While Americans Are Taxed on Death, Political Elites Get a Handout
by Brian GarstDespite being one of the more unpopular policies in America, the death tax is set to be resurrected on January 1st. How high it will ultimately rise remains to be seen. If the tax deal passes, it will return at a 35% rate and a $5 million exemption. While not good, that’s certainly better than the 55% rate and $1 million exemption we’ll see if the deal fails. Still, both rates would mean disaster for family businesses and farms.
The hard left has inexplicably decided that not pushing hard enough for excessive taxation without respiration is where they draw the line in the sand. Nancy Pelosi referred to any deal that would lesson the fleecing of Americans upon death as “a bridge too far.” Others have referred to its inclusion in the tax deal as “gratuitous.” That’s funny, given how apt the word describes the tax itself.
What are we to make of this inexplicable drive for such an unpopular policy? One explanation is that the left simply holds a profoundly distorted view of social fairness. Rather than seek equality before the law, they look to government to enforce equality of outcomes. But other forces might be at work as well.
Another possible explanation comes courtesy of a new issue brief by the American Family Business Foundation, which highlights the cozy relationship between the life insurance industry and big government. Because life insurance benefits are untaxed, even an overpriced plan can result in more money being passed on to heirs than a simple bequeathal. The life insurance industry benefits heavily from this arrangement, with an estimated $12.5 billion in revenue coming due to estate planning. Without a death tax, much of this revenue would be lost, making the $50 million per year spent on lobbying by the industry seem like a bargain.
When the death tax was phased out temporarily, the industry went to work fighting to ensure it would rise again. This is their customers money they are spending in order to promote higher taxes, which will then force those taxpayers to purchase their product if they want to fulfill the basic human desire of providing their children. Their work is now about to pay off. And this is where the left draws their line in the sand?
To add insult to injury, the very same elites who want to rob the graves of the newly departed will get a gratuity, courtesy of US taxpayers, should they die in office. Known as the death gratuity, this benefit consists of a payout equal to one year’s worth of their bloated salary to the family of a member of Congress that dies in office. So while American farmers are struggling to find a way to pay a gratuitous death tax without selling off their property, the families of the likes of Senators Kennedy and Byrd get gratuity checks of $174,000 or more. Where is Bernie Sanders to ask when enough is enough for these political elites?

Below are the 10 Commandments of the Communist Manifesto. See item #3. Sounds eerily similar to the Death Tax, doesn't it?

Taxation without Respiration. That line from the article is going to get used, a lot. And that just about says it all.
Taxes may be necessary for the government to operate within the confines of the Constitution. That is within the enumerated powers afforded by the Constitution. The Omnibus Pork Package is an abuse of those enumerated powers. It certainly is not the only abuse but a clear reckoning of progressive elitist will. The Death Tax is as egregious as it gets. The government siphoning of wealth is staggering and the haughty way in which it is done is no different than saying “screw you America, we will finance our parade regardless of your objections.” I am really getting pissed off, can anyone tell?

Senate Democrats on Tuesday unveiled a broad agenda for an end-of-session sprint that, in other years, could be a whole year's worth of activity — ranging from an arms-reduction treaty with Russia to a major immigration bill to overturning the ban on gay troops.

I had to have a talk with my nest mate on what she would have to do if I died next year. We were forced to discuss "which" property she would have to sell to pay the taxes so she could keep "part" of what we currently own.

Here's the problem with the Estate tax:
- Roughly 70% of Americans think they ARE, or WILL BE subject to the Estate Tax when they die.
- In reality, less than 1% of families and estates are ever subject to the Estate Tax.
This is actually one of those instances where the "American Dream" tends to backfire on itself. Everyone thinks they will become a multi-millionaire, when in reality, they won't.
The best case scenario may be for the current socialist house to stop the current deal from passing and for the next house to pass a bill that makes permanent the current tax rates. Send this bill to harry and the boys and dare him to not pass it. If they don't pass it then 2012 is coming, if they do pass it then dare obambi not to sign it, after all 2012 is coming.
This way we get only what we told our new representatives they were sent there for or we get the issue for 2012.

I am of the same mind. It took me 30+ years of busting my ass to get where I am, I will not have an "Anthony Weiner" tell me I have more than I deserve. They are losing steam with their movement, the 50 balls they have been juggling are becoming too much for them. They are re-grouping after their "punt" on the tax bill. Fiat governing and frantic politics being lobbed from half court will be what we see until Jan 5th.

Firstly, there's an exemption for family farms which raises the threshold required (and from what i recall a democrat (*gasp*) introduced HR5475 to make the exemption unlimited..although i'm sure this would just turn into some tax shelter where the wealthy would buy large tracts of farmland to avoid taxation.). At the 1 million exemption it's estimated fewer than 120 family farms and small businesses would face the tax in 2011. Fewer than 1.6% of family farms. 120 or less.
So before you claim this to be a disaster, please check your facts, sir.

You're entitled to that opinion, and I certainly understand it.
I'm no millionaire either, but I earn in one of the upper tax brackets. I paid more in taxes last year than 20% of the country earned. Do I love paying taxes? Of course not. I worked hard to get my career to where it is today, but I was also extremely fortunate at times as well. I also love my country, and I realize that there are many in this country who are significantly less fortunate than I even though they may have more ambition, more intelligence or whatever, but don't have access to the same resources that I did growing up.
I also know that there are plenty of people in this country who are honest, hard-working Americans who pay their taxes and still struggle mightily to put food on the table, clothes on their kids backs and so forth.
Call me a "statist", or a hippie or whatever else you want, but I don't think the idea or those with more helping those with less is a bad thing. Some people might even call it a "community".
If people that have wish to help that's good, if government forces them it's socialism and in socialism the only winner is government!

The 50% argument is a specious one at best in my opinion. While it is true that between 40 – 50% of Americans pay no Federal Income Tax, or get all they paid back at the end of the year, it is not true that those folks pay nothing. Everyone pays for SSDI and Medicare, as well as any state income tax to which you may be subject. Additionally, when you factor in federal taxes on things like gasoline, alcohol and other items, those folks actually end up paying at least as much of their gross income (percentage wise) towards federal taxes and I do.
It's not the death that is being taxed. It's the transfer of wealth. As to the unearned income, he probably didn't speak clearly….he probably mean to say unrealized gains. What happens is basically this:
Let's say you put a mil in equities. Over 20 years, that mil is now 10 mil (for example). If you were to sell that you would face taxes on a capital gain of 9 million. If you die instead, your heirs inherit a stepped up cost basis. This means if they were to sell it a year later at exactly the same prices (it was 10 million dollars) they would pay 0 in taxes. This is because of the nature of what's called "step up in basis at death"
Hopefully this makes sense.

In reality, people are greedy, and that greed sometimes has a detrimental effect on society as a whole.
The HCR debate is a good example. In theory, I have NO problem with letting the market set the rates, and letting competition keep rates reasonable and the market healthy.
The problem is that for 40 years we did that and it was a disaster. The health insurance companies, who are run by human beings, not some nebulous corporate entity, used every advantage, loophole and technicality they could to maximize profits while minimizing payouts. They colluded with each other to keep prices artificially high and to consistently drop the standards for care to the customer. The result was that American citizens are paying 2-3 times as much of the income towards health-care, and we don't even get the best health-care outcomes for our money.
Actually, cheese-they DONT punish the wealthy. Funny how Sore Ass and Buffett were billionaires 20 yrs ago and remain so today. Thats because they money is in TRUST FUNDS. Buffett , for example, has WHINED that "people like him"(how many of those are around?) dont "pay enough"-whats stopping Mr Buffett from paying more? Not a thing-like all lefties, they want YOUR $ to be confiscated, not theres.

Agreed. The estate tax is a backward slap in the face to the American people. There at least have to be exceptions for businesses and farms, because otherwise, there won't be any left.
I suspect that big insurance, as the article suggests, is behind much of the agitation over the estate tax, and that big agriculture is in line there somewhere too…there are farms to be bought up! Again, while I agree that the Democrats are very, very tone-deaf on this issue (like many others), the true impetus behind the tax is corporate America.
It's a shame we don't agree that government ought to be in place to protect the American people that authorize and empower it from the abuses of amoral corporate entities that often pay less in taxes than the typical wage earner.

Wasn't "no taxation without representation" one of the slogans that led to the first Tea Party in Boston harbor and eventually the American revolution? Maybe there's a lesson here for all Americans.

HAve you considered that the reason many people pay little or no Federal income tax is because the wage-gap has reached a point where 40-50% of the population are now "working poor" while the top 10% of earners (you know those folks who are supposed to create jobs) have seen their average income increase 70% in the last 20 years?
I'm not trying to blame anyone, but we have to look at reality. If you want to live in a country where 2% of people control 99% of the wealth that's fine. But it's not a democracy, or even a republic, it's a plutocracy. And if making sure that everyone has a vote, regardless of their income and/or the amount of taxes they paid is the only way we currently have to level the playing field than I certainly wouldn't want to change that.

Categorically untrue. Both of those countries have better health outcomes than we do. The have longer life expectancies, lower maternal mortality rates and lower incidents of heart disease, diabetes and cancer.

Remember the old adage, "first they came for…." that ends with "then they came for me"? It is NOT the government's money. IT HAS ALREADY BEEN TAXED WHEN IT WAS EARNED!!!! Why does the government (and those like you) believe that it is just and moral to AGAIN TAX the SAME money just because the earner has died? The person that earned the money has the right to do with whatever they like. If they pissed it away on a car, vacation, or booze, it is not your business (and wouldn't have been taxed other than sales tax), but because they are prudent and save so that they can leave something for their families, then it is taxable?!!!! (once again – DOUBLE TAXATION) Give me a break.
