‘The Mother of the Freedom Movement,’ Her Neighborhood Needs YOUR Help

Today, the government is bulldozing her old neighborhood. Here’s the real kicker: The homeowners are forced to pay the cost of demolition.
Nobel prize-winning libertarian economist F.A. Hayek famously wrote that “the great aim of the struggle for liberty has been equality before the law.” There is no better example of this fundamental struggle than Rosa Parks, known today as The Mother of the Freedom Movement.
She refused to be treated as a second-class citizen. But her hometown of Montgomery, Ala., segregated blacks on public transits. Minorities were forced to sit in the back, forced to give up their seats to whites, and sometimes were left standing on the side of the road after paying their fare. Rosa stood up to the Big Government Bullies and said enough is enough. Her demand for equality before the law forever transformed America.
Rosa once said:
I would like to be remembered as a person who wanted to be free . . . so other people would be also free.
Indeed, she made the world a better place. So how despicable is it that today officials in her old hometown are forcing people to give up their homes? The government is tearing down houses against the property owners’ will and then sticking them with the bill.
Christina Walsh of the Institute for Justice writes at the Daily Caller:
Imagine you come home from work one day to a notice on your front door that you have 45 days to demolish your house, or the city will do it for you. Oh, and you’re paying for it.
This is happening right now in Montgomery, Ala., and here is how it works: The city decides it doesn’t like your property for one reason or another, so it declares it a “public nuisance.” It mails you a notice that you have 45 days to demolish your property, at your expense, or the city will do it for you (and, of course, bill you).
Your tab with the city will constitute a lien on your property, and if you don’t pay it within 30 days . . . the city can sell your now-vacant land to the highest bidder for cash.
The victims of such abuse are often minorities. For decades, African-Americans across the country have disproportionately had their property rights violated by government officials. In the 1950s things got so bad that “urban renewal” became known as “negro removal.”

Dr. Mindy Fullilove, a research psychiatrist and professor of clinical psychiatry, authored a study for the Institute for Justice called Eminent Domain & African Americans. In it she writes:
[B]etween 1949 and 1973 . . . 2,532 projects were carried out in 992 cities that displaced one million people, two-thirds of them African American,” making blacks “five times more likely to be displaced than they should have been given their numbers in the population. . . . Eminent domain has become what the founding fathers sought to prevent: a tool that takes from the poor and the politically weak to give to the rich and politically powerful.
According to sources on the ground in Montgomery, hundreds of homes and properties have already been destroyed in the last five years, most or all of them owned by minorities. The state recently passed solid eminent domain reform to curtail property rights abuses, so—as Walsh explains—Montgomery is using a complex end-around to sanction their demolitions.
To be clear: What is happening to Rosa Parks’ historic neighborhood is not eminent domain abuse. That’s illegal now. Today’s abuses are occurring through an altogether different law. One major difference is that with eminent domain, the property owners are compensated for their loss. With today’s demolitions, the property owners are forced to foot the bill.
Jimmy McCall, seen in the video above, was building his dream house in Montgomery. And then the government came and bulldozed it:
It was my dream house and the day they tore it down my wife cried and my little girl cried. . . . They came and they tore down the house anyway. They have no regard for the rule of law. You know, they do what they want to do.
This weekend, Montgomery activists are teaming up with the Institute for Justice in a grassroots workshop. They will discuss strategies on how to empower themselves and protect their most basic rights.

Almost sounds like the federal government when it uses selective enforcement of law or ignores it completely. Montgomery is doing nothing more or less than our current, unesteemed administration. If they don't like it, they ignore it or use some other obscure law to achieve their means. Kinda reminds me of what BO, the coward, is doing at the useless nations to AZ.

Eminent Domain episodes like these remind me of a bit from _Watership Down_.

These people are targetted because they live in low-income areas. Governments see the potential to build higher tax-generating neighborhoods there, so they move against the residents in a callous and reprehensible manner. Race has less to do with i than economic status. It just so happens that many poor folks happen to be minorities. This is why the founders believed so strongly in property rights, and why KELO was such a travesty of a SCOTUS decision.
The founding Fathers sought to prevent this. But the court said that's not what they meant. what if it is that the court is wrong? Like amny other things that the courts have ruled on in the last hundred years, they are not always right. The founding fathers were not stupid. Nor were they vauge. They were very clear in what they wanted to limit the Government to be able to do. But the courts, have turned it into what is best for political parties and ideologies instead of what the people are given as unchangable rights.

No one deserves justice more than someone else because of their race or color or creed. We all deserve to be treated equally under the law.
One question I had when reading this is: Should what defines a public nuisance be made easier on African Americans, or should it be the same standard for all?
I say, we only define public nuisance very narrowly as a house which is dangerous to the lives of those around it. (Such as one filled with rodents that aren't dealt with.)
At the end of the day, African Americans don't respect Republicans or the Tea Parties unless we truly demonstrate treating everyone equally well. Different standards – that's not the right game. Higher standards of morality is the correct way.

I would like to know if these house are truly ones that people are currently living in, but are just in disrepair or are they actually abandoned houses that are being used as crack houses, etc. In Houston it takes years and a lot of effort to get the abandoned houses (which make the entire neighborhood unsafe) destroyed.

This is not an Eminent Domain case, this is just plain old-fashioned theft. Alabama reformed their Eminent Domain laws following the SCOTUS reprehensible ruling in Kelo.
This appears to be some local legal manipulation to declare "blight" over an entire neighborhood, order the owners to raze (not clean up or repair anything) their homes and other structures at their own expense. The article doesn't detail what happens to the empty lots that result, presumably the landowners will be given the vacant-land value in exchange for the homes they were forced out of.
Good point, but that seems unlikely if they are taking down entire neighborhoods with one batch of "raze this house" orders.
When the government takes everything you have, and you have nothing else to lose, THAT'S when it's going to be dangerous for politicians and government workers. Very dangerous.
None of the above. This isn't an Eminent Domain case, it's some kind of local manipulation of ordinances to declare entire neighborhoods "blighted" and order all structures destroyed within those boundaries. Some of the houses might be in need of repairs or upkeep, but others could be in showplace order.
Actually Detroit is bulldozing acres and acres of such run down and unfixable shacks. The occupants have no money to keep them up to code, and they are dangerous. So many are abandoned that gangs and drug dealers move in with prostitutes, and shoot up the neighborhoods and kill little kids. These places have no reason to be unless the owners can afford to fix them AND the neighborhoods….which become too expensive to protect with police and fire from the minority gangs that roam their streets and make life hell.
Sorry about Rosa Parks house, but if anyone cared they would be paying to fix it up and preserve the neighborhood. The city is just being reasonable, and folks will suffer. Look at whenever the govenment creates public housing projects for the same group of people…in three years they are destroyed and the same crimes are going on there too. Maybe there is a cultural and social problem with these folks that just sitting up front in the bus and going to white schools and eating at lunchcounters everywhere JUST CANNOT FIX. Abraham Lincoln felt that the freed slaves should be returned to Africa where they would be more in synch with the other blacks…not out of hatred, but in compassion. A civil rights activist and former congressman equated the Tea Party with the Ku Klux Klan today as he blasted a conservative rally planned in Washington, D.C., this weekend.
The Rev. Walter Fauntroy, the non-voting delegate who represented the District of Columbia from 1971 to 1991, called on African-Americans to organize a "new coalition of conscience" to rebut the rally scheduled for Saturday at the Lincoln Memorial featuring Fox News pundit Glenn Beck and former Alaska Gov. Sarah Palin.
"We are going to take on the barbarism of war, the decadence of racism, and the scourge of poverty, that the Ku Klux — I meant to say the Tea Party," Fauntroy told a news conference today at the National Press Club. "You all forgive me, but I — you have to use them interchangeably."
Fauntroy attempted to explain the comparison to white supremacists by saying that organizers behind the "Restoring Honor" rally are the same people who cut audio cables from a sound system the night before the historic March on Washington and the Rev. Martin Luther King Jr.'s "I Have a Dream" speech at the Lincoln Memorial.
The same people who cut the cables on the night before the march, that we paid $66,000 for a sound system, they cut it," Fauntroy said. "Now from Fox News and elsewhere, they are seeking to turn the world back."
Fauntroy, who is credited as one of the chief organizers of the March on Washington, remembers Aug. 28, 1963, as the "most important date of the 20th century."
The "Restoring Honor" rally, organized by the Special Operations Warrior Foundation, coincides with the anniversary of the historic March on Washington and the "I Have a Dream" speech. Organizers have said the conflicting date was a coincidence and not a deliberate display of disrespect.

This was NOT a case of Eminent Domain but a demoition of a home because it is a public nusiance (Run down etc. ). Under ED they would be compensated but this way the get NOTHING except the bill for demolition.

So, when the government comes knocking because a prominent business man wants to use the location of your private home or business to build a hotel and convention center, you'll be OK with it because he _may_ be generating far more money for the public good than you will? That was the essence of the KELO case. They took people's property at bargain basement (below property value) rates because the proposed big pharma plant would earn more in property taxes. In the end, they took people's property and Pfizer built elsewhere leaving them high and dry with vacant lots.
Start weeding them out in Nov,& replacing them with Constitutionalists. Then slap TERM LIMITS on all of them. Require a Fed Budget be published once a year, on line, on the same date.It's easier to enforce,with Term Limits. They have to work to stay.
As far as Eminant Domain and this pathetic situation with this minority neighborhood: I think that E.D. should be rarely used, and only for Emergencies, not to line the pockets of Developers.

It amounts to the same thing. Local pols are telling people they know better what to do with their private property than the actual owners do. And when you declare "blight" you are lowering the property values intentionally so that you don't have to pay as much. They used the "urban blight" rules to lower the KELO area property rates below actual value.
And basic ED allows government to confiscate land for the purpose of public projects, not for the purpose of transferring private holdings from one private entity to another. That's why KELO was such a travesty because the SCOTUS backed that idea calling it "public good."

I agree with you. No matter how humble, the govt has no right to claim your Real Estate. If it's declared condemned, then give the owners notice,and a chance to correct it etc., but lawless claiming of homes is immoral, if not illegal.
Eminant Domain has also been abused in many States in recent years. In NJ there were many illegal cases. It's heartless. When we lose our sense of humanity. We ourselves are condemned.

If I were an elected official I would not stop until that were compensated. Those home owners are victims of Government trespass. It's just wrong, and they need to be paid now.
I disagree, A. Harris. The result may be similar, but eminent domain (for public use only) is allowed under the "takings" clause of the Constitution. Blight ordinances are intended to give a municipality a bit of (sometimes necessary) leverage to compel recalcitrant or negligent owners to adequately maintain their property to avoid health and safety hazards, and to not depress values of surrounding properties.
The above article is my only information on this Alabama case, but it sounds like manipulation of an ordinance so that politicians and/or their cronies could steal the property. The Kelo case, I firmly agree, was a travesty and did not meet reasonable standards for a "public use" (not quite the same thing as "public good").

Kelo was a 5 to 4 decision, with the four more conservative justices voting against it. The case had nothing to do with states' rights, but in any event states' rights do not trump individual rights. The mechanism for eminent domain limits the jurisdiction – usually a municipality – to a fair-market-value purchase of private property for public use: School, highway, civic center, public hospital, etc. — not for sale to another private party.
According to the article, the residents had 45 days from the first notice, posted on their doors, to vacate and demolish ("raze") their property, at their own expense, to avoid having the authorities raze their property, charging them the cost of demolition and/or having liens placed on the title(s) for the cost of razing it.
Oh, wow. Now, that makes my heart hurt.
Dis-repaired houses are being condemned and torn down as they should be. Every town in the country does this, but since it is happening to black folk there, it's suddenly all racist.
Poor or wealthy…black or white…condemned or new…crime-ridden or model neighborhood…. EVERY man regardless or race, religion, or creed should be allowed to keep his home. If the gov't cannot negotiate a reasonable price and forces a man out of his home, he should be given the fair market value for his land and fair market price for his home. The home amount should be determined by the median home price in that county and the market price for the land should be determined at the price the gov't sells the vacant land for to the developers….. this would end emminant domain as we know it…. and if it really is for the good of the "city" then they will be willing to compensate justly for it.
..then that said man can build his dream home with the cash secured by the rape of his property somewhere nice and quiet and hopefully a long way away from any future shopping mall plans!!!!

What Montgomery is doing is UNCONSTITUTIONAL. If those homeowners lose their property rights, why should any of us think ours is safe? Property rights are one of the cornerstone principles of the founding fathers and conservatism- it should be defended everywhere at all times. If they trample on these rights what makes you think they won't trample on others? The "collective" mindset of those in the White House and the majority in Congress will make that a certainty.
Eminent domain is an overused tool of overeaching big statist government.. If we don't reverse this trend, we may find ourselves like the former Soviet Union where everything belonged to the "people" but no one owned anything. Not as a race, mind you, but as a group. And I mean whites, yellows, reds, and any other persons who fit in this group, but it's mainly blacks, I hate to say. It's those who won't work, who want to live off of the government, with welfare and WIC and food stamps.
They don't take care of their property, since they have nothing invested in it, and then it gets run down much faster due to the lack of concern brought on by such attitudes. It doesn't get repaired, because the people who own it aren't making any money, since the rent is fixed. Therefore, they run down sooner and have to be razed because it's cheaper to raze them and rebuild than to repair.
But mostly, it's blacks who are affected by this because they live in these conditions more than any other race. Why, I have no idea. I used to believe they moved into neighborhoods that looked like this to save money, but I've now lived long enough to see good neighborhoods brought down simply because those who moved in stop taking care of their property. It's the attitude, not the skin color. But I don't feel sorry for these people at all. Live around them, listen to them, hear their attitudes. They hate whites, no matter how much we do for them, and they think no matter how much we do for them, we owe them more.

This is not a white/ black issue, its an issue of bad goverment , its going to get much worse as goverment grows larger.
Here's your hope and change. That's the kind of person that's in office. It's about control and nothing else.
If they want a piece of the pie; then elect someone who is decent and honest.

The city can not legally declare your property a public nuisance and force you tear it down without having a process for appeal, in which they would have to present their evidence that they base their ruling on. This smacks of a violation of your 5th amendment rights under the Constitution. Due process allows interaction including an appeal process and they must compensate you if they can not adequately prove that your property is a public nuisance. Find out what they use to determine the label "public nuisance" and if it is too vague then you have a case against the law being used to target people for reasons of race, economic class, or other criteria for a class action suit. A law must have a definition that has boundaries and limitations or, being too vague is undefinable and thus unenforceable in a court of law.
