Talk About the Bill of Rights, Get 90 Days in Jail

In Washington, DC, talking about the Bill of Rights can land you in jail for 90 days.
Our nation’s capital has a licensing scheme in place that makes it illegal for anyone to “guide or escort” anyone else for hire without first getting the government’s permission. To get the license, which the Washington Post editorial board labeled a Tour de farce, eager entrepreneurs must first pay hundreds of dollars in fees, fill out a bunch of forms and pass an arbitrary test.
That is, they need to jump through all sorts of needless hoops before they’re allowed to speak.

The bottom line is that the Constitution protects your right to communicate for a living, whether you are a journalist, a stand-up comedian, a musician, or a tour guide. The government cannot be in the business of deciding who may speak and who may not.
That is why two Washington, DC, tour guides—Tonia Edwards and Bill Main, who run a company called Segs in the City—joined forces with the Institute for Justice to file a major federal lawsuit challenging DC’s tour-guide licensing scheme as a violation of their fundamental constitutional rights. Video and photos of the press conference are online.
Nearly every day, Tonia and Bill teach a group of people how to ride Segways and then take them around Washington, DC, on a tour of the city. Their business is located near the National Archives, so one of the things they tell their customers is where the Bill of Rights is located. For this, the city government could throw them in prison for three months.
The issue at stake transcends political ideology. Matt Yglesias, the influential blogger for the Center for American Progress, recently wrote about DC’s draconian law on his excellent blog:
[T]his sure seems like bad policy to me. It’s a barrier to entry that’s nice for existing tour guides and for companies in the “help tour guides pass our exam” industry, but that’s ultimately bad for visitors to the city and bad for DC residents who might want to make some money giving tours. You don’t need a license to be a tour guide in Boston and as best I can tell everything’s fine . . . . Customers there are protected by the general laws against fraud and other forms of criminal misconduct as well as whatever discipline the marketplace and people’s concern for their reputation provides.
IJ attorney Robert McNamara points out in the Washington Post that DC’s licensing scheme is part of larger, nationwide problem:
In the past 50 years, there has been an explosion of laws that require people to get a license before they join the workforce. In the 1950s, only about one out of every 20 Americans needed a license to pursue the occupation of their choice. Today, that number is one out of every three.
Simply put, occupational licensing in the United States is out of control. The fact that you cannot even talk without a license in the nation’s capital is just another example of government gone wrong.

As stated in the article, this is nothing really new. Licensing of various occupations has been around in many cities for decades so it isn't something new being foisted on the public. Do I agree with it? No simply because as with any governmental control, it's all about the control the government has over the public as well as a way to extract money.
Licensing such as this were originally put in to "protect the public" but as with any good intentioned measure put forth by government, it is easily corrupted and turns into a method to gain control and extort money. The road to Hell is paved with good intentions and many of these occupational licenses prove it.

Did anyone actually read the articles contained in the links? DC's tourist licensing is a local law that dates back to 1902. *Shrugs* I don't think its going to be around for much longer though.

No, this one can't be lumped at Obama's feet, but it's part of the type of "insider privilege" crap that paved the way for him and his ilk. This "tour guide" restriction is a local (DC) law that "protects" existing commercial enterprises from having to compete with entrepreneurs or newer businesses that may offer the same or similar service and give consumers a wider choice — sort of a protection racket, run by City Hall instead of the mob.
No, it's worse than that. They stiffle competition and "protect" existing enterprises from having to allow consumers a choice.

I have a friend who lives in DC. I spent a week down there, during the whole "beltway sniper" thing. We spent a whole day visiting all the sights. I guess he should be thrown in jail, eh? F-ing communists.
BTW, we spent the evening in a stripclub, not 2 blocks away from the White house. There were senators, and congresscritters all over that place. Nice, huh?

actually much of the impetus for this sort of crap comes from established businesses persuading government to restrict entry to the field under the guise of 'protecting the public'. instead of competing in a free market, they use the heavy hand of government (thru the well-greased hands of politicians) to do their bidding.

Governments get their revenue through taxes, fees, and fines. It is a way TO CONTROL THE PEOPLE. The more money they take the less you have. Your FREEDOM is based on your disposable income. You make your income, then you pay your expenses, and what is left over is your disposal income. With your disposable income you can invest, buy things, go on vacations etc. It's YOUR MONEY. Without it you are just a slave or indentured servant. Unfortunately, the Statists think it is THEIR money. They want to CONTROL you. A profession that is licensed really isn't anymore trustworthy than those that aren't. Be it tour guides to plumbers, paying a fee to government doesn't do anything except to help restrict choice.

As for receiving moral values without God it does make evolutionary sense. The individual and the species will survive better through cooperation and coexistence than through anarchy.

Darwin may have been saddened by the God vs no God debate that he writings and observations spawned but he didn't refudiate (ask Palin what that means) the bulk of his work. As for evolution, why do we not witness all around us various animal species that are in-between their evolved stage? Perhaps a few fish species that are now trying to leave the oceans, with fins and feathers? That certainly would go a long way toward the validation of Darwin's Theory of Evolution.
