They weren't impersonating federal (or other) officials (a serious charge), and the "federal property" might depend on whether it was a campaign office or a Senate (official business) office — that would seem to make a big difference. Either way, of course, it's "snooping," but it's a good bet (I'd say sure thing) that O'Keefe was pursuing a story, not planning a heist or sabotage.

What I find disturbing is all the talk about "the law" and yet the reason the "lawmakers" in this country are so well insulated is because they write and pass laws for just that purpose. Take New York for example where O'Keefe is facing charges because he recorded people without their consent. The only reason those laws even exist is not to protect the private citizen from being filmed but to protect corrupt politicians who don't want anything caught on tape to be admissible and thereby released to the public.

If he did something stupid and criminal, he deserves to face justice. However, we are very far from knowing everything about this, and media speculation has already created some "facts" of the case.

This may wind up being the next Duke Lacrosse team story where the intial firestorm over the alleged "facts" of the case wound up being nothing but false accusations played for political gain. Unfortunately, the Duke Lacrosse members, though exonerated, were already publically tarred and feathered, and at the end of the day with this case, that will be all that matters to many on the Left, not truth about the actual incident itself, but that they were able to use it to destroy someone who hurt them.

If you read the affadavit, James never hid the fact that he was recording the 'encounter' on his cell phone. Also, the chronology ends right after the "repairmen" said they left their credentials in their car – so…did Witness 2 take them to the switch room or not? Seems like this story is incomplete – item 8 and item 9 don't seem to be sequential events?

They can then reveal that congress has reinstated ACORN funding, which most Americans do not know…. and that Whistleblowers to govmint corruption are targets, not valued.

Read the affidavit, there is no evidence they were trying to tamper with anything, just gain access. It is the investigators conclusion the intent was to tamper but the state will need to prove this. What is missing is the physical evidence, no real phone tools were found, no bugs, no electronics just a cell phone or two. I suspect that's why they were let out on bail.

O'Keefe was not one of the individuals pretending to be a repair man either. He was just running the camera.

You also assume someone put him up to this. My understanding is O'keefe is an independent film maker. Note the word Independent. This is also consistent with the Pimp and Prostitute videos. Those were all made as an independent project as well.
