The O’Keefe Affair: Obviously a Media Malfunction

When the Christmas Day panty bomber was arrested for trying to blow up himself and the plane he rode in on, he was questioned for approximately 50 minutes before an attorney was brought in to advise him. What happened next? Mister Burning Briefs clammed up.
Contrast that with James O’Keefe, American citizen, who was denied an attorney for 28 hours after he was arrested and accused of trying to tamper with the phones of Louisiana Sen. Mary Landrieu. During that time, the FBI issued a press release on the arrest and leaked the criminal complaint. The mainstream media salivated, while ACORN’s Bertha Lewis scambled to appear before TV cameras.
The Christmas Day bomber was given Constitutional rights and Miranda’d within an hour of his arrest but a U.S. citizen was not given a lawyer until more than a day had passed?
How — and why — did a terror suspect get kid glove legal treatment? And as another conservative journalist asked, “Where was the ‘don’t rush to judgment’ media when someone killed innocents while shouting Allah Akbar? But at the first hint of a scandal, they crucify O’Keefe?”
On Monday night, O’Keefe appeared on the Sean Hannity TV program, his first public appearance since the arrest. When asked by Hannity about the incident, O’Keefe declined to say too much. “I just can’t comment any further. There’s an investigation ongoing, and I’m just going to have to leave it at that.”
Hannity asked if he recorded the entire incident. O’Keefe said he did.
Hannity: “If we were to show this video tonight, what would people conclude?”
O’Keefe: “That this is a huge misunderstanding, I think… you know, like in all my videos, like in my ACORN videos, I’m trying to get to the bottom of something. I’m trying to expose the truth. I’m trying to get to the true intent about what these people think about their constituents. I’m trying to show the American people what, are they concerned about their constituents. And that’s what I was trying to do.”
Hannity pressed him about what was on the videotapes now in the possession of the government.
O’Keefe: “Our entire visit to the Senator’s office… actually there’s two different cameras. One was on the helmet, and one was on the cellphone. So there’s tapes, the government has them in possession and I want them to be released because they refute a lot of these claims being made by the media.”
O’Keefe says the media jumped the gun and tried to destroy his reputation.
Don Surber at the Dailymail asks if James O’Keefe was framed.
“That’s the rumor swirling after the U.S. attorney recused himself from the criminal case in which O’Keefe and 3 others were arrested at Democratic Senator Mary Landrieu’s office in New Orleans. However, the U.S. attorney was a Bush appointee who was championed by Landrieu to keep his job under Obama. I am willing to bet this is the reason for his recusal, and if so, that is an honorable thing to do.”
Surber suggests that the Republicans on the House and Senate Judiciary committees might want to demand an investigation of this case.
Andrew Breitbart, publisher of BigGovernment.com said in a Fox News interview on Monday that O’Keefe was ‘framed’ by the media and the U.S. attorney’s office. Hours after that interview, Jim Letten, U.S. attorney for the Eastern District of Louisiana recused himself from the case,” according to a Fox News report.
“James O’Keefe sat in jail for 28 hours without access to an attorney, while the U.S. attorney leaked the information about his arrest, helping the media frame it as ‘Watergate Junior,’” Breitbart said.
“Breitbart said he though the U.S. attorney’s effort was part of a payback scheme against O’Keefe, who posed as a pimp and prostitute with another citizen journalist to enter ACORN offices around the country and get advice on how to apply for federal housing grants for a brothel.
“It’s tied to the Justice Department. And we’ve been very aggressive in asking (Attorney General) Eric Holder to investigate what’s seen on these ACORN tapes and he’s ignored it,” Breitbart said of the media ploy.”
FWIW, I don’t think Letten’s recusal has anything to do with Breitbart, his claims, or even O’Keefe. Letten recused himself, not his office, and the first assistant Jan Maselli Mann will take over the prosecution. My guess is Letten’s recusal is related to the fact that one of the suspects is the son of the U.S. Attorney in Shreveport, who is likely a Letten acquaintance and the basis for his recusal.”
O’Keefe is accusing members of the mainstream media of journalism malpractice over its coverage of his arrest and the circumstances surrounding it.
Obviously a media malfunction.

I'm not sure if "framed" is the right word. That implies that false accusations were made, and that false evidence was presented. As far as I know, all the official accusations are true, they just don't include anything illegal. And of course there has been no evidence at all, false or otherwise, presented.
Episodes like this further expose the MSM as willing sycophants to their masters in Washington, right and left. As “We the People,” return this country closer to it’s founding the press needs to be flipped as well, to begin to fulfill their constitutional obligations, keeping an eye on government. What O’Keefe, and Giles have done is hasten the death spiral of the failing modern press, well done guys you’re heroes of real America!
The Christmas Day Bomber will be going to jail for a long time (Obama already said so.). O'Keefe will be going to jail for a few months, tops. (And rightfully so. It's a shame someone would pretend to be a repairman in order to fraudulantly access the phone box.)

Is the situation that he went into the senator's office dressed as a repair man. Used the repair man status as an excuse to pick up the phone to see if it worked (while secretly recording it) and one of the guys went into where the phone lines come in under the auspice of checking the lines and were then going to record on tape the fact that the phone lines were fine?
Correct me if I am wrong.I think he is guilty of chasing after a non story in his usual silly way only this target, although probably just as smarmy, is just more on guard and more sophisticated than the idiots working at ACORN.
I think it will be very telling when the tapes come out. You may want to keep your powder dry until then.
I think there should be an investigation into what was really going on with the phone system, so let's be clear about that. If in fact the Rep from LA had shut the public out from accessing her, to voice their opinions and concerns. She should be in deep trouble for such a stunt, and if it took a couple of investigators (probing to find the truth), so be it.
The whole country needs flipping if you ask me: education, government, labor, media…all of it.

THIS JUST IN: Obama is dismantling NASA. Thousands of engineers and scientists to be out of work. Great opportunity for these redundants at NASA to do something good for a change. They can be re-trained to become GREEN ENGINEERS. They can be put to productive employment blowing insulation and caulking windows on all the foreclosed homes in Amerika. They should be able to learn these new and important skills quickly. Afterall it is not like caulking windows is ROCKET SCIENCE.

I think they'll be fine. There were 3 witnesses and there's a whole lot of attention on this story now. There are also quite a few important figures with reputations to protect involved.
Interesting contrast in treatment. It is almost as if they identify MORE with the panty bomber than an American citizen. How much more proof do we need? So lets see: A man trying to blow up a plane of ~300 people is allowed to gain legal rep. after 50 minutes of questioning by the FBI compared to a US citizen who means no harm to anyone, tries to corner and question a US Sen, who openly took a bribe of $300M for her vote on the healthcare reform bill, is arrested by the same FBI and held for 28 hours without legal rep while they contact and leak the arrest details to the media which then reports knowingly false details…How proud the left must be.

I recall a major news station, maybe it was CBS or perhaps a journalist or two from 60 Minutes, some years back going undercover to uncover fraudulent repair work in auto shops.
So they "fraudulently" accessed a phone box? How do you know that? I don't remember reading that in the FBI affidavit. Thought it was "manipulating" (translation: "handling") a phone.
It appears that you're mistating the law. Here is what Washington Post wrote about the applicable laws:

Before you think that O'Keefe might be headed to the slammer for five years, here's the glaring exception:

The fact that O'Keefe had a camera on the entire time will likely provide evidence enough to either exonerate or incriminate him and his colleagues.
One of many definitions for "frame": to cause an innocent person to be blamed for a crime; to contrive evidence so that someone appears to be guilty.
Newspapers and major news stations are meant to be the purveyors of truth… if any of them say someone is "guilty" long before all the facts are known, they have polluted public opinion. They have contrived information to make it appear that someone is indeed guilty – even retractions cannot undo the damage, and many in the case of O'Keefe have not made retractions, or buried them on Page 27.
David Shuster said that O'Keefe was guilty of federal crimes – he put that on Twitter. MSNBC, major newspapers across the country, FBI leaks… all had a hand in spewing false information about O'Keefe's arrest. All had a role in the contriving of a vast amount of information that was false, incomplete, or non-conclusive. If I were O'Keefe and this were to go to trial, I would sue the government and major media for tainting the jury pool with this crap. "Innocent until proven guilty" only applies to terrorists and liberals, huh?
So, based on the definition of the word "framed," and all involved the role in the framing of O'Keefe, your outrage is downright childish and ignorant. But expected… liberals prefer to avoid facts unless it suits them.
Holding him 28 hours without access to a lawyer with the FBI issuing a press release on the arrest and leaking the criminal complaint isn't being framed, but it is sure making use of the opportunity to do the same thing. Brietbart is correct.
