Obama’s Continued War on the Market

In a further attack on the housing market, the New York Times recently reported that President Obama may be amending his loan modification program to make it even more difficult for defaulting homeowners to be foreclosed upon. The Times states:
The Obama administration, under intense pressure to help millions of people in danger of losing their homes, is considering a ban on foreclosures unless they have first been examined for potential modification, according to a set of draft proposals.
That would raise the stakes from the current practice, which strongly encourages lenders to evaluate defaulting borrowers for a modification but does not make it mandatory.
Meg Reilly, a Treasury Department spokeswoman, said Thursday that the proposed foreclosure ban was “one of the many ideas under consideration in the administration’s ongoing housing stabilization efforts.” The proposal was first reported by Bloomberg News.
To be fair, the effects of this program may be minimal, with some interpreting the ban to be more about PR than anything substantive:
Laurie Goodman, a senior managing director at the Amherst Securities Group who has been highly critical of the government’s modification program, said even if the proposal came to pass, it would not be “a major change. We think there is a large public relations element to this.”
…The Mortgage Bankers Association said its members were already doing what the administration was considering.
“Lenders generally go to foreclosure as a measure of last resort, after all other options, including loan modification, are exhausted,” said John Mechem, the trade group’s vice president for public affairs.
Any enhancements the government made to the modification program would be unlikely to stem many foreclosures, said Howard Glaser, a prominent housing consultant.
Regardless of the impact however, this potential loan modification addendum adds insult to the injury of an already wrongheaded and destructive policy, and will only prolong the pain in the housing market.
The reasons for the woes in housing are quite simple. Banks extended mortgages to borrowers that were poor credit risks, and many borrowers took out mortgages that they shouldn’t have either out of speculation or profligacy. That the depression is throwing people out of work and keeping many jobless exacerbates the problem, in that unfortunately many who could have reasonably expected to afford their homes now cannot given their lack of sufficient cash flow. Of course, truly prudent buyers might have saved to purchase their homes outright with cash.
In any event, to fix the housing market requires these folks to be foreclosed upon. Keeping homes off the market artificially suppresses supply, propping up prices that already necessarily needed to fall, as house prices rose to unjustifiable levels due to the Fed’s pump priming, the CRA and the surge in demand these two factors engendered. To keep people in homes they cannot afford besides creating moral hazard and distorting banks’ balance sheets also has the effect of keeping worthy buyers from purchasing homes at decreased prices. It further prevents apartment owners from renting out their excess inventory to underwater and/or insolvent former homeowners. The effects of the government intervention in the housing market are amplified significantly when one considers the volume of securities backed by mortgages not being adequately serviced.
Government has no business in throwing this market into disequilibrium. But President Obama believes otherwise. In campaigning for Harry Reid and while announcing a further imprudent measure to provide $1.5 billion in mortgage relief in five states hit acutely by the downturn, Obama had this to say about the housing market:
“Now, government has a responsibility to help deal with this problem. Government can’t solve this problem alone. We got to be honest about that. Government alone can’t solve this problem. And it shouldn’t…It can’t stop every foreclosure, and tax dollars shouldn’t be used to reward the very irresponsible lenders and borrowers who helped bring about the housing crisis. But what we can do is help families who’ve done everything right stay in their homes whenever possible.”
This is typical Obama. He knows how to frame the issue so that while what he is saying sets a dangerous precedent, he comes off as pragmatic. He uses his rhetoric to appease those being taken advantage of by his policy, while spinning nicely the fact that he is going to screw them over. It is akin to when he defended himself as an “ardent defender of the free market” while touting his massive intervention into all aspects of the economy at the recent “Business Roundtable.”
Every single time he addresses an issue, you can bet that it will follow the same formula: “on the one hand [insert rational, conservative argument], but on the other [insert emotional/generally bleeding heart, liberal argument].” It allows him to come off as a moderate and practical leader while he obfuscates the public by saying nothing. His true stripes only show when he speaks in front of his people.
At the end of the day, the man should be judged by his actions and not his words, and his actions in the housing market are illustrative of his overall view of government’s role in the economy. Wherever market forces are working to correct the imbalances and malinvestments of a 70-year credit expansion, this President is going to implement policies to prevent the market from working and perpetuate an illusory economy.
Factor in his foreign policy and treatment of our war with Islam, and you get the sense that this President is intentionally trying to hurt this country. Somewhere, Jeremiah Wright is smiling. Ironically, for all of President Obama’s apologies for our arrogance and destructiveness, as he helps sully our preeminence and power with his own policies, he remains the most arrogant and destructive American of all.

i love this idea, once he signs the new law, how about everybody who has integrity, stop paying our bills, because the president is going to stop the bank from taking our houses. i think this is wonderful, why doesn't he make another law by fiat, nobody can be cancelled by their insurance company even if they don't pay premiums. then we can lower the cost of healthcare. i'm sure the banks, and insurance companies will stay in business once these things are done. banks don't need the money i agreed to pay them, and insurance companies don't need money to pay my doctor. unicorns and rainbows for everybody!!

Hanzo, at the very least, the U-6 measurement of unemployment of around 17% is the closest thing we have to a real unemployment rate. That being said, unemployment, like inflation and all the other govt data is watered down. John Williams over at Shadow Stats (http://www.shadowstats.com/) probably has numbers that are closest to being accurate. Government has gotten further and further away from producing data with any real meaning or credibility out of expedience and likely more insidious motives.

But as far as economice commons sense goes…………..didn't I read that only 7% of his administration has ANY experience in the 'real world' of business??? We are seeing the dismantling of our free market system, one baby step at a time. But that's a lot of steps over 4 years.

But what everyone fails to realize is that it doesn't cover everyone. My wife has been out of work for 8 months now. I lost mine a year ago and am now 'underemployed'. We are grossing (even with unemployment insurance) only 44% of what we were making 2 years ago. Back then we were paying down our debt, had 6 months in expenses in savings, and had a decent 401k. We were not living above our means (I own two paid for cars, a '98 with 200k miles and a '99 with 168k miles). We now have $950 more outgoing than incoming a month. Hence, chpt 7. Our mortgage company refused to do the gov't mod, but rather theirs. To 'qualify', I have to be caught up on the mortgage fully (including late fees) which now is 2 months behind. I also have to pay early for 6 straight months, ask for an extension, then pay again early for another 18 straight months before I qualify for a perm mod. With the gov't, it is just 3 months straight I believe. I told them to take my home (which is 37% underwater) and enjoy it. I will be living in a small apartment for the next 10 years, but such is life. My credit score 2 years ago was 790. Hers, 810. Now we are both in the low 5's.
Amen. After selling my home in LA to take a transfer to Vegas I fully intended to buy again but in 2004 and '05 it was crazy. The realtors and lenders were all over me to buy two and three houses and promised me huge profits on very little down. The RE agents were advising me to offer at least 10-15% over asking just to be considered for a property, but that that was no problem as I would make it back in a few months. HUH??____That was enough for me. Why the hell would I offer a dime more for anything than the seller was asking??____ And every RE agent I dealt with had a sister, uncle, cousin, spouse who could get me financed no problem! After a couple of months I gave up and decided to rent for a while and wait it out. And so I did and still do. And I'm not going near it anytime soon.
We have an inside joke in my office "Now is the best time to buy! Buy 3 or 4!" as the solicitations from realtors keep coming…. and the values continue to drop! They still haven't stopped!
You are right. I hope some of these sleaze bags have their day in the barrel. They deserve it as they are as much a part of this as anyone.
Let the free market be free, and take the government schacels off of all of us. Regulation is not the answer, because if it did we would not be in mess otherwise.

Doesn’t anybody know that these agents are liable and guilty of malpractice? I don’t think the general public knows that these licensed agents can’t say or do these things. Just the act and representation makes them liable for damages, and they would all lose their license. You report them to the Department of Real Estate and the shit hits the fan.
The real casualty here is a fundamental American right…the right to own property.
This issue is masked by a soft real estate market and the fact that much of the property in question is owned by institutions, but under the surface is the seachange of abuse of power at its worst. Eminent domain has nothing on this practice.
What Washington is telling us here is that THEY control the properties in question. People default on their loans and the holders of the paper have the right to seize back the collateral. Right?

Well written article Andrew. Another contributing factor in the malaise economy is the compassionate extension of unemployment compensation. Without trying to oversimplify it all comes back to human nature. For anyone to change the status quo in their life they need a motivating factor (pain). Much like the welfare state promotes more welfare, extending unemployment benefits necessarily extends unemployment.
The BIG lie that progressives perpetuate is their compassionate concern for the 'under priviledged' is really a form of enslavement. Once the government becomes the sole provider of all life's basic necessities, the motivation to do anything to improve one's lot in life devolves into begrudgingly accepting what you get and keep 'bitching' for more. Kinda like what unions do!
Obama needed to do this to provide work for all the NASA scientists and engineers he just made redundant. After all anyone who can send a rocket into outer space can figure out how to blow insulation.

What we've got to be honest about is that :
1. The government has no Constitutional authority to rewrite or alter any contract – whether it is one of the parties involved or not. Market failures are caused by contract non-enforcement. Take a class, professor.
2. The government not only can't solve this problem alone, it can't solve it period. Only lenders can solve this problem, either by voluntarily changing the terms, or through the foreclosure process. It's their decision, not yours.
3. Government has no responsibility to help any citizen, much less someone that got themselves into their own mess.
That's the way America! Just think, Obama's "Mao" is proud of you! You beat Germany's Hitler! Just wait and see! At least you were politically correct. Right?

Obama has already set a precedent by negating the contracts with the bond holders of GM and Chrysler in the government takeover of these companies. If this "program" goes through, he is setting another dangerous precedent in negating the contractual obligations between lender and borrower which could ultimately lead to the loss of private property rights in this country. He's got his proverbial foot in the door now and as history shows, it doesn't take much to push the door all the way open. November can't get here too soon.

I dunno folks, this might not be such a bad policy, and just think how we could apply the same principle to further "help" the economy:
"Ban" businesses from firing anybody and unemployment stops getting worse.
"Ban" banks from foreclosing on, or refusing credit to, ANY "business".
"Stimulate" employment by giving a "tax credit" for hiring. (Of course the tax credit will count as income, and thus be taxable!).
Raise the tax rate to 100% so the oh-so-wise-ones can "target" "aid" wherever needed at any time.
Isn't that the essence of Hope and Change?

This sounds too much like the mentality of the permanent residents of the welfare state. If someone buys a house that they could not afford they made a bad decision, period! Where is the personal accountability!?! If they were gullible enough to believe that the real estate agent can properly predict the future, and truly believe that the housing prices will continue to rise just because the real estate agent told them so, then they are fools. And as the old adage goes, “a fool and his money are soon parted.” In this case, lawsuits are just another way to redistribute peoples’ consequences for their actions to the masses. It is really no different than the progressives’ fix to things. Brother I have read your posts; I know you are better than that.

An unintended (presumably) consequence of this move will be the tightening of credit markets. Borrowers with less than a perfect FICO score and 20 or even 30% down are simply not going to be approved. Lenders are not going to take the risk of having to "sit" on properties with no payments coming in until The One tells them it's OK to foreclose.

Consequently, people like me, who are conservative and prudent, who are fortunate enough to pay cash for major purchases, are now penalized for doing so. Everyone else that has screwed the pooch gets a free pass, a government bailout, a loan modification, and we are left holding the bag.

In the last 20 years, how many times has the value of Real Property gone down? The Code-of-Ethics and fiduciary responsibilities are for a reason. Should we just let these fiduciaries continue this negligent and fraudulent behavior? If the buyers are knowledgeable, and did not rely on the negligent representations, then I would agree with you. A lot of these people getting foreclosed, are and were ignorant. It’s easy to call them “fools” if we are knowledgeable.

I agree that something should be done to hold dishonest fiduciaries responsible for their misdeeds (they have compromised their trusted position, especially in cases such as rockstone discussed above), and maybe I was a bit hasty in my response to you (I immediately envisioned the typical bandwagon lawsuits of any real estate agent that ever made a positive investment statement, such as when you just said, “In the last 20 years, how many times has the value of Real Property gone down?”, suddenly being sued for millions by someone who made an irresponsible purchase. Lawsuits focused against the blatantly negligent trustees, such as in rockstones response, focused on the removal of the agent’s license and real damages (not frivolous intangibles such as betrayal of trust for an additional $10 million) are in order.
I’m sure that in my hastiness, and generally cynical attitude with the way our nation has been heading; I read too much into your statement, sorry.
