Licensing Gone Wild: Armed Government Agents Raiding Barber Shops
by Bob EwingLet’s say you have a knack for cutting hair. If you live in Florida, guess how many hours of government-mandated instruction you’d be forced to sit through before you can become a barber?
1,200.
That’s right, well over a thousand hours. Plus, you’d have to pay thousands of dollars to cover the cost of your classes and pass a written exam. Only then will the government give you a license—that is, permission to cut hair.
Now what happens if you’re already a successful barber but didn’t have a chance to stop working and jump through all the hoops needed to get that license?
Armed government agents could raid your business and handcuff you in front of your clients. Indeed, this is already happening. Institute for Justice economic-liberty expert Paul Sherman explains:
According to the Orlando Sentinel:
As many as 14 armed Orange County deputies, including narcotics agents, stormed Strictly Skillz barbershop during business hours on a Saturday in August, handcuffing barbers in front of customers during a busy back-to-school weekend.
It was just one of a series of unprecedented raid-style inspections the Orange County Sheriff’s Office recently conducted with a state regulating agency, targeting several predominantly black- and Hispanic-owned barbershops in the Pine Hills area.
In “sweeps” on Aug. 21 and Sept. 17 targeting at least nine shops, deputies arrested 37 people — the majority charged with “barbering without a license,” a misdemeanor that state records show only three other people have been jailed in Florida in the past 10 years.
The operations were conducted without warrants, under the authority of the Department of Business and Professional Regulation inspectors, who can enter salons at will. Deputies said they found evidence of illegal activity, including guns, drugs and gambling. However, records show that during the two sweeps, and a smaller one in October, just three people were charged with anything other than a licensing violation.
Barbers with years of experience and lots of satisfied customers are being subject to harassment, embarrassment, and hundreds of dollars in fines, simply because they cut hair without having gotten permission from the government.
This is not an isolated incident.
The Institute for Justice recently launched a nationwide “city studies” investigation examining barriers to entrepreneurship in eight American cities. We found that government at every level is harassing more and more citizens and forcing ever-increasing numbers of people to get government permission just to earn a living.
We also profiled a series of entrepreneurs in a campaign called The Power of One Entrepreneur. These reports demonstrate the amazing and positive effects that a single entrepreneur can have on their community. And yet, government barriers around the country are kicking entrepreneurs out of work and preventing countless others from ever realizing their American Dream.
As Institute for Justice President Chip Mellor explains in the USA Today:
America was once known as the Land of Opportunity. It could be again, but not until state and local officials get out of the way of entrepreneurs trying to fulfill their dreams of new business and new prosperity for themselves and their families.
If the government is serious about creating jobs in this jobless recovery, perhaps it should put away the handcuffs and start allowing entrepreneurs to put themselves and others to work.

That is almost as idiotic as Indiana law that everyone is carded when buying adult beverages regardless of age. And the LCB has a monitor watching everyone transaction. The fine is $3,000.00 . We need a gov't agency to save us from the government.
My neighbor cuts hair in his basement. Usually 4-5 other neighbors use his services. Do you think I should turn him in to the government?
My God, what horrible things will citizens do next? How about the kid that cuts grass without a license? He might be looking at several years in prison for such an offence.

You miss why they were actually doing this….there was a gang using barber shops as headquarters. They ended up arresting 29 gang members in the stings.

This situation shows how government can be used to protect a group from competition by making it impossible for others to get into the business.
Then get a search warrant, go in and bust them.
This was done at state level, not federal level, voters in Florida need to pay closer attention on who they elect.
Then they should have busted them on something other than not having a licence to cut hair.
I would venture to say that the free market could certainly police this issue without any government intervention. If the barber gives lousy haircuts no one will return to his/her shop. So you get a bad haircut. Who cares? It will grow back and after it does you can go somewhere else to get your next cut. Most barbers get new customers based on word of mouth so when the word gets out that the haircuts at XXXX barbers suck no one will go there. Business fails.

There ARE reasons that these licensing laws are good and are needed. This has NOTHING to do with
the ability of the folks who are performing the task to do a decent job giving a haircut.
It has EVERYTHING to do with education of the service provider in methods and rules related to steriliza-
tion and maintenance of equipment. Would you go to a doctor to be treated for a sore throat, knowing
nothing in the exam room had been cleaned or sterilized. There ARE LAWS to be learned, proceedures
to be followed.
In addition to sterilization, there are conditions of the scalp that preclude the provider from giving service
to some folks. The process of learning to recognize these 'conditions' is important and complicated.
There are diseases that can be spread if these rules are not observed. Anyone heard of the serious fun-
gus that was being spread by improper observance of procedure among those giving pedicures?
FYI, there are state inspectors that visit barber shops and hair salons regularly to check for violations of
rules of sanitation etc.

If they are NOT going to pay licensing fees and taxes associated with starting a business, then they must be WAIVED for those who currently ARE paying them. That's the equal opportunity of capitalism.
My wife has cut my hair (IAW AFR 35-10) for almost two decades now. Only time I step into a barber is when I'm TDY and I go to an on-base shop.
These things are becoming more apparent because of our sensitivities towards government intrusion. ie; lemonaid stands, kids. . . et al.
Government should build roads, blow stuff up, kill commies (yeah, I'm old school), and have state dinners with other boring stuffed shirts.
Whenever they approach private business, they always screw things up.
They are just doing a little trimming around the edges… with a dull razor.

the licensing requirements were lifted. Would you eat in a restaurant that you knew had not been

1200 hours is NOT excessive, go to a barber school and ask for their least experienced student for
your next haircut, then come back and make that argument again…he he he!
I know someone who was a TX State Cosmetology Inspector, trust me she has anecdotes that would
make your hair stand on end.

@mipthree, there are techniques to be learned in all trades, a person just can not go in and say " I want to be a barber/hair stylist" and BAM all of a sudden they are one. It doesn't happen that way. My sister went to beauty school and there is WAY more to it then the average person will ever understand. I know because I was her guinea pig when she went for her state board exam.

Folks, my first thought when I read this was "okay, where's the OTHER side of the story?" Seriously, do you think that "as many as" 14 deputies in a county as big as Orange County, along with narcotics agents, have nothing better to do than harass poor little independent hard working barbers?
Do we really have so little respect for local law enforcement that we automatically jump to the conclusion that they are the new Gestapo? Could we not instead hypothesize that they were trying to be creative in their effort to sidestep the ACLU and find an legal excuse to raid known drug dealers?
I smell a rat. There's very many legitimate examples of government overreaching and the destruction of our liberties, but I doubt that this is one of them.

Licensing is different from regulation. If someone knows their stuff enough to pass a test to get a license they should be able to go for it.
The place I see a problem is with massage therapists. They require 500 hours of training in most places and I think these schools essentially teach them a lot of bull crap and ruin their ability to give a good massage by "teaching" them other techniques.
I cannot stand the "pressure point" stuff that most massage therapists use. I have told them at the beginning not to do anything of the sort but it is fruitless–they have been taught that pressing their finger into these points "releases" the muscle or some such nonsense.
And then after the massage, they get after you to drink plenty of water–(some even recommend 8 glasses)–"to wash out the "toxins."
Toxins? Really? It's pseudo-science and people have to go to these schools to become massage therapists. And then there is no escaping it. I can't find a good massage therapist to save my life because they have all gone to these damn schools–and why?

In the name of safety and protection the government on all levels is not so slowly taking away all of our civil liberties, in favor of government controlled commerce. The worst part of this whole thing is it is happening on both sides of the isle. Both Conservatives and liberals tend to step on the civil liberties of people in favor of government control. The only way around it is to strike some sort of balance between strict conservatism and libertarianism, where there is some very limited protection for those who cannot defend themselves, but greater personal responsibility to allow for greater freedom. Most of these regulations strongly favor larger wealthy corporations who lobby for these things in an attempt to snuff out smaller entrepreneurial competition.

For that matter, what if they found an illegal immigrant with a license? (It could happen – they get driver licenses all the time)
My guess is that nothing would happen to the illegal in either case.
They operated under the authority of the DBPR. With such license checks, the police were able to uncover drugs, piracy, and guns. The local neighborhoods are in support of this crack down – we are tired of having to be afraid of "Crime Hills."
I don't believe this was an issue of bad hair cuts – the underlying issue was what was going on at these barber shops. Anyone in Central Florida would know to steer clear of Pine Hills because it is a den of crime. Illegal immigrants, gangs, guns, drugs, and violence have taken a hold of the neighborhood and the citizens want their streets back.
Then send the bloody police down and arrest the lawbreakers, or don't they do that in Florida? Why punish those who are obeying the law because the authorities don't have the jones to go arrest those who disobey the law? That's like fining me for getting passed on the highway by someone doing 90 mph

I'm all for the rule of law. Just seems to me we got some bigger fish to fry right now. How about after we raid employers of illegals, corrupt officials, and corrupt PAC's. Then we go after all the unlicensed barbers out there. Just saying.
Interesting POV, I will have to meditate on it. One thing I can say off the top of my head is this. Even drug dealers have rights. But, if it is a clever side step, well good on them. Let's see some results though. Truck out some contraband and prove that it is not just a revenue generation scheme.

I have no feeling in two fingers of my writing hand thanks to a "highly trained" massage therapist who went after my Brachial Plexis area to fix a problem in my "shoulder."
She said that was common and the sensation would slowly come back in a few weeks.

So you can take the argument for or against licensing either way. Doesn't seem to help and the over regulation is just an excuse to get money. Either way you'll either get a good cut or a bad one and no license can guarantee which.

Where I eat is my choice, right? I cut my kids hair all the time and 1200 hours don't mean squat. You apply the "it's for saaaaaafety" argument. I ask you, on what authority does government infringe upon the right to provide for yourself via marketing your skills as labor, for which you are responsible, and usurping your pursuit of happiness to do so in a gratifying way? On what authority do you and I and everyone else have to PAY government in order to do so and be punished if you don't even though you have harmed not even one flesh and blood human being?
Where does innocent until proven guilty come into play? Where does it become wrong to punish someone for what MIGHT happen or what someone else did?

unless I missed something, the article stated that they only charged 3 people with anything other than "cutting hair without a license." seems like a lot of crap to go thru to arrest 3 people. and if they couldn't get ANY evidence of what was supposedly a major drug ring operating out of these barber shops, then they need to hire some better detectives.

Roofing without a license. They face up to 364 days in JAIL – for WORKING.

Try being required to have a stand alone special ID, which you have to pay for, that you must present to buy, or even possess, even one round of .22 ammunition, much less the firearm it goes in. The cost for that "license violation" is the revocation of your Second Amendment rights altogether for the felony that goes along with unlawful use (I.E. Possession). No, joking I am not. You must have a FIOD card to bu ammo and you must have one to own a firearm even if your grandfather left it to you when he died.

Yes; if we only just enforced our immigration laws, for example, would we need immigration "reform" at all? Why not target the people — from big corporations down to mom and pop — who enable illegal immigration by hiring illegal aliens? That would stop an awful lot of the drug crime before it even started!
Lot of people in my parts (Katrina country) who wouldn't mind it if roofers had to show a license and some sort of competence before you gave them $10k or more for a new roof. Me, I didn't have my roof repaired (other than by me) until the rush was well over, and I thoroughly vetted my new roofer before I let him touch my house. The personal responsibility approach worked for me, but at a certain point we need licensing to make sure grandma doesn't get the shaft instead.
10 to 1 the onerous restrictions placed on getting a barber's license in Florida were the result of barbers making the suggestion. Look up "barriers to market entry" and "monopolistic practices."
On the other hand, oftentimes industries will propose licensing regulations because they honestly feel it is in the best interest of both the public and the industry (or of the profession).
I've seen a few articles like this on Big Gov. They all seem to be aimed at getting conservatives' ire up over things that normally make conservatives mad (wacky lawsuits, Gestapo-like government tactics), but on closer examination they don't hold up very well. Always remember, conservatism has as its basis truth, liberty and justice. I just don't think we have all the facts, so how can we make a judgment about whether the article serves the pursuit of truth, whether justice was served, and whether this is an example of government infringing on our liberty?

Living in Orlando also gives some added perspective – I am familiar with the area in question and understand just what the police have been dealing with. Many Central Floridians support these raids because of what they have dealt with – these raids are a direct response to the high crime and the promise from our elected officials to combat crime back in 2008. I didn't vote for the current sheriff but I have to say they are doing a great job in making Orlando safer. The licensing search may had been a way to get through the door – these barber shops may have been a front for illegal activities and the police saw right through it…
I guess in the perfect Big Government world we would never use the RICO act to take down organized crime, huh?

Barbers and beauticians/stylists have had to go to school and pass an exam for DECADES. Where have you been?
In fact, back in the not-so-good old days, beauticians used to have to have a Wasserman test periodically to renew their license. What the he!! did they think the beauticians were doing?

Listen–if you want to think they were being creative, think for a minute…how you're going to feel when they decide to find some creative way to sidestep the ACLU to target you for something you may or may not be doing? I'm not a fan of the ACLU…but then again, law enforcement and prosecutors will work very hard to sidestep as many of your (our) rights as they can.
What's wrong with that? When the muscles and lymph system are stimulated and a lot of crap is flushed out of them, drinking water makes a big difference. This isn't just something taught in massage therapy schools.

I grew up in the Orlando area. The Sheriffs department was always know for being unprofessional and heavy handed.

I just looked it up. It is $70 for a license in Texas. This whole thing stinks to high heaven.

There is no reason with regard to the art and action of cutting hair that needs that many hours. There are not many ways to cut hair or to be that creative that one would need those hours. Their treating it like it was a sin that harms and destroys anyone who comes in contact with the cutting of hair. Oh wait that is nuclear science. Oops I am mistaken that hair cutting is a serious matter and when not taken serious it can harm all those involved……

Raiding a barber shop is a safe, easy way to extort money from innocent people trying to earn a living. Orange county sherrifs will arrest you for talking smack about Muslims however…..

Definitions including the occupation codes and class codes, where applicable
BA – A "barber assistant" – a person whose practice is confined solely to shampooing hair and applying hair tonics or conditioner under the supervision of a licensed Barber. The Barbers' Board no longer issues new Barber Assistants' licenses but those previously issued are renewed.
BB – A "barber" is a person who is licensed to engage in the practice of barbering in the State of Florida. The term "barbering" means any of the following practices when done for remuneration and for the public, but not when done for the treatment of disease or physical or mental ailments:
shaving, cutting, trimming, coloring, shampooing, arranging, dressing, curling, or waving the hair or beard; or applying oils, creams, lotions, or other preparations to the face, scalp, or neck, either by hand or by mechanical appliances.
BR – A "restricted barber" – a person whose practice is restricted to the terms, conditions and restrictions imposed on their license such as: hair cutting, shave, shampoo, blow dry hair, and apply hair tonics and hair sprays.
BS – A "barbershop" means any place of business wherein the practice of barbering is carried on.
Could it be that the people who were subjected to the supposedly Gestapo-like tactics were "restricted barbers" who would never have to attain 1,200 hours in instruction (because the would never be applying dangerous chemicals to the hair, face, scalp or neck of patrons)?
I don't know, I haven't been able to find out, but I am DEEPLY suspicious when someone says "barbers in Florida have to have 1,200 hours of instruction just to cut hair, isn't that ridiculous," and they don't back it up with a link proving the point.

Use your critical judgment skills! If the author has a good, valid point, then make him do a better job of making his case. This article, though, is a dud.
"…PAY the government…" ??? So what? Plumbers, electricians, etc… professionals in every
realm pay the government an annual licensing fee. I take it you would have us do away with
all licensing in order to prove we are exercising FREEDOM.
You cut YOUR OWN kids hair?… heh, heh….. we'll see how long that lasts. At a certain age
they all seem to find a way to of convincing us they need to go to a professional for those
services, enjoy the savings while you can. Been there, done that!!!
Please go to some little shack in the barrio or hood for your next haircut. It just might open
your eyes. The best and even the average need no oversight, no monitoring, but then
there are those who do…
Will their bad practices eventually ruin their business? Perhaps, but at what cost to the
consuming public before their reputation destroys them? Points to ponder…

and in case you took my question wrong, i didn't mean it as an attack. i just re-read it and it sounded a little brusque.
So you get a bad haircut. Who cares? It will grow back and after it does you can go somewhere else to get your next cut. Most barbers get new customers based on word of mouth so when the word gets out that the haircuts at XXXX barbers suck no one will go there. Regards, Mary cna
I AM A LICENSED BARBER. THE LAW SAYS YOU MUST HAVE A LICENSE TO BARBER IN FLORIDA AND MOST OTHER STATES. IT HAS BEEN THIS WAY SINCE 1937. IT PROTECTS THE PUBLIC'S HEALTH. WHY THE BIG UPROAR NOW? WHAT LOUTS! I HOPE THEY RAID THE RIFF-RAFF EVERY WEEK.
