Rather than carryover National Labor Relations Board (NLRB) nominee and current AFL-CIO and Service Employees International Union lawyer Craig Becker until next year like most of president Obama’s nominees, the U.S. Senate sent a message back to the President about his nominations. While not a severed horse head in his bed … it is like the canary in the coal-mine.

Right after the Becker nomination, The National Right to Work Committee posted this President Obama Personnel Alert video regarding Becker (link here) along with the Committee’s Becker Alert report (link here).

The report highlights the Association of Community Organizations for Reform Now (ACORN) Founder Wade Rathke’s ringing endorsement of Obama’s Becker nomination. Rathke wrote, “Here’s a big win no matter how you shake and bake it: Craig Becker being nominated for a seat on the National Labor Relations Board (NLRB)!”

Corrected: The federal enforcement agency involved in the incident with Mr. Yon at Sea-Tac was previously misidentified as the Transportation Security Administration (TSA).  The article has been updated to reflect that it was Customs and Border Protection (CBP) agents who questioned and detained Mr. Yon.

Award winning war correspondent Michael Yon was detained and handcuffed at Seattle-Tacoma International Airport Yesterday by Customs and Border Protection (CBP) personnel.

Yon was returning to the United States from Hong Kong to visit family when CBP officials stopped him during a routine security checkpoint.  “Officials asked me what was in my bag—nothing wrong with this question,” Yon said in an interview with BigGovernment.com.  “I told them it was normal stuff, clothes and toothbrushes.”

At this point the Customs officials escorted Yon to a designated screening area where they examined the contents of his bag.  “Then they asked me how much money I make,” Yon said.  Yon suggested to the Customs officials that the question was inappropriate and unrelated to transportation security.  The award-winning blogger noted another CBP officer approached Yon: “he asked who do I work for.”  ”I did not answer the question which clearly was upsetting to the [CBP] officers.”

Yon was escorted to a room elsewhere in the airport where he said he remained silent during much of the questioning.   According to Yon, “they handcuffed me for failing to cooperate.  They said I was impeding their ability to do their job.”

The late George Stigler, winner of the Nobel Prize in economics, is famous in part because of his work on “regulatory capture,” which occurs when interest groups use the coercive power of government to thwart competition and undeservedly line their own pockets.

A perfect (and distasteful) example of this can be found in today’s Washington Post, which reports that the IRS plans to impose new regulations dictating who can prepare tax returns. Not surprisingly, the new rules have the support of big tax preparation shops such as H&R Block and Jackson Hewitt, which see this as an opportunity to squeeze smaller competitors out of the market.

The IRS and the big firms claim more regulations are needed to protect consumers from shoddy work, but this is the usual rationale for licensing laws and other government-imposed barriers to entry and the Institute for Justice repeatedly has shown such rules are designed to benefit insiders rather than consumers.

Tax preparers do make many mistakes, to be sure, but that is a reflection of a nightmarish tax code, and the annual tax test conducted by Money magazine showed that even the most-skilled professionals – such as CPAs, tax lawyers, and enrolled agents – were unable to figure out how to correctly fill out a hypothetical family’s tax return. But since the IRS routinely makes major mistakes as well, perhaps the moral of the story is that we need fundamental tax reform, not IRS rules to create a cartel for the benefit of H&R Block and other big firms. Would any of this be an issue if we had a flat tax or national sales tax?

According to Reuters, Dutch authorities have announced that Umar Farouk Abdul Mutallab, the terrorist who penetrated the Dutch security system on Christmas Day on Flight 253 to Detroit, acted alone with no accomplices at the Amsterdam airport.

This directly contradicts the first-hand, eye-witness account from Kurt Haskell, a lawyer from Taylor, Michigan who was on board Flight 253.  We have reported Mr. Haskell’s account here at Big Government as well as his interview with Andrew Breitbart on The Dennis Miller Show, the nationally syndicated radio program on Westwood One.

Mr. Haskell tells us he is sticking to his story.  “I’m not surprised, we expected this.  They are trying to discredit me without actually PROVING me wrong.  But, I’m not going to shut-up about this.“

Esquire has an interview with ACORN CEO Bertha Lewis:

I called ACORN to get a response from Bertha Lewis, the group’s CEO. “I don’t think the conservative right will ever be satisfied,” she told me. “They’re not going to stop because they’re raising money on us every day — we’re a nice, simple convenient bogeyman.”

Still, Lewis seemed almost shell-shocked: “We can’t understand this obsession, and the vehemence. They just make up something and keep repeating it over and over — yesterday, I’m cleaning my house and I get a call, someone from my office saying ‘This guy from Breitbart is going crazy saying you were in the White House!’ Apparently some woman named Bertha Lewis visited the White House in September, so automatically they assumed — but it wasn’t me.”

Two ongoing trends I chronicled during 2009 highlight an ironic situation: Leftists remain tough on their domestic political opponents, while lax when it comes to our real common enemies.

As we recently saw with the Christmas airplane-bombing attempt, leftists seem bent on treating terrorists with kid gloves, insisting they receive rights normally reserved for U.S. citizens (even when this means failing to extract timely information that might save lives).

Conversely, leftists play “hardball” when their opponents are not terrorists or criminals, but instead, American businesses and industries.   One such example is the left’s battle against Bisphenol A (BPA), a chemical used for more than a half century to make plastics more durable.

Though clearly less consequential than the war on terror, the Left’s war on BPA serves as a microcosm of the larger attempt to use “junk science” and litigation to redistribute wealth from job-producing American industries into the hands of trial lawyers and liberal special interest groups.

In this regard, the Left’s attempts are reminiscent of their past battle against the insecticide DDT. In the 1960s, many developing nation’s had nearly wiped out malaria, but it came back after DDT was banned.  It did not matter that DDT was harmless to humans – and actually saved lives — the Left attacked it, ultimately causing 50 million preventable deaths.

So, China went big into windmill and solar panel production, causing the media and other liberals to breathlessly swoon over this further evidence of the wisdom of us mandating the things even though all it proves is that China is not dumb.

Rich countries say all weather is now their fault and vow to spend billions on uneconomic, inefficient and intermittent energy sources regardless of their merits or performance as penance and to show their seriousness of purpose in feeling really, really bad about the whole thing they alone talked themselves into. China volunteers to make the machines for us because, without absurd “green” policies of the sort causing energy prices to rise so high that seniors burn books to stay warm — in fact, China rejects the Kyoto agenda precisely because it has sworn off of that sort of poverty and knows what would keep them there — they can do it more cheaply.

And then they go to Copenhagen and hold us up for billions in new, “climate aid”, with more than a whiff of reparations about it because, after all, our government aided and abetted that line of argument.

Just before New Year’s, C-SPAN Chairman and CEO Brian Lamb sent a letter to Congressional leadership, requesting permission to televise negotiations around the final health care reform legislation. The letter was addressed to Speaker Nancy Pelosi, GOP Leader Rep. John Boehner, Senate Majority Leader Harry Reid and GOP Senate Leader Mitch McConnell.

The letter notes:

Now that the process moves to the critical stage of reconciliation between the Chambers, we respectfully request that you all the public full access, through television, to legislation that will affect the lives of every American.

The United States government has shelled out huge sums of money to universities, think tanks, and businesses to study global warming climate change.  The government is poised to dole out even more money for climate-change “solutions” like the cap-and-trade scheme.  With the revelations about the lengths to which the leading group of global warming doomsayers went to “hide the decline” in temperatures in their seminal studies – studies that themselves spawned an avalanche of government spending – the world is seeing that the entire enterprise may be based on a fraud.

In a normal scandal where the government appears to have been ripped off, someone in the legislative or executive branch can usually be counted on to investigate the alleged fraud, if for no other reason than advancing their own political career.  In the case of this scandal, however, the Obama administration and congressional Democrats have calculated that their political interests are best served by ignoring ClimateGate.  This is sure to continue as new scandals emerge.

That leaves only the judicial branch as a place where climate change fraud can be unmasked in a government forum.

Individuals with inside knowledge about scientists, businesses, or any organization who knowingly used false statements to get (or keep) government money to perpetuate the “climate change” machine should consider a lawsuit under the federal False Claims Act.

Everyone keeps saying how lucky we are that the “crotch” bomber on Flight 253 was unable to ignite the explosives hidden in his underwear, but I am sorry to report  that  the attack was a actually a huge success.  The plane was not destroyed and no lives were lost, but the larger, strategic goals of al Qaeda were certainly advanced.

Too many Americans, and many in our Department of Homeland Security, forget that al Qaeda targeted our economic power and symbols on 9/11.   The goal, as Osama bin Laden announced, was to force, or cause the US to take actions, that would erode our economic prosperity and weaken us as a  nation .

Unfortunately, we have given bin Laden a victory he does not deserve.  DHS has, for some time, been unaware that the failure of many of the security measures and procedures that they have championed, has resulted in additional, self inflicted wounds.

Today, in 1968, Alexander Dubceck takes over as head of the Communist Party in Czechoslovakia, ushering in the “Prague Spring” of political and economic reforms. The movement was eventually crushed by the Soviet Union and the reforms dismantled.

Following a positive reception at the 2009 Conservative Political Action Conference (CPAC), the Poker Players Alliance, a million-member strong poker advocacy group, has announced plans to return to CPAC this year.  This announcement mirrors and complements the ongoing ascendancy of limited government conservatism within the conservative movement, and it bodes well for the future of conservatism.

From the late 1990s until 2006, the conservative movement was increasingly influenced by some who wished to expand the power of the then-GOP-controlled federal government.  These big government “conservatives” wanted to use the power of the federal government to address various social issues, including even stopping Americans from playing online poker.  Fortunately, rank-and-file conservatives have been working overtime since the 2006 and 2008 election losses to restore conservatism’s true soul — liberty, free markets, and less regulation — and this is leading to a resurgence in the movement.

UPDATE: According to Politico’s Ben Smith, the Bertha Lewis who went to the White House is not ACORN’s CEO but another woman named “Bertha Lewis.” I contacted Smith to tell him that Big Government would offer a correction if the “administration official” who offered the information went on record and told us who the “other” Bertha Lewis is and got the unnamed administration source to come out from behind the veil of anonymity and use his/her name. So far, according to unnamed White House sources, “different” people with the familiar names of Malik Shabazz, Jeremiah Wright and Bill Ayers were discovered on White House visitors logs. As I skeptically asked on my Twitter account, “What are the odds?”

First thing Monday morning, Smith contacted the White House and White House spokeswoman Jen Psaki came from behind her anonymous veil and confirmed for Smith, “it was a different Bertha Lewis, though she declined to share details about that visitor, citing privacy reasons.”‘

After reading Warner Todd Huston’s article, Tea Parties: The Biggest Mistake We Could Make in 2010, I was incredulous.  It seems misguided to suggest top down management in a time when big companies, big organizations, and big government have received bailouts after spending like drunken thieves or failing in the marketplace. Under what premise can anyone make the case that the solution to our nation’s dilemma is a big organization, especially a Big Tea Party? In all cases big leadership has resulted in big corruption, which is at the root of almost every issue before us.

Since the onset of ‘change we can all believe in’, politicians at all levels seem to constantly point to small businesses as our hope for economic recovery. In an era of “too big to fail,” it would seem obvious that people, regardless of party affiliation, could agree that bigger is not better. I haven’t heard anyone speak of the positive impact that CEO-led mega-banks, automakers, or the Fannies and Freddies will have on economic recovery.

The idea that the grassroots tea party movement should become a third political party is counter productive and borders on the ludicrous. Tea Parties are about government accountability, not joining partisan politics in the corruption and incompetence that threatens American liberty. Our City Councils, State Legislatures, and Congress work for us, and it is high time that we reminded them of this and brought them into the fold.

Jaw-dropping story in today’s Washington Post:

President Obama’s chief counterterrorism adviser on Sunday defended the administration’s decision to try in federal court the man charged with attempting to bomb an airliner on Christmas Day and indicated that he would be offered a plea agreement to persuade him to reveal what he knows about al-Qaeda operations in Yemen.

Umar Farouk Abdulmutallab, the 23-year-old Nigerian charged with the failed attempt on the Amsterdam-to-Detroit flight, was initially “talking to people who detained him” but now has a public defender and “doesn’t have to,” John O. Brennan said on “Fox News Sunday.”

“We have different ways of obtaining information from individuals” in the criminal-justice process, Brennan said on NBC’s “Meet the Press.” “A lot of people . . . understand what they’re facing, and their lawyers recognize that there is advantage to talking to us in terms of plea agreements, [and] we’re going to pursue that.” Brennan told CNN’s “State of the Union” that other terrorism suspects have “given us very valuable information as they’ve gone through the plea-agreement process.”

Rationing Medicare will not require clandestine meetings in smoke filled rooms. Simply reduce physician reimbursement to below the cost of delivering quality care, and free market forces will take care of the rest.

Medicare has already begun the process of backdoor rationing. Facing overwhelming budget shortfalls, Medicare needs to trim its books. Washington found a clever solution: eliminate the billing code for “physician consults.”

As a hospital physician, I often admit Medicare patients with chest pain or shortness of breath. If my patient needs urgent help from a cardiologist, I call a colleague for assistance.

Until December 31, 2009 the cardiologist could charge a “physician consult” fee for getting out of bed, coming to the hospital, and evaluating a patient with a potentially life threatening problem. Medicare paid $195.76 for this middle-of-the-night work (the same rate as when done during the day).

By eliminating the “physician consult” billing code, Medicare now advises the specialist to charge for a “hospital admission.” For two more months, Medicare will pay $175.67 for this service. However, without a change in current law, the physician’s reimbursement for a “hospital admission” will drop to $141.63 on March 1. This is why the “Doc Fix” is so important for working physicians and their Medicare patients.

In hockey, rough sport that it is, it is rare that one player scores three goals in one game.  They call that a Hat Trick.  In the game of politics, Obama now has managed the Liberal Hat Trick in the minds of the American Public.  In November, he may just find out how rough politics can be.

Of course, many people have known for a long time just how liberal Obama is and was.  There were many warning signs in the last election cycle.  The public however, in this slightly Right of Center nation, either was so tired of ineffective Republicans or, with the help of the Media, refused to acknowledge the warning signs.  In doing so they elected Obama with 52.9% of the vote – a victory but not an overwhelming victory.

Large margin or not, since being inaugurated, Obama has run quickly to the Left. In doing so, he fulfilled Reagan’s warning that Democrat Presidential candidates run as moderates but are determined to govern more to the Left, i.e. Jimmy Carter and Bill Clinton.  The Obama Administration’s response to the terrorist bomb attempt in Detroit completed that process in the minds of the American public.
