the request form there to get the information.

In regards to Hare's daughter, of course she'll deny looking up information for her Daddy. The DMV records whenever an employee looks up information and a FOIA request can be made to see who and when somebody looked up

Be aware, though, the politician who is the head of the DMV is a long standing Chicago Dem. It would not be a big surprise at all if they claim to have lost the information, if asked.
Also, most of the Illinois DMV employees are SEIU members.

Article I, section 4 : “The Times, Places and Manner of holding Elections for Senators and Representatives, shall be prescribed in each State by the Legislature thereof; but the Congress may at any time by Law make or alter such Regulations, except as to the PLACES of choosing Senators.”
Article 1, section 5 “… and that NO State, without its consent, shall be deprived of its equal Suffrage in the Senate.”
The choosing of Senators has been done so by the voters since 1913. On the 17th Amendment, 10 states voted NO!, UTAH NEVER VOTED. The 17th Amendment has therefore denied Utah equal suffrage in the senate since 1913. All Senators that have held office since 1913 have done so illegitimately, and so have their laws been illegitimate. How can Amending the Constitution occur when it will mean Senators will have to vote themselves illegitimate? They can't, therefore a repudiation of the Amendment is the only sure fire way – perhaps led by Utah?

Does that help? The 17th amendment dealt a severe blow to the concept of Federalism, which the founders were VERY SPECIFIC ABOUT. The 17th amendment took away the States protection from the abuses of federal power allowing the federal government to get away with legislating in areas where they had no business doing so. This was a grave error seriously upsetting the balance of power so carefully crafted into the Constitution. The concept of Federalism was all but destroyed leading to endless abuses by the federal government from which there is no escape.

Judge Andrew Napolitano mentions just this point in his book "Lies the Government has Told You". It is interesting and I believe very poorly understood. Back then the excuses were that legislatures frequently became deadlocked and did not get Senators appointed. BUT rather than simply tag on, "or in the event of deadlock, appointment by the Governor of that state", the US government WIPED out the direct involvement of the States. You see the original model included participation in legislation by the people (House of Representatives) and by the many States (the Senate). So the model was completely changed, massively increasing power for the Washington, D.C. crowd.
Also, there is no crying need for the Sixteenth amendment and a tax on income. We were not primitives living in caves back in 1912. We had the largest fleet in the world, and were a superpower then. The only reason the government needed so much money was in order to create a vast bureaucracy, which they have done quite well.
Find out who Blumenthal is running against and send that guy 25 bucks. You know, if enough people did that, it could make a difference. Odd, that now local races, and state races are attracting National attention. 1913 was an ominous year, indeed. For both of those Amendments came about in 1913. However, they could not be getting away with the abuses of the 16th, without the 17.
The 16th would take an amendment, or ratification to correct, under the Constitution. Again, a monumental task. It has only been done once with the 18th being repealed by the 21st, ending prohibition. However, the 17th may be repudiated due to Utah being denied equal suffrage in the senate, as they did not vote to adapt the 17th…

nd, I'm curious how this would help. I would love to hear your reasons. I actually haven't consider this amendment before. To me, at first glance, it seems that it's a double edged sword. Without the 17th amendment we would not have gotten a Scott Brown elected or have any chance what so ever in California against Miss "please call me Senator" Barb Boxer. But on the other side of the ledger perhaps in a conservative state you wouldn't get the occasional lib elected ether. It also seems that in lieu of term limits this gives the people a chance to correct some bad mistakes. Again I haven't thought this through enough to even have an opinion but my gut tells me it may have been a tool for the progressives at turn of the century but can be a tool for the conservatives today.

The Seventeenth Amendment restates the first paragraph of Article I, § 3 of the Constitution, but replaces the phrase "chosen by the Legislature thereof" with "elected by the people thereof".

And that: "Those places were to be in the State Legislatures. "
The concept of federalism strictly limited the federal governments powers to those specifically enumerated in Article 1, Section 8 of the U.S. Constitution. The People, through the Constitution, permitted the national government to exercise certain enumerated powers. By limiting the federal government’s power and granting the States nearly unlimited power, the federal government would merely be protecting the States collectively and allowing the States to handle their own affairs. HENCE, A REPUBLIC.
The States now have no representation. This has lead us to the path of a "pure" democracy. We were founded as a Republic , NOT A DEMOCRACY. Prior to the 17th Amendment, States needed only to recall or direct their Senators before a bad law made it to the floor of the Senate. The damage could be stopped in its tracks. Hamilton, in Federalist essay 59 addresses this issue directly.
This power has been unconstitutionally snatched from the States by the INVALID 17th amendment. The Founders were adamant in their belief that federalism is the only deterrent to tyranny from an overreaching Federal government. All senators and their laws, are illegitimate since 1913.
An amendment is not required as Utah did not vote. They have been denied equal suffrage in the senate since 1913.
And then there is John Kerry.
More importantly it will state the disposition of dischage, ie Honorable, General, Under Honorable Conditions, Under Other Than Honorable Conditions, etc.

Several state legislatures have expressed interest in convening a Constitutional Convention. If conservatives can maintain the focus and intensity we are seeing building it can be done. No, it will not be easy. But, the progressives have been slowly and steadily increasing their grip on our country and we need the fortitude to stick to the task and get it done or we will continue to suffer the erosion of our rights and the transformation of our country into something we ca not abide. The Founders did not see an easy road ahead of them, but it did not stop them.

On their DD 214 it will say DEPOLYED TO Viet Nam, or Kuwait, or Iraq, or Afghanistan, and the dates, length of tours, and unit they were assigned to in country.

My DD Form 214 states clearly that my discharge was honorable and that I served in Iraq & Afghanistan. It also says I didn't get a dental exam prior to seperation. All sorts of useful info on there

Wanna be soldiers. Where the hell were they when they had the opportunity? Those of us who served in the Armed forces during the VietNam era know exactly what The VietNam era vs VietNam. Those who served "INcountry" actually went there, those who served during the ERA served either Stateside or someother theater. Many soldiers served with honor state-side, for whatever reason their MOS(military occupational skill) wasn't needed "INcountry", you will very rarely see those claim to have been Incountry, they know the sacrifice those who did made and how lucky they were to have not been there. Anyone of any politcal party who claims military service and embelishes what that service was is a discredit to the service. They should, out of shame, resign.

Those reservists who have serve 181 days of active duty, not including active duty for training or weekend drills, and are honorably discharged are considered veterans. Rep Hare would have a DD 214 which would clearly show the amount of active duty he served and his discharge information.
It never ceases to amaze me, how the libs, being the ones protesting the Vietnam war, spitting on the returning solders and throwing their medals (not the real ones) over fences, are so quick to claim being a veteran.

That would make him ineligible to be President, and, maybe, a member of Congress. Voters do not have standing to sue for the release of such information, though.)

It appears he was a reservist with no real service time(180 days). If this be true he is not considered a veteran by regulations. However, the main point is this bag of pork does not believe in the Constitution. Like other socialists, he must be voted out. Surprisingly, the local American Legion supports the bum.
