Six Important Facts About the Assault Charges Three Navy SEALs Face for Doing Their Jobs

In recent years, I’ve published too many posts about members of the Armed Forces facing undeserved charges:
- First, it was the so-called “Haditha Marines” who faced trumped-up charges, thanks largely to idiots like Rep. John Murtha (D-Pa.) declaring them guilty before a mainstream media eager to paint them in a bad light.
- Next, it was Army Ranger 1st Lt. Michael Behenna who was wrongly convicted of executing an Iraqi detainee, Ali Mansur, on May 16, 2008, and is now serving a 25-year sentence at Fort Leavenworth, Kan.
- Now, I’m following the case of three Navy SEALs facing assault charges related to their capture of Ahmed Hashim Abed. Who is Abed? He’s the alleged planner of the March 2004 ambush, killing and mutilation of four Blackwater contractors in Fallujah, Iraq. The SEALS gave this enemy combatant piece of dirt a fat lip while apprehending him.
As my first investigative reporting effort related to the SEALs’ case, I offer six important facts about the case you’re likely not to read about in the mainstream media supplied to me by a source whom I cannot name inside the Pentagon:
1) The charges or accusations against the three Navy SEALs were not made from within the SEAL community. Sources tell me they came from someone within the Navy’s Master-at-Arm community.
2) The SEALs were presented with the option of going to Captain’s Mast for these charges but declined this form of non-judicial punishment and opted for court-martial instead. Why? Because they did not want to be judged by those outside of the SEAL community and believed the court-martial route would assure them the representation necessary to prove their innocence.
3) At no time did anyone within the Naval Special Warfare community have any control over these accusations or events other than providing advice or guidance to the accused SEALs.
4) The integrity of the chain of custody of the prisoner is at question.
5) There are extenuating circumstances that indicate there is questionable evidence in some of the accusations made.
6) Evidence will come out in a court-martial that might not have come out in a Captain’s Mast in favor of the accused SEALs.

Bob, you sound just like investigative reporters as Bob Woodward used to. Instead, we have Jayson Blair teaching seminars on ethics. How far the mighty have fallen. Pulitzers are worth about as much as Nobels these days. In short, they make good door stops, and that's about it, though the winners could use them as suppositories as well. That would be far more reflective of their intrinsic value nowadays.

Where are the GOP Conservatives at on this? This is making sick to my stomach.
First let me say this, "I salute you boys". secondly, since when do we send the best of the best out to do a job with one arm tied behind their backs? Whoever the slug is that brought up these specious charges, should be assigned to the SEALS for a short tour, a very short tour. It almost makes me ashamed to have been in the Navy. Don't worry men, we the people have your backs, and if there's anything we can do, just ask. Like shoot out e-mails, or letters, or even phone calls. Please provide the info so we can show our support.

This is disgraceful to even go through this with our nations best fighters. So what if they did punch the guy, its called war ppl get hurt even killed including those taken prisoner. Also who is to say this guy didnt injure himself and say they did it? That is more than likely why they are pulling "Lt. Richard Winters" (in Band of Brothers Winters at the time chose court martial vs disciplinary action to expose his commanding officers abusiveness toward the men of the Easy Company 509th) and requesting a court martial.
Sad times we are in when terrorists are being taken for their word, a word not mentioned until after the guy was being transported for the second time… why did h wait so long to say something. I think these SEALs are real heros! Always fighting for this country and trying to save it.
They were first fighting foreign threats, now they have moved to fighting domestic threats — by insisting they go through court martial hearings. They know that all of this is CRAP and they are serving America by forcing it into the more public eye.
And may the unbridled anger of the public be felt over this treatment of our finest sons!

Prisoners often try to injury themselves and blame it on law enforcement.
Coming from a military family (three generations), these attacks on our warriors make my blood boil! We ask them to do a dangerous job and then persecute them for doing it. Thank you for writing about this and may these guys get the support of a whole nation.

Ahmed Hashim Abed got a fat lip either self inflicted or maybe by one of the SEALs. So what! He has managed to takeout an entire SEAL team from the Global War on Terror over a fat lip. He has already won a round now lets just take him out and execute him and finish off his 15 minutes of fame. EMAIL FROM THE LAW FIRM: Several are asking who to write to in the military regarding the Navy Seals. I've given them the operational chain of command which is SOCOM and the administrative chain of command information which is the Navy. The General Officer determining the legal status (to court-martial or not) of the Navy Seals is Major General Charles T. Cleveland, USA, Commanding General for Special Operations Command/Central Command. The Navy is in charge of the personal actions and discipline of any court-martial proceeding. The Chief of Naval Operations and the Secretary of the Navy addresses are below. As I'm sure you remember, the military does not have to take these three Navy SEALs to court-martial. They can give them non-punitive letters that won't interfere with the SEAL's careers. These three SEALs refused CAPT's MASS or Art 15 because they didn't believe they would get a fair hearing.

When I heard about this case, I immediately thought of the Haditha boys, and how they were ALL acquitted. Justice will be done, of that I have no doubt, but the real problem is the ridiculous charges that were brought in the first place. The guy probably resisted, so they gave him a slap. Boo freakin hoo. The guy masterminded the murder and mutilation of 4 Americans. BIG PICTURE PEOPLE! Jeez, it seems like this leadership is losing it's GD mind.

99% of the civilian & some of the military population dont have a clue what intense training & sacrifice they give for our freedom.Its a disgrace to even bring these charges against them.I am ready to burn my discharge papers & ribbins at this point.To spend millions of dollors training them ,find them guilty of something ,then discharging them ,is wasting my TAXS.These elite men can go anywhere in the world to work for any country or privite firm for big bucks with their training.It would be a shame to lose them to someone else.They also can be your enemy one day (YOUR WORST NIGHTMARE)

When this "war" started I went into Congressman Ike Skeltons office and stated that politicians were not going to do to our sons what was done to us during the Viet Nam fiasco. Marcus Luttrell, the Lone Survivor SEAL from the 2005 SEAL battle, talked to Glenn Beck on Monday on his radio show. He said these terrorists, insurgents are not dumb and use the U.S.'s ROE and media against the U.S. troops. He said they would pick up insurgents and the insurgents would beat their own heads against the wall to inflict damage and blame it on the soldiers. They are instructed and trained to do this if captured.
So, I'd say a fat lip is nothing. This is a disgrace and shameful.
I spent four years in the Navy and I am proud of my time in service. That was 50 years ago. I would not enlist today and I discourage everyone from enlisting in any service in today's political environment – both the military political environment and non-military political environment. I believe in the old days this complaint would have been ignored as soon as it left the originators hand.
Damn, My dad was in charge of the whole giving prisoners good time/bad time at Ft. Leavenworth about 10 years ago. Too bad that dude wasn't sent their then…I know damn well he would have given that guy everything he could have to get him out early as he did nothing wrong.
Men like these Navy Seals train hard for years. They lay it all on the line for God and country. What do they get in return? Disrespect and persecution from anonymous people who think nothing of using the lives of these upstanding, dedicated men as chits in a cheap, dirty political game.

I never realized what these young men go through to be a SEAL until I read the book, Lone Survivor. Every American should read it to understand the debt we owe to them. They are true American heroes. The person that brought these charges against these SEALS should have their a– kicked. Hopefully these young men are exonerated and allowed to continue on with the military careers. In the mean time I hope some of our representatives take up their cause. God bless each of them.

For the non military as a Retired Vet I can say the 'unwritten rule' is if you are guilty take the NJP (Captains Mast) f you are not guilty push for a General CM (Court Marshal). An NJP has no set rules of evidence and anything can be admitted as evidence with out regard to chain of custody or investigative research (no defense council). A CM very much resembles a civilian court with respect to council, evidence chain of custody, etc. Why then take the NJP if you are guilty – the punishment s much less severe. Ergo if guilty take the 'light' sentence of an NJP, if not guilty – require a full burden of proof.

Exactly, I had brought this up last week with another poster. I also pointed out that these men are not trained as cops, they are combat sailors with Special Warfare training. They are all volunteers twice over, they volunteered to be in the Navy, then volunteered to go through the hell of BUDs/SEALs training. Yes, even within the military community, they are held to a higher standard, as are all SOG personal because they are the best, but these tools are demeaning them by pushing trivial crap on them. So he got a fat lip, that could have happened any time, any where by anybody.
The message this sends to the men in the field: don't leave marks on them and don't bring them in alive.

On December 7, the three SEALs are set to go before a Judge and plead not guilty. This first court appearance is only the arraignment and the actual trial is set to being sometime in January.
As of right now, unconfirmed reports say that the arraignment will take place at Naval Station Norfolk in Norfolk, VA on December 7; however, we are still trying to figure out the exact time(s) and location(s).
I’m sure all of you agree that this is a complete outrage and mockery of our US Military. As Americans, we CANNOT stand for this and MUST show our support for our troops who are constantly being put in harms way to protect the country that is now bring them under fire. We must send a message that “political correctness” has reached a boiling point and that these service men will not be hung out to dry.
I put this protest event together in hopes that it would gather locals in the area who would show their support that day. I, myself, am located in Fort Worth, Texas, so chances are slim to none that I will make it out next week. I do not expect to see thousands show up for the arraignment; however, it would be nice to see a decent crowd showing their support that day. The big protests need to come in January when they go on trial. This is when we all need to make the sacrifice of traveling to support them. Don’t get me wrong though, if you want to travel to Norfolk on the 7th, please do so, I just don’t want our efforts to be misused this early in the game.
So, with that said, I ask everyone, within reason, to take to Norfolk, VA Naval Base on the 7 and send a message loud and clear that we stand behind them.

It is easy to point to these three SEALs and the fact that they are subject to a Court Martial and viscerally react with disgust, but there is more, much more than what Bob has written that goes into these types of charges, especially in a deployed environment.
First, I am a US Army Judge Advocate. I spent 15 months deployed as an Operational Law / Detention Operations Attorney in Iraq. Second, I currently represent dozens of Soldiers as a Defense Counsel in protecting their rights. So I believe I can speak from more than just my heart, I have experience, a combat patch, and a bronze star to back me up.
Point 1 – allegations came from the Master-at-Arms community – This is not surprising given that Navy Masters-at-arms are the individuals who would inprocess, search, and care for any detainees. It is their duty to report any allegations of misconduct or abuse. All, and I mean ALL, reports of alleged detainee abuse are investigated. It is required under MNF-I orders.
Point 2 – all Special Operations Forces in Iraq fall under a local Special Operations Commander, not the local land owning commander. It would likely be the field grade commander (O-4 or O5) who is unquestionably a member of the Special Operations Community. This commander has UCMJ authority over the SEALs. Now the exception to this would be if either the MNC-I or MNF-I commanders withheld jurisdiction (unlikely).
Point 3 – I find this completely unbelievable. There are numerous agreements between the different UCMJ authorities in theater over who controls charges and charging authority over individuals under their command. The local Special Operations Commander is at least an O-6 and likely reports directly to the MNC-I commander (Lieutenant General) 3 Stars. These lines are clear and the Special Operations Commander always retains UCMJ authority over his soldiers/marines/sailors unless it is taken away from a 3 star general.
Point 4 – I do not doubt this at all. Often times detainees come from Iraqis, other US Forces, other places.
Point 5 – There are always extenuating circumstances. That is what a court will determine.
Point 6 – Absolutely, with a court martial there is open discovery and the government must prove beyond a reasonable doubt that the accused are guilty of the crime charged. All facts will come out. There is no "hide the ball" in the military justice system.
I am sure that when all is said these three will be acquitted, the Navy has fine defense attorneys whose sworn duty it is to defend these Sailors.
Didn't work for the Germans, why should it work here? If the guys broke the law, they broke the law. Doesn't mattter where it was done or who reported it.

I sure hope they will be acquitted. I realize that allegations have to be investigated and it is imperative that the military has function and order, but a fat lip juxtaposed against war is bound to elicit outrage.

While everything you say is absolutely true, as we used to say in the Navy, "how things really work is on the deckplates." This case should be made an example of how NOT to do things. Imagine something like this happening in WWII in the Pacific. The immediate commander should verbally tell the Seals not to do it again, and the legal system should reprimand anybody who makes anything more of it.

It's getting to the point where a soldier can't capture anyone alive. I'd like to think that they would want to capture these bad guys alive in case we can get good information from them, but the flip side to that is that the terrorists now know all of the "tricks" and are trained to claim torture and abuse. It is bullshit like this that keeps us, the most powerful country in the history of mankind, from actually winning wars. If you don't agree a perfect example is told in Marcus Luttrell's Lone Survivor, or just listen to his interview with Katie Couric. Basically, in a nutshell, 11 of our best SEALs died (and could not accomplish their mission) simply because his unit on the ground, deep in Taliban controlled territory, was afraid of politicians back home prosecuting them for doing their job. When you are at war, you fight to WIN, period. There is no such thing as a "nice" war. If some SEALs (or whoever the hell else) gave an American murdering terrorist a fat lip it is not 1/100th of what the bastard deserves. If a few of our "leaders" actually had the balls to turn our men loose, let them do their job (without tons of red tape and apologetic politicians), and give them the support they need to win, Osama would be dead, Al-Qaeda/the Taliban would no longer exist, and we would quite possibly have most of our troops home already. A big heartfelt "Thank You" to Mike Flynn and Bob McCarty for posting this despicable story of the abuse our Soldiers/Seals are suffering as they try to do the job we have asked them to do!! In the case of lst Lt Michael Behenna, who is serving 20 years at Leavvenworth for DEFENDING himself against a known terrorist, Ali Mansur, not all the evidence was presented at his trial. The prosecution had a world reknown forensic expert, Dr. MacDonnel, as their witness. However, when the doctor heard Michael's testimony at trial as to what happened, he told the prosectutors Michael was telling the truth based on his examiniation of the forensic evidence, and that Michael did indeed DEFEND himself against this "KNOWN" terrorist, Ali Mansur, he did not commit pre-mediated murder. What is horrendous is that the prosecution sent Dr. MacDonnell home that day and would not call him as a witness.
This is so terribly wrong as the doctor's tesimony would have exonerated Michael and today he would be at home with his family instead of sitting in Leavenworth, where he has just begun his eigth month of incarceration! Further, at trial, the judge gave instruction to the jury before deliberations that since Michael had his gun drawn on the "KNOWN" terrorist Ali Mansur, that could be seen as provoking the attack by Mansur!
As the mother of a Son who served 4 deplolyments with the 82nd AIrborne, that instruction to the jury has frightening implications for our military Heroes. In other words, if holding a gun on a terrorist in this war means you are provoking an attack by the terrorists, it looks like the Army will fill Leavenworth to the brim with military Heroes who, according to the judge in Michael's trial, do not have the inherent right to defend themselves from terrorists! Ali Mansur was a known Al Qaeda member. He had already planted an IED on a roadside and Michael and his men had had been instructed by intelligence to take another route! Further, Michael had lost two of his men weeks before due to the actions of Ali Mansur and this Al Qaeda cell
What has happened to lst Lt Michael Behenna is an outrage! We are affording rights to terrroists and denying our brave men and women the right to defend thmselves. Michael Behenna's mother and myself spent the last two days in DC meeting with Congress and Senate officers and they have expressed to us their concern in this matter also. I'd like to especially thank Congressman Steve King, who not only offered to write a letter to the clemency board, but who also will request Michael be released to his family while clemency hearing/appeals take place. Obviously, the Army does not feel Michael is a threat as Mike was given a presidential detail in the interim before he was formally charged!
The complaint I have against these SEALS is that they don’t trust anyone outside of SPECWAR to judge them fairly.
Based on what I’ve read, I don’t know any officer in the Navy who would have awarded them anything other than a meritorious mast. Or who wouldn’t acquit them at court martial, to be immediately followed by an award ceremony.
I was in intel. I supported these guys before I retired. I still support these guys.
Speaking of which, I resent how the intel community is being used to provide an excuse for the people who want to treat these asswipes with kid gloves. Sure, if someone wants to surrender bring him in for interrogation. But if they don’t want to surrender, my advice to the guys on the front line is to not place your lives and careers at risk. Shoot first.
Then, bring in their pocket litter, laptop, cell phone, whatever. We’ll make do with that. We’re not in this to have a make-work project for the intel community. We’re in it to win it. And we’re not winning if SEALS are going to prison and Khalid Sheik Mohammed is getting a soap box in New York.

My son is a medic in the Army and I am praying that he doesn't go to Afganistan. He spent a year in Iraq, March 08 to March 09. It was pretty quiet. There is no doubt a great deal of (justified) anger directed at key members of the Obama Administration for these travesties of justice, but — lest we forget — with the exception of the Three-Navy-SEALs case, these travesties of justice began under the GWB Administration. That means that Bush and Rumsfeld share equal blame in these matters alongside President Obama in these matters. Additionally, there are three key DoD players who overlap both Administrations: SECDEF Gates, JCSChmn ADM Mullen, and Army Chief of Staff Casey — all three of whom strike me as Beta Males when it comes to defending our troops and taking the war to our enemies.
As a Marine this action by our military powers that be makes me sick! These charges need to be dropped immediately and a formal apology made to these Warriors. As a former naval officer, this amazes me! I did not think that the brass of the navy had bought into the PC myth to this extent. I can not believe that we will now feminize the SEALS! My blood is boiling and I am so sad for our military that we their country can't stand up for their heoric acts of service to our country. The terrorist are lying with no shame. These guys don't have a right to be called men. These people think like animals without an onounce of honesty. I have been so proud of our armed forces in this war on terror. The current US Administration is more hostile to America's military than any previous government at any time in the nation's history. I really believe that America's future is seriously jeopardized — militarily, geopolitically, economically — by the most radical, corrupt, anti-military, Democratic-run Administration and Congress ever. Americans should begin a campaign to not see another Democrat elected to Congress for at least 60 years. Not another single solitary corrupt lying Democrat elected to Congress for three generations. Let the current crop die off & vanish from our lives forever. The Democrats do not share Americans' belief in their nation, in its capitalist foundation, in its democratic and Constitutional traditions, in its Christian ethos — Democrats are willing to betray America in a heartbeat. Given all this the current legal assault on Navy SEALs will doubtless continue, just as other attacks on the CIA and America's small businesses, will also continue. This current Administration is dedicated to diminishing America's economy on all fronts and this nation's role in the world. The Democrats' corrupt attacks on America must be stopped.

My nephew shipped out to Iraq yesterday. He left behind his one-month old daughter and wife. I'm not interested in terrorists' rights" or "extenuating circumstances" that may vindicate actions he takes. I'm interested in him having the support of Americans, but including his superiors – especially the President. I'm interested in him doing his job- killing the enemies of his baby daughter – and making it home alive.
Whether you realize/acknowledge it, your attitude and the attitudes of others like you, make it increasingly difficult for him to either to perform his job or to survive his tours.
By the way, my highly decorated brother-in-law just retired from the SEALS – truly a great American and a very brave, true hero!

as a retired navy seabee i had on occasion to have the honor to be in the company ,on 3 occasions, to be in one of the seals camps in vietman. i'm proud to of known a few of this countrys best. i as many went through survival school where they vere our instructor. i can,t imagine what it takes to be one of them. they have my highest respect, prase and aw. i only wish i had what it takes to be one of you. you are our countrys real heroes, not some type of ball player. may you have fair wends and following sea's. thank you, every one of you !!
So, I take it that most everyone that is so outraged about these guys choosing to go to a court martial don't mind our military personnel submitting false statements? How will the military function effectively if accurate, factual information is corrupted by false or misleading reports?? If false statements are acceptable, how can any accurate assessment of progress in these wars be made?? The emotional reaction to a terrorist getting punched is outweighing the true issue, commanders absolutely MUST be able to trust the information his troops provide.
