Get Ready for Donald Berwick to Run Your Health Care
by Ben DomenechOn this week’s Health Care News podcast, Avik Roy, one of the most insightful writers about health care policy today, took the time to discuss with me the White House’s decision to bypass the nomination process of the U.S. Senate to recess appoint Donald Berwick as head of the Centers for Medicare and Medicaid Services (CMS). People have asked me this week why this recess appointment is such a bad thing. Well, this video clip shows why, in an honest expression of the anti-market views Berwick holds from the man himself. Here’s what he says:
“Please don’t put your faith in market forces. It’s a popular idea that Adam Smith’s invisible hand would do a better job of designing care than leaders with plans can. I do not agree. I find little evidence anywhere that market forces, bluntly used, that is, consumer choice among an array of products with competitors’ fighting it out, leads to the health care system you want and need.”
These two paths run in opposite directions: the path toward market based solutions, where people direct their own care with their doctors, making decisions for themselves, and the path toward bureaucracy based solutions, where unelected experts — “leaders with plans” — determine people’s care, making decisions for them. Berwick is clear about which path he believes America must follow.
This is all the more disturbing considering Berwick, known already for his views on “redistributing wealth” as a necessary part of health care policy, is now the most important figure in the application of the authority-grabbing Obamacare legislation. He will preside over the reorganization of Medicare and Medicaid, drive the policies of the entire health insurance marketplace (since they take their cues from Medicare), and a pile of money representing roughly 1/6th of the American economy.
The White House claimed this week that the recess appointment was in response to “Washington game-playing”, accusing Republicans of planning to “stall the nomination.” As I’ve said on blogposts, radio and podcasts this week, this is nothing more than a baldfaced lie. Republicans could not stall this nomination even if they wanted to under Senate rules. Some commenters on the left even claimed there was a secret hold placed on Berwick — but this isn’t even possible at the stage in his nomination! — as not one hearing has been called or scheduled.
The White House’s lie on Berwick is so blatant, it’s been rejected by both sides — criticized by Ruth Marcus from the left and by the Wall Street Journal on the right. Even the New York Times didn’t buy the White House’s explanation, reporting: “The recess appointment was somewhat unusual because the Senate is in recess for less than two weeks and senators were still waiting for Dr. Berwick to submit responses to some of their requests for information.”
Understand, President Obama is not just circumventing the approval process, he’s circumventing the “basic vetting standards” process — Berwick is avoiding outstanding questions from the Senate, including requests for additional documentation considered standard for nominees. Today, The Hill reports on many of the questions that have arisen about Berwick’s funding sources for his foundation. These questions have yet to be answered, and expect more digging in the days ahead from myself and health care focused reporters.
As head of CMS, Berwick represents a worse step than any policy actually contained within Obamacare. I’ve said repeatedly this legislation was, more than anything, about authority — the redistribution and enhancement of Washington regulators at the loss of states, doctors, and the marketplace. The vast majority of that authority now belongs to Berwick. As Avik Roy says in our podcast, Obamacare was a decision that bureaucrats will micromanage your health care — Berwick’s position will determine how they micromanage your health care.
Thanks to the White House’s decision, Berwick now has unprecedented power, without answering one question of significance, to apply his radical views to the lives and health care of every American.

*I* pay my health care out of pocket. Because I pay up front, in fact, I can negotiate a lower price, because I'm paying the bill, instead of, say, the government – who pays 60 to 80 percent of it, on a good day.
THAT is market forces at work, DESPITE the disruptive influence of government intrusion.
Unfortunately, Obamacare, in addition to rationing (Berwick's self proclaimed method for providing government run health care), outlaws self payment in favor of the government intrusion method.

It seems to me America has taken on the status of a car wreck along a highway. Everyone is slowing down to take a look. With each new appointee. the comments gurgle and bubble with insights about how Obama is really, really un-American. Well, he is. If the Republicans do not immediately start proceedings leading towards impeachment, the damage will be too great to rectify after Obama goes away – if he ever does. How can he can seriously share rocket science with Muslim nations via NASA? How can he sue Arizona? How can he allow the disaster in the Gulf to continue by withholding permission to activate ALL possible means to clean up the mess? He is destroying the economy by overstepping his authority, which is still limited by the Constitution. He is violating his oath of office daily. Time to act? I think so.

What has been detrimental is the government regulations that STIFLE the free market forces. Do a google search on mandates each state has on their health insurers. Why do I have to by a plan that covers smoking sessation?, mental health care?, etc. Each person should be able to determine what level of coverage, if ANY is best for them, NOT the government. Also, give me an example of a country with a population of over 1 million where universal health care actually works, and by works I mean delivers the care (should be shown by mortality rates) and has reduced overal health care costs. And please back it up with some facts. I won't hold my breath.

This president has proven, time and time again, that he doesn't care what is in the Constitution. He feels he is superior to everything and everyone.
I have to say as one who has been a recipient of our medicaid services along with my three children for many years that I am worried. My eldest daughter just turned 18 and is severely mentally disabled with a rare syndrome. I have not been able to work for most of her life as a child under the age of 18 in order to ensure she doesn't loose her medicaid and to care for her. This in turn has put myself and my two other daughters on medicaid and food stamps as well. Now that she is 18 I can finally work again with out it effecting her having coverage. She has waiver which will help with in home care for me to work. I have cried over the years with the frustration of helplessness our system perpetuates. I worry my new found relief that we don't have to be stuck at a limited income anymore will become pointless because everything could change now. I don't know what to expect. Will they change the in home services and then I won't be able to work because there won't be any help for her care? Will they decide it's cheaper to put her in a home? Which I could never do and we will be back at square one. Every time I hear some politician tell me they are gong to help I want to scream into the T.V. thanks for making it even harder! If she could have just had coverage and I could have worked paid taxes and had a co-pay it would have cost less to the government because myself and my other two kids wouldn't have needed anything else. The whole thing is insane!

In the UK socialized medicine evolved into a bifurcated system. The upperclass pay for their care and can come here to get the best care possible, everyone else waits in line to die. Our system will evolve over the decades similarly, with one vital difference, the wealthy will have to deal with shortages that no amount of wealth can fix. Imagine your a wealthy guy or gal looking at your 10 year old, 20 years from now he or she going to get cancer, and no amount of money will buy him his medicine. Why? Because it simply will not exist because the capital and equipment to create it will be decimated by socialism.

Pull a John Galt. It seems the most humane way. Or stop paying taxes "voluntarily" through the paycheck deductions. Maybe become an independent contractor – I have done this successfully in many places. The gathering on 8-28 I keep hearing about (and many other demonstrations as well) will show that we are united. That is, if the threats from the radical left (Shazzbot or whatever his name is), don't deter many of us from showing up. (He wants to kill babies!) It's a good question. The fear lately is almost palpable in whatever public setting I find myself. But I live in Arizona so that might have something to do with that sense of unease. Life is not going on as before, it seems. On a personal level, ensure that your faith is strong and based on Truth. (Let's not quibble here, okay?) I have written to John Kyl many times and he usually answers me. I gave up on McCain. Make sure only those who believe in America's uniqueness are elected – not like Raul Grijalva who has asked for people to actually boycott his own constituency. Having worked for 39 years in the health care industry with providers and health insurers I have never found an inherent superiority of private industry compared with government in running health programs. I am supremely more comfortable with Dr. Berwick than with such private industry leaders as the prior CEO of United Health who basically pillaged the market for his personal gain or the former CEO of Columbia Health who presided over a company that garnered wealth by inappropriately billing the government. Frankly, many of the comments I have read here attacking Dr. Berwick are strident and appear to be baseless.
