The Left Claims They Can’t Find Anyone Who Says Obamacare is Illegal

Explaining this farce, the university claimed they couldn’t find any law professors to argue the opposing view. Liberal blogs such as TalkingPointsMemo and Think Progress, the blog for the Soros funded mouth-piece known as Center for American Progress, picked up the story to brag that the left can’t find any law professors to argue that Obamacare is unconstitutional. Clearly they haven’t looked hard enough.
Cato Institute legal scholar Ilya Shapiro, who is also an adjunct professor at George Washington University Law School, has issued a simple challenge. He’ll debate the constitutionality of Obamacare “anywhere at anytime.”
It’s not as if he’s the only one. Randy Barnett teaches constitutional law at Georgetown University and recently wrote in the Washington Post about different possible challenges to Obamacare. He concluded that several “constitutional challenges to health-care reform have a sound basis in the text of the Constitution.” Richard Epstein, of the University of Chicago, is another well-known skeptic of the bill’s constitutionality, and several months ago authored a piece explaining why in the Wall Street Journal. There are plenty more.
Here’s the $65,000 question. If the brilliant scholars at the University of Washington couldn’t properly conduct a basic search to find any of the numerous legal scholars who find Obamacare unconstitutional, how seriously can they possibly expect us to take their legal scholarship?

With probably 90% of the media behind them, it doesn't surprise me that they would make such a ridiculous claim. In the end, this will boil down to how many Americans have an IQ above room temperature. The numbers are stacked in the conservatives favor.
The story out of UW strikes me more of an attempt at de-legitimization of the law's critics than an effort at open, honest debate. After all, what's a little dismissive scorn after you've shoved a law down the throats of an increasingly restive populace.
If (and it is a large IF), enough R's with spines and Tea Party attitude can win in November and the remain D-rats are scared to the death of losing their political lives, it might happen.
Of course, we have to have the elections as well and I do not put it past the Socialists to try and stop them. Or worse, cheat.

I went and read his article. One-half of it dealt with making the law unconstitutional by passing an amendment. Once again, the bill was not just passed under the commerce clause. It was passed under the necessary and proper clause and the Sixteenth Amendment to the Constitution. The bill sets up interstate insurance exchanges which permit individuals to purchase insurance across state lines. This is clear interstate commerce. The enforcement mechanism is a tax. I assure you, this bill contains some legislative history which states Uncle Sam is picking up a portion of the costs of the uninsured. As a result, this tax is to offset this expense. Although the Sixteenth Amendment does not require a casual nexus between the tax and the need, this bill contains one. As a result, any court will make very short work of this argument. I wish one person, just one person would explain to me why the persons on this website vilify a welfare mama who passes her costs down to society, but yet, praises an uninsured who does the exact same thing with their health care costs.

Amendment 10 The powers not delegated to the United States by the Constitution, nor prohibited by it to the States, are reserved to the States respectively, or to the people.
They can try and twist those words all they want.
Ironically, the word "care" appears once in the Constitution — in Article II, Section 3. The word applies to the President of the United States and says, "… he shall take Care that the Laws be faithfully executed. …"

According to your reasoning there would not be a need for the Constitution in the first place. If such a document which limits the scope of Government were not needed then why all the crazy, twisted, and completely off the wall logic of Supreme Court Decisions which seem to give Congress the ability to control everything under the sun using the commerce clause? Simply because a previous Court said something has no real bearing on if it is Constitutional or not. The only thing that this type of reasoning brings is twisted logic and decisions so wrong that it takes someone with years of advanced education to warp easily understood concepts so out of shape I wonder why we even bother with the fiction of Constitutionality anymore.
There are mechanisms in place to change the Constitution if we as a society do not like it but instead the Court has re–written it without changing a word by continuously finding government powers never in there. This is the result of using precident instead of evaluating each and every case on its' own merits. Precident can be a guide but it is not law. It was never ever inteaded to be that but our Legal Profession has made the system so convoluted in order to protect itself.
Either the plain and rather simple wording of the Constitution means what it says or it means nothing at all. Like I said before we can change it or even replace it, which would be folly, if we do not like it. The Federal Government may have the power to regulate the quality of the Health Care Delivered but not the power to mandate the very same care.
Do not be swayed by the argument that by not engaging in commerce by buying Health Care Insurance that you effect commerce by increasing costs for everyone. That very same logic could also be used to force every citizen to purchase a G.M. Car or force a citizen to engage in any Government approved activity. That is the real slippery slope we are all on folks and I do not intend to fall for that one.

No. There is no direct relationship between the car you buy and any cost to the government. There is in health care because the hospitals pass down the costs of the uninsured to their paying customers; the insured and the government.
I think a classic experiment would put all this back and forth arguing to rest. The capitalists in the country take the south, mid-west and portions of the southwest. We let the libs have the west coast and the northeast……….we are all civil to one another and can consider commerce between the two areas however, they stay in their areas to live and work (no transfers).

Go read the Sixteenth Amendment. Congress can tax income in any manner it chooses. For example, it can allow you to deduct home mortgage interest, but not credit card interest. So it can easily state if you have personal health insurance, you do not have to pay a tax. But if you do not, you pay the tax. I find it quite ironic that no one can explain the difference between a welfare mama and an uninsured. They both past their cost down to society.
The powers of the legislative branch are stated in the Constitution. The powers specifically granted to the Congress are spelled out in Article I, Section 8. Since it isn't that long of a section — and there aren't that many powers.
The words "general Welfare" show up in the first line of Article I, Section 8:
The Congress shall have Power To lay and collect Taxes, Duties, Imposts and Excises, to pay the Debts and provide for the common Defence and general Welfare of the United States … [Emphasis added.]
Notice that the Constitution doesn't say the "general welfare of the citizens of the United States." It says "general Welfare of the United States." This clause only gives the Congress the power to raise money to defend the country and pay for the day-to-day operations of the government. It says nothing at all about building bridges to nowhere, or paving bike paths, or spending money on any other kind of pork barrel project — including health care. The exact powers of the Congress are listed in Article I, Section 8
The provision requiring insurance is not, I repeat not using the Commerce clause as its principal grounds of constitutionality. It is the Sixteenth Amendment.

You do not pay much attention to the news. GM was not only bailed out by the Federal Govt.ut is now the majority share holder. Also the types of cars purchased directly impact how much Tax revenue that the Government recieves. I could go on but the argumant falls apart becuase the Commerce Clause was to make Interstate Commerce Regular. That means to remove any obstructions that might have been used by the individual states to such commerce. Everything can effect commerce so that was never th intention of the clause and the plain wording used makes that very clear.

OK, one last time. Back in the 70s through mid 80s, the tax code contained a provision for investment tax credit. If a business went out and purchased an asset, they received a credit of 10% of the purchase price on their return. This section was repealed by Reagan, but it was clearly constitutional. So bringing this to the 21st century, assuming arguendo the court throws out the current law, which they will not. All Congress has to do is pass a law giving a family a credit on their tax return if they have health insurance. If they do not have health insurance, they do not get a credit. Sort of like, a business could go out and by an asset to get the credit. If they did not purchase an asset, they did not get the credit. This is not hard. It is about the second week of income tax at a law school.

I actually do not think it is illegal. Consider it a tax, and the Healthcare that follows is the new entitlement from that tax. I really think it is a loser to fight it, because the thing is that although a person is forced to have health insurance it will be based on their income level, like any other tax. At least, that is what I am assuming, because who knows about what it will actually do? Take socialism, progressivism, to the final solution, follow the Evolutionary tunnel and you will see that eventually the plan is to do away with all physical currency, and have only a system of credit. Take what you need, and remember you ARE being monitored. After all Labor is the only real thing of value, if you cut out the middle-man of currency you can be super efficient, right comrades? Oh, no personal property, too. It is no big deal because Big Brother loves you, and you will Big Brother.

I think the real alarm for the bill, however, is that it will implement a National ID. It will cause people to become even more sloth, unhealthy in their living, and make the country poorer. So your concept is not only does this give congress the authority to tax but in your view it is “stand alone” document it doesn’t state what congress can tax for therefore it can tax for anything. Also since this “stand alone” document doesn’t proclaim the manner that said taxes will be used it is merely for congress to decide.

First let me agree that I do not think the Law is able to pass Constitutional muster on either the General Welfare Clause or the Commerce Clause.
I am afraid however of what is not being discussed! We have a Supreme Court where we cannot depend upon a majority of Justices to see the Constitution as a document which should always be interpreted as the founders intended based upon the various state constitutional convention discussions of these very points. For God's sake we have a learned Justice who use case law from Europe to justify decisions here in the US.

The appropriations of funding originates in the House and must be passed by the Senate. It is called de-funding. If you were to read the articles posted here you might learn a few things.

I think that the most relevant argument has to do with the fact that it interferes with the rights of the states to determine their budgets. Where does the U.S. Constitution state that the federal government, through edicts, dictates, mandates or any other means, has the right to determine what the states spend their monies on?
I think it has the possibility of not only putting the kibosh on Obamacare but of all federally-mandated programs that the states are required to spend a single cent of their own funds to enact or enforce.

You are mixing up the general welfare clause with the 16th Amendment. Now go to a mirror and ask yourself this question. Can Congress, under the 16th Amendment allow a deduction on individual returns for mortgage interest, but not credit card interest? Now do not leave. Next question. Can Congress tax some income at higher rates than other levels of income?

Some of the logic used by individuals here is unbelievable. I sure hope those who will have to defend this bill in court will be just a tad bit smarter than those here trying to explain the intracacies of the constitution. Look, people having health care isn't the worse thing in the world. I know I have never sat down and thought about how cool it would be to never have health insurance. The real problem with this bill or the idea behind it is that we all need to be taken care of by the government. There is a huge difference between enacting laws which provide ways to make it easier to get health care and just plain telling me I must buy it cause the government says so.
If you look at the bill itself in regards to the mandate you will find there is quite a bit of explanation given as to why the congress is enacting the mandate. They even cite a case from 1944 regarding insurance being interstate commerce. They clearly from the text are using the commerce clause, not the 16th amendment to justify this extraordinary requirement, which mandates a citizen to enter into a contract with a private entity just for being a citizen. Let's be real clear about the mechanism they use here…if you don't have insurance then you will have to pay a penalty. THIS IS NOT A TAX! Hey, if you wanted to raises taxes to offset the costs of universal care and pay for those who live recklessly then just do that. I'm guessing this would have been a very difficult thing to get passed. Like we need more taxes. I know, I know we already pay higher premiums because of the uninsured. This bill represents something far beyond the debate on health care. It speaks to the direction we want to take this country. It pits those who believe in freedom and choice against those who are willing to give up a little of both to have some government goodies. I understand the appeal of a president who seems to ride in on his white horse to give us all the things we need from his magic bag. Well, this has always been the MO for the Democratic party. Under the guise of helping others, they sweep in and are ready to solve everyone's problems though at any cost. Does anyone ever wonder if Nancy Pellosi or Harry Reid lay awake at night worrying about you and your family. Is there truly a belief these people go to Washington to help you. That seems terribly naive and childish if you have even a tiny understanding of politics in this country and the agenda behind these individuals. I'm not speaking of FEMA concentration camps or stupid stuff like that. But about keeping people dependent on the government and obtaining more power to control what you can and can't do in your daily lives. When Pellosi carried that gavel through the crowd for all to see…you truly believe that big smile on here face was about everyone getting health care. We do sometimes pay taxes for things we may not use ourselves. When single people pay property taxes which go towards schools or someone without a car who never drives. But these are taxes on our income and this is something the constitution clearly gives congress the right to do. So I can accept at times my taxes are misspent and misappropriated, this should also be of concern.
Let me see if I can try to dumb things down for the more simple minded left. Ok, so the federal government wants to build an amusement park. It is going to be built in the middle of the country for all to visit and enjoy with there families. This park will of course have unicorns and rainbows, maybe some pots of gold here and there. There would be cool rides like bankruptcy mountain, indiana jones and the temple of deficit spending of course. Now here's the thing, some might need help paying for the park admission since it's going to be expensive. I mean it is a government project so expect huge initial outlays and returns won't be seen until much later in the outlying years of course. Then of course since it will be all union workers, then it will be over budget and the obligatory delays due to labor disputes. But finally it gets completed, what a splendorous place it is. So now to make sure everyone can enjoy, cause having fun involves interstate commerce and is vital to reducing America's debt right? All Americans will be required to buy a season ticket to the park whether you will be able to make it that year or not. Now since some won't go, but will be buying a ticket this will offset the cost of subsidizing some tickets for those less fortunate. What if you don't want to buy the season tickets for your family, then you will pay a penalty! YES A PENALTY FOR EXISTING AS A CITIZEN AND NOT BUYING TICKETS WHICH YOU WILL NOT USE.

Well, I have heard the theory bandied about that if our dollar fails, not only does G. Soros make ANOTHER Billion+ like he did last year (off the crisis), but it will take wheelbarrows of money to buy anything. They can just run the presses day and night 365/24. I recall how after 911 it was disclosed how terrorists will plan and wait years to pull off their attack just at the right moment to ensure its maximum impact; the sole virtue terrorists appear to possess is patience.
I think we are now realizing over the last year and a few months that the same can be said of those who seek to transform the U.S. from those ideals and attributes that allowed its citizens to achieve the greatest personal freedoms and economic success that the world has known to date. This transformation didn't just happen with the last two elections. Perhaps it has been, or is close to being, completed by those two voting cycles, but this transformation began decades ago, and it began through the educational institutions. If this were not the case, it would be unconscionable to logically conclude that today there are virtually no conservative ideologies espoused by those in authority of the primary, secondary and higher educational institutions in this country. It is logical to conclude the plans of those who seek to promote the rise of the welfare state in America and the demise of the ownership of private property in this country are now witnessing their long laid plans bearing fruit. The fact that the U of WA claimed it could not find a law professor on the faculty of its Law School to argue that Obamacare is unconstitutional is not surprising. To the contrary, it would have been shocking had the university found such a professor within the halls of its Law School given the far left shift in these establishments over the last 4 or 5 decades to the total exclusion of any right leaning philosophies or ideologies. This November may well be the last opportunity for those who oppose this transformation of the U.S. to begin their plan to reverse what has been achieved by those who seek to move the U.S further down the road of collectivism. With the number of Americans who pay no income tax approaching 50%, if a movement away from the course of the last year and several months is not begun soon, once the percentage of Americans who pay no income tax exceeds 50% the opportunity to do so will be lost for a long, long time.
Excellent point. When I took debate way back in the early 60's, one was often tasked to take the opposite side of their personal position on a topic and defend it. It sharpened the intellect.
What is passed off as debate today is nothing more than an argument. You can get one of those at a local bar, from "Monty Python" or your spouse.
By the way, I wish we had implemented some of the English system. Especially where the PM has to come to the floor of Parliament and defend his policies. Could you imagine Obummer doing that?

Depending on where you live in California (and my goodness what a beautiful state, just got back from a trip to Santa Barbara), we could partition off parts that are conservative in thinking and keep them in the USofA, then let the balance fend for themselves. Similar partitioning could apply to other areas that have lib urban areas and major cities but the rural area trend conservative.

It would be interesting to see a real Constitutional Law professor debate and educate the Mao-Tse-Bama (an amateur “lecturer”) on what the Constitution really says.
The S. Ct. (Hale v Henkle) has held that the “natural person” has an “unlimited” right to contract (or not to contract). Contracts result in a voluntary surrender of rights. While rights in this country supercede law, “contract obligations” supercede rights.
The S. Ct (De-Lovio v Boit, et al)) has also held that policies of insurance are “maritime contracts” that are regulated by the “admiralty jurisdiction”, the same “alien jurisdiction” spoken of in the Declaration of Independance, the similar abuses of which provoked the Revolutionary War.
The S. Ct. (Ramsay v Allegrie) warned that admiralty does not recognize and protect individual rights (it compells performance[law]), therefor no one can be subject to this jurisdiction but by his consent, by entering into a contract. We are warned to keep this anti-American jurisdiction within its proper bounds.

If the Supreme Court rules that the Commerce Clause allows the Federal Government to compel everybody in America to buy a good (health care insurance) from a private company, then I guess that we can simply strike out every other word from the Constitution, the Declaration of Independence, and the Bill of Rights except for the Fk'ing Commerce Clause. There are some strong words in the Declaration of Independence about governments that ignore the will of the people to which we should pay close attention!

Ok, here's a start, anyway. The President has taken an oath to "preserve, protect, and defend the Constitution of the United States,” correct? So far, he has violated that oath by:
1) Bypassing the Senate by appointing multiple Czars to make policy. (Yes, other presidents have appointed Czars as well, but for the purpose of advising, not policy making.) The Czars report directly to him and are not held accountable to Congress; therefore, not held accountable to the American people. You remember us? The ones who who pay their salaries? This would be "Exceeding the constitutional bounds of the powers of the office in derogation of the powers of another branch of government." 2) Attempting to control private industry. (GM? Banks? The student loan program? Health insurance?) This would fall under (Judiciary Committee again) “Behaving in a manner grossly incompatible with the proper function and purpose of the office.”
3) In the health care bill there were grants designed to fund groups like ACORN, (or, now that they're allegedly defunct, whatever they are choosing to call themselves now.). Sen. Christopher Dodd, said ACORN could qualify to receive health-care grants under a provision of the bill that provides money for groups that are members of a “national network of community based organizations.” Payback, payoffs, coercive influence, this isn't improper use of power by a man with 20 year ties to ACORN?

My mother was raised in Britain and only emigrated here on her own in the late 60s. She is a devout Catholic and does NOT believe in abortion. She only voted in like one election and it definitely wasn't for a Democrat. But she basically hates all politicians and doesn't trust any of them and still has a European Socialist leaning to her at times. Although, she will listen to what I have to say and after I went to the 9/12 March – she was against it because she thought there would be violence and I would get hurt (Yes, I laughed at that one!) – she said that she admired me for standing up for what I believe in.
I often bring up certain things and I think she is understanding where I am coming from, but her distrust of politicians runs very deep – she thinks they are all full of crap and only out for themselves.

Obama provided a short term loan to prevent an industry vital to the United States from collapsing in the middle of a banking meltdown. We haven't even seen a serious court challenge on this one. To suggest he wants to be in the car business is ignoring the facts on the ground.
The heath care legislation was passed by the congress and signed by the president and is the law of the land. You don't get to impeach a president for laws that you don't like.

But of course I do believe that there are folks at different times in our history that are anomalies and are just true patriots. Ronald Reagan was one….a true patriot. I have a feeling we are on the verge of electing in many of such folks in 2010 and 2012.
I am working in our Senatorial race in our state for such a person. He is more concerned about reinstating the foundation of our Constitution than anything. That is happening all around the country….now we just need to get the GOP Platform to reflect the Teaparties concerns for our country. I am working our County Caucus on the Platform and with what I see being proposed on that level….I am excited.

Czars don't make policy, that's a lie. They serve at the pleasure of the president to advise and implement his policies. If you had a problem with czars you need to blame GW Bush… he had several dozen of them and was the first president to greatly expand their use. And if you think they are unconstitutional, take it to court. Let me know how that works out for you.

The courts will decide what is constitutional. But I don't even see it being challenged in court. If it is unconstitutional it needs to be challenged, and the fact that it isn't tells me you are being lied to by the RNC for money. Somebody has to pay for the lesbian strippers. I used the word law – not bill – because it is a law. I said we, as in 13 states (of which I'm a member of one of those) and at least one private law suit, are working on taking the case through the courts to over turn this law.
I said the case of the Czars is really for the congress to deal with. Perhaps you're objecting because I didn't give my reasoning — so in the smallest words possible and just for you — the courts don't get to make cases. People have to file them. They file them with the court system. Only those people who are "in standing" get to file them. "In Standing" means that the party filing has to pass the test of, "they are being harmed in some way." Since the Czars are eroding away from the rights of Congress it is up to the Congressional (Oh, is that too big a word?) leaders to file the case. Since they haven't done it and it seems very unlikely they will then it is a reasonable assumption (damn it another big word) that they won't. That they aren't safe guarding the rights and powers of the congress, it is my opinion that they are spineless but I am willing to await the findings of a physician (those are people who help others in medical matters) on that one. (warning – get your dictionary out) It would also be reasonable to extrapolate that they won't do it because they are the same dishonest, power grubbing crooks as are in the White House — more formally known as Democrats.

You really need to read the Supreme Court decisions regarding the Commerce Clause. Let me help you with an example. Uninsured individuals cross state lines to receive medical care. Since they do not have insurance, they do not have the ability to pay the bill. So some of the bill is passed down to the state the hospital is located in because hospitals do what every business does with their bad debts, they pass the costs down to their paying customers. As a result you have interstate commerce.
I know about the court challenges, and until they are successful health care reform will remain the law of the land. In my opinion they will fail and you will have to win an election to change anything.

Ahhhh…you're trying to bring up that nasty UN-Constitutional thing called "Precedence". Which are courts rulings SPECIFICALLY against the Constitution, and then OTHER courts refer to it in their OWN un-Constitutional rulings. (See, then they wouldn't have to actually CALL them something else if they actually kept their rulings WITHIN the bounds of the Constitution.)

The formal title of a Czar is "Special Advisor". The word 'Special' would tend to denote that there is something special about their position. For example, it would be temporary in nature to fit a specific need outside the normal course of conducting the affairs of the government. The word 'Advisor' would tend to denote that they provide advise — kinda wacky I know.
The objections I have are really two fold. The first one is that appointments made by the executive branch of the government (to help you out there — this is the group of crooks that includes the president) are ideally suppose to be confirmed by the congress (that's the other group of crooks headed up by Harry Reid and Nancy Plastic Face). Now in the case of 'Special Advisors', these jobs are not suppose to be duplicative of the departments of the cabinet (you can think of this as being the room where the executive branch is keeping all the excess crooks that they only need for special functions). The reason for this is that the departments heads have reporting functions to congress and have to answer questions and stuff like that. A special advisor doesn't have that requirement so they really shouldn't be more powerful that a secretary of a department.
My second concern is that special advisors should be advisors — they should only give advise. They shouldn't have administrative duties.
Not what Berry has done is somewhat unique. He has special advisors which are performing as administrative lesions between the president and his cabinet. So that would be duplicative of a department secretary's job is. Additionally at least one of his special advisors has a budget that is bigger that the entire governments budget was in the 1980s and because they are in the role of 'Special Advisor' there is not accountability to congress for what is being done with this money.
I have a problem with it any time either one of these conditions is in play. Now having said that, your massah has taken this abuse of power to a whole new level which has never been seen before. That is why everyone is having a much larger problem with it now that in the past.

Now honestly, I really don't care if people disagree with me. Doesn't really bother me at all. But when Democrats think they can squelch the point of views of others, that one rubs me the wrong way. Such as when my employee, my representative starts to decide what's better for me personally — yeah I don't go for that either.
I don't have a problem with czars, either Bush's or Obama's. Running our government is a big job and the president who is ultimately responsible should have all the help they want.
I also think that with very few exceptions, the senate should confirm the president's political appointments in good order. I don't blame them for digging in their heals on lifetime appointments like judges, but the president should have whoever he wants in his administration. Occasionally there will be a candidate who is unqualified to serve, but they should be the exception and not the rule for delaying political appointments.
We are seeing the appointment confirmation process used as a political weapon and it is going to result in the expansion of the use of czars and recess appointments.

I think you assume too much. I'm not running for office but I appreciate your confidence in me.
Actually I believe that America just needs to elect public servants who fully understand their roles and responsibilities. That they are answerable to the public for their actions and that laws are in place to control those actions and as such prevent the government from eroding the freedom of the people.
Unlike democrats who pull the lever and hope their checks keep coming, I believe in self reliance and responsibility. I look forward to the days ahead when the government gets back out of my life and allows me and my fellow brethren to breath the free air God has provided them.

I think the recess appointments are a chicken shit way to give someone a job period by any president and they should do away with it entirely. Also, Berry didn't appoint these people and congress didn't hold up their confirmation. He waited until the recess to make the appointments.

Ok…. NJ has a recall law on the books to recall sitting representatives from congress. While the current NJ secretary of state tried to ignore the law (go figure – another democrat) there is a current process following that law to recall one of there Senators. I'll grant you that the laws are not uniform if even present in all 50 states but I think the point of the rebuttal is clear.
I guess you can call the screaming at town halls a political tactic but if we have to acknowledge that then it must also be recognized that sitting democrat officials hiring union members to throw eggs at buses is just a political tactic as well. Of course the former is legal discourse and the latter is breaking the law and causing public endangerment — but again it's totally understandable once you consider the source.
If we could guarantee every appointee an up or down vote in the senate we could do away with recess appointments.But when you have the minority holding up every last appointment to gain some kind of political advantage the system is broken.
Obama has been in office for 15 months and still has almost a hundred positions to be filled that are being held up by filibuster or on hold because Colburn or Inhofe or Bunning thinks they can use it as a political bargaining chip.
It would be interesting to see what would happen if a state did try to recall a senator. I'm sure it would immediately be challenged in the courts, because there is no provision in the constitution to recall a federal officer. I think in the end it would still be up to the congress to vote.

That's not realistic and here's why. A confirmation hearing is well a hearing — wacky I know. The government just seems to love the word hearing too and they use it for all sorts of different types of meetings. But they have a really good reason for using this particular word.
It's where people get to hear testimony. It's true there are usually decisions that have to be made after the hearings but that's really after the hearing proceedings have concluded. If the president has so many damn appointments that need to be filled perhaps he should make the damn appointments. The hearings can't be scheduled until congress knows who to call to the hearing.
Strange, we have common ground again but for two completely different reasons. I agree, Berry has been in office for 15 months, and we're still waiting for him to execute. Given the reasons for the failures in his TSA appointments the system seems to be working just fine. My suggestion to Berry might be that he should look beyond his circle of corrupt friends when making appointments and it should go a lot smoother.

The appointments are not made until the senate is ready to take them up for good political reasons… Once the appointment is made the opposition goes on camera and starts throwing bricks. No president has ever submitted a complete list of appointments without seeing where the opposition is going to come from.

I woke up the other day and realized that I am really Amish! That's right! So I am founding the First United Amish Church of Arizona. I realize that I have a long way to go to fully implement the tenets of Amishism, it will be a life long struggle to implement all the tenets, but I am working on it. Unfortunately I have to use a lot of the tools of modern society to get the Church up and running. Guess I'll just have to live with that. I am Amish, no doubt!

Perhaps he should consider keeping his vacationing family in DC more often rather then jet setting on Air Force One all the time. That way he can actually get more work done. After all he hasn't made a deadline yet and he's getting further behind. Then in order to get his appointments through congress without a hitch he might consider looking beyond his circle of corruption for appointees.

Folks in the democrats are finding it hard to support his vacationing life style taking the kids and wife on hops all over the globe in AFO. And seeing that he's starting to cancel them on AFO more often now it seems he's starting to feel the pressure and taking the advice.

Some states have provisions for recalling elected officials but federal officials must be impeached or in the case of the congress, removed by a vote of the house or senate… ie, only the senate can remove a senator from office.

NJ is not the only state with laws on the books. 18 or 20 states have provisions for federal recalls, it's just that no one knows if can be done because it isn't in the Constitution and has never been challenged in court. No congressman has ever been recalled.

It's because of the procedural process rules in the senate. All senate business is conducted by unanimous consent. Any one senator can object to a point of order, and when they do, the motion is tabled. Now when you have 530 presidential appointments to consider on the floor, and 40 senators taking their turns objecting, the usual business of the senate can be brought to a standstill.
Then there is the right of any senator to put an indefinite hold on any nomination or group of nominations… and they can do it anonymously and often it is difficult for the public to learn who is doing it. Like in March when Jim Bunning put a blanket hold on all presidential appointments being considered by the senate…. he didn't even need a good reason, he just wanted to stall the process. When the heat gets too hot he'll remove his hold and some other senator will take his place and the procedural process begins again.
So no, this is actually all Republicans.
You misunderstood my point. I don't care where Bush took his vacations. He took a lot of heat for it in the media, but not from me. I was responding to the blogger who was trying to make a political point out of Obama's travels.
I don't care any more about Obama's vacations than I did about Bush's… presidents travel, some more than others. Some criticisms of Obama are warranted and some are silly. This is venting partisan frustration.

Well HuskersLoveBo – I'm one of those "uninsured" but unlike those welfare mama's you talk about, I lay cold hard cash on the counter every time I visit the hospital or the doctor. Pretty big difference there. I "work" and the welfare mama's don't. I support myself, welfare mama's are taken care of by guys like me that do work and pay taxes. So – big difference. Hard to believe you can't comprehend the difference.
As one of those "uninsured" folks that you like to compare to a "welfare mama" – I'd have to inject here that I probably paid more in taxes in the last three years than guys like you have made in your lifetime. It's what supports those "welfare mama's" – guys like me who work.
The only way to overturn progressive case law decisions is by constitutional amendment. There have been so many activist judges handing out decisions that fit an ideology and not the founding principles, that our whole system is shifted leftward. There are volumns and volumns of notes that were taken during the ratification process for our constitution at state levels. The meaning of the words is well documented and well ignored by judges these days. They all look at precedence instead of origins.
PLEASe MAKE SURE THAT Nancy, Barbara and Maxine are in the liberal bastions and they can never get a passport to visit us!

Here's a reply to your welfare mom vs. uninsured person argument. Pregnancy is a choice that people make, women do say, "gee, I'd like another child". No one says, "Gee, I want to contract AIDS or break my hip or get H1N1".
That is not the norm with insurance, health care is far and away a local transaction. Plus, before the healthcare bill, the federal government actually barred the selling of health insurance across state lines, specifically excluding it from legislation under the commerce clause. It is not like that restriction was lifted, then insurance companies did business across state lines and then the healthcare bill passed.
Where exactly did you say you got your law degree? If not that then how about we start simply, did you graduate high school?

I worked for a part of the Bell System and we worked around the clock to not impact the public for many many months leading up to the date. Inventory, eqpt changes, line painting in the buildings, non-stop training. I saw the 1st version of hi-def over 20 years ago and it was only 1 in thick as a prototype. They worked with the early space program and the CIA. Bell Labs was a National Treasure. Long Distance pricing was on its way down as the fiber optics was in very early stage deployment at Devistiture. The Trans-Atlantic cable connecting the world is still in use. In my opinion, America lost in the name of competition which costs more and delivers less.
