Obama’s Individual Health Care Mandate is Unconstitutional
by Brian DarlingThe Senate is debating the future of American health care, yet one very important issue has yet to get a full and fair debate. Is the individual mandate that forces citizens to purchase health care insurance a constitutional power of the federal government? When House Speaker Nancy Pelosi (D-Ca.) was asked this question, she answered with the non sequitur “are you serious?” Conservatives who respect the idea that the constitution maps out a federal government with limited powers would answer with a loud — “Hell No.”

The Heritage Foundation and the American Center for Law & Justice (ACLJ) recently released legal analysis calling into serious question the constitutionality of the Congress’s plan to force all citizens to purchase health insurance. These conservative institutions argue that the unprecedented idea, a mandate that all Americans be forced into a contractual agreement with a private party for health insurance, is not a constitutionally permissible activity by the federal government. My sources tell me that this issue will be raised during the Senate debate on ObamaCare very soon and may open another front in the war against ObamaCare.
The Heritage Foundation argues that the federal government has never required all Americans to buy any good or service. The individual heath insurance mandate is truly unprecedented.
An individual mandate to enter into a contract with or buy a particular product from a private party, with tax penalties to enforce it, is unprecedented — not just in scope but in kind — an unconstitutional as a matter of first principles and under any reasonable reading of judicial precedents.
One of the goals of our Founding Fathers was to set up a federal government with limited powers. Article 1 of the Constitution gives Congress powers and some powers “remain beyond Congress’s reach.”
Nowhere in the Constitution is Congress given the power to mandate that an individual enter into a contract with a private party or purchase a good or service and, as this paper will explain, no decision or present doctrine of the Supreme Court justifies such a claim of power.
The proponents of expansive federal power hang their hat on the “Commerce Clause” for Congress’s authority to mandate health care insurance for citizens.
Proponents of the individual mandate are contending that, under its power to “regulate commerce…among the several states,” Congress may regulate the doing of nothing at all! In other words, the statute purports to convert inactivity into a class of activity.
Voting is not mandated, but under this precedent, one could argue that the federal government could force citizens to vote against their will. Under the big government line of reasoning, the federal government could have tossed aside Cash for Clunkers, the failed government program to give away billions in subsidies to spur the purchasing of cars, and mandate that citizens buy a car from an American car company of their choice. Would this precedent allow the feds to say that you shall buy insurance and you shall buy it from a certain company? If this mandate is allowed to stand, it would “be the first use of the Commerce Clause to universally mandate an activity by all citizens of the United States.”
The most common argument used to justify a federal mandate to purchase health insurance is the talking point that states are allowed to force individuals to buy car insurance before they are allowed to drive. “There is a fundamental constitutional difference between the inherent police powers of the states and the enumerated powers of the national government.” Not to mention that driving is a voluntary activity, therefore you don’t have to have auto insurance if you don’t have a car. Something I didn’t realize until I read the paper is that “states require drivers to maintain auto insurance only to cover injuries to others.” The analogy between a state mandating auto insurance for those who drive and mandatory health insurance for those who choose not to purchase it is not a good one for the three reasons mentioned above.
Some, like Ruth Marcus of the Washington Post, don’t think this mandate is a big deal. Others like Hans von Spakovsky at NROnline think the mandate is a dangerous precedent.
If Congress can impose a health-insurance mandate, then there is no limit to what Congress can do, and the Constitution’s limits on congressional power will have essentially been eliminated. As Will Rogers once said, with Congress, every time they make a joke it’s a law, and every time they make a law it’s a joke. Unfortunately, none of us will be able to laugh over this pending abuse of power.
There are thousands of reasons to hate the Senate version of ObamaCare, yet the issue over the constitutionality of the mandate has yet to receive serious consideration. Lovers of small, limited government hope that sanity prevails with the 100 elites making decisions about the future of health care right now in the United States Senate, yet we have minimal confidence that they will end up doing the right thing. Maybe Senate Majority Leader Harry Reid’s new compromise, dropping the public option with a limited expansion of Medicare, will not convince enough of his caucus to pass ObamaCare and America will receive a temporary reprieve from those in Congress who love big government and hate private enterprise.
The bottom line is that if a Senator raises a constitutional point of order against the individual mandate or a Senator requests that the Courts review the issue, then the Senate will finally debate one of the fundamental questions that the Senate, and the House for that matter, should consider every time they review a piece of legislation. Is the legislation permitted under the United States Constitution? Many would argue that the invididual mandate in ObamaCare fails to pass that test.

Social Security was never constitutional, but that never stopped FDR from threatening to appoint extra justices to the Supreme Court to dilute the opposition.
Medicare was never constitutional, but that didn't stop LBJ from pointing to Social Security to double down on unconstitutional policy.
The Supreme Court's existence is outlined in the Constitution, but the number of justices isn't. Congress and the President can threaten to "print" more justices just like they are now printing more money – the new dilutes the value of the old.
The number of justices should be fixed in the Constitution, so Congress and the President can't arbitrarily create more. That is part of our system of checks and balances.
While we're talking about checks and balances, it is also worth mentioning that our Founding Fathers required Federal judges to be confirmed in the Senate. Originally, the Senate was composed of two Senators per state, with both Senators having been appointed by their state's legislature.
The Senate was tasked with confirming judges, as well as other Presidential nominees. This power was given to the Senate, not the House, because Senators representing each state would never give in to the powers that wished for an unlimited consolidation of Federal power.
The House represented the people, and the Senate represented the states. After all, our Federal government is an association of states.
This provided an important check and balance, because Senators appointed by states would never go along with a massive and unconstitutional expansion of Federal government that turned the states into relatively tiny government entities, as they are now. The appointment of Senators also made sure that a Federal official (the President) would not have another Federal body (elected Senators) rubber-stamping an unchecked expansion of Federal power.
Senators representing the states would never approve judges calling for an infantilization of the states by means of an ever-expanding Federal government, because those Senators represented the states in Congress, just as the House represents the people.
The Seventeenth Amendment, which called for the popular election of Senators, was passed in 1911.
If you wonder where your activist judges came from, look to the Seventeenth Amendment's repeal of Senatorial appointments. After its passage, the Senate became part of the Federal political class, rather than a delegation representing the states.
After that, it wasn't long before the Federal budget started exploding, engulfing more efficient local government. Today, with the exception of the big states like California and New York, most states have budgets smaller than most of the Federal divisions.
Our states have become inferior to the various Federal bureaucracies.
The Federal government is too big and too distant from the people it claims to represent. It is no wonder there is so much waste and electoral disconnect.

Joe Paterno is quoted as saying “If you take care of the little things, the big things will take care of themselves.” This is the current strategy, if you can't flat out pass something big, break it up into several little parts & pass it in several other bills. If they pass the Individual Mandate in this bill, as the article states, this will opens the lid to a Pandora's Box. And once the Fed has power over something, be damned if the are going to relinquish it.

You are right. I would love to get their salaries, healthcare benefits, and let's not forget their retirement perc's. As I recall, they were only supposed to be in session for 6 weeks out of the year, based on the original constitution. Maybe if they spent less time (and made less money – who gets a annual salary for 6 weeks of work), maybe they wouldn't have time to spend our money.

You are correct…….. However, if you live in the state of CA that's the LAST thing we need. Our state is run by unions, state & government employees and their spending has been out of control for years. As goes the state of CA, as goes the country… pretty scary, but that's where we are headed. It's sad that the unions, public workers, and people who don't actually pay taxes override all of our votes.

Thank you for that information. It is really helpful in understanding the current situation. I have thought for some time that our representatives, being paid by the federal government rather than by their respective states, is a serious conflict of interest. If our Senators (and perhaps our Representatives) were on the state's payrolls, then they would also be more subject to the will of their state's politics. Their pay and benefit packages (yes, that includes insurance) should be paid and defined their state. This could solve this conflict of interest.
Frankly, I am surprised that when the Constitution was mentioned, Pelosi didn't simply ask, " What is that?"

California's state legislature is overrun with corruption, big spending, and special interests. It represents much of what we might consider "politics at its worst."
As corrupt as a state's legislature might be, they still would never appoint Senators seeking an unlimited expansion of Federal power.
Why?
Simple. Politicians want power for themselves. Crooked politicians at the state level aren't going to appoint Senators to go to DC and reduce the power of the state, because that reduces the largesse available to the very people who would have been appointing the Senators in the first place.
What state legislature, whether honest or corrupt, would send Senators to DC to subjugate the very legislature that sent them there?
This is why checks and balances are essential to keeping government honest, constitutional, and under control. A competition for political power between the states and the Federal government would prevent the Federal government from accumulating all of the power and the influence.
The judiciary will not stop the expansion of the Federal government. The states lack the power to do so.
The only thing, hypothetically, that can halt the continued metastasis of the Federal government is the people. Despite the multiple safeguards implemented by our Founding Fathers, this is the only one left.
I say "hypothetically" as more and more people are starting to realize that the entire process is rigged. The current bunch of crooks personifies the culture of cronyism and corruption in DC. Politicians look out for each other. Their bottomless pork barrel ensures they will have no problem rounding up enough special interest support and campaign cash to fix the elections.
There are no words for these bums except jail them.
The President and Dems in Congress say that health insurance is a right and thus should be provided by the government. If that's the case then mustn't they then supply us all with guns as we have the RIGHT to bare arms? Should we not then be required to speak non stop as we have the RIGHT to free speech? Even in some Bizzarro world, where health insurance somehow is a right, to infer that one must practice or utilize said right is ludicrous. When you are forced to do something, it is not a right (as there is not a choice), it is a law. This being said a law is not a right and must pass the muster of constitutionality. Finally, a law that requires one to enter into a contract because you merely exist is not in anyform under any one of the 18 enumerated powers.

Good write! But we are starting to run out of options. There is a group called the 10th Amendment Center that is been around awhile but is really gaining momentum now. We, as States, can nullify anything that comes out of DC., we just gotta rally around each other and become huge. Spread the word, join this group. Come to think about it if the government had there way we would have to buy insurance. Then they will be telling us we have to buy organic underwear, just incase we get hungry we can eat it. Hemp clothes so if we feel a pain we can smoke it. Then they will get serious and have us all buy nothing but GM cars because the government runs it. With Pelosi overseeing GM, I hear they no longer have a right turn indicator they can only go left. Then we will all bank at the government banks where the president of that bank makes $27k per year since that is the national average earning in the US. We will only be able to buy GE products because they own the government broadcasting network (seriously they are buying Comcast cable, and no one has said monopoly yet?).
It will be a cold day in H for the government to have that control but that is exactly what they want.
I would like to see all the coal electric plants shut down for 10 days. Just to show how nice it will be with the Obama plan. Since 50% or more of our energy is produced via coal that may wake some people up.
Then when they turn the plants back on double their rates just to show how that tax credit thing will help them. We already know it won't change the weather. So these plants might as well bank some profits now before they are mothballed by the Hope and Change Nuts.

Actually they can. If they move the top age down for Medicare to 55 and the bottom aget for medicaid up to 20 years old there is only a small gap of people not covered by the government. So yes if this bill passes there are just 35 years of freedom a US citizen will have in their lives and most of the time the government will have complete access to their health, bank accounts and freedom.
We hope it is a bloodbath in 2010 but the GOP has to wise up to the fact that the Tea Party Candidates need their support when facing RINOs. Florida has that situation with Chalie vs Rubio. Rubio is the real conservative and Charlie is the RINO with the full backing of the GOP. Either the GOP gets smart or changes to the CGOP for the conservative branch.

This issue needs more attention. I don't think that most people know exactly what the individual mandate will mean. It's absolutely amazing that there isn't more outrage over this. Obama ran AGAINST the individual mandate in the primaries, and bashed Hillary and John-Boy over the head with it. What's scary is that the republicans are not going to raise a stink about it, because the insurance companies have told everyone that the only way they can accept the uninsured is if everyone is required to sign up. If Snake Eyes Pelosi and her fellow travelers get reelected next year, this country will implode, and it won't be pleasant…..
